BN Is Dishonest And A Political Cheat For Playing The Double-Faced Game Of Opposing The Privatisation Of Penang Port And Yet Allowing Seaport Terminal Sdn Bhd To Finalise The Takeover Of Penang Port By December This Year.<\/strong> <\/p>\n

BN is dishonest and a political cheat for playing the double-faced game of opposing the privatisation of Penang Port on the one hand and on the other hand allowing Seaport Terminal(Johor) Sdn Bhd(Seaport) to finalise the takeover of Penang Port by December this year. Unfortunately, it would appear that the federal government has given a letter of award without disclosing any details and providing any assurances to Penangites on the future of this public good. <\/p>\n

The BN federal government must come clean on the Penang Port privatisation exercise by confirming Seaport\u2019s director Datuk Mohd Sidik Shaik Osman statement in the New Straits Times on 2 August that Seaport has already received the letter of award and will be in charge by the end of this year. In that case what is the point of BN Penang opposing this privatisation exercise but is another fait accompli that not only deceives others but also oneself? <\/p>\n

Today Transparency International President Datuk Paul Low had slammed the privatisation exercise as violating the practices of good governance and transparency. He said awarding the contract to Seaport without an open competitive tender implies that the Federal government does not practice what it preaches on accountability and fighting corruption. Datuk Low even urged the Malaysian Anti-Corruption Commission(MACC) to look into allegations by the Penang Chinese Chamber of Commerce that the disposal of the Penang Port contravenes the Anti-Competition Act. <\/p>\n

Penangites have the right to know the terms of this deal, and whether this privatisation is nothing more than a piratisation exercise, as it involves an important public good that is the Penang Port. So far there have only been sketchy details with Datuk Mohd refusing to state the amount of capital injection by Seaport into Penang Port but with vague remarks of a capital expenditure of RM1 billion by 2017 and RM4.7 billion by 2022. <\/p>\n

Will the privatisation exercise be automatically terminated if Seaport fails to invest these sums of money? And why has Seaport refused to immediately undertake the RM353 million dredging of the port channel project? The Penang state government will only support the privatisation of Penang Port if it fulfils 5 principal conditions:-<\/p>\n

a) Conduct an open competitive tender and not a limited tender open only to those invited to make a bid.<\/p>\n

b) Clear and definite repudiation by the Finance Minister or Transport Minister of Penang Port Commission Chairman Datuk Seri Dr Chua Soi Lek\u2019s assertions that Penang Port will be a feeder port that will be secondary to Seaport\u2019s two other ports in Port of Tanjung Pelepas (PTP) and Pasir Gudang port;<\/p>\n

c) Immediate implementation of the RM 353 million project to dredge the port channel to at least 15-17 meters immediately before the privatisation is completed;<\/p>\n

d) Full public consultation with the stakeholders in the shipping industry, the Penang state government and the people of Penang;<\/p>\n

e) Public and complete disclosure of plans and of amounts invested by Seaport how this privatisation of a public good(Penang Port) can benefit Penangites and restore Penang Port into a world class regional commercial port <\/p>\n

All these lies, half-truths and empty promises are proof that the Penang Port privatisation exercise is going to go ahead without any disclosure of information and no assurances that the RM353 million dredging works will be carried out as promised in the 9th and 10th Malaysia Plans. Once again, the BN federal government has failed to keep the interests of Penangites at heart by going ahead with the privatisation of the Penang Port without providing guarantees that it will not end up as another piratisation exercise for private profit at the expense of public interest.<\/p>\n

BN tidak jujur dan berpolitik murahan dengan bermain talam dua muka berkaitan bantahan penswastaan Pelabuhan Pulau Pinang di satu sisi manakala satu sisi lagi membenarkan Seaport Terminal (Johor) Sdn Bhd (Seaport) untuk memuktamadkan pengambilalihan Pelabuhan Pulau Pinang menjelang Disember tahun ini. Malangnya ia muncul apabila Kerajaan Persekutuan telah memberi surat anugerah tanpa mendedahkan apa-apa maklumat dan memberikan apa-apa jaminan masa depan kepada penduduk Pulau Pinang berkaitan kepentingan awam ini.<\/p>\n

Kerajaan Persekutuan Barisan Nasional (BN) mesti tampil menjelaskan berkaitan penswastaan Pelabuhan Pulau Pinang berikutan kenyataan Pengarah Seaport Datuk Mohd Sidik Shaik Osman dalam akhbar News Straits Times pada 2 Ogos bahawa Seaport telah menerima surat anugerah dan akan melaksanakannya menjelang akhir tahun ini. Dalam kes ini, apakah motif Kerajaan Barisan Nasional membantah langkah penswastaan ini tetapi dalam satu lagi keadaan mereka bukan sahaja menipu orang lain tetapi juga diri sendiri?<\/p>\n

Hari ini, Presiden Transparency International, Datuk Paul Low telah mengecam langkah penswastaan sebagai melanggar amalan urus tadbir yang baik dan telus. Beliau berkata penganugerahan kontrak kepada Seaport tanpa melalui tender terbuka secara kompetitif menunjukkan bahawa Kerajaan Persekutuan tidak pernah mengamalkan apa yang disarankan berkaitan akauntabiliti dan melawan rasuah. Datuk Low menggesa Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) untuk melihat dakwaan oleh Dewan Perniagaan Pulau Pinang bahawa pelupusan Pelabuhan Pulau Pinang telah melanggar Akta Anti- Persaingan.<\/p>\n

Rakyat Pulau Pinang mempunyai hak untuk mengetahui terma-terma perjanjian ini dan sama ada penswastaan ini tidak lebih daripada menjalankan pelanunan kerana ia melibatkan kepentingan awam. Setakat ini terdapat hanya butiran tidak lengkap telah diterima dan Datuk Mohd enggan menyatakan jumlah suntikan modal oleh Seaport kepada Pelabuhan Pulau Pinang tetapi secara kasar perbelanjaan modal adalah sebanyak RM1 bilion menjelang 2017 dan RM4.7 bilion menjelang 2022.<\/p>\n

Adakah penswastaan ini akan secara automatik ditamatkan jika Seaport gagal untuk melabur sejumlah wang? Dan mengapa Seaport enggan untuk segera melaksanakan pengorekan RM353 juta projek saluran pelabuhan ini? Kerajaan Negeri Pulau Pinang hanya akan menyokong penswastaan Pelabuhan Pulau Pinang jika ia memenuhi 5 syarat utama :-<\/p>\n

a)Mengadakan tender terbuka secara kompetitif dan bukannya tender yang terhad kepada mereka yang dijemput untuk membuat tawaran<\/p>\n

b)Jelas dan pastikan sangkalan daripada Menteri Kewangan atau Menteri Pengangkutan terhadap dakwaan Pengerusi Penang Port Commission Datuk Seri Dr Chua Soi Lek bahawa Pelabuhan Pulau Pinang akan dijadikan pelabuhan penghantar yang akan memainkan peranan sokongan keapda dua pelabuhan lain iaitu Pelabuhan Tanjung Pelepas (PTP) dan Pelabuhan Pasir Gudang<\/p>\n

c)Pelaksanaan segera peruntukan RM353 juta untuk mengorek saluran pelabuhan kepada sekurang-kurangnya 15-17 meter dengan segera sebelum penswastaan dijalankan<\/p>\n

d)Rundingan awam dijalankan sepenuhnya dengan pihak-pihak yang berkepentingan di dalam industri perkapalan, Kerajaan Negeri Pulau Pinang dan rakyat Pulau Pinang.<\/p>\n

e)Mendedahkan butiran dan pelan yang lengkap serta jumlah pelaburan Seaport, dan bagaimana penswastaan Pelabuhan Pulau Pinang ini boleh memberi manfaat kepada penduduk Pulau Pinang dan mengembalikan status Pelabuhan Pulau Pinang kepada pelabuhan komersial serantau yang bertaraf dunia.<\/p>\n

Semua pembohongan, janji separuh benar dan janji-janji kosong ini adalah bukti bahawa penswastaan Pelabuhan Pulau Pinang akan diteruskan tanpa mendedahkan mana-mana maklumat dan tiada jaminan bahawa kerja-kerja pengorekan RM353 juta akan dijalankan seperti yang telah dijanjikan dalam Rancangan Malaysia ke-9 dan ke-10. Sekali lagi, Kerajaan Persekutuan Barisan Nasional telah gagal untuk menjaga kepentingan penduduk Pulau Pinang dengan meneruskan penswastaan Pulau Pinang tanpa memberikan jaminan bahawa ia tidak akan berakhir dengan satu lagi pelanunan demi keuntungan peribadi dan mengorbankan kepentingan awam.<\/p>\n
