As instructed by the Penang Chief Minister YAB Tuan Lim Guan Eng, MPPP is making public the concession agreement for the BOT of the above 3 project facilities known collectively as the Penang\u2019s People\u2019s Park that would yield a 7 acres green public park free for the public.<\/p>\n<p>2.         The Concession Agreement has been signed on 19\/08\/2011 between MPPP and Eco Meridian Sdn Bhd (EMSB), a wholly owned subsidiary of S.P Setia as the Concessionaire of the Project Facilities. The Concession Agreement has been duly stamped on 24\/08\/2011.<\/p>\n<p><!--more-->3.         Kindly find as stated below the brief facts on the terms and conditions of the Agreement. sPICE will consist of :<br \/>\n(I)        an exhibition hall<br \/>\n(ii)        ball room<br \/>\n(iii)       grand foyer &#038;<br \/>\n(iv)       complementary retail outlets.<\/p>\n<p>4.         Anticipated Costs For the Project.<br \/>\nThe anticipated project costs to be borne by the Concessionaire (EMSB) is at least RM250,955,259.00 which could rise up to RM 300 million and includes the refurbishment and rectification works costs for existing PISA Indoor Stadium and existing PISA  Aquatic Centre. SP Setia Group Berhad has given a performance security in a form of corporate guarantee worth RM10 million upon signing of the Agreement.<\/p>\n<p>5.         Concession\/ Lease Period<br \/>\n            Concession\/lease period of the project facilities is from the date of signing of the Agreement up   to a period of 30 years commencing from the concession period. EMSB is entitle to apply for  a   renewal of  the lease for a two(2) further terms of 15 years each in the event of an extension or    further extension.<\/p>\n<p>6.         Project Completion Date<br \/>\n            The scheduled project completion date is 36 months from the commencement date. EMSB shall            be liable to pay to MPPP an agreed liquidated damages for the delay in the completion of the          Project Facilities at the rate of RM20,000 per day of delay.<\/p>\n<p>7.         Sale of Hotel Site in order to complement the Project Facilities<br \/>\nMPPP agrees to sell and transfer a part of Lot 7481 to EMSB for the purpose of a Hotel site      with leasehold title 99 years. The purchase price of the Hotel site is RM13,669,980.00       calculated based on an agreed rate of RM100.00 per square foot. A Sale and Purchase              Agreement has been signed between the parties on 19\/08\/2011.<\/p>\n<p>8.         Grant of Development Rights<br \/>\nMPPP agrees to grant to EMSB the right to Additional Density of any developments within   the island of Pulau Pinang over and above the maximum permissible density for the land,    provided always that the total sum of such development rights utilized and spread over all projects within the island of Pulau Pinang does not exceed 1,500 residential units(note that this is not additional 1,500 residential units per project but spread out throughout the island during the concession period). Should EMSB not be able to source land able to absorb the additional 1,500 residential units spread out throughout the island, then EMSB shall forfeit these rights at no cost to MPPP. Such development rights are only exercisable during the concession period and if the development rights are not completely exercised by the end of the concession period or prior to any early termination, the balance portion shall lapsed. <\/p>\n<p>9.         Low Medium Costs Housing Units<br \/>\nEMSB to construct 450 of LMC housing units which shall not exceed RM72,500 for the 1,500 residential units and the State Authority shall provide a piece of land for the purpose of the same.<\/p>\n<p>10.       Vacant Possession<br \/>\n            Vacant possession of the Project site shall be on 31\/10\/2011.<\/p>\n<p>11.       Progress Reports<br \/>\n            EMSB shall during the implementation period furnish to MPPP monthly progress reports in  regards to the construction of the Project Facilities .<\/p>\n<p>12.       No Dealings<br \/>\n            EMSB shall not transfer, charge, lease or deal with the Project site. <\/p>\n<p>13.       Annual Event Days<br \/>\n            MPPP and the State Government shall have access to and use of the Project Facilities for all                  purposes necessary or incidental to its functions for a combined maximum period of 42 event        days in  a calendar year free of charge.<\/p>\n<p>14.       Traffic Impact AssessmentA (TIA)<br \/>\n            A TIA of the area has to be carried out at and complied with.<\/p>\n<p>15.       Penang People\u2019s Park(PPP)<br \/>\nPPP will fulfill Penang\u2019s aspirations to be an international and intelligent city that is a location of choice for investors, a destination of choice for tourists and habitat of choice for sustainable living comprising 5 key important portions:-<br \/>\n1. RM300 million sPICE;<br \/>\n2. A new 7 acre public park<br \/>\n3. Refurbished, repaired and upgraded Penang International Sports Arena(PISA);<br \/>\n4. Refurbished, repaired and upgraded Aquatic Centre;<br \/>\n5. A new hotel and retail outlets and additional car park.<\/p>\n<p>&#8212;&#8212;&#8211; Mandarin Translation &#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>\u69df\u57ce\u4eba\u6c11\u516c\u56ed\u57fa\u7840\u8bbe\u65bd\u7684\u5efa\u8bbe- \u8fd0\u8425- \u8f6c\u8ba9\uff08B.O.T\uff09\u7684\u7279\u8bb8\u5408\u7ea6\u5185\u5bb9\u7b80\u4ecb\uff08\u7531\u69df\u5c9b\u5e02\u653f\u5c40\u6cd5\u5f8b\u7ec4\u51c6\u5907\uff09\uff1a<\/p>\n<p> (I)        \u5730\u4e0b\u5f0f\u69df\u57ce\u56fd\u9645\u4f1a\u5c55\u4e2d\u5fc3 (sPICE) \u53ca\u96f6\u552e\u5546\u94fa\u3001\u996e\u98df\u5e97\u94fa\u3001\u529e\u516c\u5ba4<br \/>\n (II)       \u69df\u57ce\u6e56\u5185\u56fd\u9645\u5ba4\u5185\u4f11\u80b2\u9986\uff08PISA\uff09\u7ffb\u65b0\u53ca\u6574\u4fee<br \/>\n(III)       \u69df\u57ce\u6e56\u5185\u56fd\u9645\u5ba4\u5185\u6c34\u4e0a\u4f11\u80b2\u4e2d\u5fc3\uff08PISA\uff09\u7ffb\u65b0\u53ca\u6574\u4fee<\/p>\n<p>1.         \u5728\u69df\u5dde\u9996\u957f\u6797\u51a0\u82f1\u7684\u6307\u793a\u4e0b\uff0c\u69df\u5c9b\u5e02\u653f\u5c40\u5728\u6b64\u516c\u5e03\u4e0a\u8ff0\u4e09\u9879\u8ba1\u5212\u7684\u5efa\u8bbe-\u8fd0\u8425-\u8f6c\u8ba9\u7279\u8bb8\u5408\u7ea6\u5185\u5bb9\uff0c\u4e0a\u8ff0\u5de5\u7a0b\u4e5f\u79f0\u69df\u57ce\u4eba\u6c11\u516c\u56ed\uff0c\u4e3a\u516c\u4f17\u63d0\u4f9b7\u82f1\u4ea9\u7684\u7eff\u8272\u7a7a\u95f4\u3002<\/p>\n<p>2.\t\u4e0a\u8ff0\u7279\u8bb8\u5408\u7ea6\u4e8e2011\u5e748\u670819\u65e5\u7531\u69df\u5c9b\u5e02\u653f\u5c40\u53ca\u5b9e\u8fbe\u96c6\u56e2\u5b50\u516c\u53f8Eco Meridian \u79c1\u4eba\u6709\u9650\u516c\u53f8\u7b7e\u7f72(EMSB), \u5b9e\u8fbe\u96c6\u56e2\u662f\u4e0a\u8ff0\u8bbe\u65bd\u7684\u7279\u8bb8\u7ecf\u8425\u516c\u53f8\u3002\u6709\u5173\u5408\u7ea6\u5df2\u7ecf\u4e8e2011\u5e748\u670824\u65e5\u76d6\u7ae0\u751f\u6548\u3002<\/p>\n<p>3.         \u4ee5\u4e0b\u662f\u5408\u7ea6\u6761\u4ef6\u534f\u8bae\u7684\u6982\u62ec\u5185\u5bb9\uff0c\u4f1a\u5c55\u4e2d\u5fc3\u5c06\u5305\u62ec\uff1a<br \/>\n(I)        \u5c55\u89c8\u5385<br \/>\n(ii)        \u5927\u5bb4\u4f1a\u5385<br \/>\n(iii)       \u5927\u524d\u5385<br \/>\n(iv)       \u96f6\u552e\u5546\u94fa<\/p>\n<p>4.         \u5de5\u7a0b\u9884\u4f30\u6210\u672c<br \/>\n\u4e0a\u8ff0EMSB\u7279\u8bb8\u7ecf\u8425\u7684\u9884\u4f30\u6210\u672c\u662f\u81f3\u5c112\u4ebf5095\u4e075259\u4ee4\u5409\uff0c\u53ef\u80fd\u4e0a\u5347\u81f33\u4ebf\u4ee4\u5409\uff0c\u5de5\u7a0b\u5305\u62ec\u73b0\u6709\u7684\u6e56\u5185\u56fd\u9645\u5ba4\u5185\u4f53\u80b2\u9986\u53ca\u6c34\u4e0a\u4f53\u80b2\u7684\u7ffb\u65b0\u53ca\u7ef4\u4fee\u5de5\u7a0b\u3002\u5b9e\u8fbe\u96c6\u56e2\u516c\u53f8\u5df2\u7ecf\u5728\u7b7e\u7f72\u534f\u8bae\u65f6\uff0c\u7f34\u4ed8\u4e86\u4e00\u7b141000\u4e07\u4ee4\u5409\u7684\u4f01\u4e1a\u5c65\u7ea6\u4fdd\u8bc1\u91d1\u3002<\/p>\n<p>5.         \u7279\u8bb8\u79df\u8d41\u671f\u9650<br \/>\n           \u4e0a\u8ff0\u8bbe\u65bd\u7684\u7279\u8bb8\u53ca\u79df\u8d41\u671f\u9650\u4e3a30\u5e74\uff08\u4ece\u5408\u7ea6\u7b7e\u7f72\u7684\u65e5\u671f\u5f00\u59cb\u7b97\u8d77\uff09\u3002EMSB \u53ef\u4ee5\u7533\u8bf7\u66f4\u65b0\u79df\u8d41\u4e24\u6b21\uff0c\u6bcf\u6b21\u66f4\u65b0\u671f\u9650\u4e3a15\u5e74<\/p>\n<p>6.         \u5de5\u7a0b\u5b8c\u5de5\u65e5\u671f<br \/>\n            \u5de5\u7a0b\u9884\u8ba136\u4e2a\u6708\u5185\u5b8c\u5de5\u3002\u5982\u679c\u5de5\u7a0b\u65e0\u6cd5\u5982\u671f\u5b8c\u5de5\uff0cEMSB\u5c06\u652f\u4ed8\u89c4\u5b9a\u7684\u8fdd\u7ea6\u507f\u91d1\u7ed9\u69df\u5c9b\u5e02\u653f\u5c40\uff0c\u6bcf\u5ef6\u8fdf\u4e00\u5929\u4ed82\u4e07\u4ee4\u5409\u3002<\/p>\n<p>7.         \u51fa\u552e\u9152\u5e97\u5730\u6bb5\u4ee5\u8865\u52a9\u5174\u5efa\u8bbe\u65bd\u7ecf\u8d39<br \/>\n\u69df\u5c9b\u5e02\u653f\u5c40\u540c\u610f\u51fa\u552e\u53ca\u8f6c\u79fbLot 7481\u5730\u6bb5\u7ed9EMSB\uff0c\u505a\u4e3a\u9152\u5e97\u5730\u6bb5\uff0c\u79df\u8d41\u671f99\u5e74\u3002\u4e0a\u8ff0\u9152\u5e97\u5730\u6bb5\u7684\u51fa\u552e\u4ef7\u683c\u4e3a\u6bcf\u5e73\u65b9\u516c\u5c3a100\u4ee4\u5409\uff0c\u603b\u5171\u4e3a1366\u4e079980\u4ee4\u5409\u3002\u53cc\u65b9\u5df2\u7ecf\u57282011\u5e748\u670819\u65e5\u7b7e\u7f72\u4e70\u5356\u5408\u7ea6\u3002 <\/p>\n<p>8.         \u6388\u4e88\u53d1\u5c55\u6743<br \/>\n\u69df\u5c9b\u5e02\u653f\u5c40\u540c\u610f\u6388\u6743\u7ed9EMSB\uff0c\u8ba9\u4ed6\u4eec\u63d0\u9ad8\u69df\u5c9b\u53d1\u5c55\u9879\u76ee\u7684\u623f\u5c4b\u5355\u4f4d\u5bc6\u5ea6\uff0c\u8d85\u8d8a\u5f53\u5c40\u89c4\u5b9a\u7684\u6700\u9ad8\u5bc6\u5ea6\uff0c\u867d\u7136\u53d1\u5c55\u5546\u62e5\u6709\u8fd9\u9879\u53d1\u5c55\u6743\u5229\uff0c\u53ef\u662f\u904d\u5e03\u5168\u5c9b\u53d1\u5c55\u9879\u76ee\u53ef\u589e\u52a0\u7684\u623f\u5c4b\u5355\u4f4d\u4e0d\u80fd\u8d85\u8fc71500\u4e2a \uff08\u6ce8\u610f\uff1a\u8fd9\u4e0d\u662f\u6307\u6bcf\u4e2a\u9879\u76ee\u53ef\u4ee5\u989d\u5916\u5174\u5efa1500\u4e2a\u5355\u4f4d\uff0c\u800c\u662f\u5728\u7279\u8bb8\u7ecf\u8425\u671f\u5185\u5168\u5c9b\u53ef\u589e\u52a0\u7684\u623f\u5c4b\u603b\u6570\u3002\uff09\u5982\u679cEMSB\u65e0\u6cd5\u627e\u5230\u571f\u5730\uff0c\u5c06\u4e0a\u8ff01500\u4e2a\u623f\u5c4b\u5355\u4f4d\u5e76\u5165\u4ed6\u4eec\u7684\u53d1\u5c55\u8ba1\u5212\uff0c\u5c4a\u65f6\uff0cEMSB\u5c06\u88ab\u4e27\u5931\u8fd9\u9879\u6743\u5229\uff0c\u69df\u5c9b\u5e02\u653f\u5c40\u65e0\u9700\u652f\u4ed8\u4efb\u4f55\u8d39\u7528\u3002\u4ed6\u4eec\u53ea\u53ef\u4ee5\u5728\u7279\u8bb8\u7ecf\u8425\u671f\u5185\u884c\u4f7f\u4ed6\u4eec\u7684\u6743\u5229\uff0c\u5982\u679c\u4ed6\u4eec\u65e0\u6cd5\u5728\u7279\u8bb8\u7ecf\u8425\u671f\u5185\u884c\u4f7f\u4ed6\u4eec\u7684\u53d1\u5c55\u6743\uff0c\u6216\u63d0\u524d\u4e2d\u6b62\uff0c\u4e58\u4f59\u7684\u90e8\u5206\u81ea\u52a8\u5931\u6548\u3002 \u7981\u6b62\u5de5\u5730\u4e70\u5356<br \/>\n            EMSB \u4e0d\u80fd\u9488\u5bf9\u5de5\u7a0b\u5730\u6bb5\u8fdb\u884c\u8f6c\u79fb\u3001\u6536\u8d39\u3001\u51fa\u79df\u53ca\u4e70\u5356\u3002 <\/p>\n<p>13.       \u5e74\u5ea6\u6d3b\u52a8\u65e5<br \/>\n            \u5982\u679c\u69df\u5c9b\u5e02\u653f\u5c40\u548c\u5dde\u653f\u5e9c\u9700\u8981\u8fdb\u884c\u6d3b\u52a8\uff0c\u6211\u4eec\u6709\u6743\u514d\u8d39\u4f7f\u7528\u4e0a\u8ff0\u8bbe\u65bd\u9ad8\u8fbe 42\u5929\u3002<\/p>\n<p>14.       \u4ea4\u901a\u5f71\u54cd\u8bc4\u4f30 \uff08TIA\uff09<br \/>\n            \u5f53\u5c40\u5c06\u8fdb\u884c\u8bc4\u4f30\uff0c \/>\n\u69df\u57ce\u4eba\u6c11\u516c\u56ed\u5c06\u4f1a\u6ee1\u8db3\u69df\u57ce\u6210\u4e3a\u56fd\u9645\u53ca\u667a\u80fd\u90fd\u5e02\u7684\u613f\u666f\uff0c\u5373\u6210\u4e3a\u6295\u8d44\u8005\u7684\u9996\u9009\u5730\u3001\u6e38\u5ba2\u7684\u65c5\u6e38\u80dc\u5730\u53ca\u6e34\u671b\u6c38\u7eed\u751f\u6d3b\u7684\u7406\u60f3\u5bb6\u56ed\uff0c\u6db5\u76d65\u4e2a\u91cd\u8981\u7684\u90e8\u5206\uff1a<\/p>\n<p>1\uff09.
