Does MCA And Gerakan Dare To Sacrifice Their Ministerial Posts For Principle That They Will Not Enter Cabinet Unless The Prime Minister Reverses The BN Government\u2019s Twin Declarations In Parliament That Malaysia Is Not A Secular But An Islamic State And Support Hudud Laws To Be Implemented On Muslims in Kelantan?<\/strong><\/p>\n Does MCA and Gerakan dare to sacrifice their Ministerial posts for principle that they will not enter Cabinet unless the Prime Minister reverses the BN\u2019s government\u2019s twin declarations in Parliament that Malaysia is not a secular but an Islamic state and will support hudud laws to be implemented on Muslims in Kelantan? This was stated by Minister in the Prime Minister’s Department Jamil Khir Baharom in Parliament on 27 March 2014 and in a written answer to Sibu MP Oscar Ling Chai Yew in Parliament last week.<\/p>\n <\/p>\n The BN government is taking this unconstitutional step when the Federal Court had defied the decision of a five-member bench of the Supreme Court in 1988 on the case of Che Omar Che Soh vs Public Prosecutor, that the law in this country was secular. The Supreme Court in 1988 had fully considered all aspects including the \u201chistory\u201d of Malaysia based on the Malay Sultanate who are also heads of Islam in their respective starts and the special position of Islam as the religion on the Federation of Malayisa but still ruled that the Federal Constitution was secular law.<\/p>\n Some legal jurists have pointed out the impracticality and fallacy of Malaysia being an Islamic state when there is a casino operating in Genting and there are also interest-bearing loans in our financial system, which were approved earlier and contrary to Islamic precepts.<\/p>\n Further, there is historical justification why the Supreme Court ruled that Malaysia is not an Islamic state but a secular state. Our founding Prime Minister Tunku Abdul Rahman was first recorded telling Parliament on May 1, 1958: \u201cI would like to make it clear that this country is not an Islamic state as it is generally understood; we merely provided that Islam shall be the official religion of the state.\u201d<\/p>\n Tun Hussein Onn, Malaysia\u2019s third PM and father of current Defence Minister Datuk Hishamudin Tun Hussein Onn supported Tunku by rejecting the notion that Malaysia is an Islamic state, adding that \u201cThe nation can still be functional as a secular state with Islam as the official religion\u201d.<\/p>\n Neither did Tun Abdul Razak pushed for the implementation of hudud laws. However former Prime Minister Tun Dr Mahathir Mohamad at the Gerakan National Conference on 29.9.2001 declared Malaysia as an Islamic state. For this reason, the newly-elected MP for Teluk Intan Datuk Mah Siew Keong has deceived his voters that he will oppose hudud when Gerakan did not dare to object to Mahathir declaring Malaysia as an Islamic state.<\/p>\n Najib Tun Razak went one step further when he became the first Prime Minister in April 2014 to state that the BN government did not object to the implementation of hudud laws on Muslims in Malaysia. All previous former Prime Ministers had objected to the implementation of hudud laws, including Tun Dr Mahathir Mohamad, who said one country can not have two different legal systems and Muslims in Malaysia are not ready for hudud.<\/p>\n Will Mah Siew Keong resign as MP or state that he will reject all Ministerial posts until Najib declares that Malaysia is not an Islamic state and will not implement hudud laws in Malaysia? Why is MCA Deputy President Datuk Wee Ka Siong not reviewing MCA\u2019s position in BN as promised following this development?<\/p>\n Worse is the sense of betrayal felt by Sabahans and Sarawakians who clearly did not bargain for joining a Federation of Malaysia that is an Islamic state! The time has come for all Malaysians to pressure BN to return to the right path and respect the fundamental institutions of Merdeka and the Federal Constitution of Malaysia that is not an Islamic state. Otherwise Malaysia will be a very different country compared to what we were born up with that betrays the legacy left behind by our first 3 Prime Ministers Tunku Abdul Rahman, Tun Abdul Razak and Tun
