Not Only Inspector-General of Police Khalid Abu Bakar but Home Minister Ahmad Zahid Hamidi should also resign if the IGP can refuse to comply with civil court children custodial orders, permitting the criminal deaths of those under police custody to continue and condoning violent acts by pro-BN gangsters. The IGP has caused outrage when he stated that the police would remain neutral in cases where there are conflicting judgements between syariah and civil courts regarding the custody of children.

The two civil court orders that the children be returned to the mother involve M Indira Gandhi against her ex-spouse Muhammad Ridhuan Abdullah in Ipoh, and the case of S Deepa against her ex-spouse Izwan Abdullah in Seremban. To avoid being “sandwiched” by a conflicting syariah court order that gave custody to the Muslim husband convert, the IGP said the police will choose the middle path by not enforcing the two civil court orders and instead placing the children in childcare centres.

This is a dangerous and unconstitutional first step initiated by the police that undermines and subvert the secular basis of the Federal Constitution by refusing to comply with a civil court order. Never in Malaysian history has the police openly defied civil court orders by refusing to enforce them. This will not only result in lawlessness but may lead in future cases for the police to act selectively.

Now, the police has taken the dangerous first step by refusing to comply with the civil court order. What is there to stop the police from then acting selectively in future by only complying with the syariah court orders and not the civil court orders?

The IGP must be reminded that our Federal Constituion is secular in nature and right from its inception during Merdeka, the police is empowered to carry out and enforce civil court orders. If Khalid fails to understand this basic constitutional duty to uphold the law, then he is not fit to be the IGP and should resign immediately.

For powerless and ineffective political parties like MCA calling for Khalid’s resignation, would MCA pull out from BN if Home Minister Ahmad Zahid Hamidi refuses to force the IGP’s resignation? And yet MCA leaders have no honour and dignity by being so hard up for the perks and privileges of office of a Cabinet Minister, when civil servants can disobey them and treat them with utter contempt!

The time has come for Khalid to also resign for failing to stop police custodial deaths of those detained in lockups from continuing. The latest happened a few days ago in Penang bringing the number of police custodial deaths involving Penang to seven cases this year, and ten nationwide. By blaming the police custodial deaths on the health of the victim is not only an abdication of responsibility but also indicates that the custodial deaths will only persist, continuing this inhuman cruelty and sorrow to many helpless families.

Further the IGP has also condoned acts of violence by UMNO gangsters against PR leaders by failing to take stern action against them. Many of these UMNO gangsters continue their violent acts because of the failure of the police to act against them at the first instance. Ahmad Zahid Hamidi should bear full responsibility for politicizing the police force.

After all what moral authority as Ahmad Zahid Hamidi to act against police inaction or wrongdoing when he himself can condone threats by UMNO gangsters to reward those who slapped Seputih MP Teresa Kok is not criminal in nature and calling the Chinese as ungrateful for not supporting BN?

如果作为全国总警长的卡立阿布峇卡可以公然拒绝遵从民事法庭判决的儿童抚养权归属、三番四次地让扣留犯在警方管控范围内死亡,以及纵容支持国阵的流氓到处撒野,那么,不止他要立刻辞职谢罪,就连内政部长阿末扎希也应当引咎下台。身为全国总警长,在面对伊斯兰法庭与民事法庭相关儿童监护权的判决冲突时,竟表明警方要保持中立,此番言论已犯下众怒。

针对霹雳及森美兰的两起孩童抚养权争夺案,两地民事法庭最终皆判决孩子归母亲所有,胜诉的母亲包括来自怡保的英迪拉甘地,以及芙蓉的迪帕。她们分别从穆斯林丈夫莫哈默以及伊斯旺手上,夺回了孩子的抚养权。不过,总警长却说,基于伊斯兰法庭将孩子的抚养权判予改信穆斯林的丈夫,为避免成为“三明治”,警方将采取中立态度,即不执行民事法庭发出的谕令,改为将孩子置于托儿所。

警方采取此举是危险且违宪的,他们拒绝遵从民事法庭的谕令,将会摧毁奉行世俗的联邦宪法。在我国历史上,从未出现警方公然违抗庭令并拒绝执行法庭的指示。这不仅削弱了法律的力量,未来更将促使警方可恣意的选择性执法。

现在,警方拒绝遵从民事法庭的判决,已经展开了危险的第一步,未来,我们该如何停止警方选择性执法,即只奉伊斯兰法庭为圭臬,却无视于民事法庭的判决?

全国总警长必须清楚了解,我国联邦宪法的本质是以世俗为基础,自独立以降,我们一直维持如此的状况,而警方则被赋权来执行民事法庭的庭令。如果卡立阿布峇卡不了解宪法赋予他的职责来维持法治,那么,他不再适任总警长一职,应当马上离职。

至于那些卑微无力的政党如马华,尽管力促卡立辞职谢罪,但如果内长阿末扎希拒绝命令总警长辞职,马华是否敢于退出国阵以示抗议?马华领袖若无法挺起腰杆,任由公仆为所欲为,那何来荣誉与尊严?

时至今日,总警长不应再留在这职位上,另一个原因是因为扣留犯一而再地在警局内毙命。几天前,槟州再次发生这样的悲剧,导致今年州内类似的案件增加至7宗,全国则为第10宗。警方把问题归咎于扣留犯的个人健康问题,无疑是在推卸责任,若不正面以对,这样残酷的事情只会周而复始的上演,让更多无助的家庭徒然悲哀。

除此之外,总警长也纵容巫统的流氓多番对民联领袖行使暴力,面对流氓,总警长竟采取绥靖立场,姑息以待。因警队失灵,造成了这些巫统流氓目中无人,持续恣意地行使暴力。对于此事,阿末扎希应该负上全责,因为是他政治化了我们的警队。

当巫统流氓鼓动别人赏士布爹区国会议员郭素沁巴掌时,而阿末扎希却能无动于衷,以不触法为由来纵容他们的所为;华人只因不支持国阵而被遭内长指责为不懂感恩,凡此种种,试问,阿末扎希还有什么道德立场来指责做错事的警队?
