{"id":3770,"date":"2013-12-18T17:57:42","date_gmt":"2013-12-18T09:57:42","guid":{"rendered":"http:\/\/limguaneng.com\/?p=3770"},"modified":"2013-12-18T17:57:42","modified_gmt":"2013-12-18T09:57:42","slug":"penangs-new-housing-rules-effective-1-february-2014enbmcn","status":"publish","type":"post","link":"https:\/\/limguaneng.com\/index.php\/2013\/12\/18\/penangs-new-housing-rules-effective-1-february-2014enbmcn\/","title":{"rendered":"Penang\u2019s New Housing Rules Effective 1 February 2014(en\/bm\/cn)"},"content":{"rendered":"<p>Press Statement by Penang Chief Minister Lim Guan Eng in Komtar, George Town on 18.12.2013<\/p>\n<p>Penang\u2019s Housing Rules From 1 February 2014 Designed To Protect Penang From Being Adversely Affected By A Property Bubble As Well As Ensuring That Public Housing And Affordable Housing Are Bought By Genuine Purchasers Who Are Qualified First Time Buyers From Lower and Middle-Income Groups.<\/p>\n<p>The new housing rules announced in the 2014 Penang state Budget approved at the Penang State Assembly and proposed to be effective from 1 February 2014 are designed to protect Penang from being adversely affected by a property bubble as well as ensuring that public housing and affordable housing are bought by genuine purchasers who are qualified first time buyers from lower and middle-income groups.<\/p>\n<p><!--more--> Public housing are low-cost houses up to RM42,000 and low-medium cost houses from RM72,500 to RM400,000 on the island and from RM72,500 to RM250,000 on the Seberang.<\/p>\n<p>As a responsible government seeking sustainable economic growth and development, the Penang state government is careful to avoid the pitfalls of any property bubble that will bring hardship to the rakyat and damage the economy. Japan is a good lesson of the dangers of a property bubble. These housing rules were discussed with stakeholders especially those from the property industry who had objected to them.<\/p>\n<p>The state government has set up a RM500 million Public Housing And Affordable Housing Fund to build 20,000 units of public housing and affordable housing in all 5 districts of Penang. This is the largest amount set aside by any state government in Malaysian history to build affordable and public housing. Naturally, these new rules are necessary as the state government is concerned that first-time buyers may not be given the first opportunity to buy them and reduce exploitation for speculative gain.<\/p>\n<p>104 Units of Shared Ownership Scheme (SOS) &#038; 51 Units of Rent-Buy Scheme<\/p>\n<p>Further the State Government would also implement Malaysia\u2019s first ever Shared Ownership Scheme(SOS), a historic joint purchase initiative between the state government and poor purchasers, for those who just miss out on getting a 90% or 100% bank loan, by offering a 30% interest-free loan from the state government whilst they need to borrow the remaining 70% from banks instead of a 90% or 100% bank loan. 104 units of low-cost houses in Taman Sungai Duri, Seberang Perai Selatan will be the pilot scheme for SOS. The State Government would also implement a \u201crent-buy scheme\u201d of 51 units in Taman Seruling Emas Flats, Seberang Perai Selatan for the poor who are unqualified to obtain any bank loans or where banks refuse to lend any amount of loans to them.<\/p>\n<p>As a people-centric government, the Penang state government wants to achieve housing democracy that allows every working family to own their own homes. Ensuring that public housing (low cost and low medium cost houses) is owned by the poor and genuine first time buyers is our priority. The state government is committed to assisting first-time buyers to have the opportunity to buy affordable homes and is willing to accept any criticism or face any legal challenges by those who oppose this commitment, whether from NGOs or BN.<\/p>\n<p>The Penang state EXCO had during its last meeting refined the new housing rules for clarity and certainty as follows:<\/p>\n<p>1.\tPublic Housing \u2013 Low Cost And Low Medium Cost Housing<\/p>\n<p>All low cost homes (up to RM42,000) and low-medium cost homes(up to RM72,500) purchased cannot be sold for 10 years from the date of Sale and Purchase Agreement. Those who wish to sell during the first 10 years must appeal to the state government and can only be sold to \u201clisted buyers\u201d. The price transacted will not be set by the state government but will be on a \u201cwilling buyer, willing seller\u201d basis by both the \u201clisted buyer\u201d and the seller. Listed buyers are those who have registered with the Housing Department of the state government and are certified as low income groups that are qualified to purchase low-cost or low-medium cost housing. This 10 year rule will cover all past and future purchases. The balloting of houses will be subject to oversight by an auditing firm, the first time this is done by any state government in Malaysia.<\/p>\n<p>2.\tAffordable Housing<\/p>\n<p>Affordable housing is classified as houses which were initially purchased below RM400,000 on the island and RM 250,000 on the mainland. Affordable housing purchased can not be sold for for a period of 5 years from date of Sales and Purchase Agreement. Those who wish to sell during the first 5 years must appeal to the state government and can only be sold to \u201clisted buyers\u201d. The price transacted will not be set by the state government but will be on a \u201cwilling buyer, willing seller\u201d basis by both the \u201clisted buyer\u201d and the seller. \u201cListed buyers\u201d are those who have registered with the Housing Department of the state government and are certified as middle-income groups that are qualified to purchase affordable housing. This 5 year rule will only cover all properties transacted on or after 1 February 2014. In other words it will not be retrospective but affect only Sales and Purchase Agreement signed on or after 1 February 2014.<\/p>\n<p>3.\tPurchases By Non-Citizens<\/p>\n<p>Non-citizens can only purchase properties in Penang in excess of RM1 million and for landed property on the island must exceed RM2 million. All purchases of properties by non-residents will be subject to a 3% levy on the transacted price for Sales and Purchase Agreement signed on or after 1 February 2014. Exemptions are provided for purchases for industry purposes or for a purpose that promotes employment, education, human talent or promoting Penang as an international and intelligent city.<\/p>\n<p>4.\t2% Levy On Property Purchased After 1.2.2014 Sold Within 3 Years<\/p>\n<p>A 2% levy will be imposed on the seller for all property sold within 3 years from the date of the Sales &#038; Purchase Agreement(SPA) signed from 1 February 2014. In other words, this is not retrospective. Properties bought with the SPA signed before 1 February 2014 will not be subject to this levy. Only properties bought with the SPA on or after 1 February 2014 will be subject to the 2% levy if sold within 3 years. This 2% levy is not applicable to affordable housing.<\/p>\n<p>Active discussions are continuing with the Bar Council, banks, property developers both in and outside Penang as well as other associations to brief them on the new housing rules which are in force for SPA signed on or after 1 February 2014 , except for low-cost or low-medium cost housing.<\/p>\n<p>Kenyataan Akhbar oleh Ketua Menteri Pulau Pinang Lim Guan Eng di Komtar, George Town pada 18. 12.2013<br \/>\nPeraturan Perumahan Baru Pulau Pinang Berkuatkuasa Pada 1 Februari 2014<\/p>\n<p>Peraturan Perumahan Baru Pulau Pinang bermula 1 Februari 2014 dirancang untuk melindungi Pulau Pinang daripada terjejas akibat gelembung hartanah dan memastikan perumahan awam dan perumahan mampu milik yang dibeli oleh pembeli tulen kali pertama yang layak daripada kumpulan berpendapatan rendah dan sederhana.<\/p>\n<p>Peraturan perumahan baru yang diumumkan dalam Pembentangan Bajet 2014 Negeri Pulau Pinang di Dewan Undangan Negeri dan cadangan berkuatkuasa bermula 1 Februari 2014 dirancang untuk melindungi Pulau Pinang daripada terjejas akibat gelembung hartanah dan memastikan perumahan awam dan perumahan mampu milik yang dibeli oleh pembeli tulen kali pertama yang layak daripada kumpulan berpendapatan rendah dan sederhana.<\/p>\n<p>Perumahan awam adalah rumah kos rendah yang berharga sehingga RM42, 000 dan rumah kos sederhana rendah yang berharga dari RM72, 500 hingga RM400, 000 di kawasan Pulau dan berharga dari RM72, 500 hingga RM250, 000 di kawasan Seberang.<\/p>\n<p>Sebagai sebuah kerajaan yang bertanggungjawab bagi memastikan pertumbuhan ekonomi yang mapan dan kekal membangun, Kerajaan Negeri Pulau Pinang sentiasa berhati-hati bagi mengelakkan daripada terperangkap dalam mana-mana gelembung hartanah yang kelak akan menjejaskan dan merosakkan ekonomi. Jepun adalah satu contoh terbaik mengenai bahayanya gelembung hartanah. Peraturan-peraturan perumahan ini telah dibincangkan bersama-sama dengan pemegang-pemegang amanah terutamanya dari industri hartanah yang membantah cadangan ini.<\/p>\n<p>Kerajaan Negeri telah menubuhkan Dana Perumahan Awam dan Mampu Milik berjumlah RM500 juta untuk membina 20,000 unit perumahan awam dan perumahan mampu milik meliputi kesemua 5 daerah di Pulau Pinang. Ini adalah peruntukan terbesar yang ditubuhkan oleh mana-mana Kerajaan Negeri dalam sejarah Malaysia untuk membina perumahan awam yang mampu milik. Secara dasarnya, peraturan baru ini dilihat perlu memandangkan Kerajaan Negeri amat prihatin sekiranya pembelian rumah pertama tidak diberi peluang untuk membeli rumah dan bagi mengurangkan eksploitasi meraut keuntungan.<\/p>\n<p>104 unit di bawah Skim Milikan Bersama atau \u201cShared Ownership Scheme\u201d (SOS) dan 51 unit di bawah Skim Sewa dan Beli atau \u201cRent-Buy Scheme\u201d<\/p>\n<p>Lanjutan daripada itu, Kerajaan Negeri juga akan melaksanakan Skim Milikan Bersama atau \u201cShared Ownership Scheme\u201d (SOS) yang julung kali dilaksanakan di Malaysia \u2013 inisiatif bersejarah pembelian bersama antara Kerajaan Negeri dan Pembeli Kurang Berkemampuan yang telah terlepas daripada mendapatkan 90% atau 100% pinjaman bank dengan menawarkan 30% pinjaman tanpa faedah daripada Kerajaan Negeri manakala baki pinjaman 70% adalah daripada pihak bank berbanding 90% atau 100% pinjaman bank. 104 unit rumah kos rendah di Taman Sungai Duri, Seberang Perai Selatan akan menjadi skim perintis untuk SOS. Kerajaan Negeri juga akan melaksanakan Skim Sewa dan Beli atau \u201cRent-Buy Scheme\u201d di 51 unit di Flat Taman Seruling Emas, Seberang Perai Selatan untuk golongan yang tidak berkemampuan yang tidak layak untuk memperolehi mana-mana pinjaman bank atau bank yang enggan memberi sebarang pinjaman kepada mereka.<\/p>\n<p>Sebagai sebuah kerajaan yang berjiwa rakyat, Kerajaan Negeri Pulau Pinang mahu mencapai demokrasi perumahan yang membenarkan setiap keluarga yang bekerja memiliki rumah sendiri. Keutamaan adalah bagi memastikan perumahan awam (kos rendah dan kos sederhana rendah) dimiliki oleh mereka yang tidak berkemampuan dan pembeli tulen kali pertama. Kerajaan Negeri komited untuk membantu pembeli kali pertama agar berpeluang untuk membeli rumah mampu milik dan bersedia untuk menerima sebarang kritikan atau berdepan cabaran undang-undang daripada mereka yang menentang komitmen ini.<\/p>\n<p>EXCO Kerajaan Negeri Pulau Pinang pada mesyuarat semalam telah memperhalusi peraturan perumahan baru ini demi jelas dan pasti seperti di bawah :<\/p>\n<p>A.\tPerumahan Awam \u2013 Kos Rendah dan Kos Sederhana Rendah<\/p>\n<p>Semua rumah kos rendah (sehingga RM42,000) dan rumah kos sederhana rendah (sehingga RM72,500) yang dibeli tidak boleh dijual dalam tempoh 10 tahun dari tarikh Perjanjian Jual dan Beli. Mereka yang ingin menjualnya dalam tempoh 10 tahun pertama perlu membuat rayuan kepada Kerajaan Negeri dan hanya boleh dijual kepada pembeli tersenarai atau \u201clisted buyers\u201d. Harga niaga tidak akan ditetapkan oleh Kerajaan Negeri tetapi akan diberikan kepada pembeli berkemampuan, kesediaan pembeli atau \u201cwilling buyer, willing seller\u201d oleh kedua-dua pembeli tersenarai dan penjual. Pembeli yang disenaraikan adalah mereka yang telah berdaftar dengan Bahagian Perumahan Kerajaan Negeri dan disahkan sebagai golongan berpendapatan rendah yang layak untuk membeli rumah kos rendah dan rumah kos sederhana rendah. Peraturan 10 tahun ini akan meliputi semua belian yang lepas dan akan datang. Cabutan rumah akan tertakluk kepada pegawasan oleh sebuah firma audit \u2013 pertama kali dilaksanakan oleh mana-mana Kerajaan Negeri di Malaysia.<\/p>\n<p>B.\tPerumahan Mampu Milik<\/p>\n<p>Perumahan Mampu Milik diklasifikasikan sebagai rumah yang pada mulanya dibeli dengan harga di bawah RM400,000 di dalam Pulau dan RM250,000 di Seberang Perai. Perumahan mampu milik yang dibeli tidak boleh dijual dalam tempoh 5 tahun dari tarikh Perjanjian Jual dan Beli. Mereka yang ingin menjual dalam tempoh 5 tahun pertama perlu membuat rayuan kepada Kerajaan Negeri dan hanya akan dijual kepada \u201cpembeli tersenarai\u201d. Harga rumah tidak akan ditetapkan oleh Kerajaan Negeri tetapi akan diberikan kepada \u201cwilling buyer, willing seller\u201d oleh kedua-dua pembeli tersenerai dan penjual. Pembeli yang tersenarai adalah mereka yang telah berdaftar dengan Bahagian Perumahan Kerajaan Negeri dan disahkan sebagai kumpulan berpendapatan pertengahan yang berkelayakan untuk membeli perumahan mampu milik. Peraturan 5 tahun ini meliputi rumah yang diniagakan pada atau selepas 1 Februari 2014. Dengan erti kata lain, ia tidak akan dibelakangkirakan(retrospektif) tetapi akan hanya ke atas Perjanjian Jual dan Beli yang ditandatangani pada atau selepas 1 Februari 2014.<\/p>\n<p>C.\tPembelian oleh Bukan Warganegara<\/p>\n<p>Bukan warganegara hanya boleh membeli hartanah di Pulau Pinang yang melebihi RM1juta dan bagi tanah dan bangunan di Pulau mesti melebihi RM2 juta. Semua pembelian hartanah oleh bukan pemastautin akan dikenakan fi kebenaran 3% atas harga transaksi untuk Perjanjian Jual dan Beli yang telah ditandatangai pada atau selepas 1 Februari 2014. Pengecualian diberikan kepada pembelian bagi tujuan industri atau tujuan untuk menggalakkan peluang pekerjaan, pendidikan, bakat manusia atau mempromosikan Pulau Pinang sebagai bandaraya bertaraf antarabangsa dan pintar.<\/p>\n<p>D.\tFi kebenaran 2% untuk Hartanah yang dibeli selepas 1.2.2014 dijual dalam tempoh 3 tahun pertama<\/p>\n<p>Fi kebenaran 2% akan dikenakan ke atas penjual untuk semua hartanah yang dijual dalam tempoh 3 tahun dari tarikh Perjanjian Jual dan Beli (SPA) yang ditandatangani pada 1 Februari 2014. Dalam erti kata lain, ini tidak retrospektif. Hartanah yang dibeli di mana SPA ditandatagani sebelum 1 Februari 2014 tidak akan dikenakan fi kebenaran ini. Hanya hartanah yang dibeli dengan SPA pada atau selepas 1 Februari 2014 akan dikenakan fi kebenaran 2% jika dijual dalam tempoh 3 tahun. Fi kebenaran 2% ini tidak terpakai untuk perumahan mampu milik.<\/p>\n<p>Perbincangan yang berterusan dengan Majlis Peguam, bank-bank, pemaju hartanah di dalam dan di luar Pulau Pinang bersama-sama dengan persatuan-persatuan lain akan terus diadakan bagi memberi penerangan berhubung dengan peraturan perumahan baru yang berkuatkuasa sebaik SPA ditandatangani pada atau selepas 1 Februari 2014, kecuali untuk perumahan kos rendah dan kos sederhana rendah.<\/p>\n<p>LIM GUAN ENG<\/p>\n<p>\u69df\u5dde\u9996\u5e2d\u90e8\u957f\u6797\u51a0\u82f1\u4e8e2013\u5e7412\u670818\u65e5\u5728\u69df\u57ce\u4e54\u6cbb\u5e02\u5149\u5927\u53d1\u8868\u7684\u58f0\u660e\uff1a<\/p>\n<p>2014\u5e742\u67081\u65e5\u8d77\u7684\u69df\u5dde\u623f\u5c4b\u65b0\u653f\u7b56<\/p>\n<p>2014\u5e742\u67081\u65e5\u8d77\u69df\u5dde\u623f\u5c4b\u7684\u65b0\u6761\u4f8b\uff0c\u662f\u4e3a\u4e86\u4fdd\u62a4\u69df\u57ce\u514d\u4e8e\u623f\u5730\u4ea7\u6ce1\u6cab\u7684\u8d1f\u9762\u5f71\u54cd\uff0c\u540c\u65f6\u786e\u4fdd\u516c\u5171\u623f\u5c4b\u53ca\u53ef\u8d1f\u62c5\u623f\u5c4b\u7684\u8d2d\u5c4b\u8005\uff0c\u662f\u771f\u6b63\u6765\u81ea\u4f4e\u6536\u5165\u53ca\u4e2d\u7b49\u6536\u5165\u7684\u7b2c\u4e00\u6b21\u8d2d\u5c4b\u8005\u3002<\/p>\n<p>\u69df\u57ce\u7acb\u6cd5\u8bae\u4f1a\u57282014\u5e74\u9884\u7b97\u6848\u63d0\u5448\u5efa\u8bae\u3001 2014\u5e742\u67081\u65e5\u5f00\u59cb\u63a8\u884c\u7684\u623f\u5c4b\u65b0\u6761\u4f8b\uff0c\u662f\u4e3a\u4e86\u4fdd\u62a4\u69df\u57ce\u514d\u4e8e\u623f\u5730\u4ea7\u6ce1\u6cab\u7684\u8d1f\u9762\u5f71\u54cd\uff0c\u540c\u65f6\u786e\u4fdd\u516c\u5171\u623f\u5c4b\u53ca\u53ef\u8d1f\u62c5\u623f\u5c4b\u7684\u8d2d\u5c4b\u8005\uff0c\u662f\u771f\u6b63\u6765\u81ea\u4f4e\u6536\u5165\u53ca\u4e2d\u7b49\u6536\u5165\u7684\u7b2c\u4e00\u6b21\u8d2d\u5c4b\u8005\u3002<\/p>\n<p>\u516c\u5171\u623f\u5c4b\u662f\u4ef7\u683c\u5b9a\u4e8e4\u4e072000\u4ee4\u5409\u4ee5\u4e0b\u7684\u5ec9\u4ef7\u5c4b\uff0c7\u4e072\u5343500\u4ee4\u5409\u81f340\u4e07\u4ee4\u5409\uff08\u69df\u5c9b\uff09\u53ca7\u4e072\u5343500\u4ee4\u5409\u81f325\u4e07\u4ee4\u5409\uff08\u5a01\u7701\uff09\u7684\u623f\u5c4b\u3002<\/p>\n<p>\u505a\u4e3a\u4e00\u4e2a\u8d1f\u8d23\u4efb\u7684\u653f\u5e9c\uff0c\u6211\u4eec\u8981\u8ffd\u6c42\u53ef\u6301\u7eed\u7684\u7ecf\u6d4e\u6210\u957f\u53ca\u53d1\u5c55\uff0c\u69df\u5dde\u653f\u5e9c\u6b63\u5c0f\u5fc3\u7684\u907f\u514d\u91cd\u8e48\u623f\u5730\u4ea7\u6ce1\u6cab\uff0c\u56e0\u4e3a\u8fd9\u5c06\u8ba9\u4eba\u6c11\u9677\u5165\u56f0\u5883\uff0c\u5e76\u7834\u574f\u7ecf\u6d4e\u3002\u65e5\u672c\u5c31\u662f\u623f\u5730\u4ea7\u6ce1\u6cab\u5371\u673a\u7684\u6700\u597d\u6559\u8bad\u3002\u6211\u4eec\u4e0e\u53d7\u5f71\u54cd\u7684\u4eba\u58eb\u8ba8\u8bba\u8fc7\u8fd9\u4e9b\u623f\u5730\u4ea7\u6761\u4f8b\uff0c\u7279\u522b\u662f\u90a3\u4e9b\u53cd\u5bf9\u8fd9\u4e9b\u6761\u4f8b\u7684\u623f\u5730\u4ea7\u754c\u3002<\/p>\n<p>\u5dde\u653f\u5e9c\u8bbe\u7acb\u4e865\u4ebf\u4ee4\u5409\u7684\u516c\u5171\u623f\u5c4b\u53ca\u53ef\u8d1f\u62c5\u623f\u5c4b\u57fa\u91d1\uff0c\u4ee5\u5728\u5168\u69df\u4e94\u4e2a\u53bf\u5174\u5efa2\u4e07\u4e2a\u516c\u5171\u623f\u5c4b\u53ca\u53ef\u8d1f\u62c5\u623f\u5c4b\u3002\u8fd9\u662f\u9a6c\u6765\u897f\u4e9a\u53f2\u4e0a\u627f\u62c5\u6700\u591a\u53ef\u8d1f\u62c5\u53ca\u516c\u5171\u623f\u5c4b\u6570\u91cf\u7684\u5dde\u653f\u5e9c\u3002\u8fd9\u4e9b\u65b0\u6761\u4f8b\u662f\u5fc5\u987b\u7684\uff0c\u5dde\u653f\u5e9c\u62c5\u5fc3\u7b2c\u4e00\u6b21\u8d2d\u5c4b\u8005\u6ca1\u6709\u673a\u4f1a\u8d2d\u4e70\uff0c\u6211\u4eec\u4e5f\u8981\u51cf\u5c11\u6295\u673a\u8c0b\u5229\u8005\u7684\u5265\u524a\u3002<\/p>\n<p>104 \u5355\u4f4d\u7684\u201c\u5171\u4eab\u62e5\u6709\u6743\u8ba1\u5212\uff08SOS\uff09\u53ca 51\u5355\u4f4d\u7684\u201c\u79df\u8d2d\u8ba1\u5212\u201d<\/p>\n<p>\u63a5\u4e0b\u6765\uff0c\u5dde\u653f\u5e9c\u4e5f\u4f1a\u63a8\u884c\u9a6c\u6765\u897f\u4e9a\u7b2c\u4e00\u9879\u201c\u5171\u4eab\u62e5\u6709\u6743\u8ba1\u5212\uff08SOS\uff09\u201d\uff0c\u8fd9\u662f\u53f2\u4e0a\u7b2c\u4e00\u4e2a\u7531\u5dde\u653f\u5e9c\u548c\u8d2b\u7a77\u8005\u4e00\u8d77\u8d2d\u5c4b\u7684\u8ba1\u5212\uff0c\u9488\u5bf9\u90a3\u4e9b\u65e0\u6cd5\u8d37\u6b3e90%\u6216100%\u7684\u8d2d\u5c4b\u8005\uff0c\u5dde\u653f\u5e9c\u5c06\u63d0\u4f9b30%\u514d\u606f\u8d37\u6b3e\uff0c\u5269\u4e0b\u768470%\u4ed6\u4eec\u5219\u5fc5\u987b\u5411\u94f6\u884c\u8d37\u6b3e\u3002\u5a01\u5357Taman Sungai Duri\u7684 104\u5355\u4f4d\u7684\u5ec9\u4ef7\u5c4b\uff0c\u5c06\u4f1a\u662f\u201c\u5171\u4eab\u62e5\u6709\u6743\u8ba1\u5212\uff08SOS\uff09\u201d\u7684\u5148\u9a71\u8ba1\u5212 \u3002\u5dde\u653f\u5e9c\u4e5f\u5c06\u5728\u5a01\u5357Taman Seruling Emas\u7ec4\u5c4b
