Prominent lawyer Tommy Thomas will be the state government\u2019s counsel to file the action at the Federal court over the next 2 weeks.<\/p>\n<p>The Penang State Government urges BN to acquiesce to carry out local government elections in the Penang Island Municipal Council(MPPP) and Seberang Perai Municipal Council(MPSP) to avoid Penang following other PR states in suing the federal government to protect and promote democracy and the people\u2019s rights. Doing so would mean that Penang would be the 3rd state to sue the BN Federal government after Kelantan and Selangor.<\/p>\n<p><!--more-->Restoring the \u201cthird vote\u201d has long been a fundamental demand and commitment of the Penang State Government since its election in 2008. This aspiration of allowing Penangites the right not only to elect their MPs, State Assemblypersons and Chief Ministers should also be extended to local councilors and the Mayor. Local government election was banned by the Federal government on 1.3.1965 and the BN had failed to deliver its promise to restore local government elections.<\/p>\n<p>To realise this commitment the Penang PR state government passed the Local Government Elections(Penang Island and Province Wellesley) Enactment 2012 or LGE at the Penang state Assembly on 9.5.2012. Consent was granted by the Penang Governor on 15.6.2012 in accordance with Article 26 of the Penang state constitution.<\/p>\n<p>When the new PR state government took over and communicated this intention to restore the 3rd vote, the Election Commission in January last year rejected the state government\u2019s request on the grounds that there was no such law in force compelling such conduct of elections. When the LGE was approved by the Penang state Assembly, Minister of Housing and Local Government dismissed the Penang state government\u2019s effort as unconstitutional and refused to comply with the state government\u2019s request.<\/p>\n<p>The State Government takes the position that local government elections are a State matter under the Ninth Schedule of the Federal Constitution, and that the State Legislature has jurisdiction to provide for the holding of local elections under the Ninth Schedule and Article 113(4) of the Federal Constitution.<\/p>\n<p>The State Government has informed the Election Commission that the Enactment would come into force in Penang by 31 January 2013,  however State Government has failed to obtain any commitment from the Election Commission to conduct the elections to the MPPP and MPSP in accordance with the Enactment.<\/p>\n<p>In line with its commitment to restore the third vote, the State Government has now instructed its lawyers to apply to the Federal Court for leave to seek declarations that section 15 of the Local Government Act 1976 (federal law enacted by Parliament), which purported to abolish local government elections throughout Malaysia, is invalid or inoperative in Penang, and that the 2012 Enactment passed by the Penang State Legislature validly provides for the Election Commission to conduct local government elections in Penang.<\/p>\n<p>The Penang state government will together with former Aliran President Ramakrishnan be the two plaintiffs in this historic suit against the Federal government and the Election Commission at the Federal Court. Ramakrishnan has long cherished a dream to vote his own local councilors.<\/p>\n<p>BACKGROUND<\/p>\n<p>\u2022      On 14 July 2009, YB Chow Kon Yeow, the State EXCO for Local Government and Traffic Management, wrote to the Federal Government to ask for local government elections to be put on the agenda of the National Council of Local Government, but this request was rejected.<br \/>\n\u2022      On 11 August 2009, the State Legislative Assembly passed a resolution calling upon the Federal authorities to take action to reinstate local government elections, but this resolution was again rejected.<br \/>\n\u2022      On 4 March 2010, Penang State Government wrote to the Election Commission asking it to conduct local government elections to the MPPP and MPSP under the Local Government Elections Act 1960, but the Election Commission refused.<br \/>\n\u2022      On 18 January 2012, the State Government exempted both the MPPP and the MPSP from section 15 of the Local Government Act 1976, which had rendered inoperative all legal provisions relating to local government elections.<br \/>\n\u2022      On 9 May 2012, the State Legislative Assembly passed the Local Government Elections (Penang Island and Province Wellesley) Enactment 2012, providing for the Election Commission to hold local government elections.<br \/>\n\u2022      On 18 December 2012, the State Government wrote to the Election Commission informing it that the Enactment would be enforced as from 31 January 2013.<\/p>\n<p>Lim Guan Eng<\/p>\n<p>&#8212;&#8211;BM Version &#8212;&#8211;<\/p>\n<p>Kenyataan Media oleh Ketua Menteri Pulau Pinang Lim Guan Eng mengumumkan peguam Tommy Thomas sebagai peguam Kerajaan Negeri untuk menyaman SPR dan Kerajaan Persekutuan pada 26hb Feb 2013 di Kuala Lumpur.<\/p>\n<p><strong>Kerajaan Negeri Pulau Pinang mengajurkan BN supaya akur untuk melaksanakan pilihanraya kerajaan tempatan bagi Majlis Perbandaran Pulau Pinang (MPPP) dan Majlis Perbandaran Seberang Perai (MPSP) untuk mengelakkan Pulau Pinang daripada mengikuti jejak langkah negeri-negeri Pakatan Rakyat yang telah menyaman Kerajaan Persekutuan demi memelihara dan menggalakkan demokrasi dan hak asasi rakyat.<br \/>\n<\/strong><br \/>\nKerajaan Negeri Pulau Pinang tidak mempunyai pilihan selain membawa Kerajaan Pusat dan Suruhanjaya Pilihan Raya ke Mahkamah Persekutuan untuk mendesak pemulihan undi ketiga Dan pilihanraya kerajaan tempatan untuk Majlis Perbandaran Pulau Pinang (MPPP) dan Majlis Perbandaran Seberang Perai (MPSP). Peguam terkemuka Tommy Thomas akan menjadi peguam Kerajaan Negeri untuk memfailkan saman tersebut di Mahkamah Persekutuan dalam masa dua minggu lagi.<\/p>\n<p>Kerajaan Negeri Pulau Pinang mengajurkan BN supaya akur untuk melaksanakan pilihanraya kerajaan tempatan bagi Majlis Perbandaran Pulau Pinang (MPPP) dan Majlis Perbandaran Seberang Perai (MPSP) untuk mengelakkan Pulau Pinang daripada mengikuti jejak langkah negeri-negeri Pakatan Rakyat yang telah menyaman Kerajaan Persekutuan demi memelihara dan menggalakkan demokrasi dan hak asasi rakyat. Tindakan menyaman akan menjadikan Pulau Pinang negeri ketiga yang menyaman Kerajaan Persekutuan BN selepas Kelantan dan Selangor.<\/p>\n<p>Mengembalikan undi ketiga adalah tuntutan asas dan menjadi komitmen Kerajaan Negeri Pulau Pinang sejak pilihanraya 2008. Aspirasi untuk memberikan warga Pulau Pinang hak utnuk bukan sahaja memilih Ahli Parlimen, Ahli Dewan Undangan Negeri dan Ketua Menteri seharusnya dilanjutkan untuk pemilihan ahli majlis dan Datuk Bandar. Pilihanraya kerajaan tempatan telah dimansuhkan oleh Kerajaan Persekutuan pada 1.3.1965 dan BN telah gagal menepati janjinya untuk mengembalikan pilihanraya tersebut.<\/p>\n<p>Untuk merealisasikan komitmen ini Kerajaan Pakatan Rakyat Pulau Pinangtelah meluluskan Enakmen Pilihanraya Kerajaan Tempatan (Pulau Pinang dan Province Wellesley) 2012 pada 9 Mei 2012. Persetujuan telah pun diberikan oleh Yang Di Pertua Negeri Pulau Pinang pada 15 Jun 2012 menepati Perkara 26 Perlembagaan Negeri Pulau Pinang.<\/p>\n<p>Apabila kerajaan baru Pakatan Rakyat mengambil alih pentadbiran dan menyatakan hasrat untuk mengembalikan undi ketiga, pihak Suruhanjaya Pilihan Raya telah menolak permintaan Kerajaan Negeri dengan alasan bahawa tidak ada undang-undang yang memperuntukkan perlaksanaan pilihanraya sedemikian. Ketika Enakmen tersebut diluluskan di peringkat DUN, Menteri Perumahan dan Kerajaan Tempatan memperlecehkan usaha Kerajaan Negeri sebegai melanggar Perlembagaan dan enggan bekerjasama dan bersetuju dengan permintaan Kerajaan Negeri.<\/p>\n<p>Kerajaan Negeri berpendirian bahawa pilihanraya kerajaan tempatan adalah satu perkara kelolaan Negeri di bawah Jadual Kesembilan Perlembagaan Persekutuan, dan bahawa Dewan Undangan Negeri mempunyai bidang kuasa untuk mengadakan peruntukan bagi mengadakan pilihan raya tempatan di bawah Jadual Kesembilan dan Perkara 113 (4) Perlembagaan Persekutuan.<\/p>\n<p>Kerajaan Negeri telah memaklumkan kepada Suruhanjaya Pilihan Raya bahawa Enakmen tersebut akan berkuat kuasa di Pulau Pinang pada 31 Januari 2013, walau bagaimanapun Kerajaan Negeri telah gagal mendapatkan sebarang komitmen dari Suruhanjaya Pilihan Raya untuk melaksanakan pilihan raya bagi MPPP dan MPSP selaras dengan Enakmen tersebut.<\/p>\n<p>Selaras dengan komitmen untuk mengembalikan undi ketiga, Kerajaan Negeri kini telah mengarahkan peguamnya untuk memohon kepada Mahkamah Persekutuan untuk memberi keizinan bagi mendapatkan pengisytiharan bahawa seksyen 15 Akta Kerajaan Tempatan 1976 (sebuah undang-undang persekutuan yang digubal oleh Parlimen), yang memansuhkan pilihanraya kerajaan tempatan di seluruh Malaysia, adalah tidak sah atau tidak berkuat kuasa di Pulau Pinang; dan bahawa Enakmen 2012 yang diluluskan oleh Dewan Undangan Negeri Pulau Pinang  sebagai sah dan memperuntukkan bagi Suruhanjaya Pilihan Raya untuk menjalankan pilihan raya kerajaan tempatan di Pulau Pinang.<\/p>\n<p>Kerajaan Negeri akan bersama Encik P Ramakrishnan dalam saman ini, seorang warganegara malaysia, dan seorang pengundi berdaftar yang telah mengundi dalam pilihan raya negeri dan persekutuan sejak 1964 dan juga bekas presiden Aliran, yang mahu mengundi dalam pilihan raya kerajaan tempatan. <\/p>\n<p>Kerajaan Negeri Pulau Pinang bersama-sama dengan bekas Presiden Aliran saudara Ramakrishnan akan menjadi dua plaintif dalam saman yang bersejarah ini terhadap kerajaan Persekutuan dan Suruhanjaya Pilihan Raya (SPR) di Mahkamah Persekutuan.<\/p>\n<p>LATAR BELAKANG<\/p>\n<p>\u2022 Pada 14 Julai 2009, YB Chow Kon Yeow, EXCO Negeri bagi Kerajaan Tempatan dan Pengurusan Trafik, telah menulis surat kepada Kerajaan Persekutuan untuk meminta pilihan raya kerajaan tempatan untuk dimasukkan dalam agenda Majlis Kebangsaan Kerajaan Tempatan, tetapi permintaan ini adalah ditolak.<br \/>\n\u2022 Pada 11 Ogos 2009, Dewan Undangan Negeri telah meluluskan resolusi menyeru pihak Kerajaan Persekutuan untuk mengambil tindakan bagi mengembalikan pilihan raya kerajaan tempatan, tetapi resolusi ini sekali lagi ditolak.<br \/>\n\u2022 Pada 4 Mac 2010, Kerajaan Negeri Pulau Pinang telah menulis surat kepada Suruhanjaya Pilihan Raya bagi meminta untuk dijalankan pilihanraya kerajaan tempatan untuk MPPP dan MPSP di bawah Akta Pilihan Raya Kerajaan Tempatan 1960, tetapi Suruhanjaya Pilihan Raya (SPR) enggan berbuat demikian.<br \/>\n\u2022 Pada 18 Januari 2012, Kerajaan Negeri yang mengecualikan kedua-dua MPPP dan MPSP dari seksyen 15 Akta Kerajaan Tempatan 1976, yang telah memansuhkan semua peruntukan undang-undang berkaitan pilihanraya kerajaan tempatan.<br \/>\n\u2022 Pada 9 Mei 2012, Dewan Undangan Negeri telah meluluskan Enakmen Pilihanraya Kerajaan Tempatan (Pulau Pinang dan Seberang Perai) 2012, memperuntukkan supaya Suruhanjaya Pilihan Raya mengadakan pilihanraya kerajaan tempatan.<br \/>\n\u2022 Pada 18 Disember 2012, Kerajaan Negeri telah menulis surat kepada Suruhanjaya Pilihan Raya memaklumkan bahawa Enakmen tersebut akan berkuatkuasa mulai 31 Januari 2013.<\/p>\n<p>&#8212;-Mandarin Version&#8212;&#8211;<\/p>\n<p>\u69df\u5dde\u9996\u5e2d\u90e8\u957f\u6797\u51a0\u82f1\u4e8e2013\u5e742\u670826\u65e5\u5728\u5409\u9686\u5761\u5ba3\u5e03\u59d4\u4efb\u6c64\u7c73\u6258\u9a6c\u65af\u4e3a\u69df\u5dde\u653f\u5e9c\u4ee3\u8868\u5f8b\u5e08\uff0c\u5165\u7980\u8054\u90a6\u6cd5\u9662\uff0c\u8d77\u8bc9\u9009\u59d4\u4f1a\u53ca\u8054\u90a6\u653f\u5e9c\uff1a<\/p>\n<p><strong>\u69df\u5dde\u653f\u5e9c\u4fc3\u8bf7\u56fd\u9635\u8ba4\u540c\u5e76\u5728\u69df\u5c9b\u5e02\u653f\u5c40\u53ca\u5a01\u7701\u5e02\u653f\u5c40\u63a8\u884c\u5730\u65b9\u653f\u5e9c\u9009\u4e3e\uff0c\u4ee5\u907f\u514d\u69df\u5dde\u4eff\u6548\u5176\u5b83\u6c11\u8054\u5dde\u5c5e\uff0c\u8d77\u8bc9\u8054\u90a6\u653f\u5e9c\u6765\u634d\u536b\u53ca\u4fc3\u8fdb\u6c11\u4e3b\u53ca\u4eba\u6743\u3002<\/strong><\/p>\n<p>\u69df\u5dde\u653f\u5e9c\u522b\u65e0\u9009\u62e9\uff0c\u53ea\u597d\u628a\u8054\u90a6\u653f\u5e9c\u53ca\u9009\u59d4\u4f1a\u5e26\u5230\u8054\u90a6\u6cd5\u9662\uff0c\u4ee5\u8feb\u4f7f\u4ed6\u4eec\u6062\u590d\u6c11\u4e3b\u7b2c\u4e09\u7968\uff0c\u5e76\u4e3a\u69df\u5c9b\u5e02\u8bae\u4f1a\u53ca\u5a01\u7701\u5e02\u8bae\u4f1a\u4e3e\u884c\u5730\u65b9\u8bae\u4f1a\u9009\u4e3e \u3002\u5dde\u653f\u5e9c\u59d4\u4efb\u8457\u540d\u7684\u5f8b\u5e08\u6c64\u7c73\u6258\u9a6c\u65af\u69df\u5dde\u653f\u5e9c\u4e3a\u4ee3\u8868\u5f8b\u5e08\uff0c\u5728\u672a\u6765\u4e24\u5468\u5185\u5165\u7980\u8054\u90a6\u6cd5\u9662\u3002<\/p>\n<p>\u69df\u5dde\u653f\u5e9c\u4fc3\u8bf7\u56fd\u9635\u8ba4\u540c\u5e76\u5728\u69df\u5c9b\u5e02\u653f\u5c40\u53ca\u5a01\u7701\u5e02\u653f\u5c40\u63a8\u884c\u5730\u65b9\u653f\u5e9c\u9009\u4e3e\uff0c\u4ee5\u907f\u514d\u69df\u5dde\u4eff\u6548\u5176\u5b83\u6c11\u8054\u5dde\u5c5e\uff0c\u8d77\u8bc9\u8054\u90a6\u653f\u5e9c\u6765\u634d\u536b\u53ca\u4fc3\u8fdb\u6c11\u4e3b\u53ca\u4eba\u6743\u3002\u56e0\u4e3a\uff0c\u69df\u5dde\u5c06\u662f\u7ee7\u5409\u5170\u4e39\u53ca\u96ea\u5dde\u4e4b\u540e\uff0c\u7b2c\u4e09\u4e2a\u8d77\u8bc9\u8054\u90a6\u653f\u5e9c\u7684\u5dde\u5c5e\u3002<\/p>\n<p>\u6062\u590d\u6c11\u4e3b\u7b2c\u4e09\u7968\u662f\u69df\u5dde\u653f\u5e9c\u81ea2008\u5e74\u9009\u4e3e\u7684\u57fa\u672c\u8981\u6c42\u53ca\u5fd7\u613f\u3002\u8fd9\u4e0d\u53ea\u80fd\u8ba9\u69df\u5dde\u4eba\u6c11\u6709\u6743\u9009\u51fa\u56fd\u4f1a\u8bae\u5458\u3001\u5dde\u8bae\u5458\u53ca\u9996\u957f\uff0c\u4ed6\u4eec\u4e5f\u5c06\u6709\u6743\u9009\u51fa\u5e02\u8bae\u5458\u53ca\u5e02\u957f\u3002\u5730\u65b9\u653f\u5e9c\u9009\u4e3e\u5df2\u57281965\u5e743\u67081\u65e5\u88ab\u8054\u90a6\u653f\u5e9c\u7981\u6b62\uff0c\u56fd\u9635\u4e5f\u6ca1\u6709\u5c65\u884c\u8bfa\u8a00\uff0c\u6062\u590d\u5730\u65b9\u8bae\u4f1a\u9009\u4e3e\u3002<\/p>\n<p>\u4e3a\u4e86\u5b9e\u73b0\u69df\u5dde\u6c11\u8054\u653f\u5e9c\u7684\u613f\u671b\uff0c\u6211\u4eec\u57282012\u5e745\u67089\u65e5\u901a\u8fc72012\u5e74\u5730\u65b9\u653f\u5e9c\u9009\u4e3e\uff08\u69df\u5c9b\u53ca\u5a01\u7701\uff09\u6cd5\u4ee4\u3002\u69df\u5dde\u5143\u9996\u4e8e2012\u5e746\u670815\u65e5\u4f9d\u636e\u69df\u5dde\u5baa\u6cd5\u7b2c26\u6761\u6587\u8ba4\u540c\u4e0a\u8ff0\u6cd5\u4ee4\u3002<\/p>\n<p>\u5f53\u6c11\u8054\u5dde\u653f\u5e9c\u6267\u653f\u5e76\u8868\u793a\u613f\u610f\u6062\u590d\u7b2c\u4e09\u7968\u65f6\uff0c\u9009\u4e3e\u59d4\u5458\u4f1a\u5374\u5728\u53bb\u5e741\u6708\u62d2\u7edd\u5dde\u653f\u5e9c\u7684\u8981\u6c42\uff0c\u7406\u7531\u662f\u6ca1\u6709\u6cd5\u4ee4\u53ef\u4ee5\u8ba9\u4ed6\u4eec\u6267\u884c\u5730\u65b9\u9009\u4e3e\u3002\u5f53\u69df\u5dde\u7acb\u6cd5\u8bae\u4f1a\u901a\u8fc7\u5730\u65b9\u9009\u4e3e\u6cd5\u4ee4\u65f6\uff0c\u623f\u5c4b\u53ca\u5730\u65b9\u653f\u5e9c\u90e8\u957f\u5374\u8bf4\u69df\u5dde\u653f\u5e9c\u4e0d\u7b26\u5408\u5baa\u6cd5\uff0c\u56e0\u6b64\u62d2\u7edd\u9075\u4ece\u5dde\u653f\u5e9c\u7684\u8981\u6c42\u3002<\/p>\n<p>\u5dde\u653f\u5e9c\u4e5f\u5df2\u7ecf\u8868\u660e\u7acb\u573a\uff0c\u5730\u65b9\u653f\u5e9c\u9009\u4e3e\u5728\u8054\u90a6\u5baa\u6cd5\u7b2c9\u76ee\u5f55\u4e0b\u662f\u5dde\u5c5e\u4e8b\u52a1\uff0c\u800c\u5728\u8054\u90a6\u5baa\u6cd5\u7b2c9\u76ee\u5f55\u53ca\u7b2c113\uff084\uff09\u6761\u6587\u4e4b\u4e0b\uff0c\u5dde\u7acb\u6cd5\u673a\u6784\u6709\u6743\u4e3e\u884c\u5730\u65b9\u653f\u5e9c\u9009\u4e3e\u3002<\/p>\n<p>\u5dde\u653f\u5e9c\u5df2\u7ecf\u901a\u77e5\u9009\u59d4\u4f1a\u6709\u5173\u6cd5\u4ee4\u5df2\u57282013\u5e741\u670831\u65e5\u6b63\u5f0f\u751f\u6548\uff0c\u4f46\u662f\u5dde\u653f\u5e9c\u81f3\u4eca\u90fd\u8fd8\u6ca1\u6709\u83b7\u5f97\u9009\u59d4\u4f1a\u4efb\u4f55\u7b54\u590d\uff0c\u6309\u6761\u4f8b\u4e3a\u69df\u5c9b\u5e02\u8bae\u4f1a\u53ca\u5a01\u7701\u5e02\u8bae\u4f1a\u4e3e\u884c\u5730\u65b9\u8bae\u4f1a\u9009\u4e3e\u3002
