Why Has Malaysia Anti-Corruption Commission(MACC) Still Not Taken Action Against Penang Regional Development Authority (PERDA) And Its Chairman Which Has Now Been Cited By The 2015 Auditor-General’s Report For Selling Below Market Price With Financial Losses To The Public?(e/c)

Why has MACC still not taken action against PERDA and its Chairman, which has now been cited by the 2015 Auditor-General’s(AG) report for selling below market price leading to financial losses. I had earlier exposed the sale by PERDA of its land located along Jalan Dato Keramat near MRSM Transkrian Seberang Perai Selatan for RM1.42 million sale last year.

The market valuation by the Finance Ministry was over RM16.6 million, but yet PERDA sold it at only RM1.42 million, a loss of some RM15.2 million. The AG Report agreed with me that there was no open tender and neither was there any current market valuation. The only difference was that the AG Report estimated the financial loss to the public of RM6.15 million whereas the Penang state government’s estimate of losses to PERDA is RM15.2 million.

The AG Report stated that the justification for the sale of land at a lower price was not supported by a technical report. Penang state EXCO Dr Afif Bahardin had lodged a report with MACC on this land scandal by PERDA but so far there has been no action by MACC.

The AG report also revealed that there was another sale of 5.8 acres of land in Sungai Baong below market valuation by PERDA at a loss of RM410,000. PERDA should fully account for this grave inconsistency and come clean for these financial losses. MACC should also investigate this latest revelation by the AG Report.

The report also pointed out that for the same period, Perda’s management weakness also showed up in phase two of the Taman Panchur Utama housing project, for which the certificate of completion and compliance was issued 315 days from the date of the certificate of practical completion.

“The defect liability period was not fully utilised and Perda had to pay penalties of RM67,124 due to the delay in handing over the keys to purchasers, and the quality of construction was less than satisfactory,” it said. Is PERDA continuing to keep a deafening silence and not taking action against anyone in PERDA for such mismanagement and financial wrongdoings that resulted in so much losses?

我在较早前曾经揭露槟州区域发展机构(PERDA)以142万令吉的价格,出售一片位于高渊理大工程分院附近的土地。为何反贪污委员会至今仍未对槟州区域发展机构采取行动?有关机构的主席现在已经被2015年总稽查司报告点名,指其用低于市价的价格贱卖土地,造成了财务亏损。

根据财政部的评估,这片土地的市值至少1660万令吉,但槟州区域发展机构却仅仅以142万令吉的价格脱手,损失了1520万令吉。总稽查司报告也认同了我的观点,即这项交易并没有采用公开招标,也没有最新的市场估价。唯一不同的是,总稽查司报告认为有关交易让人民损失了615万令吉,而槟州政府则认为损失达1520万令吉。

总稽查司报告中亦点出,有关单位以低价售地并未获得技术报告的支持。槟州行政议员阿菲夫之前已针对上述丑闻报警,但反贪会迟迟没有行动。

总稽查司报告也揭露位于Baong河的5.8英亩土地被槟州区域发展机构(PERDA)以低于市价出售,损失了41万令吉。槟区域发展机构必须为这项损失公开说明以示公信。反贪会更应该为这项总稽查司报告所揭露的售地案展开调查。

该稽查报告也指出,在同一时期槟区域发展机构的管理弊端也显现在班卓花园第二期房屋计划,因为该房屋计划的竣工与使用准证(certificate of completion and compliance)竟然与落实完工准证(certificate of practical completion.)相差315天。

稽查报告透露”槟区域发展机构没有善用损坏责任期,导致延期缴交钥匙给购屋者必须赔偿6万7124令吉,而且施工品质让人不满。“ 槟区域发展机构继续保持缄默,而且没有因为这些管理及财务弊端导致的损失向该机构内的任何人士采取行动。
