Press Statement By DAP Secretary-General And MP For Bagan Lim Guan Eng In Kuala Lumpur On 13.8.2013.<\/p>\n
The emergency Central Working Committee(CWC) last night unanimously agreed to make a final effort to see the Registrar of Societies (ROS) Datuk Abdul Rahman Othman to press him for only 2 explanations of the reasons why and under what powers of the Societies Act is he directing the DAP to hold re-elections for its Central Executive Committee(CEC). The DAP is willing to hold party re-elections provided these two explantions are given in a manner that is reasonable, lawful and with factual basis.<\/p>\n
Without these two explanations by the ROS, the DAP leadership would be completely helpless in not being able to answer the queries of DAP delegates at a Party Congress on why the party leadership succumbed and surrendered meekly to such arbitrary and high-handed abuse of power by the ROS in directing re-elections.<\/p>\n
The DAP CWC reiterates that the CEC election in December 2012 last year was properly and cleanly conducted. When a computer glitch caused the wrong announcement of the successful candidates, DAP immediately rectified it and even got an accounting firm to verify the corrected results. There was no mistake either in vote counting or tabulation but only in posting the results, leading to one candidate Vincent Wu wrongly announced as a successful candidate when it should be Zairil Khir Johari.<\/p>\n
This mistake had been duly rectified by reinstating Zairil Khir Johari as the winning candidate. DAP had fully explained this honest mistake to the officials from the Registrar of Societies by furnishing all relevant materials. The mistake was admitted voluntarily by DAP without being exposed by ROS or BN in the interests of upholding transparency and accountability. DAP is now being punished for being honest and truthful.<\/p>\n
Directing re-elections solely on the basis that the ROS is dissatisfied, is unlawful because it violates the basic principle of \u201creasonableness in the exercise of powers, natural justice and due legal process\u201d. The two explanations of the reasons why and under what powers of the law in the Societies Act, are necessary in the interests of accountability and transparency.<\/p>\n
If DAP accepts the ROS rationale that no explanation needed to be given, then what is there to stop the ROS from directing that fresh elections be called again and again merely because the ROS is not satisfied. Contrast the quick action taken against the DAP on complaints filed this year with the non-action by ROS on complaints filed on the SUPP 2011 party elections 2 years ago.<\/p>\n
The DAP CWC is unhappy that the ROS has repeatedly behaved unprofessionally, unethically and even unlawfully by making media announcements that had no factual or legal basis. If the ROS believes that they have been defamed by the DAP, they can always sue the DAP in court for defamation.<\/p>\n
Instead of facts by the DAP that were verified by an accounting firm, ROS appears to believe the unsubstantiated lies of Utusan Malaysia(UM) and New Straits Times(NST) that 753 DAP delegates had been denied their right to attend the DAP Congress in Penang or that there were 547 \u201cphantom\u201d delegates attending the Congress.<\/p>\n
The ROS has to date not responded to our request for these two explanations nor on my request for a meeting. DAP National Organising Secretary Anthony Loke will be making arrangements for the appointment with the ROS.<\/p>\n

Mesyuarat tergempat Jawatankuasa Kerja Pusat (CWC) malam tadi sebulat suara bersetuju untuk melakukan usaha terakhir untuk bertemu dengan Pendaftar Pertubuhan (ROS) Datul Abdul Rahman Othman untuk menuntut supaya hanya dua penjelasan diberikan atas sebab kenapa dan di bawah kuasa apa daripada Akta Pertubuhan itu beliau mengarahkan DAP untuk melakukan pemilihan semula Jawatankuasa Eksekutif Pusat (CEC). DAP sedia mengadakan pemilihan semula dengan syarat dua penjelasan ini diberikan secara munasabah, menepati undang-undang dan dengan berasaskan fakta.<\/p>\n
Tanpa dua penjelasan ini daripada pihak ROS, pimpinan DAP tidak akan mampu untuk menjelaskan kepada perwakilan DAP di kongres parti kenapa pemimpin parti mengalah dan menyerah dengan begitu mudah kepada suatu salahguna kuasa yang digunakan sewenang-wenangnya oleh ROS untuk mengarahkan pemilihan semula.<\/p>\n
CWC DAP mengulangi pendirian bahawa pemilihan CEC pada Disember 2012 telah dijalankan secara teratur dan bersih. Apabila kesilapan komputer mengakibatkan pengumuman yang salah bagi calon yang berjaya, DAP bingkas membetulkannya malah turut meminta sebuah firma perakaunan untuk memeriksa keputusan yang dibetulkan itu. Tidak ada kesilapan sama ada dalam pengiraan undi atau penjumlahan tetapi hanya dalam pengumuman keputusan, yang mengakibatkan seorang calon, Vincent Wu diumumkan sebagai calon yang berjaya, sedangkan nama yang sepatutnya diumumkan ialah Zairil Khir Johari.<\/p>\n
Kesilapan ini telah dibetulkan dengan meletakkan Zairil Khir Johari sebagai calon yang menang. DAP telah pun memberi penjelasan penuh tentang kesilapan yang tidak disengajakan ini kepada pegawai-pegawai dari ROS dengan mengemukakan semua dokumen dan bahan yang diperlukan. Kesilapan tersebut diakui oleh DAP tanpa didedahkan oleh ROS mahupun BN dalam mengangkat peri penting ketelusan dan akauntabiliti. DAP kini dihukum kerana berlaku jujur dan berkata benar.<\/p>\n
Mengarahkan pemilihan semula hanya atas sebab ROS tidak berpuas hati, adalah salah di segi undang-undang kerana melanggari prinsip asas perlaksanaan kuasa secara munasabah, selain prinsip keadilan serta proses undang-undang yang sepatutnya. Dua penjelasan tentang sebab-sebab kenapa serta di bawah kuasa apa daripada Akta Pertubuhan adalah amat penting demi akauntabiliti dan ketelusan. <\/p>\n
Sekiranya DAP menerima rasional ROS bahawa ia tidak perlu memberi sebarang penjelasan, jadi apa yang boleh menghalang ROS daripada mengarahkan pemilihan semula berkali-kali hanya kerana ROS tidak berpuas hati. Bezakan tindakan pantas terhadap DAP berdasarkan aduan yang difailkan tahun ini berbanding sikap tidak mengambil tindakan ROS terhadap aduan yang difailkan terhadap pemilihan parti SUPP yang diadakan dua tahun lalu.<\/p>\n
CWC DAP sangat kecewa dengan sikap ROS yang berulang kali berkelakuan tidak profesional, tidak beretika malah tidak menepati undang-undang dengan membuat kenyataan media yang tidak mempunyai asas fakta mahupun undang-undang. Jika ROS percaya bahawa mereka telah difitnah oleh DAP, mereka pastinya boleh membawa DAP ke mahkamah dan memfailkan saman fitnah. <\/p>\n
Berbanding fakta yang diberikan DAP yang turut diperiksa oleh sebuah firma perakaunan, ROS nampaknya mempercayai penipuan Utusan Malaysia dan juga New Straits Times bahawa 753 perwakilan DAP telah dinafikan hak mereka untuk hadir ke kongres DAP di Pulau Pinang dan bahawa terdapat 547 perwakilan \u2018hantu\u2019 hadir ke kongres. <\/p>\n
Pihak ROS sehingga hari ini belum menjawab permintaan kami untuk dua penjelasan ini, mahupun permintaan saya untuk bertemu dan berbincang. Setiausaha Organisasi DAP, Anthony Loke akan mengaturkan janjitemu bersama pihak ROS.<\/p>\n
