Is the Malaysian Cabinet and in particular 4 Ministers lying or Lynas the liar, over the controversy whether the Temporary Operating License(TOL) granted to Lynas has a strict conditon that the rare earth toxic waste residue can not remain in Malaysia but must be exported out of the country? Whilst Lynas claims that it has become a political football due to impending general elections, this is a serious issue with long-term consequences lasting a lifetime that is more important than once in 5 years elections.<\/p>\n
Many Malaysians worried about their health and children\u2019s safety are asking following conflicting reports between both Lynas and the Malaysian government whether the TOL makes it compulsory for the wastes to be exported. Based on which party the statements were addressed to, it is clear that Lynas is telling the truth and the entire BN Cabinet is lying.<\/p>\n
BN Cabinet and in particular the 4 Ministers are lying that rare earth toxic waste residue must be exported out of Malaysia because Lynas will not dare lie to the Australian Stock Exchange(ASE) with their statement that the license permitted the wastes to remain in Malaysia. It is easy for BN to lie to the people as they have done so for the last 55 years without suffering any serious adverse consequences.<\/p>\n
However for Lynas to lie to the ASE has serious repercussions which could lead to the sacking of its top officials, including CEO, and even suspension of Lynas from the ASE. Lynas would not risk such punishment from the ASE with lies.<\/p>\n
Two days ago the Cabinet endorsed a ministerial statement by 4 Ministers instructing Australian miner Lynas to ensure all residue and by-products from its rare earth refinery are removed from the country. The 4 Cabinet members are Minister of International Trade and Industry Datuk Seri Mustapa Mohamed, Minister of Science, Technology and Innovation Datuk Seri Panglima Dr Maximus Johnity Ongkili, Minister of Natural Resources and Environment Datuk Seri Douglas Unggah Embas and Health Minister Datuk Seri Liow Tiong Lai.DAP demands the resignation of 4 Ministers for their lie that there is a legal binding agreement to compel Lynas to ship out their toxic residue.<\/p>\n
However, this clearly contradicts what Lynas Corporation had said in a stock exchange filing yesterday that the license remains issued and valid, with no requirement to ship out any residue produced from Malaysia and there is no legal impediment to Lynas carrying out its operations at the plant. If what the 4 Ministers said are true, then it is only a simple matter for the government to revoke Lynas\u2019 TOL or shut down Lynas operations immediately for breach of condition of failing to export the toxic residues.<\/p>\n
By failing to shut down Lynas or take action and instead only issue statements clearly shows that requiring the toxic residue to be exported out of Malaysia is not an integral part of the TOL conditions and agreements. Lynas\u2019 admission that rare earth waste will remain and not exported out of Malaysia presents a rare opportunity for the Malaysian government to cancel the Kuantan Rare Earth Facility for breach of compliance without needing to pay compensation amounting to billions of ringgit.<\/p>\n
If BN refuses to defend the interests of the people\u2019s health and the environment by cancelling the Lynas plant for breach of compliance, then PR will do so when we take over Putrajaya as the plant can now be cancelled for breach of compliance without needing to pay a single sen in compensation.<\/p>\n

Kabinet BN dan 4 menteri telah berbohong bahawa baki sisa nadir bumi akan dieksport keluar dari Malaysia kerana Lynas tidak akan berani berbohong dengan Bursa Saham Australia (ASE) dengan kenyataan mereka bahawa lesen telah membenarkan sisa tersebut untuk kekal di Malaysia.<\/strong><\/p>\n Adakah Kabinet Malaysia dan 4 menteri tertentu berbohong atau Lynas yang berbohong mengenai kontroversi sama ada Lesen Operasi Sementara (TOL) yang diberikan kepada Lynas menetapkan syarat bahawa sisa toksik nadir bumi tidak boleh kekal di Malaysia tetapi akan dieksport ke luar negara? Walaupun Lynas mendakwa bahawa perkara ini telah menjadi ‘bola sepak politik’ disebabkan pilihan raya umum yang akan menjelang tetapi ini adalah perkara serius dengan kesan jangka panjang seumur hidup adalah penting berbanding sekali dalam 5 tahun pilihanraya.<\/p>\n Ramai rakyat Malaysia bimbang tentang kesihatan dan keselamatan anak- anak mereka yang bertanya berikutan laporan yang bercanggah di antara kedua- dua Lynas dan kerajaan Malaysia sama ada TOL menjadikan sisa ini wajib dieksport. Tidak kira parti mana kenyataan itu dituju, ia jelas menunjukkan bahawa Lynas memaklumkan perkara yang benar dan keseluruhan Kabinet BN telah berbohong.<\/p>\n Kabinet BN khususnya 4 menteri tersebut telah berbohong bahawa sisa toksik nadir bumi mesti dieksport keluar dari Malaysia kerana Lynas tidak akan berani berbohong dengan Bursa Saham Australia (ASE) dengan kenyataan mereka bahawa permit tersebut membenarkan pengekalan sisa di Malaysia. Mudah bagi BN untuk berbohong kepada rakyat kerana mereka telah berbuat demikian selama 55 tahun yang lalu tanpa mengalami apa-apa kesan sampingan yang serius.<\/p>\n Walaubagaimanapun, untuk Lynas berbohong kepada ASE akan meninggalkan kesan yang serius yang boleh membawa kepada pemecatan pegawai tertinggi termasuk Ketua Pegawai Eksekutif (CEO) dan juga penggantungan Lynas dari ASE. Lynas tidak akan mengambil risiko seperti itu dengan membohong.<\/p>\n Dua hari lalu, Kabinet telah meluluskan kenyataan bersama oleh 4 menteri yang mengarahkan pelombong Lynas Australia untuk memastikan semua sisa dan produk dari kilang penapisan nadir bumi dikeluarkan dari negara ini. 4 ahli kabinet tersebut adalah Menteri Perdagangan Antarabangsa dan Industri Datuk Seri Mustapa Mohamad, Menteri Sains, Teknologi dan Inovasi, Datuk Seri Panglima Dr Maximum Johnity Ongkili; Menteri Sumber Asli dan Alam Sekitar Datuk Seri Dounglas Uggah Embas dan Menteri Kesihatan Datuk Seri Liow Tiong Lai. DAP menuntut peletakan jawatan 4 menteri tersebut berikutan pembohongan mereka bahawa terdapat perjanjian undang-undang yang memaksa Lynas untuk membawa keluar sisa toksik mereka.<\/p>\n Walaubagaimanapun, ini jelas bercanggah dengan apa yang diperkatakan oleh Lynas Corporation bahawa lesen telahpun dikeluarkan dan sah, dengan tiada keperluan untuk memindahkan sebarang sisa yang dihasilkan di Malaysia dan tiada halangan undang- undang untuk Lynas menjalankan operasinya di kilang. Jika apa yang diperkatakan oleh 4 Menteri tersebut adalah benar, maka mudah untuk kerajaan Malaysia membatalkan TOL Lynas atau menutup operasi Lynas serta- merta atas kegagalan pelanggaran syarat untuk mengeskport sisa toksik.<\/p>\n Kegagalan menutup Lynas atau mengambil tindakan dengan hanya mengeluarkan kenyataan jelas menunjukkan syarat untuk mengeskport sisa toksik keluar dari Malaysia tidak merupakan sebahagian daripada syarat-syarat perjanjian TOL. Pengakuan Lynas bahawa sisa nadir bumi akan kekal dan tidak akan dieksport keluar dari Malaysia memberikan satu peluang yang jarang berlaku kepada kerajaan Malaysia untuk membatalkan Loji Nadir Bumi Kuantan atas pelanggaran syarat tanpa perlu membayar pampasan berjumlah berbillion ringgit.<\/p>\n Jika BN enggan untuk mempertahan kepentingan kesihatan dan alam sekitar rakyat dengan membatalkan loji Lynas atas pelanggaran syarat tersebut, maka PR akan melakukannya apabila kita mengambil alih Putrajaya kerana loji tersebut kini boleh dibatalkan atas pelanggaran syarat tanpa perlu membayar
