The DAP Central Executive Committee(CEC) at its meeting last night made the following decisions:-<\/p>\n
A. Instruct all DAP Wanita And DAP Socialist Youth(DAPSY) State Committees To Lodge Police Reports Against Inspector General Of Police(IGP).<\/p>\n
The DAP CEC instructs all DAP Wanita and DAPSY state committees to lodge police reports against the IGP for being in contempt of the Federal Constitution and gross failure to perform his statutory role by refusing to enforce and comply with civil court orders on child custody cases. A template of the report will be provided by DAP National Legal Bureau chief and Puchong MP Gobind Singh Deo and DAP National Vice-Chair and Ipoh Barat MP M. Kulasegaran. Kula is also the lawyer for M Indira Gandhi and had successfully obtained an Ipoh High Court order granting custody of her daughter following a legal tussle with her Muslim convert ex-husband.<\/p>\n
<\/p>\n
The refusal of the IGP to comply with civil court orders is clearly a breach of statutory duty that has exposed Khalid Abu Bakar as completely unfit for such a high an important position because he has forgotten one of the police duties under Section 20 of the Police Act 1967 is to execute any orders of summons, subpoenas, warrants, etc, legally issued by the courts. Prime Minister Datuk Seri Najib Tun Razak\u2019s suggestion of referring such child custody cases to the Federal Court fails to address, correct and punish such open contempt of courts and defiance of the IGP\u2019s statutory duty.<\/p>\n
Gobind Singh Deo will kick off the filing of the nation-wide series of police reports by DAP tomorrow in Kuala Lumpur.<\/p>\n
B. A Special Committee Comprising Of Professor P Ramasamy, Gobind Singh Deo, M. Kulasegaran and Senator Ariffin S.M. Omar On Police Custodial Deaths.
\nThe DAP CEC is gravely concerned about the failure of the Home Affairs Minister Ahmad Zahid Hamidi, the police and the IGP to prevent police custodial deaths. The latest police custodial death in Penang, seventh this year, brings the number of police custodial deaths nationally for the first 6 months of 2014 to ten nationwide.<\/p>\n
By blaming the police custodial deaths on the health of the victim is not only an abdication of responsibility but also indicates that custodial deaths will only persist, continuing this inhuman cruelty and sorrow to many helpless families. A Special Committee comprising of Penang Deputy Chief Minister 2 Professor P Ramasamy, Gobind Singh Deo, M. Kulasegaran and Senator Ariffin S.M. Omar on Police Custodial Deaths will help to collect information, assist the victim\u2019s family and include filing civil suits against the police.<\/p>\n
C. UMNO and BN Should Stop Playing Political Games With Hudud To Win Muslim Support But Instead Respect The Sanctity Of The Secular Nature Of The Federal Constitution.
\nDAP fully endorses Selangor state assembly speaker Hannah Yeoh for allowing a motion by UMNO Sungai Air Tawar assemblyperson Kamarol Zaki Abdul Malik on hudud to study whether it is ready to be implemented in Selangor. Hannah has demonstrated that despite her publicly stated opposition to hudud, she is performing her constitutional role as an impartial, neutral and democratic Speaker for all including the Opposition, by allowing freedom of expression at the highest legislative body in Selangor.<\/p>\n
UMNO surprisingly withdrew the motion yesterday without any reason given and Hannah is correct to view the filing and withdrawal of UMNO\u2019s hudud motion as a blatant political stunt. UMNO and BN should stop playing political games with hudud to win Muslim support but instead respect the sanctity of the secular nature of the Federal Constitution.<\/p>\n
By filing the hudud motion, UMNO has shown that they are the real instigators of implementing hudud laws in Malaysia. Further UMNO has also exposed MCA\u2019s double-faced politics of \u201copposing hudud outside but keeping quiet inside\u201d when UMNO disclosed that MCA President Liow Tiong Lai did not object when informed about this impending hudud motion.<\/p>\n
DAP is consistent in our principle of opposing the implementation of hudud laws in Malaysia because it is unconstitutional. Whilst we respect Islam and the position of hudud in Islam, implementation of hudud laws is against the Federal Constitution and not suitable in a plural society like Malaysia.<\/p>\n
