Press Statement By DAP Secretary-General And MP For Bagan Lim Guan Eng In Kuala Lumpur On 26.9.2013.<\/p>\n
DAP shall abide and comply with the decision of the Kuala Lumpur High Court tomorrow on whether DAP can hold re-elections on Sunday 29 September 2013 through a National Special Congress, which is expressly provided for in the DAP Party Constitution. Should the High Court allow the injunction, then the National Special Congress can not proceed on Sunday to conduct re-elections.<\/p>\n
DAP is shocked that the ROS director-general Datuk Abdul Rahman Othman continues to insist that the DAP has not complied with the directive to hold a National Congress. To date, he has only communicated through the press without any letter in writing. He has also behaved most unprofessionally and irresponsibly by refusing to give reasons for his decision on the holding of re-elections in writing, causing the DAP not to know what wrongdoing has the party committed.<\/p>\n
Datuk Abdul Rahman should have read the DAP Party Constitution carefully that there is a specific clause that allows party elections of the Central Executive Committee(CEC) to be held through a Special Congress and not only through a National Congress. Under a Special Congress, a seven-day notice to delegates is sufficient but a minimum 10-week notice is required for a National Congress. DAP had given 3 weeks notice, which is more than the one week required for the Special Congress.<\/p>\n
Clearly by denying that there is such a specific clause to hold party CEC elections in a Special Congress, the ROS is resorting to lies to help UMNO victimise the DAP for our historic victories in the recent general elections. How can ROS talk about upholding justice for all party members when the ROS does not respect the DAP party constitution which ROS had earlier approved?<\/p>\n
DAP calls on party members to remain calm and accept any decision made by the High Court 11 am tomorrow in Jalan Duta. CEC members will also be present to allow a quick decision to be made following the outcome of the judgment made.<\/p>\n

DAP akan mematuhi keputusan Mahkamah Tinggi Kuala Lumpur esok sama ada ia boleh mengadakan pemilihan semula pada hari Ahad 29 September 2013 melalui sebuah Kongres Khas Kebangsaan sepertimana yang termaktub di dalam Perlembagaan Parti DAP. Seandainya mahkamah membenarkan perintah injunksi, maka Kongres Khas tidak boleh diteruskan pada hari Ahad untuk mengadakan pemilihan semula.<\/p>\n
DAP terkejut dengan tindakan Ketua Pengarah ROS, Datuk Abdul Rahman Othman yang terus mendesak bahawa DAP tidak mematuhi arahan bagi mengadakan Kongres Kebangsaan. Sehingga hari ini, beliau hanya berkomunikasi melalui media massa tanpa menulis sebarang surat rasmi. Beliau juga berkelakuan secara tidak profesional dan tidak bertanggungjawab apabila enggan memberikan sebab bertulis kepada keputusannya supaya diadakan pemilihan semula, yang menyebabkan DAP sendiri tidak tahu apa sebenarnya kesilapan yang telah dilakukan parti.<\/p>\n
Datuk Abdul Rahman sepatutnya membaca Perlembagaan Parti DAP dengan cermat dan menyedari bahawa terdapat klausa khusus yang membenarkan pemilihan parti untuk melantik Jawatankuasa Eksekutif Pusat (CEC) diadakan melalui Kongres Khas dan bukan sahaja melalui Kongres Kebangsaan. Dalam hal Kongres Khas, notis tujuh hari kepada perwakilan adalah mencukupi, manakala notis minima 10 minggu adalah diperlukan bagi Kongres Kebangsaan. DAP telah memberikan notis tiga minggu, lebih daripada satu minggu yang dikehendaki bagi Kongres Khas.<\/p>\n
Jelas sekali dengan menafikan kewujudan klausa khusus dalam Perlembagaan untuk mengadakan pemilihan CEC parti dalam Kongres Khas, ROS kini harus berbohong dan menipu bagi membantu UMNO memangsakan DAP dikeranakan kejayaan bersejarahnya dalam pilihan raya umum yang lalu. Bagaimana mungkin ROS bercakap tentang bertindak adil terhadap semua ahli parti apabila ROS sendiri tidak menghormati Perlembagaan Parti DAP yang disahkan sendiri oleh pihak ROS?<\/p>\n
DAP menyeru semua ahli parti agar bertenang dan menerima apa sahaja keputusan mahkamah tinggi pada jam 11 pagi esok di Jalan Duta. Ahli-ahli CEC juga akan turut bersama supaya keputusan pantas boleh dibuat sejurus selepas mahkamah memberikan penghakiman. <\/p>\n
