Press Statement By DAP Secretary-General And MP For Bagan Lim Guan Eng In Kuala Lumpur On 9.2.2015.

Yesterday’s PR Leadership Council meeting in Kuala Lumpur was the first attended by all 3 party leaders of PR in a year. Yesterday’s Leadership council meeting reaffirmed the 2009 Common Policy Framework signed by all 3 parties and that PR operates based on decision by consensus of all 3 parties, hence requires that the the twin issues of the Kelantan Shariah Criminal Code(hudud) and local government elections must first be discussed by PR Leadership Council. A special Leadership Council meeting will be held in the coming weeks to discuss both these contentious issues.

DAP has adopted a firm position of restoring local government elections that was banned by the then Alliance(BN) government in 1965. Local government elections is reflected implicitly in the PR Common Policy Framework adopted in December 2009 which used the phrase “strengthen local government democracy” and explicitly in the 2013 PR Penang General Election Manifesto that specifically mentioned implementing local government elections as well as the Selangor Pakatan Rakyat 2013 General Elections Manifesto with the specific undertaking to “carry out decentralization through a gradual implementation of Local Government Elections”. This was agreed by all 3 parties in the respective states. Further, no political party in PR had ever moved a resolution in their party Annual Assembly or Muktamar opposing local government elections.

However DAP is willing to let the issue of local government election be first discussed by the PR Leadership Council meeting. As for the Kelantan Shariah Criminal Code or hudud laws, PAS admits that these laws are not in the PR Common Policy framework or in the PR General Election manifesto. However PAS claims that these laws were passed in the 90s even before PR was formed.

Whether a solution can be reached to resolve these two contentious issues, it is important that a meeting of the PR Leadership council comprising of the 3 party leaders, must be held first in accordance with the principle that PR operates based on consensus decision-making.

In the meantime, BN operates through a one-party state, that is now abandoning inclusiveness and the Malaysian spirit for everyone regardless of race and religion. Instead BN is now following UMNO’s racial exclusiveness and extremism as epitomised by a former Deputy Minister falsely blaming the Chinese community in Kedah for burning the Koran when it was done by Malay Muslim man with mental problems and yet remaining unpunished. Worse the Agriculture and Agro-based Industry Minister Ismail Sabri Yaakob is defended by the Prime Minister and regarded as a hero for his racist remark that the Chinese are oppressing the Malays and blaming the Chinese for causing the prices of goods not to be reduced.

Kenyataan Media Setiausaha Agung DAP dan Ahli Parlimen Bagan Lim Guan Eng di Kuala Lumpur pada 9.2.2015

Majlis Pimpinan Tertinggi Pakatan Rakyat di Kuala Lumpur kelmarin adalah yang pertama dihadiri oleh ketiga-tiga pemimpin parti Pakatan bagi tahun ini. Mesyuarat itu menegaskan semula Dasar Bersama tahun 2009 yang telah ditandatangani oleh ketiga-tiga parti dan bahawa Pakatan bergerak berasaskan keputusan bersama ketiga-tiga parti. Justeru itu, isu Kanun Jenayah Syariah Kelantan (hudud) dan pilihanraya kerajaan tempatan perlu dibincangkan terlebih dahulu oleh Majlis Pimpinan Tertinggi PR. Satu mesyuarat khas Majlis Tertinggi akan diadakan dalam beberapa minggu lagi untuk membincangkan kedua-dua isu yang menjadi pertikaian itu.

DAP mengambil pendirian tegas untuk mengembalikan pilihanraya kerajaan tempatan yang telah diharamkan oleh kerajaan Perikatan (BN) pada tahun 1965. Pilihanraya kerajaan tempatan boleh dibaca secara tersirat dalam Dasar Bersama yang ditetapkan pada Disember 2009 dengan menggunakan ungkapan “memperkukuh demokrasi kerajaan tempatan” dan secara tersurat dalam Manifesto Pilihanraya Umum Pakatan Rakyat Pulau Pinang yang secara khusus menyebut tentang pelaksanaan pilihanraya kerajaan tempatan, selain Manifesto Pilihanraya Umum Pakatan Rakyat Selangor 2013 yang secara jelas menyebut “menjalankan desentralisasi menerusi pelaksanaan secara bertahap Pilihanraya Kerajaan Tempatan.” Hal ini dipersetujui oleh ketiga-tiga parti di negeri berkenaan. Selain itu, tiada parti politik dalam Pakatan pernah mengemukakan usul dalam Perhimpunan Agung atau Muktamar mereka untuk menentang pilihanraya kerajaan tempatan.

Bagaimanapun, DAP sanggup membiarkan isu pilihanraya kerajaan tempatan terlebih dulu dibincangkan dalam mesyuarat Majlis Tertinggi Pakatan. Berkenaan Kanun Jenayah Syariah Kelantan pula, atau undang-undang hudud, PAS mengakui bahawa ia tidak terdapat dalam Dasar Bersama Pakatan mahu pun Manifesto Pilihanraya Umum Pakatan. PAS mendakwa bahawa undang-undang ini diluluskan pada tahun 90an sebelum Pakatan dibentuk.

Tidak kira sama ada penyelesaian boleh dicapai untuk merungkai kedua-dua isu itu atau tidak, mustahak untuk diadakan terlebih dulu mesyuarat Majlis Tertinggi Pakatan yang melibatkan pemimpin ketiga-tiga parti, selaras dengan prinsip Pakatan yang bergerak atas pembuatan keputusan secara muafakat.

Pada masa yang sama, BN bergerak secara bersendirian sehingga mengabaikan sifat inklusif dan semangat Malaysia bagi setiap orang tanpa mengira kaum dan agama. Malah BN kini mengambil sifat eksklusif dan ekstremisme perkauman UMNO seperti yang ditunjukkan oleh seorang bekas Timbalan Menteri yang secara salah menuduh masyarakat Cina di Kedah membakar Quran, sedangkan perbuatan itu dilakukan oleh seorang lelaki Muslim yang kurang siuman, dan pemimpin berkenaan sehingga kini masih belum dihukum. Lebih buruk, Menteri Pertanian dan Industri Asas Tani Ismail Sabri Yaakob yang dipertahankan oleh Perdana Menteri dan dianggap sebagai hero kerana mengeluarkan kata-kata bahawa Cina sedang menindas Melayu dan menyalahkan kaum Cina kerana menyebabkan harga barangan tidak turun.

民主行动党秘书长兼峇眼区国会议员林冠英于2015年2月9日在吉隆坡发表声明:

昨天在吉隆坡举行民联最高领导层会议是过去一年内来,民联三党领袖首次一起出席。昨天的最高领导层会议重新确定2009年三党一同签署的民联共同政纲,以及民联根据三党的共识运作,因此,吉兰丹伊斯兰刑事法及地方政府选举必须经过民联最高领导层的讨论。我们将在几个星期后,在一个特别领导层会议上,讨论上述两项具争议性的议题。

行动党在恢复地方议会选举方面立场鲜明,地方议会选举在1965年被国阵政府禁止。地方政府选举也隐含在2009年12月民联的共同政纲里,文件使用“加强地方政府民主”的字眼,也明确的出现在2013年全国大选槟州民联竞选宣言里,还特别提到推行地方政府选举,2013年全国大选雪州民联竞选宣言也特别指出“通过渐进推行地方政府选举促进地方分权”。这是经过三党在各自州属内同意的。此外,民联中没有任何一个政党曾经在他们的常年大会中提呈反对推行地方政府选举的动议。

但是,行动党愿意让民联最高领导层讨论地方政府选举。至于吉兰丹伊斯兰刑事法,伊斯兰党承认这些法律并不存在于民联共同纲领或者民联大选宣言内。但是,伊斯兰党宣称这些法律早在90年代通过,当时民联还没有成立。

究竟有没有方法可以解决上述两个具争议性的课题?三党的民联最高领导层会议是非常重要的,这项会议必须基于民联是在决策共识下运作的原则。

同时,国阵则是一党坐大的情况下运作的,它已经抛弃它的包容性以及不分种族、宗教的马来西亚精神。现在的国阵只是跟随巫统的种族排外性及极端主义,下列事件可以看出,包括我国前副部长怪罪吉打华裔社群焚烧《可兰经》,可事实上是一名马来精神病患所为,而有关部长还没有被处罚。更糟的是,农业及农基工业部长依斯迈沙比里在发表种族主义言论指华人压迫马来人后、怪罪华人导致商品不跌价,还获首相袒护及表扬为英雄。
