Media Statement: DAP Secretary-General, Lim Guan Eng’s message in the run-up to the DAP Special Congress 2013 on 29 September 2013:

Saya sebenarnya hendak mengutuskan surat ini lebih awal, untuk menyeru semua cawangan dan perwakilan jawatankuasa pusat supaya menghadiri Kongres Khas Kebangsaan bagi melaksanakan pemilihan semula Jawatankuasa Eksekutif Pusat (CEC) pada 29 September 2013 di One World Hotel di Bandar Utama, Selangor; demi memastikan kesinambungan parti kita ini. Yakinlah bahawa ROS belum berputus asa dalam menggugat kewujudan DAP.
Namun disebabkan pergerakan jentera ROS yang dikawal UMNO, kami mahu untuk sentiasa mutakhir dengan siri taktik kotor yang digunakan terhadap DAP. Jangan kita sangsi bahawa taktik kotor untuk mensabotaj pemilihan semula party serta merendah-rendahkan kredibiliti parti dan integriti pemimpin parti adalah satu tindakan balas dendam di atas kejayaan DAP dalam Pilihan Raya Umum ke-13.
Untuk rekod, biar saya ulang cerita apa yang telah terjadi. Kepimpinan DAP telah bertanggungjawab penuh untuk membetulkan kesilapan yang dibuat sewaktu pengumuman oleh bekas Pegawai Pemilihan Sdr Pooi Weng Keong berkenaan keputusan ahli CEC yang dilantik sewaktu Kongres Kebangsaan yang lalu di Pulau Pinang pada 15-16 Disember 2012. Kesilapan tersebut tidak didedahkan oleh orang luar tetapi ditemui secara dalaman, dan kepimpinan DAP telah berlaku jujur mengakui kesilapan itu serta membetulkannya. Keputusan yang tela dibetulkan telah disahkan oleh sebuah firma perakaunan antarabangsa.
Pihak ROS cuba mengeksploitasi kejujuran pimpinan DAP dengan menggunakannya sebagai alasan untuk tidak mengiktiraf CEC yang telah dilantik sehari sebelum hari penamaan calon PRU ke 13 pada 20 April 2013. Memandangkan tindakan tersebut akan menghalang Setiausaha Agung DAP daripada memberi kebenaran para calon untuk menggunakan simbol parti, DAP mengumumkan bahawa ia akan menggunakan simbol PAS sebagai ganti. Setelah menerima tamparan hebat daripada umum kerana menggunakan taktik kotor demikian, ROS mengalah dan menyatakan bahawa DAP masih boleh menggunakan simbol parti.
Selepas kejayaan bersejarah kita dalam pilihanraya umum, UMNO menggunakan ROS untuk cuba berlaku khianat kepada DAP dengan mengarahkan pemilihan semula. Pada awalnya pimpinan parti memutuskan untuk melawan ROS di mahkamah apabila ia enggan memberi sebab mahupun berjumpa dengan pimpinan kita yang mahukan penjelasan tentang sebab-sebab perlunya diadakan pemilihan semula.
Meski pun yakin menang di mahkamah, Pengerusi Kebangsaan Sdr Karpal Singh mendapat khabar bahawa ROS akan menggunakan cabaran ke mahkamah terhadap arahan tidak sah ROS sebagai alasan untuk membatalkan pendaftaran DAP. Walaupun Sdr Karpal yakin boleh menang di mahkamah, perlawanan tersebut bukanlah sangat tentang soal undang-undang tetapi lebih kepada politik.
Kepimpinan DAP membuat keputusan bahawa meski pun kita menang di mahkamah, parti tidak boleh berkeadaan seperti digantung tak bertali dan mungkin dibatalkan pendaftarannya dalam jangka masa sekurang-kurangnya setahun sementara kes tersebut diselesaikan oleh pihak mahkamah. Kewujudan DAP tidak boleh diperjudikan. Pemimpin boleh kehilangan kebebasan dan dipenjara tetapi DAP tidak boleh dibatalkan pendaftarannya.
Atas sebab itu dengan rasa berat hati keputusan dibuat untuk mengadakan pemilihan semula, walaupun kepimpinan parti tidak melakukan kesalahan. Calon-calon yang sama dan senarai perwakilan yang sama digunakan tahun lalu adalah senarai akhir yang layak. Kesemua ahli CEC yang lama dan baru telah mengambil pendirian secara bersama berkaitan krisis yang sedang mengancam survival parti dan sebulat suara bersetuju untuk mengadakan pemilihan semula berdasarkan senarai calon dan perwakilan yang sama.
Ahli Parlimen Serdang Sdr Dr Ong Kian Ming telah dilantik sebagai Pegawai Pemilihan dan sebuah firma perakaunan antarabangsa, PKF International akan memantau proses pemilihan bermula dari proses memaklumkan tentang Kongres Khas Kebangsaan sehinggalah pengiraan undi bagi memastikan tidak ada sebarang kesilapan.
Perlembagaan Parti memberi kuasa untuk mengadakan pemilihan dalam Kongres Khas Kebangsaan. Mereka yang terlibat menggesa DAP untuk patuh kepada keputusan ROS supaya mengadakan pemilihan semula kini terlibat pula dalam usaha menghalang dan mengkhianati pemilihan semula tersebut. Mereka telah mencabar pelaksanaan pemilihan semula dengan memohon perintah injunksi dari mahkamah yang akan didengar pada 25 September 2013.
Seandainya para pengkhianat (saboteur) ini berjaya, Kongres Khas Kebangsaan akan ditunda. Sebaliknya Kongres Khas Kebangsaan akan diadakan pada 29 September 2013. Kalau pun para pengkhianat ini gagal, mereka tidak akan berputus asa. Atas sebab ini, mesti ada kehadiran yang baik oleh para perwakilan parti untuk menolak dan menentang usaha jahat untuk menghancurkan DAP, yang gagal dilakukan BN dan UMNO dalam pilihanraya umum.
DAP adalah satu-satunya parti yang menepati kata-kata, melaksanakan apa yang disebut dan bertindak atas prinsip dan polisi. Jelas sekali bahawa kita mampu mentadbir dengan lebih baik berbanding BN.
DAP mewakili harapan rakyat Malaysia dan masa depan anak-anak muda. Marilah kita berlaku adil terhadap harapan mereka untuk masa depan yang lebih cerah dengan memastikan survival DAP demi merealisasikan impian Malaysia untuk peluang saksama bagi semua orang untuk hidup makmur dalam keamanan serta berjaya dengan hasil usaha gigih.

I had meant to send out this letter earlier in urging all branches and DAP central committee delegates to attend the National Special Congress for re-elections of our Central Executive Committee(CEC) on 29th September 2013 at One World Hotel in Bandar Utama, Selangor to ensure our party’s continued survival. Let there be no doubt that ROS has not given up on threatening DAP’s existence.
However due to the machinations of UMNO-controlled Registrar Of Societies (ROS), we wanted to be as current as possible with the series of dirty tactics used against DAP. Let there be no doubt that these dirty tactics to sabotage the party re-elections, undermine the party’s credibility and the leadership’s integrity is an act of political vengeance for DAP’s successes in the 13th General Elections.
Let me recap events for the record. The DAP leadership had taken full responsibility by rectifying the mistake made in the announcement by the then Returning Officer Sdr Pooi Weng Keong of the elected CEC at the last National Congress in Penang on 15-16 December 2012. The mistake was not exposed by outsiders but were discovered internally and the DAP leadership had truthfully admitted and corrected the mistake. The corrected results were certified by an international accounting firm.
The ROS had tried to exploit the DAP’s leadership honesty by using this as a pretext not to recognize the elected CEC on the eve of the nomination day of the 13th general elections on 20.4.2013. As this would prevent the DAP Secretary-General from authorizing the use of our party symbol, the DAP announced that it would use the PAS symbol instead. Facing a huge public backlash at such dirty tactics, the ROS backed off and said that the DAP can still use the party symbol.
After our historic victories in the general elections, UMNO used the ROS to fix up the DAP by directing re-elections. Initially the party leadership decided to fight ROS in court when ROS refused to give reasons nor see our leaders seeking an explanation on the reasons for holding party re-elections.
Whilst confident of success in court, National Chair Sdr Karpal Singh got wind that the ROS will use our challenge in court against the ROS’ illegal decision as a pretext to deregister the DAP. Even though Sdr Karpal was confident of winning in court, the battle is not so much legal as it is political.
The DAP leadership decided that even if we finally win in court, the party cannot afford to be in limbo and be de-registered during the time of at least a year it takes for the matter to be decided in court. The existence of the DAP cannot be put at risk. Leaders can lose their freedom and be imprisoned but the DAP must not be de-registered.
For that reason the painful decision was taken to hold re-elections, even though the party leadership had done no wrong. The same candidates and the same delegate list used last year will be the qualifying list. All members of the new and old CEC took the same united position on the developing crisis threatening the party’s survival and unanimously agreed to the re-elections based on the same candidates and delegate list.
MP for Serdang Sdr Dr Ong Kian Ming has been appointed the Returning Officer and an international accounting firm PKF International will monitor the election process from the sending of notification for the National Special Congress to the counting of votes to ensure that it is error-free.
The Party Constitution empowers the holding of elections in a National Special Congress. The very people involved in urging the DAP to abide by the ROS ruling to hold re-elections are now involved in trying to prevent and sabotage the holding of re-elections. They have challenged the holding of re-elections by filing for an injunction in court which will be heard on 25 September 2013.
If these saboteurs succeed, then the National Special Congress will be postponed. Otherwise the National Special Congress will be held on 29th September 2013. Even if these saboteurs fail, they will not give up. For this reason, there must be a good attendance by party delegates to repudiate and repel once and for all this attempt to destroy the DAP, what BN and UMNO is unable to do in the general elections.
DAP is the one party that has walked the talk, practice what we preached and delivered on our principles and policies. Clearly we have proven we can govern better than BN.
DAP represents the hopes of Malaysians and the future for our young. Let us do justice to their hopes of a brighter future by ensuring the survival of the DAP to keep alive the Malaysian dream of equal opportunity for everyone to prosper in peace and succeed by hard work.

秘书长来函
我本来还打算提早发出此信函，以敦促各支部及行动党中央委员会代表们出席即将于2013年9月29日假雪兰莪州万达镇One World酒店举行的全国特别党员代表大会，以重选我们的中央执行委员会(CEC)来确保我党能度过难关。毫无疑问，社团注册局(ROS)从未放弃要威胁行动党的存在。
然而，有鉴于巫统所掌控的社团注册局诡计多端，我们要极尽所能面对种种对付行动党的肮脏手段。这些破坏我党重选、打击我党信誉及领导层诚信的龌龊行径，毋庸置疑是针对行动党在第13届大选中取得成功的政治报复。
让我重述事情的来龙去脉。2012年12月15日至16日在槟城举办的上一次全国党代表大会上，当时的选举官贝荣强同志宣布党中央执行委员会中选代表名单时出错，行动党领导层已为此负起全责并加以纠正。此过失没有被外人所揭发，而是内部发现问题后，由领导层如实承认并修正错误。修正后的成绩也经由一家国际会计事务所核证。
但是，社团注册局试图利用行动党领导层的坦诚，在第13届全国大选落在2013年4月13日的提名日前夕，籍此拒绝承认中选的中委。因为此举能阻止行动党秘书长授权使用我党旗帜上阵，行动党只好宣布借用伊斯兰党的标志出征。眼见肮脏手段受到公众巨大的反弹，社团注册局只好让步并允许行动党使用自己的标志。
当我们在全国大选取得历史性的胜利以后，巫统利用社团注册局以要求重选来对付行动党。一开始，当社团注册局拒绝提出合理交代，并无视我们的领袖寻求解释举行重选的原因时，行动党领导层决定与社团注册局对簿公堂。
虽然对于在庭上取胜信心十足，但全国主席卡巴星同志听闻社团注册局将以我们在庭上挑战社团注册局非法决定的举措为由，撤消行动党的注册。即使卡巴星同志对于官司胜券在握，但这场仗难以依法处理，因为当中涉及政治。
行动党领导层认为即使我们最终打赢官司，党也无法承受在等待法庭判决的至少一年当中，面对被搁置及被撤消注册的命运。行动党的存在不能被典当。领袖们可以失去他们的自由及被监禁，但行动党绝不能被吊销注册。
基于这个原因，我们作出痛苦的决定举行重选，纵使党领导层并没有做错。去年用过的候选人及中央代表名单，将被继续沿用。所有新旧中央执行委员会的成员针对党生死存亡的危机采取了统一的立场，并一致同意依据相同的候选人及中央代表名单进行重选。
沙登区国会议员王建民博士已受委任为选举官，同时鹏歌富达国际会计师事务所(PKF International)将从发出全国特别党代表大会通知，到计算选票的过程全程监督，以确保选举万无一失。
我党党章赋权于全国特别党代表大会中举行选举。而那些涉及敦促行动党遵守社团注册局指示举行重选的人，现在却企图阻止及破坏重选。他们以向法庭申请禁令挑战行动党的重选，聆讯落在2013年9月25日。
如果这些破坏者得逞，全国特别党代表大会将会延期。否则大会将如期于2013年9月29日举行。即使这些破坏者徒劳无功，他们也不会善罢甘休。因此，党中央代表务必积极出席，以便能一劳永逸地排除和阻遏所有企图摧毁行动党的手段，而摧毁我党正是国阵和巫统在全国大选中做不到的。
行动党是一个言出必行的政党，对自己的主张身体力行，并实现了我们的原则和政策。显然，我们证明了自己能比国阵更好地执政。
行动党代表着马来西亚人的希望和年轻一代的未来。让我们通过确保行动党度过难关，继续维护马来西亚全民机会平等，共享繁荣和平及为成就奋斗的梦想，公平看待他们对更美好未来的希望。
