\nPutting People And Not Profits First By Closing Down Lynas Rare Earth Plant Instead of Issuing a Permanent or Temporary Operating License(POL or TOL) and Scrapping The Proposed Two Nuclear-Power Generating Plants.

\nMalaysia should celebrate World Environment Day by putting people and not profits first by closing down Lynas rare earth plant instead of issuing a TOL or POL and scrapping the proposed two nuclear-power generating plants. Malaysian regulatory authority Atomic Energy Licensing Board (AELB) and the Ministry of Science, Technology and Innovation (MOSTI) should explain whether they are approving the application by Lynas for the Permanent Operating License following Lynas financial crisis and non-compliance with the conditions stated in the Temporary Operating License(TOL).<\/p>\n

Last month, Lynas Corp. planned to defer some debt repayments and sell as much as A$40 million in shares after it share prices slumped. Lynas had spent about A$1 billion ($930 million) on a rare earths processing plant in Kuantan. The TOL (Temporary Operating License) for two years is due to expire on the 2nd September 2014.<\/p>\n

Under the terms of the issuance, as recommended by the International Atomic Energy Agency (IAEA) report, Lynas is required to submit the plan for the PDF (Permanent Deposit Facility) for its radioactive waste before TOL is granted. Lynas failed to submit the plan before the issuance of the TOL but AELB relaxed the provision by granting them instead 10 months after it commenced operations to comply.<\/p>\n

On the eve of the 10 months dateline, Lynas submitted a \u2018conceptual\u2019 plan of the PDF while the Deputy Minister of MOSTI, Dato Abu Bakar Mohd Diah replied in the Parliament that Lynas did identify the site and the plan for the PDF but he declined to reveal the site. This showed clearly that Lynas failed to comply with the requirements stated in the TOL.<\/p>\n

The risks of Lynas being insolvent are real as Lynas has only a closing cash balance of AUD$23.4 million as at 31 March 2014. For the next quarter, Lynas will require at least AUD$ 48.172 million to be able to continue operating as a business. In desperation for additional cash, Lynas is seeking to raise AUD$30 million through rights issue and another AUD$10 million through institutional placement to boost its working capital.<\/p>\n

The BN government should be reminded of their horrifying mistake of allowing the Japanese Asian Rare Earth(ARE) plant to operate in Bukit Merah. After it was shut down, the former ARE owner is spending USD100 million in clean-up operations of the radioactive wastes. In view of the possible closure of Lynas, which is 10 times the size of ARE, the radioactive waste left behind will be a huge environmental and financial burden for future generations, especially if Lynas collapses financially.<\/p>\n

Worse the BN federal government is pressing ahead with building two nuclear-powered generating plants even though Malaysia has a healthy power reserve margin of more than 30%. A people-centric government that is accountable and transparent would never allow these projects that put profits of its cronies over people\u2019s health without considering the long-term environmental costs.<\/p>\n

Dahulukan rakyat sebelum keuntungan dengan menutup loji nadir bumi Lynas dan bukannya memberikan lesen operasi sementara atau tetap serta membatalkan cadangan membina dua loji tenaga nuklear.<\/strong><\/p>\n

Malaysia patut meraikan Hari Alam Sekitar Sedunia dengan mendahulukan rakyat sebelum keuntungan, dengan menutup loji nadir bumi Lynas dan bukannya memberikan lesen operasi sementara atau tetap serta membatalkan cadangan membina dua loji tenaga nuklear. Agensi kawal selia, Lembaga Perlesenan Tenaga Atom (AELB) serta Kementerian Sains, Teknologi dan Inovasi (MOSTI) wajar menerangkan sama ada mereka meluluskan permohonan lesen operasi tetap Lynas berikutan krisis kewangan syarikat tersebut dan ketidakpatuhan kepada syarat yang ditetapkan dalam lesen operasi sementara.<\/p>\n

Bulan lepas, Lynas Corp. merancang untuk menangguhkan pembayaran beberapa hutang dan menjual sehingga A$40 juta sahamnya selepas nilai sahamnya merudum. Lynas membelanjakan sekitar A$1 bilion ($930 juta) untuk loji pemprosesan nadir bumi di Kuantan. Lesen operasi sementara dua tahun yang dimilikinya akan luput pada 2 September 2014.<\/p>\n

Di bawah syarat perlesenan seperti yang dicadangkan dalam laporan International Atomic Energy Agency (IAEA), Lynas dikehendaki mengemukakan pelan fasiliti pembuangan sisa tetap (Permanent Disposal Facility, PDF) untuk bahan buangan radioaktifnya sebelum lesen tersebut diberikan. Lynas telah gagal berbuat demikian sebelum pemberian lesen sementara namun pihak AELB memberikan keringanan dengan memberikan tempoh 10 bulan selepas ia memulakan operasi untuk mematuhi keperluan tersebut.<\/p>\n

Di ambang tarikh tamat 10 bulan tersebut, Lynas mengemukakan pelan konsep PDF terbabit sementara Timbalan Menteri MOSTI, Dato\u2019 Abu Bakar Mohd Diah dalam jawapan parlimennya memberitahu bahawa Lynas sudah mengenal pasti tapak dan pelan untuk PDF tersebut namun enggan mendedahkan tempatnya. Ini jelas menunjukkan bahawa Lynas gagal untuk mematuhi syarat yang ditetapkan dalam lesen operasi sementara.<\/p>\n

Risiko untuk Lynas menjadi bankrap adalah risiko yang nyata memandangkan Lynas hanya mempunyai baki tunai akhir sebanyak AUD$23.4 juta pada 31 Mac 2014. Untuk suku berikutnya, Lynas memerlukan sekurang-kurangnya AUD$ 48.172 juta untuk meneruskan operasi. Dalam keadaan terdesak untuk wang tunai tambahan, Lynas sedang berusaha untuk mengumpul AUD$30 juta melalui terbitan hak (rights issue) dan AUD$10 juta lagi melalui penempatan institusi untuk menambahkan modal kerja.<\/p>\n

Kerajaan BN mesti diingatkan tentang kesilapan lampau mereka membenarkan operasi loji Japanese Asian Rare Earth (ARE) di Bukit Merah. Selepas ia ditutup, bekas pemilik ARE membelanjakan USD100 juta untuk operasi pembersihan sisa-sisa radioaktif. Dengan kemungkinan penutupan Lynas, yang mempunyai saiz sepuluh kali ganda berbanding ARE, sisa radioaktif yang ditinggalkan akan menjadi beban kewangan dan alam sekitar untuk generasi akan datang, terutamanya jika Lynas lumpuh sama sekali dari segi kewangan.<\/p>\n

Lebih teruk lagi, Kerajaan Persekutuan BN nampaknya ingin meneruskan pembinaan dua loji janakuasa tenaga nuklear walaupun Malaysia mempunyai marjin simpanan tenaga yang baik sehingga lebih 30%. Kerajaan yang berjiwa rakyat dan yang bertanggungjawab serta telus tidak akan membenarkan projek-projek yang mendahulukan keuntungan kroni daripada kepentingan kesihatan rakyat tanpa mempertimbangkan kos jangka panjang terhadap alam sekitar.<\/p>\n
