Press Conference Statement By Penang Chief Minister Lim Guan Eng in Komtar, George Town On 26.2.2016.<\/p>\n
The Penang state government wishes to highlight two recent High Court cases which reveals the potentially huge compensation payout faced by the present Penang state government involving hundreds of millions of ringgit due to criminal failures of the previous BN state government.<\/p>\n
The two recent cases involve one in Majlis Perbandaran Seberang Perai(MPSP) in 1994 known as the NEG Engineering Sdn Bhd case involving a huge RM 243 million claim whilst the second one is against the state government on a land acquisition matter in 1992 known as the Bagan Serai Housing Estate Sdn Bhd case on the present Megamall complex site in Prai, Seberang Perai.(see attached). MPSP was fortunate to win the NEG Engineering Sdn Bhd case which involved an active politician who was a leader in the previous government, but there is a possibility that they may appeal. Reports have also been filed by MPSP to the police and Malaysia Anti-Corruption Commission(MACC).<\/p>\n
Unfortunately the Penang state government lost the second case, the Megamall case, and is appealing to the Court of Appeal involving potential compensation that could be similar to NEG Engineering Sdn Bhd. This Megamall case is similar to the state government losing on another land matter in Bukit Mertajam due to an error by the previous state government, resulting in compensation of RM 29.4 million to Tang Hak Ju. The state government was forced to pay RM 14.7 million and is still trying to reclaim back the sum in courts.<\/p>\n
Again Majlis Bandaraya Pulau Pinang(MBPP) was forced to pay RM 20 million compensation to Boustead Holdings Bhd to reduce the height of their hotel from 12 storeys approved by the previous government to 5 storeys. This RM20 million payment was made in exchange for reducing the height of the building by 7 storeys, to comply with the promise made to UNESCO, but not fulfilled by the previous government, that all buildings in the George Town Heritage area would not exceed 5 storeys or 18 meters.<\/p>\n
The present Penang state government lives in daily fear and nightmare of facing huge compensation payouts due to the failures of the previous BN state government that can bankrupt the state. When compensation was paid by the state government, no one offered or raised a single cent to assist us despite sweet promises made by some NGOs. The threat of bankruptcy is real. For this reason, the Penang state government has unwillingly acceded to all previous rulings made by the BN state government to avoid huge compensation payout that can bankrupt Penang.<\/p>\n
One of the potential threats is compensation claims by landowners above 76 meters who were approved development as special projects by the previous state government, which may run up to billions of ringgit.<\/p>\n

We wish to welcome Universiti Malaya Law Professor Prof. Gurdial Singh Nijar and Dato Ambiga Sreenevasan to assist the Majlis Bandaraya Pulau Pinang(MBPP) to avoid paying huge compensation legally for rejecting development for land above 76 meters(250 feet) or special projects that were approved by the previous government. This follows the latest decision made by Dato Yeo Yang Poh, the Chairman of the Appeals Board, established under the Town & Country Planning Act on the Sunway Bhd case(see attached).<\/p>\n
The Appeals Board indicated that MBPP did not need to approve the development order sought by Sunway Bhd for their land above 76 meters that were allowed development of either 6 units per acre or 15 units per acre by the previous government. And that compensation need not be paid by MBPP for rejecting such special projects from landowners.<\/p>\n
However, this Appeals Board decision can be subject to judicial review by the High Court. Sunway Bhd and other landowners affected by this decision has 90 days to do so. Sunway Bhd has communicated to me of their intention to do so and may seek compensation, should the Appeals Board decision be affirmed by the High Court. This gives MBPP an opportunity to overturn the special projects approved given by the previous state government without paying financial compensation.<\/p>\n
I am pleased to announce that we are getting high-powered legal expertise in both Professor Gurdial and Datuk Ambiga. Both have consented to assist the state government legally when the judicial review is argued in the High Court, in what is expected to be the case of the century for planning law in Malaysia.<\/p>\n

Dua Kes Terbaru Di Mahkamah Tinggi Yang Berpotensi Melibatkan Bayaran Pampasan Jutaan Ringgit Yang Mungkin Terpaksa Ditanggung Oleh Kerajaan Negeri Pulau Pinang Sekarang Akibat Daripada Kerajaan Negeri Barisan Nasional Terdahulu<\/strong><\/p>\n Kerajaan Negeri Pulau Pinang berhasrat untuk membangkitkan dua kes Mahkamah Tinggi baru-baru ini yang mendedahkan bayaran pampasan jutaan ringgit yang mungkin terpaksa ditanggung oleh Kerajaan Negeri Pulau Pinang sekarang akibat daripada kegagalan jenayah Kerajaan Negeri Barisan Nasional Terdahulu.<\/p>\n Dua kes Mahkamah baru-baru ini yang melibatkan kes Majlis Perbandaran Seberang Perai (MPSP) pada tahun 1994 dikenali sebagai NEG Engineering Sdn. Bhd. yang melibatkan jumlah RM243 juta sementara kes yang kedua melibatkan kerajaan negeri ke atas pengambilan tanah pada tahun 1992, yang dikenali sebagai kes Bagan Serai Housing Estate Sdn. Bhd. yang kini terletak di Prai iaitu Megamall Complex, Seberang Perai. MPSP adalah bernasib baik untuk memenangi kes dengan NEG Engineering Sdn. Bhd. yang melibatkan ahli politik yang aktif yang juga merupakan seorang pemimpin dalam kerajaan yang lepas, tetapi terdapat kebarangkalian bahawa mereka akan merayu. Laporan polis juga telah dibuat oleh MPSP kepada Polis dan Suruhanjaya Pencegahan Rasuah (SPRM).<\/p>\n Malangnya, Kerajaan Negeri Pulau Pinang kalah dalam kes kedua iaitu kes Megamall dan sedang merayu di Mahkamah Rayuan yang melibatkan pampasan yang lebih kurang sama dengan kes NEG Engineering Sdn. Bhd. Kes Megamall ini adalah sama seperti kes di mana Kerajaan Negeri kalah dalam satu kes tanah di Bukit Mertajam akibat daripada kesilapan Kerajaan Negeri terdahulu, yang mengakibatkan pampasan sebanyak RM29.4 juta kepada Tang Hak Ju. Kerajaan Negeri dipaksa untuk membayar sebanyak RM14.7 juta dan masih berusaha untuk menuntut balik bayaran tersebut di Mahkamah.<\/p>\n Majlis Bandaraya Pulau Pinang (MBPP) sekali lagi dipaksa untuk membayar pampasan sebanyak RM20 juta kepada Boustead Holdings Bhd untuk mengurangkan ketinggian hotel daripada 12 tingkat kepada 5 tingkat yang diluluskan oleh Kerajaan Negeri terdahulu. Bayaran sebanyak RM20 juta ini dibayar sebagai pampasan untuk mengurangkan ketinggian sebanyak 7 tingkat bagi memenuhi ketetapan syarat yang dibuat oleh pihak UNESCO yang mana semua bangunan di dalam kawasan George Town Heritage tidak boleh melebihi 5 tingkat atau 18 meter yang tidak dipenuhi oleh Kerajaan Negeri terdahulu.<\/p>\n Kerajaan Negeri Pulau Pinang yang terkini hidup di dalam ketakutan untuk berhadapan dengan bayaran pampasan yang tinggi akibat daripada kegagalan Kerajaan Negeri Barisan Nasional yang terdahulu yang boleh mengakibatkan kerajaan menjadi bankrup. Apabila Kerajaan Negeri membayar pampasan, tiada pihak yang menawarkan walau sesen untuk membantu meskipun janji-janji manis dibuat oleh beberapa NGO. Ancaman menjadi bankrup ini adalah benar. Atas sebab ini, Kerajaan Negeri Pulau Pinang terpaksa bersetuju dengan keputusan terdahulu yang dibuat oleh Kerajaan Negeri Barisan Nasional untuk mengelakkan bayaran pampasan yang boleh mengakibatkan kebankrupan negeri Pulau Pinang.<\/p>\n Salah satu daripada ancaman ialah bayaran pampasan yang mungkin mencecah berbilion ringgit yang dibuat kepada tuan punya tanah yang melebihi 76 meter bagi projek pembangunan istimewa yang telah diluluskan oleh Kerajaan Negeri yang terdahulu.<\/p>\n Mengalu-alukan Perwakilan Professor Prof. Gurdial Singh A\/L Sadu Singh dan Dato Ambiga Sreenevasan Untuk Membantu Majlis Bandaraya Pulau Pinang (MBPP) Untuk Mengelakkan Ganti Rugi Kewangan Yang Besar Yang Perlu Dibayar Kepada Pemaju Atas Keputusan Menolak Permohonan Kebenaran Merancang Yang Melibatkan Ketinggian 76 meter (250 kaki) Atau Bagi Projek Istimewa Yang Telah Diluluskan Oleh Kerajaan Negeri Terdahulu<\/p>\n Kami dengan ini menyambut perwakilan Professor Fakulti Undang-undang Universiti Malaya Prof. Gurdial Singh Nijar A\/L Sadu Singh dan Dato’ Ambiga Sreenevasan bagi membantu Majlis Bandaraya Pulau Pinang (MBPP) untuk mengelakkan ganti rugi kewangan besar yang perlu dibayar kepada Pemaju atas keputusan menolak permohonan kebenaran merancang yang melibatkan ketinggian 76 meter (250 kaki) atau bagi projek istimewa yang telah diluluskan oleh Kerajaan Negeri terdahulu. Ini adalah berikutan dengan keputusan terkini yang dibuat di bawah Akta Perancangan Bandar dan Desa 1976 oleh Dato Yeo Yang Poh, Presiden Lembaga Rayuan (seperti dilampirkan).<\/p>\n Lembaga Rayuan telah mengulas bahawa MBPP tidak sepatutnya meluluskan pemajuan oleh Sunway City (Penang) Sdn. Bhd. bagi tanah melebihi ketinggian 76 meter yang mana membenarkan pemajuan untuk 6 unit per ekar atau 15 unit per ekar oleh Kerajaan Negeri terdahulu dan seterusnya gantirugi tidak perlu dibayar oleh MBPP bagi menolak projek istimewa sedemikian kepada Pemaju.<\/p>\n Walau bagaimanapaun, keputusan Lembaga Rayuan tersebut adalah tertakluk kepada Semakan Kehakiman di Mahkamah Tinggi. Sunway City (Penang) Sdn. Bhd. dan pemilik tanah yang lain yang telah terkilan dengan keputusan ini mempunyai 90 hari untuk berbuat demikian. Sunway telah memaklumkan hasratnya kepada saya tentang niatnya untuk berbuat demikian dan mungkin akan menuntut ganti rugi jika Mahkamah Tinggi mengesahkan keputusan Lembaga Rayuan. Ini akan memberikan peluang kepada MBPP untuk menolak (overturn) projek-projek istimewa yang telah diluluskan oleh Kerajaan Negeri terdahulu tanpa perlu membayar gantirugi kewangan.- 2 –<\/p>\n Saya dengan sukacitanya ingin mengumumkan bahawa Kerajaan Negeri akan mendapat pakar perundangan yang berkelayakkan tinggi seperti Professor Gurdial dan Dato Ambiga. Kedua-dua pakar perundangan ini telah memberi persetujuan untuk mewakili Kerajaan Negeri sekiranya semakan kehakiman dibicarakan di Mahkamah Tinggi yang mana kes ini akan menjadi kes utama dalam abad Estate Sdn Bhd \u6848\u4ef6\uff08\u8be6\u89c1\u9644\u4ef6\uff09\u3002<\/p>\n \u4e00\u5219\u4ee5\u5e78\u7684\u662f\uff0c\u76ee\u524d\u5a01\u7701\u5e02\u653f\u5c40\u8d62\u5f97\u4e86NEG Engineering Sdn Bhd\u6848\u7684\u5b98\u53f8\u3002\u4f46\u8fd9\u6848\u4ef6\u7275\u6d89\u76ee\u524d\u4ecd\u6d3b\u8dc3\u653f\u575b\u7684\u524d\u671d\u653f\u5e9c\u9886\u8896\uff0c\u4ed6\u4eec\u53ef\u80fd\u8fd8\u4f1a\u4e0a\u8bc9\u3002\u76ee\u524d\uff0c\u5a01\u7701\u5e02\u653f\u5c40\u5df2\u7ecf\u5411\u8b66\u65b9\u53ca\u53cd\u8d2a\u59d4\u5458\u4f1a\u62a5\u6848\u3002<\/p>\n
