Parliamentary Speech By DAP Secretary-General And MP For Bagan Lim Guan Eng During The Second Reading Of The Sedition(Amendment) Act 2015 In Dewan Rakyat On 9 April 2015. <\/p>\n

DAP strongly objects and condemns the proposed amendments to the 1948 Sedition Act, because the harsh strengthening of the repugnant laws is a historic act of national betrayal by the Prime Minister and the BN Government that launches 10 oppressive attacks against 30 million Malaysians. Instead of fulfilling his promise first made on the eve of Malaysia Day 2011 and repeated it twice(on July 2012 and after the 13th General Election on 2 July 2013 during an BBC interview), Prime Minister Datuk Seri Najib Tun Razak has chosen to dishonour it by breaking his word to repeal the Sedition Act. <\/p>\n

The Prime Minister did not even apologise publicly or seem contrite for breaking his promise to repeal the Sedition Act made 3 times. We hold the Prime Minister and BN parties personally responsible for this historic act of national betrayal to their principles, to their own promises, to the upholding of parliamentary democracy and most important of all to the people of Malaysia. Worse, the BN Federal government is now trying to accumulate and amass greater and wider oppressive and arbitrary powers with these repugnant amendments. <\/p>\n

The famous American President Abraham Lincoln was supposed to have said, \u201cNearly all men can stand adversity, but if you want to test a man’s character, give him power.” Malaysians realise now the true character of the BN parties that hold power at the Federal government level. Whilst the 52% will feel justified for not supporting BN, the 48% will question what is the worth of a government that does not keep its promises? <\/p>\n

Malaysians from Sabah and Sarawak will also feel betrayed if their right to question whether the failure of BN to abide and adhere to the terms, conditions and guaranteed rights for Sabahans and Sarawakians in establishing Malaysia based on the 1963 Federal Constitution would also give rise to questions of the right to secede is now considered seditious. After all Sabahans and Sarawkians may ask why can\u2019t they raise such question when the BN Federal government betrays their promises guaranteed in the 1963 Malaysia Federal Constitution.<\/p>\n

If so, then why is the BN government also not making it a seditious offence for those who fail to abide and adhere to these terms for Sabah and Sarawak agreed to in forming Malaysia or those who fail to respect the inalienable rights of Sabahans and Sarawakians? My colleague from Kuching will expand on this in his speech later. <\/p>\n

By now inserting a new clause for seditious tendency without any prior consultation with the people of Sabah and Sarawak, this double-standard of regarding calls for secession from Malaysia as seditious, but failing to observe and respect the rights of Sabahans and Sarawakians as not seditious, may be considered a breach of the rights granted when Malaysia was formed on 16 September 1963. By deleting any calls for secession as seditious, is the government now saying that calling for secession is not considered as seditious?<\/p>\n

The proposed oppressive amendments is an open attack on the Malaysian people in 10 key areas:-
\n1. Attack on fundamental human rights of freedom of speech and expression as enshrined in the United Nations\u2019 Universal Declaration of Human Rights and even our own Federal Constitution. There used to be freedom of speech but no freedom after speech in Malaysia. With these harsh amendments, that provides sentencing of up to 20 years in prison, there will be neither freedom after speech nor freedom of speech.<\/p>\n

2. Attack on freedom of the press, especially the online media. Clearly the amendments permit the BN government to extend its tentacles to silence and stifle the free voices in the online media, just as have they have controlled and manipulated the mainstream media;<\/p>\n

3. Attack on the rule of law where lawyers say there was still no clarity of what amounts to “seditious tendency” in Section 3(1), but there was now a new clause of seditious tendency that is vague. Further there is no justice when no consideration is given to a youthful or first time offender.<\/p>\n

4. Attack on the judiciary where the fixing of a minimum sentence of 3 years imprisonment, is a gross interference with judicial discretion on sentencing. Further is the government not only disrespecting but also in contempt of the judiciary by making such amendments when it is sub judice as the issue is still pending decision by the Federal Court on whether the sedition law is constitutional.<\/p>\n

5. Attack on parliament and the parliamentary process by delimiting the right of MPs and State Assemblymen to enjoy the right of legal immunity of anything said in the House by even prosecuting for sedition the Penang DAP ADUN for Sri Delima, YB RSN Rayer when he attacked UMNO in the Penang State Assembly. Further, BN has treated Parliament as a mere rubberstamp by bulldozing bills in the early hours of the morning and only giving short notice of less than 2 days for such an important amendment bill.<\/p>\n

6. Attack on honourable and noble conduct of keeping one\u2019s word and promises, especially government leaders. Failure to keep one\u2019s promises gives politicians a bad name, if even the Prime Minister can do it without any regret.<\/p>\n

7. Attack on Malaysia\u2019s role in the United Nations Human Rights Council, of which Malaysia is a member. Malaysia will become a laughing stock of being a member of a UN council promoting human rights when it is stamping out freedom of expression.<\/p>\n

8. Attack on creativity and innovation which relies on the 3Ts of Talent, Technology and Tolerance of new ideas;<\/p>\n

9. Attack on our future where our future generation will live in a climate of fear and silenced by fear. What difference will this future be from the box-office movie The Hunger Games, where sedition is also severely punished.<\/p>\n

10. Attack on the opposition, which has been victimised by selective prosecution and double-standards where the enhancement of punishment under these amendments, will automatically disqualify a member of Parliament. So far 160 people have been arrested, from law professors to a cartoonist representing all sections of society! Amongst the list of DAP leaders, MPs and ADUNs charged or investigated under the Sedition Act are as follows(see attached) <\/p>\n

BN had attempted but failed to categorise those who commit seditious offences as serious as murder by refusing to grant bail for so-called aggravated sedition. This is a travesty of justice that making a speech is as serious a criminal offence as murder. Why is corruption cases also not placed at the same level of not being granted bail? <\/p>\n

There are now two Malaysias. We must not give up on our great Malaysian Dream \u2013 the promise in the Malaysian Federal Constitution offering justice, freedom, opportunity and equality. Or the other Malaysian nightmare of injustice, oppression, cronyism and discrimination. <\/p>\n

By concentrating such powers on the Executive, the separation of powers is further undermined by emasculating the supremacy of Parliament and the independence of the Judiciary. Clearly those who seek to amass such power must be power-crazy, whether it is the Attorney-General or the police or the Home Minister. <\/p>\n

DAP urges the Prime Minister and the BN government to return to sanity and calls for the Sedition Amendment Bill to be withdrawn, deferred or at least referred to a Parliamentary Select Committee. These amendments will only instil fear. Let our children live free, free from fear.<\/p>\n

Ucapan Parlimen oleh Setiausaha Agung DAP merangkap Ahli Parlimen Bagan Lim Guan Eng pada bacaan kali kedua Rang Undang-undang Akta Hasutan (Pindaan) 2015 di Dewan Rakyat pada 9 April 2015:<\/p>\n

Pengukuhan keras terhadap Akta Hasutan yang menjijikkan adalah satu pengkhianatan nasional oleh Perdana Menteri dan Kerajaan BN yang melancarkan 10 serangan penindasan terhadap 30 juta rakyat Malaysia.<\/p>\n

DAP dengan tegas menentang dan mengecam cadangan pindaan terhadap Akta Hasutan 1948 kerana pengukuhan yang lebih tegas terhadap undang-undang yang menjijikkan itu adalah satu tindakan pengkhianatan terhadap negara oleh Perdana Menteri dan Kerajaan BN yang melancarkan 10 serangan penindasan terhadap 30 juta rakyat Malaysia. Daripada menunaikan janji yang pertama kali dibuat pada ambang Hari Malaysia 2011, yang kemudian diulang dua kali (pada Julai 2012 dan selepas Pilihanraya Umum ke-13 pada 2 Julai 2013 dalam satu wawancara bersama BBC), Perdana Menteri Datuk Seri Najib Tun Razak telah memilih untuk mengkhianati dan memungkiri janjinya untuk memansuhkan Akta Hasutan.<\/p>\n

Perdana Menteri langsung tidak memohon maaf secara terbuka atau sedikit pun merasa kesal kerana telah memungkiri janji tiga kalinya untuk memansuhkan Akta Hasutan. Kami meletakkan tanggungjawab penuh terhadap Perdana Menteri dan parti-parti komponen BN atas pengkhianatan mereka terhadap prinsip, janji-janji, tanggungjawab menjunjung demokrasi berparlimen dan lebih penting lagi amanah terhadap seluruh rakyat Malaysia. Apa yang lebih teruk lagi, Kerajaan Persekutuan BN kini cuba untuk mengumpulkan kuasa menindas secara sewenang-wenang yang lebih besar dan hebat dengan pindaan-pindaan yang menjijikkan ini.<\/p>\n

Presiden Amerika Syarikat yang ternama, Abraham Lincoln dikatakan pernah menyebut, \u201cNearly all men can stand adversity, but if you want to test a man’s character, give him power.” Hampir semua orang boleh bertahan dengan kesukaran, tetapi jika mahu menguji sikap seseorang, berikan dia kuasa. Rakyat Malaysia menyedari sikap sebenar parti-parti BN yang memegang kuasa di peringkat Persekutuan. Sementara 52% rakyat akan merasa wajarlah mereka tidak menyokong BN, baki 48% lagi akan mempersoalkan apa nilai sebuah kerajaan yang memungkiri janji?<\/p>\n

Rakyat Malaysia di Sabah dan Sarawak juga akan berasa dikhianati sekiranya hak mereka untuk mempersoalkan kegagalan BN untuk mematuhi syarat-syarat dan hak-hak yang dijamin untuk rakyat Sabah Sarawak ketika Malaysia ditubuhkan berdasarkan Perlembagaan Persekutuan 1963 akan turut menimbulkan persoalan hak untuk menarik diri kini turut dikira menghasut. Rakyat Sabah dan Sarawak mungkin bertanya kenapa mereka tidak boleh menimbulkan persoalan sedemikian sedangkan Kerajaan Persekutuan BN telah mengkhianati janji yang telah dijamin dalam Perlembagaan Persekutuan Malaysia 1963.<\/p>\n

Jika demikian kenapa Kerajaan BN tidak menjadikannya satu kesalahan menghasut apabila ada yang gagal menepati syarat-syarat yang telah dipersetujui Sabah dan Sarawak ketika membentuk Malaysia, atau mereka yang gagal menghormati hak-hak rakyat Sabah dan Sarawak yang tidak boleh dipisah daripada mereka? Rakan saya dari Kuching Chong Chieng Jen akan bercakap lebih panjang tentang hal ini dalam ucapan beliau nanti.<\/p>\n

Kini, memasukkan satu klausa baru bagi kecenderungan menghasut tanpa sebarang rundingan bersama rakyat Sabah dan Sarawak, tindakan double standard untuk menyifatkan seruan menarik diri dari Malaysia sebagai menghasut, namun pada masa yang sama gagal menghormati hak rakyat Sabah dan Sarawak sebagai tidak menghasut, boleh dikira sebagai melanggar perjanjian hak yang diberi ketika Malaysia dibentuk pada 16 September 1963. Dengan memadamkan sebarang seruan untuk berpisah sebagai satu hasutan, adakah kerajaan sekarang mengatakan bahawa seruan berpisah sudah tidak lagi dikira menghasut?<\/p>\n

Cadangan pindaan yang menindas ini adalah serangan terbuka kepada rakyat Malaysia dalam 10 perkara utama:<\/p>\n

1. Serangan ke atas hak asasi manusia untuk bersuara dan memberi pendapat seperti yang termaktub dalam Deklarasi Antarabangsa Hak Asasi Manusia PBB dan juga Perlembagaan Persekutuan sendiri. Dahulunya wujud kebebasan bersuara, tetapi tiada kebebasan selepas bersuara di Malaysia. Dengan pindaan yang lebih keras ini, yang tidak membenarkan ikat jamin dan memperuntukkan hukuman sehingga 20 tahun penjara, bukan sahaja tidak akan kebebasan selepas bersuara, kebebasan bersuara pun tidak ada.<\/p>\n

2. Serangan terhadap kebebasan akhbar, terutamanya media online. Jelas sekali pindaan ini membolehkan kerajaan BN untuk melebarkan gapaiannya bagi membisukan suara-suara bebeas dalam media online, sepertimana mereka telah mengawal dan memanipulasi media arus perdana.<\/p>\n

3. Serangan ke atas kedaulatan undang-undang di mana para peguam mengatakan masih tidak ada sebarang keterangan tentang apa yang dimaksudkan dengan \u2018kecenderungan menghasut\u2019 dalam Seksyen 3(1), tetapi kini wujud pula satu klausa baru tentang kecenderungan menghasut yang begitu kabur. Tidak ada keadilan juga apabila tidak ada sebarang pertimbangan diberikan untuk kesalahan pertama atau pesalah berusia muda.<\/p>\n

4. Serangan terhadap badan kehakiman apabila penetapan hukuman minima tiga tahun penjara adalah satu campurtangan terhadap budi bicara badan kehakiman dalam memberikan hukuman. Tambahan pula adalah kerajaan bukan sahaja tidak menghormati malah menghina mahkamah dengan membuat pindaan ini walaupun ia sub judice kerana masih ada isu yang sedang berjalan di Mahkamah Persekutuan tentang sama ada undang-undang ini bertepatan dengan Perlembagaan.<\/p>\n

5. Serangan terhadap Parlimen dan proses parlimen dengan menghadkan hak Ahli Parlimen dan Ahli Dewan Undangan Negeri untuk menikmati kekebalan tentang apa yang diucapkan di dalam Dewan dengan mendakwa Adun DAP Pulau Pinang Sri Delima RSN Rayer di bawah Akta Hasutan apabila beliau menyerang Umno dalam sidang DUN Pulau Pinang. Malah BN telah memperlakukan Parlimen sebagai sekadar rubberstamp dengan memaksakan rang undang-undang di tengah malam dan hanya memberi notis singkat kurang dua hari untuk satu pindaan yang begitu penting.<\/p>\n

6. Serangan terhadap perilaku terhormat dan mulia untuk menepati janji, terutamanya pemimpin kerajaan. Kegagalan untuk mematuhi janji memberi ahli politik reputasi yang buruk, walaupun Perdana Menteri boleh melakukannya tanpa sedikit pun rasa bersalah.<\/p>\n

7. Serangan terhadap peranan Malaysia di dalam Majlis PBB yang dianggotai negara. Malaysia akan menjadi bahan ketawa kerana menjadi anggota majlis PBB yang mempromosi hak asasi manusia padahal ia sedang menginjak-injak kebebasan bersuara.<\/p>\n

8. Serangan terhadap kreativiti dan inovasi yang bergantung kepada bakat, teknologi dan toleransi terhadap idea-idea baru;<\/p>\n

9. Serangan terhadap masa depan kita apabila generasi akan datang hidup dalam ketakutan dan dibisukan dengan ketakutan. Apa bezanya masa depan yang sedemikian jika dibanding dengan filem box office The Hunger Games, di mana hasutan turut menerima hukuman yang berat.<\/p>\n

10. Serangan terhadap pembangkang, yang telah dimangsakan dengan pendakwaan terpilih dan double standard di mana bertambahnya hukuman di bawah pindaan-pindaan ini akan secara automatik menghilangkan kelayakan seorang Ahli Parlimen. Setakat ini 160 orang telah ditahan, daripada pensyarah undang-undang sehinggalah kartunis, mewakili setiap bahagian masyarakat. Antara pemimpin DAP, Ahli Parlimen dan Adun yang telah didakwa atau disiasat di bawah Akta Hasutan adalah seperti berikut (lihat lampiran)<\/p>\n

BN telah mencuba namun gagal untuk mengkategorikan mereka yang melakukan kesalahan menghasut adalah sebahaya membunuh dengan menafikan ikat jamin bagi apa yang disifatkan sebagai menghasut teruk (aggravated sedition). Ini adalah satu penghinaan terhadap keadilan yang menjadikan ucapan sebagai satu kesalahan jenayah yang serius seperti membunuh. Kenapa kes rasuah tidak pula diletakkan pada kedudukan yang sama dengan tidak dibenarkan ikat jamin?<\/p>\n

Kini sudah wujud dua Malaysia. Kita tidak boleh putus asa dengan Impian Malaysia – satu janji berasaskan Perlembagaan Persekutuan yang menawarkan keadilan, kebebasan, peluang dan kesaksamaan. Dan satu lagi Malaysia yang membawa mimpi ngeri kezaliman, penindasan, kronisme dan diskriminasi.<\/p>\n

Dengan menumpukan kuasa kepada pihak Eksekutif, doktrin pemisahan kuasa terus direndahkan dengan melemahkan supremasi Parlimen dan kebebasan badan kehakiman. Jelas sekali mereka yang ingin mengumpulkan kekuasaan yang sedemikian benar-benar gila kuasa, tidak kiralah ia Peguam Negara, pihak polis mahupun Menteri Dalam Negeri.<\/p>\n

DAP menggesa Perdana Menteri dan kerajaan BN untuk kembali waras dan menyeru supaya Rang Undang-undang pindaan Akta Hasutan ditarik balik, ditangguhkan atau sekurang-kurangnya dirujuk kepada sebuah Jawatankuasa Pilihan Khas Parlimen. Pindaan-pindaan ini hanya akan menyemai ketakutan. Izinkanlah anak-anak kita hidup bebas, bebas daripada ketakutan.<\/p>\n

\u9996\u76f8\u4e0d\u53ea\u6ca1\u6709\u516c\u5f00\u9053\u6b49\uff0c\u4e5f\u770b\u4e0d\u51fa\u4ed6\u80cc\u5f03\u4e09\u6b21\u627f\u8bfa\u540e\u6709\u6240\u6094\u609f\u3002\u6211\u4eec\u8981\u9996\u76f8\u53ca\u56fd\u9635\u6210\u5458\u515a\u8d1f\u8d77\u80cc\u53db\u56fd\u6c11\u3001\u80cc\u53db\u539f\u5219\u7684\u5386\u53f2\u6027\u8d23\u4efb\uff0c\u4ee5\u634d\u536b\u8bae\u4f1a\u6c11\u4e3b\u3001\u66f4\u91cd\u8981\u7684\u662f\u9a6c\u6765\u897f\u4e9a\u4eba\u6c11\u3002\u66f4\u7cdf\u7684\u662f\uff0c\u56fd\u9635\u8054\u90a6\u653f\u5e9c\u73b0\u5728\u6b63\u8981\u901a\u8fc7\u4e0a\u8ff0\u8ba9\u4eba\u538c\u6076\u7684\u4fee\u6b63\u6848\u6765\u7d2f\u79ef\u53ca\u5f3a\u5927\u3001\u66f4\u538b\u8feb\u3001\u66f4\u72ec\u88c1\u7684\u6743\u529b\u3002<\/p>\n
