The Penang State Government Has No Choice But To Take the Federal Government and the Election Commission to Federal Court To Compel The Restoration Of The 3rd Vote And Local Government Elections In the Pennag Municipal Council(MPPP) and Seberang Perai Municipal Council(MPSP).
\n<\/strong>
\nThe Penang state government has no choice but to take the Federal Government and the Election Commission to Federal Court to compel the restoration of the 3rd vote and local government elections in the Pennag Municipal Council(MPPP) and Seberang Perai Municipal Council(MPSP). Restoring the \u201cthird vote\u201d has long been a fundamental demand and commitment of the Penang State Government since its election in 2008.<\/p>\n

The State Government takes the position that local government elections are a State matter under the Ninth Schedule of the Federal Constitution, and that the State Legislature has jurisdiction to provide for the holding of local elections under the Ninth Schedule and Article 113(4) of the Federal Constitution.<\/p>\n

In May 2012, the Penang State Legislative Assembly passed the Local Government Elections (Penang Island and Province Wellesley) Enactment 2012, which provides for the Election Commission to conduct local government elections in Penang.<\/p>\n

The State Government has informed the Election Commission that the Enactment would come into force in Penang by 31 January 2013, however State Government has failed to obtain any commitment from the Election Commission to conduct the elections to the MPPP and MPSP in accordance with the Enactment.<\/p>\n

In line with its commitment to restore the third vote, the State Government has now instructed its lawyers to apply to the Federal Court for leave to seek declarations that section 15 of the Local Government Act 1976 (federal law enacted by Parliament), which purported to abolish local government elections throughout Malaysia, is invalid or inoperative in Penang, and that the 2012 Enactment passed by the Penang State Legislature validly provides for the Election Commission to conduct local government elections in Penang.<\/p>\n

The State Government will be joined in this suit by Mr P Ramakrishnan, a malaysian citizen, a registered voter that has voted in both state and federal election since 1964 and a former president of Aliran, whom like to vote in local government election. The State Government has instructed that necessary application be filed within the next two weeks.<\/p>\n

The Penang state government will together with former Aliran President Ramakrishnan be the two plaintiffs in this historic suit against the Federal government and the Election Commission at the Federal Court.<\/p>\n

BACKGROUND<\/p>\n

\u00b7 On 14 July 2009, YB Chow Kon Yeow, the State EXCO for Local Government and Traffic Management, wrote to the Federal Government to ask for local government elections to be put on the agenda of the National Council of Local Government, but this request was rejected.
\n\u00b7 On 11 August 2009, the State Legislative Assembly passed a resolution calling upon the Federal authorities to take action to reinstate local government elections, but this resolution was again rejected.
\n\u00b7 On 4 March 2010, Penang State Government wrote to the Election Commission asking it to conduct local government elections to the MPPP and MPSP under the Local Government Elections Act 1960, but the Election Commission refused.
\n\u00b7 On 18 January 2012, the State Government exempted both the MPPP and the MPSP from section 15 of the Local Government Act 1976, which had rendered inoperative all legal provisions relating to local government elections.
\n\u00b7 On 9 May 2012, the State Legislative Assembly passed the Local Government Elections (Penang Island and Province Wellesley) Enactment 2012, providing for the Election Commission to hold local government elections.

Kerajaan Negeri Pulau Pinang tidak mempunyai pilihan selain membawa Kerajaan Pusat dan Suruhanjaya Pilihan Raya ke Mahkamah Persekutuan untuk mendesak pemulihan undi ketiga Dan pilihanraya kerajaan tempatan untuk Majlis Perbandaran Pulau Pinang (MPPP) dan Majlis Perbandaran Seberang Perai (MPSP).<\/p>\n

Kerajaan Negeri Pulau Pinang tidak mempunyai pilihan lain kecuali untuk membawa Kerajaan Pusat dan Suruhanjaya Pilihan Raya ke Mahkamah Persekutuan bagi mendesak pemulihan undi ketiga dan pilihan raya kerajaan tempatan bagi Majlis Perbandaran Pulau Pinang (MPPP) dan Majlis Perbandaran Seberang Perai (MPSP). Mengembalikan “undi ketiga” telah lama menjadi tuntutan utama dan komitmen Kerajaan Negeri Pulau Pinang sejak pilihan raya pada tahun 2008.<\/p>\n

Kerajaan Negeri berpendirian bahawa pilihanraya kerajaan tempatan adalah satu perkara kelolaan Negeri di bawah Jadual Kesembilan Perlembagaan Persekutuan, dan bahawa Dewan Undangan Negeri mempunyai bidang kuasa untuk mengadakan peruntukan bagi mengadakan pilihan raya tempatan di bawah Jadual Kesembilan dan Perkara 113 (4) Perlembagaan Persekutuan.<\/p>\n

Pada bulan Mei 2012, Dewan Undangan Negeri Pulau Pinang telah meluluskan Enakmen Pilihanraya Kerajaan Tempatan (Pulau Pinang dan Province Wellesley) 2012, yang memperuntukkan supaya Suruhanjaya Pilihanraya menjalankan pilihanraya kerajaan tempatan di Pulau Pinang.<\/p>\n

Kerajaan Negeri telah memaklumkan kepada Suruhanjaya Pilihan Raya bahawa Enakmen tersebut akan berkuat kuasa di Pulau Pinang pada 31 Januari 2013, walau bagaimanapun Kerajaan Negeri telah gagal mendapatkan sebarang komitmen dari Suruhanjaya Pilihan Raya untuk melaksanakan pilihan raya bagi MPPP dan MPSP selaras dengan Enakmen tersebut.<\/p>\n

Selaras dengan komitmen untuk mengembalikan undi ketiga, Kerajaan Negeri kini telah mengarahkan peguamnya untuk memohon kepada Mahkamah Persekutuan untuk memberi keizinan bagi mendapatkan pengisytiharan bahawa seksyen 15 Akta Kerajaan Tempatan 1976 (sebuah undang-undang persekutuan yang digubal oleh Parlimen), yang memansuhkan pilihanraya kerajaan tempatan di seluruh Malaysia, adalah tidak sah atau tidak berkuat kuasa di Pulau Pinang; dan bahawa Enakmen 2012 yang diluluskan oleh Dewan Undangan Negeri Pulau Pinang sebagai sah dan memperuntukkan bagi Suruhanjaya Pilihan Raya untuk menjalankan pilihan raya kerajaan tempatan di Pulau Pinang.<\/p>\n

Kerajaan Negeri akan bersama Encik P Ramakrishnan dalam saman ini, seorang warganegara malaysia, dan seorang pengundi berdaftar yang telah mengundi dalam pilihan raya negeri dan persekutuan sejak 1964 dan juga bekas presiden Aliran, yang mahu mengundi dalam pilihan raya kerajaan tempatan. Kerajaan Negeri telah mengarahkan supaya permohonan-permohonan yang perlu untuk difailkan dalam tempoh dua minggu akan datang.<\/p>\n

Kerajaan Negeri Pulau Pinang bersama-sama dengan bekas Presiden Aliran saudara Ramakrishnan akan menjadi dua plaintif dalam saman yang bersejarah ini terhadap kerajaan Persekutuan dan Suruhanjaya Pilihan Raya (SPR) di Mahkamah Persekutuan.<\/p>\n

LATAR BELAKANG<\/p>\n

\u00b7 Pada 14 Julai 2009, YB Chow Kon Yeow, EXCO Negeri bagi Kerajaan Tempatan dan Pengurusan Trafik, telah menulis surat kepada Kerajaan Persekutuan untuk meminta pilihan raya kerajaan tempatan untuk dimasukkan dalam agenda Majlis Kebangsaan Kerajaan Tempatan, tetapi permintaan ini adalah ditolak.
\n\u00b7 Pada 11 Ogos 2009, Dewan Undangan Negeri telah meluluskan resolusi menyeru pihak Kerajaan Persekutuan untuk mengambil tindakan bagi mengembalikan pilihan raya kerajaan tempatan, tetapi resolusi ini sekali lagi ditolak.
\n\u00b7 Pada 4 Mac 2010, Kerajaan Negeri Pulau Pinang telah menulis surat kepada Suruhanjaya Pilihan Raya bagi meminta untuk dijalankan pilihanraya kerajaan tempatan untuk MPPP dan MPSP di bawah Akta Pilihan Raya Kerajaan Tempatan 1960, tetapi Suruhanjaya Pilihan Raya (SPR) enggan berbuat demikian.
\n\u00b7 Pada 18 Januari 2012, Kerajaan Negeri yang mengecualikan kedua-dua MPPP dan MPSP dari seksyen 15 Akta Kerajaan Tempatan 1976, yang telah memansuhkan semua peruntukan undang-undang berkaitan pilihanraya kerajaan tempatan.
\n\u00b7 Pada 9 Mei 2012, Dewan Undangan Negeri telah meluluskan Enakmen Pilihanraya Kerajaan Tempatan (Pulau Pinang dan Seberang Perai) 2012, memperuntukkan supaya Suruhanjaya Pilihan Raya mengadakan pilihanraya kerajaan tempatan.
