DAP would be subjected permanently to arbitrary dictates and high-handed abuse of power by RoS if RoS fails to fulfill the two conditions of fully explaining the grounds why DAP should hold fresh elections and the relevant provision exercised under the Societies Act. During the emergency meeting, CEC members were shocked that the RoS could make such an important decision in such a high-handed and arbitrary manner merely on the basis that it is dissatisfied without giving any reasons.<\/p>\n
Issuing a short directive to hold fresh elections on a purely subjective basis that one is dissatisfied without giving any grounds of dissatisfaction, is unacceptable by any moral and ethical standards, undemocratic, a denial of natural justice and due legal process. If this is the basis of the decision-making process by the RoS, then opposition parties like the DAP would be permanently held to ransom by ridiculous and baseless complaints. In future there is nothing to stop the RoS from directing the holding of fresh elections at any time at the RoS\u2019whim and fancy without giving any reasons. <\/p>\n
The DAP is fully entitled to be informed why its corrective measures taken to rectify the error in announcing the results was not accepted by the RoS. All supporting documents was given to ther RoS to prove that the party elections in December last year was conducted properly, legally and democratically where all qualified delegates were fully informed without any dishonest practice of money politics.<\/p>\n
The only mistake was in the posting of the results by the Returning Officer that led to the wrong votes being announced for a few candidates which had an impact on only one successful candidate. The mistake led to one candidate, Vincent Wu, who was wrongly announced as a successful candidate, being replaced by the actual successful candidate, Zairil Khir Johari.<\/p>\n
When this error was discovered, this was admitted to and rectified by the party voluntarily without being exposed by any outside parties. The correct results were even verified an an independent auditing firm. The party is now punished for refusing to cover-up mistakes, and for being both honest and truthful. <\/p>\n
That was the reason that at an emergency meeting on 31.7.2013, the DAP CEC unanimously resolves to respond to the notice from the ROS dated 30 July 2013 as follows:-<\/p>\n
\u201cThat the DAP is unable to accept the directive of the ROS as contained in the letter aforesaid unless the following two conditions are fulfilled:-
\n(a) the Registrar provides reasons for which it is dissatisfied with the explanation provided by the DAP in respect of the conduct of the Central Executive Committee or CEC elections on 15 December 2012 pursuant to the section 16(1) notice under the Societies Act 1966 as stated in the letter aforesaid; and
\n(b) the Registrar explains under which provision of law the directive to hold fresh CEC elections is given as stated in the letter aforesaid.\u201d<\/p>\n

DAP akan kekal berhadapan dengan arahan secara sewenang-wenang serta salahguna kuasa oleh Pendaftar Pertubuhan (ROS) jika ROS terus gagal untuk mematuhi dua syarat untuk memberi penjelasan penuh tentang sebab-sebab kenapa DAP perlu melakukan pemilihan semula serta peruntukan undang-undang yang berkaitan, di bawah Akta Pertubuhan.<\/strong><\/p>\n DAP akan kekal berhadapan dengan arahan secara sewenang-wenang serta salahguna kuasa oleh Pendaftar Pertubuhan (ROS) jika ROS terus gagal untuk mematuhi dua syarat untuk memberi penjelasan penuh tentang sebab-sebab kenapa DAP perlu melakukan pemilihan semula serta peruntukan undang-undang yang berkaitan, di bawah Akta Pertubuhan. Dalam mesyuarat tergempar semalam, ahli CEC amat terkejut bagaimana pihak ROS boleh membuat keputusan yang sebegitu penting secara sewenang-wenangnya hanya atas alasan bahawa ia tidak puas hati tanpa memberi apa-apa sebab.<\/p>\n Tindakan memberikan arahan singkat supaya mengadakan pemilihan semula atas alasan yang begitu subjektif bahawa ia tidak berpuas hati tanpa memberi sebab-sebab kenapa ia tidak berpuas hati adalah tidak boleh diterima menurut mana-mana standard etika, tidak demokratik, serta merupakan satu penafian keadilan dan proses undang-undang yang sepatutnya. Jika inilah alasan dalam proses membuat keputusan oleh pihak ROS, maka parti pembangkang seperti DAP sampai bila-bila pun akan dijadikan tebusan lantaran aduan yang mengarut dan tidak berasas. Di masa hadapan, tidak akan ada apa-apa yang boleh menghalang ROS daripada mengarahkan supaya diadakan pemilihan semula pada bila-bila masa sesuka hati ROS tanpa memberikan sebab. <\/p>\n DAP berhak untuk dimaklumkan kenapa tindakannya untuk membetulkan kesilapan dalam pengumuman keputusan pemilihan tidak diterima oleh ROS. Semua dokumen sokongan telah pun diserahkan kepada ROS bagi membuktikan bahawa pemilihan parti Disember tahun lalu telah dilakukan dengan baik, menepati undang-undang serta secara demokratik di mana semua perwakilan yang layak telah dimaklumkan tanpa sebarang perlakuan tidak jujur serta politik wang. <\/p>\n Satu-satunya kesilapan adalah dalam hal penyiaran keputusan oleh ketua pegawai pemilihan yang mengakibatkan jumlah undi yang salah diumumkan untuk beberapa calon dan hanya memberi kesan kepada satu calon yang berjaya. Kesilapan ini mengakibatkan seorang calon, Vincent Wu, yang telah diumumkan sebagai calon yang berjaya secara silap digantikan dengan calon yang sepatutnya, Zairil Khir Johari. <\/p>\n Apabila kesilapan ini disedari, ia terus diperakui dan diperbetulkan oleh pihak parti secara sukarela tanpa didedahkan oleh mana-mana pihak luar. Keputusan yang betul turut diperiksa oleh sebuah firma audit bebas dan berkecuali. Pihak parti sekarang sedang dihukum kerana enggan menutup kesilapan, dan kerana berlaku jujur dan berkata benar. <\/p>\n Itulah sebabnya dalam mesyuarat tergempar pada 31 Julai 2013, CEC DAP telah secara sebulat suara membuat keputusan untuk menjawab notis daripada pihak ROS bertarikh 30 Julai 2013 seperti berikut:-<\/p>\n \u201cBahawa DAP tidak dapat menerima arahan pihak ROS seperti yang terkandung di dalam surat tersebut kecuali dua syarat berikut dipenuhi:-<\/p>\n a) Pihak Pendaftar memberikan sebab-sebab kenapa ia tidak berpuas hati dengan penjelasan yang telah diberikan oleh DAP tentang perjalanan pemilihan Jawatankuasa Eksekutif Pusat atau CEC pada 15 Disember 2013 menurut notis di bawah seksyen 16(1) Akta Pertubuhan 1966 seperti yang dinyatakan dalam surat tersebut; dan<\/p>\n (b) Pihak Pendaftar menjelaskan di bawah peruntukan undang-undang apa arahan supaya pemilihan semula CEC diadakan seperti yang dinyatakan dalam surat tersebut.\u201d<\/p>\n LIM GUAN
