\nCommission of Enquiry into the Worksite Incident at Tanjung Bungah
\n(\u201ccommission\u201d)<\/p>\n
Whereas it appears to the Yang di-Pertua Negeri to be expedient to issue a Commission appointing Commissioners and authorizing them to enquire into the failure of temporary structures in the Worksite Incident on 21 October 2017 at Tanjung Bungah, in the State of Penang.<\/p>\n
Now, therefore, in the exercise of the powers conferred upon him by sub-section 2(3)(d) and subsection 3(1) of the Commissions of Enquiry Act 1950 [Act 119], the Yang di-Pertua Negeri issues a Commission and appoints \u2014<\/p>\n
Y Bhg Dato\u2019 Yeo Yang Poh;<\/p>\n
Y Bhg Dato\u2019 Dr Gue See Sew; &<\/p>\n
Y Bhg Professor Dr Ramli Nasir;<\/p>\n
to be the Commissioners to carry out the enquiry, with the following Terms of Reference:<\/p>\n
(a)\tTo enquire into the cause or causes of the failure of temporary structures in a worksite incident that took place at Tanjung Bungah on 21 October 2017 (\u201cthe Worksite Incident\u201d) at the Taman Sri Bunga construction site (\u201cthe Construction Site\u201d); including whether or not the cause or causes were related to the nearby quarry.
\n(b)\tTo enquire into whether the failure of the said temporary structures, and the resulting deaths and injuries, were due to any negligence, recklessness, breach of professional or legal duty, misconduct, or deliberate act or omission, on the part of any person, company or authority.
\n(c)\tTo recommend any appropriate legal or other action, if necessary, which ought to be taken against any person, company or authority found to be responsible for the said failure and the loss of lives, and injuries.
\n(d)\tTo enquire into whether all necessary approvals for or in respect of the project at the Construction Site had been properly applied for and obtained in accordance with the applicable laws.
\n(e)\tTo recommend any appropriate measures, and any changes or improvements to the relevant processes and procedures, that ought to be taken or made by any authority or by any other party, in order to prevent or avoid the recurrence of similar incidents.
\n(f)\tTo make any further or other findings and recommendations that may be related or incidental to any or all of the above matters.<\/p>\n
And directs that \u2014<\/p>\n
Y Bhg Dato\u2019 Yeo Yang Poh shall be the Chairman of the Commission; and that the Chairman and one other Commissioner shall constitute a quorum for any sitting or hearing;<\/p>\n
the Enquiry shall be held in public, at such places, on such dates and during such hours as the Chairman may from time to time determine;<\/p>\n
the Commissioners shall, in the execution of this Commission, regulate themselves and adopt such rules and procedures as the Chairman may from time to time deem proper or expedient;<\/p>\n
the Commissioners may from time to time appoint such legal, technical or clerical officers and staff (whether a public officer or not), including any conducting officer, investigating officer, assisting officer, research officer, administrative coordinator, registrar, assistant registrar, spokesperson, interpreter, transcriber, and security personnel; as the Chairman may deem necessary or desirable, to assist them in the execution of this Commission; and<\/p>\n
after completion of the Enquiry, the Commissioners shall submit a report to the Yang di-Pertua Negeri, within 3 months from the first day of sitting of the Commission, or within such extended time as may from time to time be granted.<\/p>\n

\u6709\u9274\u4e8e\u6b64\uff0c\u5728\u7b2c119\u67611950\u5e74\u8c03\u67e5\u59d4\u5458\u4f1a\u6cd5\u4ee4\u9644\u5c5e\u4e4b\u7b2c2(3)(d)\u6761\u6587\u53ca\u7b2c3(1)\u6761\u6587\u4e4b\u4e0b\uff0c\u5dde\u5143\u9996\u884c\u4f7f\u5176\u6743\u529b\u59d4\u4efb\uff1a<\/p>\n

\n(a)\u8c03\u67e5\u8fd9\u9879\u4e8e2017\u5e7410\u670821\u65e5\u5728\u4e39\u7ed2\u6b66\u96c5Taman Sri Bunga\u5efa\u7b51\u5de5\u5730\uff08\u201c\u5efa\u7b51\u5de5\u5730\u201d\uff09\u7684\u5de5\u5730\u4e8b\u6545(\u201c\u5de5\u5730\u4e8b\u6545\u201d)\u4e2d\u4e34\u65f6\u7ed3\u6784\u4f1a\u5931\u6548\u7684\u539f\u56e0\u6216\u591a\u9879\u539f\u56e0\uff1b\u5f53\u4e2d\u5305\u62ec\u8c03\u67e5\u8fd9\u6216\u8fd9\u4e9b\u539f\u56e0\u662f\u5426\u4e0e\u6bd7\u90bb\u7684\u91c7\u77f3\u573a\u6709\u5173\u3002<\/p>\n
(b)\u8c03\u67e5\u6240\u6307\u7684\u4e34\u65f6\u7ed3\u6784\u5931\u6548\u5bfc\u81f4\u4f24\u4ea1\u662f\u5426\u7275\u6d89\u4efb\u4f55\u4e2a\u4eba\u3001\u516c\u53f8\u4f01\u4e1a\u3001\u6709\u5173\u6743\u529b\u5f53\u5c40\u7684\u758f\u5ffd\u3001\u7f54\u987e\u5b89\u5168\u3001\u8fdd\u53cd\u4e13\u4e1a\u6216\u6cd5\u5f8b\u804c\u8d23\u3001\u8fdd\u53cd\u64cd\u5b88\u3001\u84c4\u610f\u4e3a\u4e4b\u6216\u5931\u804c\u3002<\/p>\n
(c)\u5982\u679c\u4efb\u4f55\u4e2a\u4eba\u3001\u516c\u53f8\u4f01\u4e1a\u3001\u6709\u5173\u6743\u529b\u5f53\u5c40\u8bc1\u5b9e\u771f\u7684\u662f\u8087\u4e8b\u8d23\u4efb\u8005\uff0c\u5982\u6709\u5fc5\u8981\uff0c\u5c06\u5efa\u8bae\u4efb\u4f55\u76f8\u5e94\u7684\u6cd5\u5f8b\u884c\u52a8\u6216\u5176\u4ed6\u63aa\u65bd\uff0c\u4ee5\u5bf9\u4ed8\u8087\u4e8b\u8d23\u4efb\u8005\u3002<\/p>\n
(d)\u8c03\u67e5\u8be5\u5efa\u7b51\u5de5\u5730\u7684\u76f8\u5173\u8ba1\u5212\u662f\u5426\u8ba4\u771f\u4ed4\u7ec6\u7533\u8bf7\u901a\u8fc7\u6240\u6709\u5e94\u6709\u7684\u6279\u51c6\u7a0b\u5e8f\uff0c\u5e76\u4e14\u4f9d\u6cd5\u884c\u4e8b\u3002<\/p>\n
(e)\u5efa\u8bae\u76f8\u5e94\u63aa\u65bd\u3001\u6539\u9769\u6216\u7cbe\u8fdb\u6709\u5173\u6743\u529b\u5f53\u5c40\u6216\u5404\u9020\u7406\u5e94\u91c7\u7eb3\u7684\u76f8\u5173\u7a0b\u5e8f\uff0c\u4ee5\u514d\u91cd\u8e48\u8986\u8f99\u3002<\/p>\n
(f)\u540e\u7eed\u5c06\u4ee5\u66f4\u591a\u6216\u5176\u4ed6\u7684\u5efa\u8bae\u9488\u5bf9\u8be5\u4e8b\u4ef6\u518d\u4f5c\u8865\u5145\u3002<\/p>\n

3. \u59d4\u5458\u4eec\u5fc5\u987b\u9075\u4ece\u4e3b\u5e2d\u4efb\u4f55\u65f6\u5019\u6240\u53d1\u51fa\u7684\u6307\u793a\uff1b<\/p>\n
4. \u59d4\u5458\u4eec\u6709\u6743\u5728\u4e3b\u5e2d\u8ba4\u4e3a\u6709\u9700\u8981\u7684\u60c5\u51b5\u4e0b\uff0c\u5728\u4efb\u4f55\u65f6\u59d4\u4efb\u4efb\u4f55\u6280\u672f\u6216\u6587\u4e66\u4eba\u5458\uff08\u4e0d\u8bba\u662f\u516c\u52a1\u5458\uff09\uff0c\u5305\u62ec\u4efb\u4f55\u6267\u884c\u4eba\u5458\u3001\u8c03\u67e5\u4eba\u5458\u3001\u52a9\u7406\u3001\u7814\u7a76\u4eba\u5458\u3001\u884c\u653f\u534f\u8c03\u5458\u3001\u767b\u8bb0\u5458\u3001\u52a9\u7406\u767b\u8bb0\u5458\u3001\u53d1\u8a00\u4eba\u3001\u53e3\u8bd1\u5458\u3001\u5f55\u97f3\u5458\u548c\u4fdd\u5b89\u4eba\u5458\uff1b\u4ee5\u53ca <\/p>\n
5. \u59d4\u5458\u4f1a\u5fc5\u987b\u4ece\u7b2c\u4e00\u5929\u5f00\u5ead\u8c03\u67e5\u8d77\uff0c\u4e09\u4e2a\u6708\u7684\u65f6\u95f4\u5185\u5b8c\u6210\u8c03\u67e5\u62a5\u544a\uff0c\u5e76\u5c06\u6709\u5173\u62a5\u544a\u5448\u4ea4\u69df\u5dde\u5143\u9996\u3002\u82e5\u6709\u5ef6\u957f\uff0c\u5219\u987b\u5728\u89c4\u5b9a\u7684\u65f6\u95f4\u5185\u5b8c\u6210\u3002<\/p>\n
