Teng\u2019s commitment is doubtful when Khoo Boo Soon, director of Taman Manggis Phase II Development Sdn Bhd, announced on 29 November that the Taman Manggis land will be used not to build PPR but to build affordable housing costing RM400,000.<\/p>\n<p>What guarantees can Teng make that Khoo\u2019s original announcement of building RM400,000 housing will not be implemented? After all, Teng had earlier expressed anger and refused to co-operate with Penang UMNO for tearing Gerakan President Tan Sri Koh Tsu Koon\u2019s picture but now works happily together with Penang UMNO even though there was no apology from UMNO.<\/p>\n<p>The state government can not sell the land to BN Penang when there is no iron-clad guarantee and clear commitment that the directors of Taman Manggis will not renege on the promise to build PPR. This lack of clarity is compounded by Teng and other BN leaders not being directors of Taman Manggis Phase II Development Sdn Bhd.<\/p>\n<p>BN Penang Chairman Teng Chang Yeow had wrote on 3.10.2012 that BN Penang have accepted the Penang state government\u2019s offer to buy at RM 450 per square feet to build PPR. Teng had paid only 1% \u201cearnest money\u201d or RM 224,074 dated 3.10.2012 on behalf of BN Penang. On 4 October, I had replied to Teng that the remainder 99% or RM 22,183,227 must be paid within 30 days by BN Penang, which was then extended till  5 December 2012.<\/p>\n<p>The state government had considered the land too small for public housing when the Housing and Local Government Ministry sets the minimum land area required is 2 acres. Instead an 11 acre site in Jalan S.P. Chelliah was chosen to build public housing- something not done before. The Taman Manggis land was chosen for a private hospital and sold by open competitive tender at RM 232 per square foot, which is above the Federal government\u2019s valuation price of RM 212 per square foot.<\/p>\n<p>Even though BN has claimed that the land was set aside by the BN state government in 2003 to build PPR, there was no public announcement in the newspapers from 2003-8. Why BN could not and had no money to build PPR from 2003-7 when BN was in power, but BN can find RM 22,407,300 to do so when they are in opposition?<\/p>\n<p>Teng and BN Penang\u2019s excuse for not paying up because the land had already been sold to KLIDC and that there is no sales and purchase agreement ignores the fact that no land title has been issued. How can there be a sales and purchase agreement without any land titles? And so long as the land title is not issued, the state government has the prerogative to sell the land to any other person. This land sale is a special case not by open tender, but directly granted to BN Penang by alienation.<\/p>\n<p>The same situation applies when the Penang Port Commission paid in full the RM 15 million premium for the land on Swettenham Pier. In that case, there was also no sale and purchase agreement. Instead it was granted by alienation like the Taman Manggis land. As the land title was not issued, the state government can refund the premium to Penang Port Commission in full and hold on to the land title. Even KLIDC accepts this legal status and the sale of the Taman Manggis land to BN Penang by the state government, subject to a full refund of their premium paid and reimbursement of costs incurred.<\/p>\n<p>Finally it is the insincerity and no genuine commitment from Teng Chang Yeow and Penang BN to build PPR is the main cause of the cancellation by the state government of the purchase of 1.1 acre land in Taman Manggis for RM 22,407,300.<\/p>\n<p>Lim Guan Eng<\/p>\n<p>&#8212;&#8211;BM Version &#8212;<br \/>\nKenyataan Akhbar oleh Ketua Menteri Pulau Pinang Lim Guan Eng di Komtar, George Town pada 6.12.2012<\/p>\n<p><strong>Ketidakikhlasan Teng Chang Yeow Dan BN Pulau Pinang Untuk Membina Perumahan Kos Rendah Untuk Sewa (PPR Atau Projek Perumahan Rakyat) Adalah Punca Pembatalan Pembelian Tanah 1.1 Ekar Di Taman Manggis Pada Harga RM22,407,300.<\/strong><\/p>\n<p>Dalam mesyuarat semalam, EXCO Pulau Pinang telah memutuskan untuk membatalkan tawaran kepada Pengerusi BN Pulau Pinang Teng Chang Yeow untuk penjualan tanah 1.1 ekar di Taman Manggis untuk RM22,407,300 atas kegagalan untuk mematuhi 4 faktor utama:<br \/>\n&#8211; Ketidakikhlasan Teng dan BN Pulau Pinang untuk membina PPR atau rumah kos rendah untuk sewa ekoran kenyataan yang bercanggah daripada Khoo Boo San bahawa bukan PPR tetapi rumah mampu milik berharga RM400,000 yang akan dibina.<br \/>\n&#8211; Kegagalan untuk menukar pengarah dan pemegang saham syarikat pemaju BN, iaitu Taman Manggis Phase II Development Sdn Bhd untuk memasukkan Teng dan pemimpin-pemimpin BN Pulau Pinang kerana Teng sendiri telah bersetuju dengan kerajaan negeri bahawa BN Pulau Pinang yang akan membeli tanah tersebut.<br \/>\n&#8211; Kegagalan untuk menyemak semula modal berbayar untuk syarikat pemaju perumahan kepada nilai yang ditentukan oleh Kementerian Perumahan dan Kerajaan Tempatan, iaitu 3% Nilai Pembangunan Kasar (GDV).<br \/>\n&#8211; Kegagalan untuk membayar baki 99% atau RM22,183,227 pada 5 Disember 2012, walaupun lanjutan sebulan sudah diberi kepada Teng dan BN.<\/p>\n<p>Keengganan BN untuk membayar dengan penuh harga tanah 1.1 ekar di Taman Manggis iaitu RM22,407,300 walaupun mereka mendakwa sudah menyediakan wang tersebut, menimbulkan persoalan tentang kejujuran dan komitmen Teng dan BN Pulau Pinang dalam membeli tanah untuk pembinaan rumah kos rendah untuk sewa (PPR). Komitmen Teng diragui apabila Khoo Boo Soon, pengarah Taman Manggis Phase II Development Sdn Bhd, mengumumkan pada 29 November bahawa tanah Taman Manggis akan digunakan untuk perumahan mampu milik yang berharga RM400,000 dan bukan pembinaan PPR.<\/p>\n<p>Apakah jaminan Teng bahawa pengumuman asal Khoo untuk membina perumahan berharga RM400,000 tidak akan dilaksanakan? Dahulu, Teng pernah marah dan enggan bekerjasama dengan UMNO Pulau Pinang kerana mengoyakkan gambar Presiden Gerakan Tan Sri Kon Tsu Koon tetapi kini beliau bekerjasama dengan UMNO Pulau Pinang walaupun UMNO tidak meminta maaf.<\/p>\n<p>Kerajaan negeri tidak boleh menjual tanah kepada BN Pulau Pinang apabila tiada jaminan kuat dan komitmen jelas bahawa pengarah-pengarah Taman Manggis tidak akan memungkiri janji untuk membina PPR. Pendirian Teng yang tidak jelas ditambah teruk lagi dengan keengganan kepimpinan BN untuk menjadi pengarah dalam syarikat Taman Manggis Phase II Development Sdn Bhd. <\/p>\n<p>Pengerusi BN Pulau Pinang Teng Chang Yeow telah menulis pada 3.10.2012 bahawa BN Pulau Pinang telah menerima tawaran kerajaan negeri Pulau Pinang untuk menjual tanah pada harga RM450 sekaki persegi untuk pembinaan PPR. Teng telah membayar 1% sebagai wang cengkeram atau RM224,074 yang bertarikh 3.10.2012 bagi pihak BN Pulau Pinang. Pada 4 Oktober, saya telah menjawab bahawa baki 99% atau RM22,183,227 harus dibayar dalam jangka masa 30 hari oleh BN Pulau Pinang, yang kemudiannya telah dilanjutkan kepada 5 Disember 2012.<\/p>\n<p>Kerajaan negeri telah membuat keputusan bahawa tanah tersebut adalah terlalu kecil untuk perumahan awam apabila Kementerian Perumahan dan Kerajaan Tempatan telah menetapkan 2 ekar sebagai keluasan tanah minima untuk tujuan tersebut. Sebaliknya, tanah 11 ekar di Jalan SP Chelliah telah dipilih untuk pembinaan perumahan awam &#8211; sesuatu yang tidak pernah dilakukan dahulu. Tanah Taman Manggis telah dipilih untuk hospital swasta dan dijual melalui tender terbuka pada harga RM232 sekaki persegi, lebih tinggi daripada unjuran penilaian kerajaan Persekutuan iaitu RM212 sekaki persegi.<\/p>\n<p>Walaupun BN mendakwa bahawa tanah tersebut telah disimpan oleh kerajaan negeri BN pada tahun 2003 untuk pembinaan PPR, tiada sebarang pengumuman awam yang dibuat dalam surat khabar dari tahun 2003 hingga 2008. Kenapa BN tidak dapat mencari wang untuk membina PPR dari 2003 hingga 2007 semasa mereka berkuasa, tetapi BN boleh mencari RM22,407,300 apabila mereka menjadi pembangkang?<\/p>\n<p>Alasan Teng dan BN Pulau Pinang bahawa mereka tidak membayar penuh kerana tanah tersebut sudah dijual kepada KLIDC serta ketiadaan perjanjian jual-beli adalah alasan yang tidak masuk akal kerana geran hak milik belum dikeluarkan. Bagaimanakah boleh kita memberi perjanjian jual-beli tanpa geran hak milik tanah? Dan selagi geran hak milik tanah tidak dikeluarkan, kerajaan negeri mempunyai hak untuk menjual tanah tersebut kepada sesiapa sahaja. Penjualan tanah kepada BN ini tidak melalui tender terbuka tetapi secara pemindahan hak milik tanah.<\/p>\n<p>Situasinya sama apabila Penang Port Commission telah membayar premium RM15 juta untuk tanah Swettenham Pier. Dalam kes tersebut, tiada perjanjian jual-beli. Sebaliknya ia telah dipindah milik seperti tanah Taman Manggis. Dan kerana geran hak milik tanah tidak dikeluarkan, kerajaan negeri boleh membayar balik premium tersebut kepada Penang Port Sdn Bhd dan terus memegang hak milik tanah. KLIDC menerima status ini dan juga penjualan tanah Taman Manggis kepada BN Pulau Pinang, tertakluk kepada pembayaran balik premium serta kos mereka.<\/p>\n<p>Akhir sekali, ketidakikhlasan Teng Chang Yeow dan BN Pulau Pinang untuk pembinaan PPR adalah sebab utama pembatalan oleh kerajaan negeri atas pembelian tanah 1.1 ekar di Taman Manggis pada harga RM22,407,300.<\/p>\n<p>Lim Guan \/>\n\u69df\u5dde\u9996\u5e2d\u90e8\u957f\u6797\u51a0\u82f1\u4e8e2012\u5e7412\u67086\u65e5\u5728\u4e54\u6cbb\u5e02\u53d1\u8868\u58f0\u660e\uff1a<\/p>\n<p><strong>\u9093\u7ae0\u8000\u53ca\u69df\u5dde\u56fd\u9635\u6beb\u65e0\u8bda\u610f\u5174\u5efa\u4f9b\u51fa\u79df\u7684\u5ec9\u4ef7\u5c4b\uff08\u6216\u4eba\u6c11\u7ec4\u5c4b\uff09\uff0c\u624d\u662f\u4ed6\u4eec\u53d6\u6d88\u4ee52240\u4e077300\u4ee4\u5409\u8d2d\u4e70\u5c71\u7af9\u56ed1.1\u82f1\u4ea9\u5730\u6bb5\u7684\u539f\u56e0\u3002<\/strong><\/p>\n<p>\u5728\u6628\u5929\u7684\u4f1a\u8bae\uff0c\u69df\u5dde\u884c\u653f\u8bae\u5458\u51b3\u5b9a\u53d6\u6d88\u69df\u5dde\u56fd\u9635\u9093\u7ae0\u8000\u7684\u8d2d\u5730\u732e\u8bae\uff0c\u5373\u4ee52240\u4e077300\u4ee4\u5409\u8d2d\u4e70\u5c71\u7af9\u56ed1.1\u82f1\u4ea9\u5730\u6bb5\uff0c\u56e0\u4e3a\u4ed6\u4eec\u65e0\u6cd5\u7b26\u5408\u4e0b\u5217\u56db\u4e2a\u6761\u4ef6\uff1a<\/p>\n<p>\u2022        \u9093\u7ae0\u8000\u53ca\u69df\u5dde\u56fd\u9635\u6beb\u65e0\u8bda\u610f\u5174\u5efa\u4f9b\u51fa\u79df\u7684\u5ec9\u4ef7\u5c4b\uff08\u6216\u4eba\u6c11\u7ec4\u5c4b\uff09\uff0c\u56e0\u4e3a\u90b1\u6b66\u987a\u53d1\u8868\u4e86\u4e0d\u4e00\u81f4\u7684\u8a00\u8bba\uff0c\u6307\u4ed6\u4eec\u4e0d\u662f\u8981\u5174\u5efa\u4eba\u6c11\u7ec4\u5c4b\uff0c\u800c\u662f\u4ef7\u503c40\u4e07\u4ee4\u5409\u7684\u53ef\u8d1f\u62c5\u623f\u5c4b\u3002<br \/>\n\u2022      \u4ed6\u4eec\u6ca1\u6709\u5c06\u56fd\u9635\u623f\u5c4b\u53d1\u5c55\u516c\u53f8\uff0c\u5c71\u7af9\u56ed\u7b2c\u4e8c\u9636\u6bb5\u53d1\u5c55\u79c1\u4eba\u6709\u9650\u516c\u53f8\u7684\u8463\u4e8b\u53ca\u80a1\u4e1c\u6362\u6210\u9093\u7ae0\u8000\u53ca\u5176\u4ed6\u69df\u5dde\u56fd\u9635\u9886\u8896\uff0c\u5e76\u5411\u793e\u56e2\u6ce8\u518c\u5c40\u6ce8\u518c\uff0c\u56e0\u4e3a\u5dde\u653f\u5e9c\u53ca\u9093\u7ae0\u8000\u5df2\u7ecf\u540c\u610f\u662f\u69df\u5dde\u56fd\u9635\u4e70\u5730\u3002<br \u3002<\/p>\n<p>\u65e2\u7136\u69df\u5dde\u56fd\u9635\u58f0\u79f0\u4ed6\u4eec\u6709\u94b1\uff0c\u4e3a\u4ec0\u4e48\u4ed6\u4eec\u4e0d\u613f\u610f\u7f34\u8fd82240\u4e077300\u4ee4\u5409\u7ed9\u5dde\u653f\u5e9c\u65f6\uff0c\u8fd9\u8ba9\u4eba\u6000\u7591\u9093\u7ae0\u8000\u53ca\u69df\u5dde\u56fd\u9635\u7684\u8bda\u4fe1\uff0c\u662f\u4e0d\u662f\u6709\u8bda\u610f\u8981\u8d2d\u5730\u5174\u5efa\u5ec9\u4ef7\u5c4b\u7ed9\u4eba\u6c11\u7ec4\u5c4b\u3002\u5728\u5c71\u7af9\u56ed\u7b2c\u4e8c\u9636\u6bb5\u53d1\u5c55\u79c1\u4eba\u6709\u9650\u516c\u53f8\u8463\u4e8b\u90b1\u6b66\u987a\u4e8e11\u670829\u65e5\u5ba3\u5e03\uff0c\u5c71\u7af9\u56ed\u5730\u6bb5\u5c06\u7528\u6765\u5174\u5efa\u4ef7\u503c40\u4e07\u4ee4\u5409\u7684\u53ef\u8d1f\u62c5\u623f\u5c4b\uff0c\u800c\u4e0d\u662f\u4eba\u6c11\u7ec4\u5c4b\u65f6\uff0c\u9093\u7ae0\u8000\u7684\u8bda\u610f\u4e5f\u5907\u53d7\u7f6e\u7591\u3002<\/p>\n<p>\u9093\u7ae0\u8000\u53ef\u4ee5\u5982\u4f55\u4fdd\u8bc1\u90b1\u6b66\u987a\u6240\u5ba3\u5e03\u768440\u4e07\u53ef\u8d1f\u62c5\u623f\u5c4b\u4e0d\u4f1a\u5b9e\u884c\uff1f\u518d\u8bf4\uff0c\u9093\u7ae0\u8000\u8f83\u65e9\u524d\u5df2\u7ecf\u5bf9\u4e8e\u69df\u5dde\u5deb\u7edf\u6495\u6bc1\u6c11\u653f\u515a\u4e3b\u5e2d\u4e39\u65af\u91cc\u8bb8\u5b50\u6839\u7684\u8096\u50cf\uff0c\u8868\u8fbe\u6124\u6012\u53ca\u62d2\u7edd\u4ed6\u4eec\u5408\u4f5c\uff0c\u800c\u4e14\u5728\u69df\u5dde\u5deb\u7edf\u8fd8\u672a\u9053\u6b49\u7684\u60c5\u51b5\u4e0b\uff0c\u5982\u4eca\u7adf\u7136\u4e0e\u4ed6\u4eec\u5408\u4f5c\u6109\u5feb\u3002<\/p>\n<p>\u5dde\u653f\u5e9c\u4e0d\u80fd\u628a\u4e0a\u8ff0\u5730\u6bb5\u51fa\u552e\u7ed9\u69df\u5dde\u56fd\u9635\uff0c\u56e0\u4e3a\u5c71\u7af9\u56ed\u53d1\u5c55\u6709\u9650\u516c\u53f8\u7684\u8463\u4e8b\u6ca1\u6709\u51b3\u5fc3\u4fdd\u8bc1\u53ca\u5c55\u73b0\u4ed6\u4eec\u7edd\u4e0d\u98df\u8a00\u3001\u5fc5\u5b9a\u5174\u5efa\u4eba\u6c11\u7ec4\u5c4b\u7684\u8bda\u610f\u3002\u8fd9\u53ef\u4ee5\u4ece\u4e0a\u8ff0\u516c\u53f8\u7684\u8463\u4e8b\u5e76\u975e\u9093\u7ae0\u8000\u53ca\u56fd\u9635\u9886\u8896\u53ef\u4ee5\u770b\u51fa\u3002<\/p>\n<p>\u69df\u5dde\u56fd\u9635\u9886\u8896\u9093\u7ae0\u8000\u57282012\u5e7410\u67083\u65e5\u81f4\u51fd\u5dde\u653f\u5e9c\uff0c\u6307\u69df\u5dde\u56fd\u9635\u5df2\u7ecf\u63a5\u53d7\u69df\u5dde\u653f\u5e9c\u7684\u732e\u8bae\uff0c\u4ee5\u6bcf\u5e73\u65b9\u5c3a450\u4ee4\u5409\u8d2d\u5730\u4ee5\u5174\u5efa\u4eba\u6c11\u7ec4\u5c4b\u3002\u9093\u7ae0\u8000\u53ea\u57282012\u5e7410\u67083\u65e5\u4ee3\u8868\u69df\u5dde\u56fd\u9635\u4ed8\u4e861%\u621622\u4e074074\u4ee4\u5409\u7684\u5b9a\u91d1\u300210\u67084\u65e5\uff0c\u6211\u56de\u590d\u9093\u7ae0\u8000\u8bf4\uff0c\u5269\u4f59\u768499%\u62162218\u4e073227\u4ee4\u5409\u5fc5\u987b\u572830\u5929\u5185\u7f34\u6e05\uff0c\u540e\u6765\uff0c\u7f34\u6e05\u4f59\u6b3e\u7684\u5bbd\u9650\u671f\u5c55\u5ef6\u52302012\u5e7412\u67085\u65e5\u3002<\/p>\n<p>\u5dde\u653f\u5e9c\u8003\u8651\u8fc7\uff0c\u4e0a\u8ff0\u5730\u6bb5\u592a\u5c0f\u4e0d\u9002\u5408\u5174\u5efa\u516c\u5c4b\uff0c\u56e0\u4e3a\u623f\u5c4b\u53ca\u5730\u65b9\u90e8\u89c4\u5b9a\u81f3\u5c11\u97002\u82f1\u4ea9\u3002\u56e0\u6b64\uff0c\u5dde\u653f\u5e9c\u62e8\u51faSP\u9f50\u4e9a\u676511\u82f1\u4ea9\u5730\u6bb5\u6765\u5174\u5efa\u4eba\u6c11\u7ec4\u5c4b\uff0c\u8fd9\u662f\u524d\u6240\u672a\u6709\u7684\u3002\u5c71\u7af9\u56ed\u5730\u6bb5\u88ab\u516c\u5f00\u62db\u6807\u3001\u4ee5\u6bcf\u5e73\u65b9\u5c3a232\u4ee4\u5409\u6210\u4ea4\uff0c\u7528\u6765\u5174\u5efa\u79c1\u4eba\u533b\u9662\uff0c\u6210\u4ea4\u4ef7\u8fd8\u9ad8\u51fa\u8054\u90a6\u653f\u5e9c\u7684\u4f30\u4ef7\uff0c\u5373\u6bcf\u5e73\u65b9\u5c3a212\u4ee4\u5409\u3002<br
