Commission of Enquiry into the Worksite Incident at Tanjung Bungah
(“commission”)

Whereas it appears to the Yang di-Pertua Negeri to be expedient to issue a Commission appointing Commissioners and authorizing them to enquire into the failure of temporary structures in the Worksite Incident on 21 October 2017 at Tanjung Bungah, in the State of Penang.

Now, therefore, in the exercise of the powers conferred upon him by sub-section 2(3)(d) and subsection 3(1) of the Commissions of Enquiry Act 1950 [Act 119], the Yang di-Pertua Negeri issues a Commission and appoints —

Y Bhg Dato’ Yeo Yang Poh;

Y Bhg Dato’ Dr Gue See Sew; &

Y Bhg Professor Dr Ramli Nasir;

to be the Commissioners to carry out the enquiry, with the following Terms of Reference:

(a) To enquire into the cause or causes of the failure of temporary structures in a worksite incident that took place at Tanjung Bungah on 21 October 2017 (“the Worksite Incident”) at the Taman Sri Bunga construction site (“the Construction Site”); including whether or not the cause or causes were related to the nearby quarry.
(b) To enquire into whether the failure of the said temporary structures, and the resulting deaths and injuries, were due to any negligence, recklessness, breach of professional or legal duty, misconduct, or deliberate act or omission, on the part of any person, company or authority.
(c) To recommend any appropriate legal or other action, if necessary, which ought to be taken against any person, company or authority found to be responsible for the said failure and the loss of lives, and injuries.
(d) To enquire into whether all necessary approvals for or in respect of the project at the Construction Site had been properly applied for and obtained in accordance with the applicable laws.
(e) To recommend any appropriate measures, and any changes or improvements to the relevant processes and procedures, that ought to be taken or made by any authority or by any other party, in order to prevent or avoid the recurrence of similar incidents.
(f) To make any further or other findings and recommendations that may be related or incidental to any or all of the above matters.

And directs that —

Y Bhg Dato’ Yeo Yang Poh shall be the Chairman of the Commission; and that the Chairman and one other Commissioner shall constitute a quorum for any sitting or hearing;

the Enquiry shall be held in public, at such places, on such dates and during such hours as the Chairman may from time to time determine;

the Commissioners shall, in the execution of this Commission, regulate themselves and adopt such rules and procedures as the Chairman may from time to time deem proper or expedient;

the Commissioners may from time to time appoint such legal, technical or clerical officers and staff (whether a public officer or not), including any conducting officer, investigating officer, assisting officer, research officer, administrative coordinator, registrar, assistant registrar, spokesperson, interpreter, transcriber, and security personnel; as the Chairman may deem necessary or desirable, to assist them in the execution of this Commission; and

after completion of the Enquiry, the Commissioners shall submit a report to the Yang di-Pertua Negeri, within 3 months from the first day of sitting of the Commission, or within such extended time as may from time to time be granted.

Appointment under Section 7

In the exercise of the powers conferred upon him by section 7 of the Commissions of Enquiry Act 1950 [Act 119], the Yang di-Pertua Negeri, Pulau Pinang appoints Dato’ Ng Wee Kok to be the Secretary to the Commission of Enquiry into the Worksite Incident at Tanjung Bungah.

(“委员会”)

仅此我们向州元首御请成立及委任调查委员会,并且赋权予委员会调查于2017年10月21日在槟城州丹绒武雅工地中的临时结构失效发生的工地事故。

有鉴于此,在第119条1950年调查委员会法令附属之第2(3)(d)条文及第3(1)条文之下,州元首行使其权力委任:

1.拿督杨映波
2.拿督魏世福博士
3.南利纳西尔教授

他们将依据如下所需规范执行这项调查委员会:
(a)调查这项于2017年10月21日在丹绒武雅Taman Sri Bunga建筑工地(“建筑工地”)的工地事故(“工地事故”)中临时结构会失效的原因或多项原因;当中包括调查这或这些原因是否与毗邻的采石场有关。

(b)调查所指的临时结构失效导致伤亡是否牵涉任何个人、公司企业、有关权力当局的疏忽、罔顾安全、违反专业或法律职责、违反操守、蓄意为之或失职。

(c)如果任何个人、公司企业、有关权力当局证实真的是肇事责任者,如有必要,将建议任何相应的法律行动或其他措施,以对付肇事责任者。

(d)调查该建筑工地的相关计划是否认真仔细申请通过所有应有的批准程序,并且依法行事。

(e)建议相应措施、改革或精进有关权力当局或各造理应采纳的相关程序,以免重蹈覆辙。

(f)后续将以更多或其他的建议针对该事件再作补充。

因此:

1. 拿督杨映波将会是有关委员会的主席;任何的会议或听证会,皆须获得主席与另一名委员的出席,始能达致法定人数之规定;

2. 委员会主席有权决定调查之地点、日期与时间。调查过程必须公开;

3. 委员们必须遵从主席任何时候所发出的指示;

4. 委员们有权在主席认为有需要的情况下,在任何时委任任何技术或文书人员(不论是公务员),包括任何执行人员、调查人员、助理、研究人员、行政协调员、登记员、助理登记员、发言人、口译员、录音员和保安人员;以及

5. 委员会必须从第一天开庭调查起,三个月的时间内完成调查报告,并将有关报告呈交槟州元首。若有延长,则须在规定的时间内完成。
