Press Statement By DAP Secretary-General And MP For Bagan Lim Guan Eng In Penang On 10.5.2014.

Penang BN chief Teng Chang Yeow should be congratulated for adopting MCA’s dirty tactics of using the mainstream media to either black out or downplay DAP’s replies on their lies over the proposed implementation of hudud law by PAS and UMNO. I will respond to Teng’s latest false attacks against the DAP for telling “three bluffs” on PAS’ intention to implement the hudud law.

I answer Teng’s 3 lies with the expectation that Teng would explain why UMNO President Datuk Seri Najib Tun Razak can decide on BN Malaysia’s stand to support PAS implementing hudud on Muslims in Kelantan in Najib’s position as BN Chairman but Teng can not decide on BN Penang position as BN Penang Chairman. In contrast, I can state as Penang Chief Minister, that the PR Penang state government and Penang PR will not implement hudud in Penang as it was never part of PR national or state 2013 general election manifesto.

If the mainstream media obediently fail to publish this in full, Teng need not answer why as Penang BN Chair, he does not possess the same powers over Penang BN as Najib has over BN Malaysia in deciding BN Malaysia’s stand. Is this a classic example of MCA and Gerakan “being in government but do not rule” or is Teng just simply being quietly obedient to UMNO?

I will expose Teng’s 3 lies as follows. One, Teng is being dishonest by not revealing that in all PR documents signed, that implementing hudud is a PAS not a PR agenda and that PAS has a right to pursue the Islamic law just as DAP has a right to oppose PAS doing it. In the statement signed by both PAS President Datuk Seri Abdul Hadi Awang and myself, why did Teng not mention that our respective struggle and co-operation is subject to the Federal Constitution?

That is the reason DAP opposes the implementation of hudud law because it is unconstitutional. That is the reason why hudud did not become PR policy because all 3 parties of PAS, DAP and PKR must agree. As DAP’s position has not changed, implementation of hudud is not PR policy. However, it is different in BN because BN’s policy does not depend on Gerakan or MCA agreeing. In BN, UMNO’s position supporting PAS implementing hudud in Kelantan is BN’s position.

Is Teng following MCA Deputy President Wee Ka Siong’s dishonesty when Wee said that Minister in the Prime Minister’s Department Jamil Khir Baharom did not represent BN when Jamil started the entire controversy by instigating PAS in Parliament on March 27 2014 to implement hudud on Muslims in Kelantan? Jamil had said that “the federal government will be ready to work with any state government that is ready to implement hudud including Kelantan, because Umno Kelantan assemblypersons had supported the passing of Kelantan Syariah Criminal Code Enactment II to implement hudud in 1993”.

How can Wee say that Jamil did not represent BN to support PAS implementing hudud in Kelantan when Jamil was replying on behalf of the BN government in Parliament? As a former Deputy Minister himself, Wee should know that any replies given in Parliament is made on behalf of the BN government not just on behalf only of either MCA or UMNO. This is the principle of collective responsibility in government.

Teng has also made another lie by claiming that the Penang Islamic Religious Affairs Council (MAINPP) is a state agency. As the Chairman and members of MAINPP are recommended by the state government for final approval by the King, Teng argues that the Chief Minister should direct MAINPP to retract its support for implementing hudud in Kelantan.

Is Teng so ignorant of the fact that MAINPP is an independent statutory body established by a special state law approved by The Penang State Assembly on 15th April 1959 and named as Islamic Administration Law 1959? MAINPP is similar to the Auditor-General Office. Once appointed, the government does not interfere in the AG’s audit reports except to explain and justify expenditures.

As a former EXCO member, Teng should know that the Chief Minister, as a non-Muslim, does not interfere in MAINPP affairs. By asking me to interfere, is Teng implying that Koh Tsu Koon had previously interfered in MAINPP? Dato Salleh Man as MAINPP Chairman can give his views but ultimately it is the state government that decides whether to accept or not. And the Penang state government has decided that the hudud law will not be implemented in Penang.

Teng said thirdly, based on a newspaper cutting on September 2010, former Johor DAP chief and the present Johor Opposition Leader Dr Boo Cheng Hou had expressed his support for hudud. I was in Johor Baru for a DAP Geylang Patah Dinner last night with Dr Boo and Dr Boo was angered by Teng’s lie. Dr Boo had publicly said in his speech last night that he had never supported hudud. If Teng can prove his allegations against Dr Boo, then DAP will take stern action against Dr Boo. However if Teng fails to prove this false report in the newspaper cutting, then Teng should fully apologise to Dr Boo and retire from politics.

Teng should adopt former MCA president Dr Chua Soi Lek’s suggestion made in Malaysiakini of his full agreement with the DAP that only UMNO can stop the implementation of hudud law in Kelantan. As UMNO controls the largest number of MPs(88) in Parliament, only UMNO and UMNO alone shall determine the success or failure in PAS’ attempt to implement hudud in Kelantan. For that reason Chua said that it is only logical that UMNO must be convinced not to support PAS implementing hudud in Kelantan. Can MCA and Gerakan convince UMNO?

做为掌握88议席的国会最大党,巫统将决定吉兰丹在伊斯兰刑法课题的最终命运,也只有巫统拥有这个能力来否决或支持伊斯兰党在丹州落实此法。

恭贺槟州国阵主席邓章耀加入马华之流,利用主流媒体在伊法课题上极尽可能地抹黑行动党,或特意忽视行动党回覆伊党及巫统提出的落实伊法议题。 我将在这里回应邓章耀用伊党欲落实伊法的课题来攻击行动党的“三项谎言”。

随着我的回应,希望邓章耀也能解释,为何巫统主席拿督斯里纳吉能够以国阵主席之名,站在国阵的立场上,决定支持伊党於吉兰丹对穆斯林落实伊法。而身为槟州国阵主席的邓章耀,却无法为槟州国阵做出决定?相较之下,我以槟州首席部长的身份,表明槟州政府及槟州民联将不会在州内实施伊法,因为这从来不是2013年大选期间,民联在全国或州的竞选宣言之一。

如果主流媒体无法全文刊登这次的回应,那邓章耀大可不必回答,为何身为槟州国阵主席,他不能履行主席的职权代槟州国阵发言,即便在另一边厢,纳吉可以代表全国国阵选择立场。这是不是马华及民政典型的“当家不当权”?或邓章耀纯粹是巫统身边的顺民?

以下,我将一一揭露邓章耀的三个谎言。其一,邓章耀并未老实地告诉大家,在民联所有共同签署的文件中,实施伊法是伊党个己而非民联的议程。伊党拥有这个权利去追求伊斯兰法,正如行动党亦有权反对伊党落实伊法一样。在这份我与伊党主席拿督斯里哈迪阿旺共同签署的文件中,邓章耀没有告诉你的是,我们各自的斗争与合作,一切都需建立在联邦宪法之下。

行动党反对落实伊法,因为它已经违宪在先。它无法成为民联的共同政策,因为要予以落实,就必须得到民联三个成员党即伊党、行动党及公正党的一致同意。行动党迄今立场不变,所以实施伊法不是民联的政策。无论如何,我们和国阵不同,因为国阵的政策不需民政或马华点头。在吉兰丹落实伊法的课题上,巫统已经代表全体国阵,决定支持伊党落实。

邓章耀是否会追随马华署理总会张魏家祥的脚步,学他一样不老实?. 魏家祥说首相署部长加米尔不代表国阵时,他错了,并且也不老实,是加米尔於2014年3月27日在国会挑起整件事,唆使伊斯兰党在吉兰丹向穆斯林推行伊斯兰刑事法。加米尔也说,“联邦政府愿意与任何准备推行伊斯兰刑事法的州政府合作,包括吉兰丹,因为巫统吉兰丹州议员已经在1993年支持通过吉兰丹伊 斯兰刑事法修正案II,在该州推行伊斯兰刑事法。”

显然的,加米尔明明代表国阵政府在国会上作答,魏家祥怎能睁眼说瞎话,指加米尔不是代表国阵支持伊党在吉兰丹落实伊法?曾经官拜副部长的魏家祥,理应清楚知道,国阵政府在国会上的任何答复,都是代表整个国阵政府,而非仅仅代表马华或巫统个别政党而已。这是我们政府的集体负责制度。

邓章耀也说,槟州伊斯兰教理事会(MAINPP)隶属槟州政府 ,因为这组织的主席及成员由州政府提名,並交元首批准。邓章耀辩称,首席部长应指示该单位撤回对在吉兰丹实施伊法的支持。

难道邓章耀完全不知道,事实上,槟州伊斯兰教理事会是在“1959年伊斯兰行政法”中所诞生的法定独立单位?这项特别法案是於1959年4月15日在槟州立法议会所通过,有关组织宛如总稽查司,一旦经委任,政府就不能干预总稽查司的报告,仅能解释及说明各种开销。

邓章耀曾是州行政议员,应了解首席部长并非穆斯林,不能插手槟州伊斯兰教理事会的事务。他现在叫我干预,是否意味许子根过去曾经这么做,因此他认定首长可以插手?身为槟州伊斯兰教理事会主席的拿督沙烈曼,当然可以提供他的看法,但最终采取与否,权力在槟州政府的手上。而州政府亦已做了决定,即不会在州内实施伊法。

第三,邓章耀根据2010年9月的剪报,指柔佛行动党主席、现任柔佛反对党领袖巫程豪医生曾表态支持伊法。但我昨晚在新山出席振林山行动党区部晚宴时,巫程豪亲口告诉我,邓章耀的这个谎言令人恼怒。巫程豪也在当晚致词时,公开声明他从未支持伊斯兰刑法。若邓章耀能够证明其指控,那行动党势必严厉对付巫医生。反之,要是邓章耀无法证明,那他应该无条件向巫医生道歉,並从此退出政坛。

马华前总会长蔡细历医生曾经在当今大马表示,他认同行动党,即只有巫统可以制止伊法在吉兰丹落实。做为掌握88议席的国会最大党,巫统将决定吉兰丹在伊斯兰刑法课题的最终命运,也只有巫统拥有这个能力来否决或支持伊斯兰党在丹州落实此法。按照蔡细历的逻辑,只有说服巫统,伊法才不会在吉兰丹落实。邓章耀或许应该听一下蔡细历的建议,但,马华及民政说服得了巫统吗?
