Inspector-Generalof Police(IGP) Tan Sri Khalid Abu Bakar is madly lying for tweeting that policehave adopted a “no tolerance” policy on sedition, when no action istaken against UMNO leaders who make seditious, false and provocative remarksagainst non-Muslims and non-Malays. This morning, police detained The Edgepublisher Ho Kay Tat and The Malaysian Insider(TMI) chief executive JahabarSadiq when they presented themselves at the Dang Wangi district policeheadquarters for questioning.
Beforethat, TMI managing editor Lionel Morais, senior editors Amin Shah Iskandar andZulkifli Sulong were arrested and held overnight over a report on theConference of Rulers published by the news portal which is said to beerroneous. The five are investigated under Section 4 of the Sedition Act forpublishing seditious material and Section 233 of the Communication andMultimedia Act 1998. If found guilty, they can be fined up to RM5,000 andjailed up to three years or both. Malaysia has the most politicised Inspector-General of Police(IGP) since Tan Sri Rahim Nor’s infamous act of beating up Datuk Seri Anwar Ibrahim that gave Anwar the infamous black eye. DAP condemns in the strongest terms the arrest of a Shah Alam MP Khalid Samad at 3.20 am in his home, not for committing any offence that harm or stole from the rakyat, but for exercising a fundamental human right of gathering peacefully to protest against injustice and the Goods & Services Tax imposed on 1 April 2015.
PAS Shah Alam MP and central executive committee member Khalid Samad was rudely awaken from his sleep and arrested in the dead of the night under Penal Code section 143 for illegal assembly related to the Kita Lawan rally at the Sogo shopping mall. Is it necessary to put on a show of brute naked force by conducting such arrests in the dead of the night, when Khalid would never run away but would be willing to go to any police station in the daytime as requested? Inspector-General of Police Tan Sri Khalid Abu Bakar is undoubtedly a proven BN gladiator who can easily win in general elections based on his sterling record of punishing opponents of BN but unashamedly practices double-standards in letting off racists and extremists. No one is too unimportant to escape his steel dragnet whether young or old, ordinary rakyat or PR MPs, male or female as long as they are anti-BN or send out anti-BN tweets. Even apolitical young women from TV presenters BFM’s Aishay Tajuddin to lawyers like Michelle Yesudasas(defending the detained lawyer Eric Paulsen) tweeting about rape are not let off the hook.
BN claims that there is freedom of speech in Malaysia, but the IGP is there to ensure that there is no freedom after speech for those who oppose BN. Malaysia would not be so intolerant, if the IGP had also acted fairly without fear or favour against hate speech by those who support BN. Unfortunately, no one was arrested for their tweets threatening bloodshed against non-Malays despite constant reminders being sent to the IGP. Nor was action taken against those pro-UMNO politicians who threaten to burn the Malay version of the Bibles or even an UMNO politician who spread seditious lies about the Kuala Kedah Chinese community burning the holy Koran. DAP leaders feel angry and betrayed by PAS Kelantan leaders and several of its pro-UMNO national leaders for its dishonesty, deceit and treachery by turning its back on PR and instead willing to trust UMNO to implement the Shariah Criminal Code II Enactment or hudud laws. Instead of the promised 4 amendments to the original 1993 hudud laws as promised to PR leaders during the final PR Leadership Council meeting chaired by Datuk Seri Anwar Ibrahim on 8 February 2015, PAS tabled the entire hudud bill with the full 71 clauses.
DAP firmly opposes the implementation of hudud laws not because it is Islamic, but because hudud is unconstitutional and contrary to our Federal Constitution. The Federal Constitution clearly spells out that even though Islam is the religion of Malaysia, Malaysia is not an Islamic state. The highest court, the Supreme Court in 1988 in the case of Che Omar bin Che Soh v Public Prosecutor, had reaffirmed that Malaysia is not an Islamic state.

BN politicians are surprised at the reaction of investors to the Malaysian stock market and foreign exchange market to economic conditions in Malaysia that caused Kuala Lumpur Composite Index(KLCI) to have the unfortunate record of the worst performing stock market, and our currency the ringgit the largest depreciation in Asia Pacific in 2014. These BN politicians do not understand why our stock market dropped by 5.7% in 2014, the highest drop amongst all Asia Pacific bourses, despite a good economic growth rate of 6% last year.
Even countries like Thailand with lower economic growth rates of barely 1% in 2014, the Thailand stock exchange index rose by 15.3%, whilst Philippines was a star performer with a rise of 22.8% in the stock index in 2014 despite a growth rate less than Malaysia. DAP condemns the police for delaying far longer than necessary, the release from detention of DAP Socialist Youth chief and MP for Rasah Teo Kok Seong as well as activists Adam Adli Abdul Halim and Mandeep Singh, by abusing Section 117 of the Criminal Procedure Code(CPC) in seeking a four day remand order over their involvement in the #KitaLawan rallies. The magistrate instead issued Teo a one day remand order whilst the other two were given a 3-day remand order.
According to Section 117 (2) CPC, remand order is given by magistrate to detain an accused person based on the maximum punishment for offences being investigated. If the offence under investigation is punishable with imprisonment for less than fourteen (14) years, then the remand shall not be more than four (4) days on the first application, and shall not be more than three (3) days on the second application.
