Penang BN Chairman Teng Chang Yeow should be courageous enough to say unequivocally that Lim Guan Eng lied when Lim Guan Eng said that not a single cent has been paid to the contractor for the under-sea tunnel project but only for the three main highways, so that I can prove in court that I am telling the truth. Teng refused to accept my statement that not a single cent was paid for the undersea tunnel project and claimed that the Penang state government is lying even though Penang state EXCO Lim Hock Seng had repeatedly stated that any payment made to the contractor was for the three main highways?<\/p>\n
Teng knows that it is the Penang state government\u2019s policy not to sue when defamatory statements are made against it. However when defamatory statements are made against individual leaders, such as myself, then action can be taken in court. I have taken many defamatory actions in court against the BN media and have won most of them.<\/p>\n
The award for the RM6.3 billion project comprising of the under-sea tunnel and 3 main highways was conducted through an open competitive tender. HSSI Sdn Bhd, a professional engineering consultant, was appointed and paid by the state government as an independent \u201cchecker\u201d to verify and certify the designs and claims made by the project contractor – Consortium Zenith Construction Sdn Bhd (Zenith). The costs of preparing the EIA reports will finally be borne by Zenith. HSSI is engaged by the state government as an Independent Checking Engineer (ICE) and not to prepare EIA reports.<\/p>\n
HSSI Sdn Bhd was granted the job through an open competitive tender awarded by the Penang State Tender Committee because they submitted the lowest bid. Treasury Instructions issued under the 1957 Financial Procedures Act requires the Penang State Tender Committee to be chaired by the Penang State Secretary and comprising government officials. How come Teng as a former Penang state EXCO, is not aware of such laws?<\/p>\n
How can there be alleged corruption in the entire project, when the entire contract is conducted through an open competitive tender? Clearly the entire investigation is a malicious political witch hunt designed to sabotage these infrastructure projects designed to alleviate traffic congestion and undermine the Penang state government in the run up to the coming general elections.<\/p>\n
I reiterate that the RM208 million payment was made to Zenith, in the form of land swap of 3.7 acres of net developed land at an above market price of RM 1,300 per square feet, in relation to the three main highways and not a single cent for the under-sea tunnel. Teng again lied when he claimed that 50 acres of land had been \u201cswapped\u201d to Zenith.<\/p>\n
The state government did not grant 50 acres of land to Zenith as claimed by Teng. Neither is the state government responsible for any business transactions entered into by Zenith with other private companies which the state government is not privy to or has not approved.<\/p>\n
Teng should neither hide nor run but courageously said that I lied when I stated that the Penang state government had not paid a single cent for the under-sea tunnel so that I can take Teng to court to prove who is telling the truth. Should Teng fail to do so, then I can understand why Gerakan President Mah Siew Keong refused to name Teng as the choice for BN\u2019s Penang Chief Minister even though Teng is the BN Penang Chairman, should BN win Penang in the coming general elections.<\/p>\n

Pengerusi BN Pulau Pinang Teng Chang Yeow mesti berani untuk mengatakan dengan jelas bahawa Lim Guan Eng bohong apabila Lim Guan Eng berkata satu sen pun tidak dibayar kepada kontraktor untuk projek terowong dasar laut tetapi hanya untuk projek tiga lebuh raya, supaya saya boleh membuktikan di mahkamah bahawa saya menyatakan perkara yang benar. Teng enggan menerima kenyataan saya bahawa tidak ada satu sen pun telah dibayar untuk projek terowong dasar laut dan mendakwa bahawa Kerajaan Negeri Pulau Pinang berbohong walaupun EXCO Negeri Pulau Pinang Lim Hock Seng telah berulang kali menyatakan bahawa sebarang bayaran yang dibuat adalah untuk tiga projek lebuh raya utama.<\/p>\n Teng mengetahui dasar Kerajaan Negeri Pulau Pinang yang tidak akan mengambil tindakan saman apabila kenyataan fitnah dibuat terhadapnya. Walau bagaimanapun, apabila kenyataan fitnah dibuat terhadap pemimpin individu, seperti saya sendiri, maka tindakan boleh diambil di mahkamah. Saya telah mengambil banyak tindakan terhadap media BN di mahkamah kerana memfitnah dan telah memenangi sebahagian besar daripada saman tersebut.<\/p>\n Penganugerahan untuk projek bernilai RM6.3 bilion yang terdiri daripada terowong dasar laut dan 3 projek lebuh raya utama dijalankan melalui tender terbuka yang kompetitif. HSSI Sdn Bhd, perunding kejuruteraan profesional telah dilantik dan dibayar oleh Kerajaan Negeri sebagai \u201cpemeriksa\u201d bebas untuk mengesahkan dan memperakui reka bentuk dan tuntutan yang dibuat oleh kontraktor projek \u2013 Konsortium Zenith Construction Sdn. Bhd. (Zenith). Kos untuk penyediaan laporan EIA akan ditanggung oleh Zenith. HSSI telah dilantik oleh Kerajaan Negeri sebagai Independent Checking Engineer (ICE) dan bukan menyediakan laporan EIA.<\/p>\n HSSI Sdn. Arahan Perbendaharaan yang dikeluarkan di bawah Akta Prosedur Kewangan 1957 memerlukan Jawatankuasa Tender Negeri Pulau Pinang dipengerusikan oleh Setiausaha Kerajaan Negeri Pulau Pinang dan terdiri daripada pegawai kerajaan. Bagaimana Teng sebagai seorang bekas EXCO Negeri Pulau Pinang, tidak mengetahui perihal undang-undang sedemikian?<\/p>\n Bagaimana terdapat dakwaan rasuah dalam keseluruhan projek, apabila keseluruhan kontrak dijalankan melalui tender terbuka yang kompetitif? Jelas sekali keseluruhan siasatan ini bermotifkan politik jahat yang jahat untuk mensabotaj projek-projek infrastruktur yang dibangunkan untuk mengurangkan kesesakan lalu lintas serta menjejaskan Kerajaan Negeri Pulau Pinang dalam menghadapi pilihan raya umum akan datang.<\/p>\n Saya mengulangi pernyataan ini sekali lagi bahawa bayaran RM208 juta yang dibuat kepada Zenith adalah dalam bentuk pertukaran tanah seluas 3.7 ekar di net developed land di atas harga pasaran RM1,300 setiap kaki persegi, untuk tiga lebuh raya utama dan tidak ada satu sen pun dibayar untuk terowong dasar laut. Teng sekali lagi berbohong apabila mendakwa bahawa 50 ekar tanah telah \u201cditukarkan\u201d kepada Zenith.<\/p>\n Kerajaan Negeri tidak memberikan 50 ekar tanah kepada Zenith seperti yang didakwa oleh Teng. Kerajaan Negeri tidak bertanggungjawab untuk sebarang transaksi perniagaan yang dimasuki oleh Zenith dengan syarikat swasta lain di mana Kerajaan Negeri tidak mengambil bahagian atau yang belum diluluskan. <\/p>\n Teng tidak boleh sembunyi atau lari tetapi perlu berani untuk menyatakan bahawa saya berbohong apabila saya menyatakan bahawa Kerajaan Negeri Pulau Pinang tidak membayar satu sen pun untuk projek terowong dasar laut, supaya saya boleh mengheret Teng ke mahkamah untuk membuktikan siapa yang menyatakan kebenaran. Sekiranya Teng gagal berbuat demikian, maka saya faham mengapa Presiden Gerakan Mah Siew Keong pun tidak mahu menamakan Teng sebagai calon Ketua Menteri Pulau Pinang walaupun Teng merupakan Pengerusi BN Pulau Pinang, sekiranya BN memenangi Pulau Pinang pada pilihan raya umum akan datang.<\/p>\n LIM GUAN ENG<\/p>\n ====================================<\/p>\n
