<p><strong>DAP Is Big Enough For Tunku Abdul Aziz To Remain As National Vice-Chair And Accomodate His Irreconciliable Differences With The DAP On Bersih’s Quest To Conduct A Sit-In Protest In Dataran Merdeka To Press For Clean Elections.</strong></p>
<p>When announcing his resignation from DAP, Senator Tunku Abdul Aziz Tunku Ibrahim cited “irreconcilable differences” with the party leadership in dissenting with DAP’s official position to support Bersih 3.0 to conduct a peaceful sit-in protest in Dataran Merdeka to press for clean, free and fair elections. DAP is big enough for Tunku Abdul Aziz to remain as National Vice-Chair and accomodate his” irreconciliable differences” with the DAP on Bersih’s quest to conduct a sit-in protest in Dataran Merdeka to press for clean elections</p>
<p><span id="more-2312"></span>Malaysiakini reported Tunku Abdul Aziz as saying his open disagreement with DAP made Tunku himself choose not to be re-nominated as a senator for Penang when his term expired on 30 May 2012, and stated that he was not sacked from his Dewan Negara&#8217;s post by DAP. Tunku Aziz had also suggested to the party leadership that DAP should subject him to the &#8220;same disciplinary procedure as any other party member&#8221; for his dissent. As disciplinary action from DAP was not forthcoming he had decided to resign from the DAP to avoid further embarrassment.</p>
<p>I would like to express my sadness at Tunku’s announcement. DAP believes in freedom of speech and that every member and leader has a right to differ. I don&#8217;t agree that any disciplinary action should be taken against Tunku for differing with the party on Bersih&#8217;s right to do the sit-in protest in Dataran Merdeka.</p>
<p>Indeed there was general unhappiness at all levels in the party that he openly went against the party official position on Bersih before the rally on 28 April and also after. However, just as Tunku has the right to openly voice his dissent, the party’s right to state its position on such a fundamental policy position as Bersih must also be respected. The party did not punish Tunku for voicing his dissent openly nor at any stage asked him to leave or resign.</p>
<p>I feel sad about Tunku wanting to leave the party because of differences over Bersih. After all Tunku had joined DAP because DAP offered a platform to promote integrity and fight corruption. DAP’s performance in government after winning power in Penang in 2008 has been walking the talk in promoting integrity and fighting corruption.</p>
<p>Penang Pakatan Rakyat has taken the lead with open competitive tenders, open disclosure of government contracts and public declaration of assets by leaders. Not only Transparency International and the Auditor-General Report praised Penang’s financial performance, even former MCA President Tun Dr Ling Liong Sik praised Penang for performing well and been clean from corruption.</p>
<p>Despite Tunku open dissent, the DAP leadership does not want him to leave the party but remain as DAP Vice-Chair. I hope we can resolve whatever differences within the party in the spirit of comradeship. I will contact Tunku to see him to discuss with him and hope he can change his mind about leaving the party.</p>

<p><strong>DAP Memberi Ruang Yang Luas Dan Tempat Untuk Tunku Abdul Aziz Sebagai Naib Pengerusi Kebangsaan Serta Boleh Menerima Perbezaan Pendapat Dengan DAP Berkenaan Usaha Bersih Untuk Membuat Protes “Duduk-Bantah” Di Dataran Merdeka Untuk Menuntut Pilihan Raya Bersih.</strong></p>
<p>Apabila mengumumkan perletakan jawatannya daripada DAP, Senator Tunku Abdul Aziz Tunku Ibrahim telah menyatakan “perbezaan pendapat” sebagai sebab, atas perselisihan dengan pendirian rasmi DAP untuk menyokong Bersih 3.0 dan menyertai protes “duduk-bantah” di Dataran Merdeka untuk menuntut pilihan raya bersih, bebas dan adil. DAP memberi ruang yang luas dan tempat untuk Tunku Abdul Aziz untuk kekal sebagai Naib Pengerusi Kebangsaan serta boleh menerima perbezaan pendapat dengan DAP atas usaha Bersih untuk membuat protes “duduk-bantah” di Dataran Merdeka untuk menuntut pilihan raya bersih.</p>
<p>Mengikut laporan Malaysiakini, Tunku Abdul Aziz telah menyatakan bahawa akibat perselisihan pendapat secara terbuka dengan DAP, beliau sendiri tindak ingin dicalonkan semula sebagai senator Pulau Pinang selepas tamat tempoh perkhidmatannya pada 30 Mei 2012, dan juga menyatakan bahawa beliau tidak diberhentikan daripada jawatannya dalam Dewan Negara oleh DAP. Tunku Aziz juga telah mencadangkan kepada pimpinan parti supaya “mengambil tindakan tatatertib yang setimpal dengan ahli-ahli lain” kerana menyuarakan pendapatnya yang berbeza. Oleh sebab tindakan tatatertib tidak diambil, beliau mengambil keputusan untuk letak jawatan daripada DAP untuk mengelakkan malu.</p>
<p>Saya ingin menyatakan kedukacitaan terhadap pengumuman Tunku. DAP percaya dalam prinsip kebebasan untuk bersuara dan setiap ahli dan pemimpin mempunyai hak untuk berbeza pendapat. Saya tidak setuju bahawa tindakan tatatertib harus diambil ke atas Tunku kerana berbeza pendapat dengan parti atas hak Bersih untuk melakukan protes “duduk-bantah” di Dataran Merdeka.</p>
<p>Sememangnya terdapat rasa tidak puas hati di kalangan ahli-ahli parti di setiap tahap kerana beliau telah mengambil pendirian terbuka yang bertentangan dengan parti dalam isu Bersih sebelum dan juga selepas perhimpunan pada 28 April. Namun begitu, jika Tunku berhak untuk menyuarakan pendapatnya yang berbeza, hak parti untuk menyatakan pendirian dalam isu dasar yang asas ini harus dihormati juga. Parti tidak sesekalipun mengambil apa-apa tindakan terhadap Tunku kerana menyuarakan perbezaan pendapatnya atau pun meminta agar beliau keluar atau letak jawatannya.</p>
<p>Saya berasa dukacita kerana Tunku ingin keluar dari parti disebabkan perbezaan pendapat dalam isu Bersih. Hakikatnya, Tunku telah memasuki DAP kerana DAP menawarkan pentas untuk mempromosikan integriti dan melawan rasuah. Prestasi DAP dalam kerajaan selepas mengambil alih Pulau Pinang pada tahun 2008 jelas telah membuktikan bahawa kami mempromosikan integriti dan melawan rasuah.</p>
<p>Pakatan Rakyat Pulau Pinang telah mempelopori usaha integriti dan anti-rasuah melalui tender terbuka, pendedahan terbuka kontrak-kontrak kerajaan dan pengisytiharan harta oleh pemimpin-pemimpin. Bukan sahaja Transparency International malah Laporan Ketua Audit Negara juga telah memuji prestasi kewangan Pulau Pinang. Bahkan bekas presiden MCA Tun Dr Ling Liong Sik juga telah memuji Pulau Pinang kerana prestasi yang baik dan bersih daripada rasuah.</p>
<p>Walaupun beliau telah berbeza pendapat secara terbuka, kami tidak ingin beliau meninggalkan parti dan sebaliknya ingin beliau terus menjadi Naib Pengerusi DAP. Saya harap kita boleh menyelesaikan apa-apa perbezaan pendapat secara dalaman dan dengan semangat kesetiakawanan. Saya akan menghubungi beliau untuk berjumpa dan berbincang dengannya atas harapan beliau akan bertukar fikiran dan tidak keluar dari parti.</p>

<p>民主行动党秘书长兼槟州首席部长林冠英于2012年5月15日在乔治市发表声明：</p>
<p><strong>民主行动党有足够的空间容纳东姑阿都阿兹继续成为全国副主席，并容纳他与行动党之间，针对净选盟要求在独立广场静坐抗议不能妥协的歧见。</strong></p>
<p>上议员东姑阿都阿兹敦姑依布拉欣在退党时，他指出他与行动党领导层存有“不能妥协的歧见”，他不同意行动党的正式立场，即支持净选盟3.0在独立广场静坐抗议、要求更干净、自由及公平的选举。行动党有足够的空间容纳东姑阿都阿兹继续成为全国副主席，并容纳他与行动党之间，针对净选盟要求在独立广场静坐抗议不能妥协的歧见。</p>
<p>《当今大马》报道说，东姑阿都阿兹说由于他公开反对行动党，以致他自己选择不再被提名成为槟州的上议员，同时指出他的上议员职位并不是被行动党所开除。东姑阿兹也建议党领袖应该就他的不同意见，像对待其他党员一样，对他采取纪律行动。由于行动党并没有对他采取纪律行动，他决定退党以避免更多的难堪情况。</p>
<p>我对于东姑退党的宣布表示难过。行动党相信言论自由，每一个党员及领袖都可以拥有不同声音。我不赞同为了东姑反对行动党支持净选盟在独立广场静坐抗议的立场，而对他采取纪律行动。</p>
<p>东姑在428净选盟集会前后皆公开反对行动党的正式立场，确实让党内各阶级都觉得不快。但是，正如东姑有权公开说明他不认同党的立场，行动党针对净选盟的基本政策立场也必须被尊重。行动党没有因为东姑的言论立场而惩罚他，也没有任何人要求他离开或辞职。</p>
<p>对于东姑因为对竞选盟运动的立场分歧而要退党，我感到很难过。东姑加入行动党是因为行动党提供一个提倡廉洁及打击贪污的平台。行动党在2008年执政槟州后，在提倡廉洁及打击贪污方面实现了讲到做到的执政表现。</p>
<p>槟州民联政府在公开招标、公开政府合约及公开申报领袖资产方面取得领先的地位。不只国际透明组织及国家稽查报告称赞槟州的财政表现，连马华前总会长敦林良实也称赞槟州的杰出表现及廉洁且远离贪污。</p>
<p>撇开东姑的公开立场，行动党领袖皆不愿让他离开行动党，并希望他继续出任行动党副主席。我希望我们能以党内同志团结一心的精神，解决党内的任何歧见。我将会联络东姑，与他会面商量，希望原本要退党的他，可以回心转意。</p>

<p><strong>Tan Sri Nor Mohamed Yakcop And UMNO No Longer Needs Non-Malay Votes By Adopting Perkasa “Ketuanan Melayu” Race Card With Threats And Fears That Malaysia Will Revert To 1511 If BN Loses The 13th General Elections.</strong></p>
<p>Minister in the Prime Minister’s Department Tan Sri Nor Mohamed Yakcop is no different from Perkasa by playing the “Ketuanan Melayu” race card with threats and fears that Malaysia will revert to 1511 if BN loses the 13th general elections. 1511 was the year that the Melaka Sultanate was successfully invaded by the Portuguese, the start of foreign colonisation of Malaya. </p>
<p><span id="more-2309"></span>Tan Sri Nor used 1511 to back up his false claims that the opposition did not have the capability to pursue the bumiputera agenda. This is a wrong comparison as the Portuguese were a foreign power and the 13th General Elections will be decided by Malaysians. Ironically, it is PR that should be laying this allegation against BN and the Election Commission due to the presence of phantom and dubious voters, including foreigners as registered voters, who could decisive play role in the next general elections. </p>
<p>Clearly should BN retain power in the next general elections, black will become white and white become black as shown by New Straits Times and Utusan Malaysia being forced to apologise for printing for false news or being asked to pay damages for defamation.</p>
<p>By playing the race card of bumiputera agenda in the next general elections, Tan Sri Nor and UMNO have sent a strong signal that they do not care about non-Malay voters. UMNO and Tan Sri Nor are using the bumiputera agenda as the only agenda for winning the general elections, citing Penang as an example where the Malays have been neglected. </p>
<p>Challenges Tan Sri Nor To State What Programmes Under The Previous BN State Government For Malays Had Been Discontinued By PR State Government.</p>
<p>The Penang PR state government challenges Tan Sri Nor to state how Malays in Penang have been neglected under PR rule. Can Tan Sri Nor spell out the programmes that the previous state government had done under former Chief Minister Tan Sri Dr Koh Tsu Koon that had not been continued by the present PR state government? Should Tan Sri Nor fail to do so then he is no different from Perkasa in adopting the tactics of race-baiting and fear-mongering. </p>
<p>In fact not only was welfare assistance continued, PR has increased them to historic levels never done before by the previous BN state government for the last 50 years. More than RM50 million have been spent on introducing and increasing cash assistance ranging from RM 100 yearly aid for senior citizens, the disabled, single mothers as well as students in Standard 1 &#038; 4, Form 1 &#038;4. Further micro-credit loans for the poor and single mothers, one-off payments of RM 1,000 to beneficiaries of senior citizens and government universities students from household with monthly income less than RM4,000 as well as RM 200 for every child born.</p>
<p>Most impressive of all is Penang’s success in wiping out hard-core poverty in one year what BN could not achieve in 50 years by ensuring every household enjoys a minimum monthly income of RM600. By 2015 Penang will be the first state in Malaysia to wipe out poverty.</p>
<p>Even when state government contracts were awarded by open competitive tender based on the best price, quality and management, 70% of the contracts were won by Malay contractors. This is a reduction from the previous practice of giving 100% to UMNO cronies, but in terms of value the genuine Malay contractors gained more as compared under the previous government.</p>
<p>The reason for this is that the PR state government had increased the expenditure for social programs and infrastructure by 55% from RM 1,387 million in the 4 years of 2004-7 to RM 2,142 million spent under 4 years of PR rule from 2008-2011. For instance, Penang state allocation for road projects, where nearly 100% were won by Malay contractors, were increased from RM 10.25 million in 2007 to RM 41.6 million in 2012. And in 2012, the largest allocation in Penang’s history for Islamic affairs of RM64 million was approved.</p>
<p>By playing with emotion and sentiment, instead of using reason and facts, Tan Sri Nor shows that he is no different from Perkasa. In Penang, Perkasa has been allowed to beat up and injure reporters, not once but twice in the Penang Bridge in July last year and on 26th February in the anti-Lynas rally in Esplanade. No action has been taken on those Perkasa and UMNO attackers. On 10 May 2012. Perkasa were even allowed by the police to conduct a Hindu death ritual on the main gate of my residence in Penang.</p>
<p>If Tan Sri Nor can succeed in exploiting fear dating back to 1511 by pursuing a racist approach of only bumiputra agenda and ketuanan Melayu, this is the death ritual of democracy, multi-racial harmony, multi-cultural diversity and 1Malaysia! </p>

<p><strong>Tan Sri Nor Mohamed Yakcop Dan UMNO Tidak Memerlukan Lagi Undi Bukan Melayu Dengan Menggunakan Sahutan Perkauman “Ketuanan Melayu” Dengan Ugutan Dan Taktik Ketakutan Bahawa Malaysia Akan Kembali Kepada Tahun 1511 Jika BN Kalah Dalam Pilihan Raya Umum Ke-13.<br />

Menteri dalam Jabatan Perdana Menteri Tan Sri Nor Mohamed Yakcop tidak berbeza dengan Perkasa kerana menggunakan sahutan perkauman “Ketuanan Melayu” dengan ugutan dan taktik ketakutan bahawa Malaysia akan kembali kepada tahun 1511 jika BN kalah dalam pilihan raya umum ke-13. 1511 adalah tahun kejatuhan kesultanan Melaka kepada kuasa Portugis dan permulaan penaklukan kuasa asing di Malaya. </p>
<p>Tan Sri Nor menggunakan tahun 1511 untuk menyokong dakwaan palsunya bahawa pembangkang tidak mempunyai kebolehan untuk menerajui agenda bumiputera. Perbandingan ini adalah salah kerana Portugis merupakan kuasa asing manakala pilihan raya umum ke-13 akan ditentukan oleh rakyat Malaysia. Ironiknya, sepatutnya PR yang menuduh BN dan Suruhanjaya Pilihan Raya atas kehadiran pengundi hantu yang diragui, termasuk warga asing yang didaftarkan sebagai pemilih, yang berupaya untuk memainkan peranan yang penting dalam pilihan raya yang akan datang. </p>
<p>Adalah jelas bahawa sekiranya BN mengekalkan kuasa dalam pilihan raya umum yang akan datang, hitam akan menjadi putih dan putih akan menjadi hitam seperti yang ditunjukkan oleh New Straits Times dan Utusan Malaysia yang terpaksa meminta maaf kerana menyiarkan berita palsu. </p>
<p>Dengan menggunakan agenda perkauman bumiputera dalam pilihan raya umum yang akan datang, Tan Sri Nor dan UMNO telah memberi isyarat yang kuat bahawa mereka tidak mempedulikan pengundi bukan Melayu. UMNO dan Tan Sri Nor menggunakan agenda bumiputera sebagai satu-satunya agenda untuk memenangi pilihan raya umum, dengan mengatakan bahawa Pulau Pinang adalah contoh di mana orang Melayu telah terpinggir. </p>
<p><strong>Cabar Tan Sri Nor Untuk Menyatakan Program-Program Apa Di Bawah Kerajaan Negeri BN Dahulu Untuk Orang Melayu Yang Telah Dibatalkan Oleh Kerajaan Negeri PR. </strong></p>
<p>Kerajaan negeri PR Pulau Pinang mencabar Tan Sri Nor untuk menyatakan jumlah orang Melayu yang telah terpinggir di bawah pentadbiran PR. Bolehkah Tan Sri Nor menyenaraikan program-program yang telah dilaksanakan oleh mantan Ketua Menteri Tan Sri Dr Koh Tsu Koon yang telah dibatalkan oleh kerajaan negeri PR? Sekiranya Tan Sri Nor gagal untuk membuat demikian maka beliau tidak berbeza dengan Perkasa kerana menggunakan taktik umpan-perkauman dan taktik ketakutan.</p>
<p>Hakikatnya bukan sahaja bantuan kebajikan diteruskan, malah PR telah meningkatkannya kepada tahap yang tidak pernah dicapai oleh kerajaan negeri BN selama 50 tahun. Lebih daripada RM50 juta telah dibelanjakan untuk melaksanakan dan meningkatkan bantuan kewangan daripada RM100 setahun untuk warga emas, OKU, ibu tunggal serta pelajar-pelajar Tahun 1 &#038; 4, Tingkatan 1 &#038; 4. Tambahan juga, kerajaan negeri PR memberi pinjaman mikro-kredit kepada golongan miskin dan ibu tunggal, serta bayaran RM1,000 sekali sahaja untuk waris warga emas dan pelajar-pelajar daripada isi rumah yang berpendapatan kurang<br />
daripada RM4,000 yang berjaya diterima IPTA serta RM200 untuk setiap bayi baru lahir. </p>
<p>Yang paling mengkagumkan, Pulau Pinang telah berjaya membasmi miskin tegar dalam satu tahun, di mana BN telah gagal selama 50 tahun, dengan memastikan bahawa setiap isi rumah mempunyai pendapatan sekurang-kurangnya RM600 sebulan. Menjelang 2015, Pulau Pinang akan menjadi negeri pertama untuk membasmi kemiskinan sama sekali.</p>
<p>Walaupun apabila kontrak kerajaan negeri diberi melalui tender terbuka berdasarkan faktor-faktor harga paling baik, kualiti dan pengurusan, 70% daripada kontrak telah dimenangi kontraktor Melayu. Ini adalah pengurangan jika dibandingkan dengan 100% yang diberi kepada kroni UMNO, tetapi dari segi nilai, kontraktor-kontraktor Melayu yang tulen telah bermanfaat jika dibandingkan dengan kerajaan dahulu.</p>
<p>Sebabnya adalah kerana kerajaan negeri PR telah meningkatkan perbelanjaan untuk program-program sosial dan infrastruktur sebanyak 55% daripada RM1,387 juta selama 4 tahun 2004-7 kepada RM2,142 juta di bawah pentadbiran PR selama 4 tahun dari 2008-2011. Sebagai contoh, peruntukan negeri Pulau Pinang untuk projek jalanraya, di mana hampir 100% telah dimenangi oleh kontraktor Melayu, telah ditingkatkan daripada RM10.25 juta pada tahun 2007 kepada RM42.6 juta pada tahun 2012. Dan pada tahun 2012, peruntukan paling besar dalam sejarah Pulau Pinang untuk hal-ehwal agama Islam iaitu RM64 juta telah diluluskan.</p>
<p>Dengan bermain emosi dan sentimen dan mengabaikan fakta dan logik, Tan Sri Nor menunjukkan bahawa beliau tidak berbeza dengan Perkasa. Di Pulau Pinang, Perkasa dibenarkan untuk memukul dan mencederakan wartawan, bukan sekali tetapi dua kali di Jambatan Pulau Pinang pada bulan Julai tahun lepas dan pada 26 Februari semasa perhimpunan anti-Lynas di Padang Kota Lama. Tiada tindakan telah diambil ke atas ahli-ahli Perkasa dan UMNO yang ganas. Pada 10 Mei 2012, Perkasa telah dibenarkan oleh polis untuk melakukan upacara pengebumian Hindu di depan pintu rumah saya di Pulau Pinang.</p>
<p>Jika Tan Sri Nor berjaya untuk menggunakan ketakutan tahun 1511 dengan pendekatan perkauman agenda bumiputera dan ketuanan Melayu, maka ia akan menandakan penguburan demokrasi, harmoni kepelbagaian kaum dan budaya serta 1Malaysia!</p>

<p>首相署部长丹斯里诺莫哈末耶谷与土著威权组织没有差别，他玩弄“马来主权”种族牌，威胁说如果国阵输掉第13届大选，马来西亚将会回到1511年。1511年是葡萄牙侵略马六甲王朝，开始了马来亚的殖民地历史。</p>
<p>丹斯里诺用1511年来支撑他的虚假论点，在野党没有能力维护土著议程。这是错误的比喻，因为葡萄牙是外国势力，而第13届大选是由马来西亚人来决定国家的命运。讽刺的是，这本来应该是民联对国阵和选委会讲的话，由于幽灵选民及可疑选民的出现，包括外国人也可以投票，在来届大选起着决定性的角色。</p>
<p>很明显地，国阵如果在来届大选保住政权，黑的将成为白的、白的将成为黑的，正如《新海峡时报》和《马来西亚前锋报》，他们因刊登假新闻的被迫道歉，或因诽谤而被令赔款。</p>
<p>在来届大选利用土著议程的种族牌，丹斯里诺及巫统已经传达了一个强烈的信号，那就是他们不在乎非马来人的选民。巫统和丹斯里诺采用土著议程做为唯一赢得选举的议程，并以槟城为例子，马来人被忽略。</p>
<p>挑战丹斯里诺说明，哪一些前朝政府为马来人所推行的计划，在民联政府执政期间被中止。</p>
<p>槟州民联政府挑战丹斯里诺说明，槟州马来人在民联治理期间如何被忽略。丹斯里诺可不可以讲出，哪一些前朝首长丹斯里许子根所推行的政策，在民联执政期间被中止？如果丹斯里诺不这么做，那么他就是与土权组织没有差别，玩弄种族牌和恐惧牌。</p>
<p>事实上，我们不只延续了福利援助计划，民联政府还增加至前所未有的水平， 是国阵过去50年也没做的事。我们拨出超过5000万令吉来推行现金援助，从乐龄人士、残障人士、单亲妈妈每年100令吉回馈金，以及一年级、四年级、中一、中四学生的援助金。为贫穷人士及单亲妈妈而设的微型贷款、一次性支付1000令吉给逝世乐龄人士怃恤金及家庭收入少过4000令吉政府大学学生、以及每名新生儿200令吉。</p>
<p>最令人印象深刻的是槟州成功在一年内扫除赤贫，确保每个家庭每月收入达600令吉，这是国阵过去50年也做不到的。2015年，槟州将会成为全马第一个扫除贫穷的州属。</p>
<p>就连州政府合约也是通过公开招标，依据最好的价格、最好的品质、最好的管理颁发的。70%的合约由马来承包商获得。虽然比起以前100%给完巫统朋党，但是在价值方面而言，真正有能力的马来承包商比前朝政府获得更多。</p>
<p>这其中的原因是，在2008-2011年间，槟州民联政府增加了社会福利及基建开销，比2004-2007年的13亿8700万令吉增加55%，达21亿4200万令吉。例如，槟州的道路工程拨款从2007年1025万令吉增加至2012年4160万令吉，近乎100%由马来承包商获得。2012年，州政府批准了史上最高的伊斯兰事务拨款6400万令吉。</p>
<p>丹斯里诺不讲道理和事实，一味地玩弄情绪，显示他与土权组织没有差别。在槟州，土权组织的人可以致伤记者，不只一次，而是发生了两个次，一次在去年7月，另一次发生在2月26日关仔角反莱纳斯集会。但是，当局没有对土权组织、巫统袭击人士采取任何行为。在2012年5月10日，警方竟然允许土权组织在我的私人住家门前进行一场兴都教葬礼。</p>
<p>如果丹斯里诺可以成功地利用1511年来吓唬人，继续追求土著议程和马来主权，这才是民主、多元种族和谐、多元文化及一个马来西亚的葬礼！</p>

<p><strong>Treating All Malaysians Regardless Of Race, Religions Or Gender As Our Children By Embracing Love And Rejecting Hate Will Help To Create A Malaysian Nation That Allows Everyone To Live With Dignity.</strong></p>
<p>All Malaysians regardless of race, religions or gender are treated as our children by embracing love and rejecting hate, would help to create a Malaysian nation that allows everyone to live with dignity. There is deep concern that public institutions either are involved in violence or condone violence by racist and extremist organisations such as Perkasa.</p>
<p>All mothers reject the language and actions of violence. The path towards non-violence is to embrace love and establish a civil society </p>
<p>A civil society is a  “shared society”, would allow Malaysians to make diversity a positive force for equal opportunity and social justice. Four elements constitute such a “shared society” — democratic participation in decision-making, respect for diversity and the dignity of an individual, equal opportunity and the prohibition of discrimination.</p>
<p>We must stand together to fight corruption and abuse of power because only this  success will build trust, provide progress and development to the people. Then only can the people live with dignity. Our children possesses the inalienable right to live in dignity in an environment that is clean, green,  safe and healthy.</p>

<p>Masyarakat madani adalah “masyarakat yang dikongsi” dan akan membolehkan rakyat Malaysia untuk menjadikan kepelbagaian sebagai kuasa positif untuk kesaksamaan peluang dan keadilan sosial. “Masyarakat yang dikongsi” terdiri daripada empat elemen – penyertaan demokratik dalam proses membuat keputusan, menghormati kepelbagaian dan martabat individu, peluang saksama serta larangan diskriminasi.</p>
<p>Kita harus berdiri bersama untuk membanteras korupsi dan salah guna kuasa kerana hanya kejayaan ini akan membina kepercayaan dan membolehkan kemajuan dan pembangunan rakyat. 			<content:encoded><![CDATA[<p>DAP Declares A Full Boycott Of The Independent Panel Into Violence During The Bersih 3.0 Rally So Long As Tun Hanif Mohammad Hanif Omar Is A Chairman And Member As He Has Compromised His Impartiality By Publicly Condemning Bersih 3.0 As Communist-Linked And An Attempt to Overthrow The Government.</p>
<p>Tun Mohammad Hanif Omar has dismissed allegations that as head of the investigation panel into the violence during the Bersih 3.0 rally, would result in biased findings saying that he has always acted fairly and impartially in previous enquiries and police investigations. The former Inspector-General of Police(IGP) said there would be no conflict of interest as the panel would be dealing with facts.</p>
<p><span id="more-2299"></span>The question at hand is not whether he has been fair and impartial before or that he was the former IGP. The fatal flaw was that he had already taken a partisan stand against Bersih by claiming that communist sympathizers were involved and supporting Prime Minister Najib Abdul Razak&#8217;s allegation that the rally was an attempt to overthrow the government. In actual fact, by making such wild allegations, he should be a potential witness to the investigation panel rather than be a member.</p>
<p>Tun Hanif’s presence of the panel is a clear cut case of conflict of interest. For example, if a panel were to be set up to discuss whether to grant a sports betting license to other companies, then Tun Hanif would definitely not qualify due to conflict of interest, because as deputy chairman of Genting he would be a potential rival. As his affiliations are publicly known, his participation in such a panel would be untenable.</p>
<p>Tun Hanif is first and foremost disqualified from serving on the investigation panel due to this conflict of interest as not only is the police being accused, he has publicly condemned Bersih thereby revealing his prejudice and bias against the rally. Finally, by linking Bersih to communism, Hanif is still fighting yesterday’s long-concluded wars, making the outcome of these investigations a foregone conclusion. Following his perverse logic, then Malaysia should not have signed the peace agreement with the Communist Party of Malaya on 2.12.1989.</p>
<p>DAP thereby declares a full boycott of the independent panel into violence during the Bersih 3.0 rally so long as Tun Hanif Mohammad Hanif Omar is a chairman and member as he has compromised his impartiality by publicly condemning Bersih 3.0 as communist-linked and an attempt to overthrow the government.</p>
<p>DAP supports the Bersih steering committee’s suggestion that the panel would be better served by United Nations rapporteur Frank La Rue (left), who had offered to probe the matter, and his colleague Maina Kiai, as well as the National Human Rights Commission (Suhakam). DAP also agrees with the Malaysian Bar Council that the independent panel lacks any legal framework and no features as legal immunity for those involved in the proceeding as well as lacking legal power to call or subpoena witnesses or call for the production of documents. </p>
<p>For these reasons and Tun Mohamad Hanif Omar presence in the independent panel to probe incidents of violence during the Bersih 3.0 rally has raised deep public concerns that the investigation will either be a whitewash of police brutality on peaceful demonstrators, a massive cover-up of the sufferings of the victims or a pretext to justify BN’s wild lies that Bersih 3.0 was a coup d&#8217;état attempt.</p>

<p>DAP Mengisytiharkan Pemboikotan Panel Bebas Untuk Menyiasat Keganasan Semasa Perhimpunan Bersih 3.0 Selagi Tun Hanif Omar Menjadi Pengerusi Dan Ahli Kerana Beliau Telah Menunjukkan Pendiriannya Yang Berat Sebelah Dengan Mengecam Perhimpunan Bersih 3.0 Sebagai Berkait Dengan Komunis Dan Cubaan Untuk Menggulingkan Kerajaan. </p>
<p>Tun Mohammad Hanif Omar telah menolak dakwaan bahawa lantikan beliau sebagai ketua panel siasatan keganasan semasa perhimpunan Bersih 3.0 akan menghasilkan keputusan yang berat sebelah dengan menegaskan bahawa beliau selalu bersikap adil dan tidak berat sebelah dalam siasatan-siasatan terdahulu. Bekas Ketua Polis Negara (KPN) ini telah menjamin bahawa tidak akan berlaku konflik kepentingan kerana panel akan berhadapan dengan fakta.</p>
<p>Persoalannya bukan sama ada beliau pernah bersikap adil dan tidak berat sebelah dalam siasatan dahulu atau semasa beliau menjawat sebagai KPN. Kesilapan besarnya adalah apabila beliau mengambil pendirian yang partisan terhadap Bersih dengan mendakwa bahawa golongan pro-komunis telah terlibat serta menyokong dakwaan Perdana Menteri Najib Abdul Razak bahawa perhimpunan Bersih 3.0 adalah cubaan untuk menggulingkan kerajaan. Sebaliknya, dengan membuat tuduhan liar seperti itu, beliau berpotensi untuk menjadi saksi dan bukan ahli panel.</p>
<p>Kehadiran Tun Hanif dalam panel adalah suatu kes konflik kepentingan yang jelas. Sebagai contoh, jika sebuah panel ditubuhkan untuk membincangkan sama ada lesen judi sukan patut diberi kepada syarikat-syarikat lain, maka Tun Hanif tidak layak atas sebab konflik kepentingan sebagai timbalan pengerusi Genting yang merupakan syarikat pesaing. Oleh kerana hubungannya dengan Genting diketahui umum, maka beliau tidak akan layak untuk menyertai panel sedemikian.</p>
<p>Oleh itu, Tun Hanif terlebih dahulu tidak layak untuk menyertai panel siasatan kerana konflik kepentingan bukan sahaja kerana yang dituduhnya adalah pihak polis, tetapi kerana beliau telah mengecam Bersih secara umum dan mendedahkan pendiriannya yang berat sebelah terhadap perhimpunan tersebut. Akhirnya, dengan mengaitkan Bersih dengan komunis, Hanif masih lagi melawan musuh zaman dahulu, serta membuatkan hasil siasatan ini satu perkara yang sudah pasti. Mengikut logiknya yang tidak masuk akal, maka Malaysia tidak sepatutnya menandatangani perjanjian keamanan dengan Parti Komunis Malaya pada 2.12.1989.</p>
<p>DAP dengan ini mengisytiharkan pemboikotan panel bebas untuk menyiasat keganasan semasa perhimpunan Bersih 3.0 selagi Tun Hanif Omar menjadi pengerusi dan ahli kerana beliau telah menunjukkan pendiriannya yang berat sebelah dengan mengecam perhimpunan Bersih 3.0 sebagai berkait dengan komunis dan cubaan untuk menggulingkan kerajaan.</p>
<p>DAP menyokong cadangan jawatankuasa pemandu Bersih bahawa panel tersebut akan bermanfaat dengan penglibatan pelapor Pertubuhan Bangsa-bangsa Bersatu Frank La Rue yang telah menawarkan diri untuk membantu dalam siasatan, dan rakan sekerjanya Maina Kiai, serta penglibatan Suruhanjaya Hak Asasi Manusia Malaysia (Suhakam). DAP juga bersetuju dengan Majlis Peguam Malaysia bahawa panel siasatan kekurangan rangka kerja perundangan dan tidak mengurniakan imuniti undang-undang kepada mereka yang terlibat dalam prosiding serta kekurangan kuasa undang-undang untuk memberi sepina kepada saksi-saksi atau menuntut dokumen-dokumen.</p>
<p>Untuk sebab-sebab ini, kehadiran Tun Hanif Omar dalam panel bebas untuk menyiasat keganasan semasa perhimpunan Bersih 3.0 telah menimbulkan kebimbangan rakyat dan persoalan sama ada siasatan ini akan mengaburkan kebenaran keganasan polis atas peserta yang berhimpun secara aman, menutup penderitaan mangsa-mangsa ataupun menjadi alasan untuk mewajarkan penipuan BN bahawa Bersih 3.0 merupakan cubaan coup d&#8217;état.</p>

<p>民主行动党秘书长兼峇眼区国会议员林冠英于2012年5月12日，在吉隆坡发表声明：</p>
<p><strong>行动党宣布，只要敦哈聂夫继续担任主席及委员，我们将抵制净选盟3.0大集会暴力独立调查团， 因为他曾公开批评净选盟3.0与共产党员有关、有意推翻民选政府，这种评论已经彰显他的不公正性。</strong></p>
<p>敦莫哈末哈聂夫驳斥那些指责他领导独委会调查净选盟3.0暴力事件，将导致调查结果不公的言论，并说他在之前的警方调查工作向来公正不阿。这名前任总警长也说，他的委任并没有利益冲突，因为调查团将会处理真相。</p>
<p>现在在问题不在于他任职全国总警长期间，是否公平和公正。真正的问题在于他对于净选盟已有预设政治立场，他说共产党员的同情者也参与其中，他也支持首相纳吉的说法，宣称净选盟大集会意图推翻政府。事实上，在发表这种言论后，他应该被列为目击者，而不是独委会成员。</p>
<p>敦哈聂夫被委任为独委会成员，很明显地存有利益冲突。例如，如果政府要设立一个委员会，讨论是否要发出赌博娱乐执照给其它公司，那么敦哈聂夫肯定有利益冲突不符合资格受任， 他身为云顶的署理主席，肯定是潜在的竞争对手。而由于他的背景人人皆知，因此他不适合参与这类委员会。</p>
<p>敦哈聂夫应该是第一个 不具资格的独委会成员，由于这个独委会的调查对象涉及警方，而他曾经公开谴责净选盟，他对集会的偏见已经显示利益冲突的问题。最后，他竟然将净选盟与共产主义挂钩，看来他还活在那场已经总结的历史战争中，让我们可以预见调查的结果。根据他的错误逻辑，马来西亚根本不应该在1989年12月2日与马来亚共产党签署和平协议。</p>
<p>行动党因此宣布，只要敦哈聂夫继续担任主席及委员，我们将抵制净选盟3.0大集会暴力独立调查团， 因为他曾公开批评净选盟3.0与共产党员有关、有意推翻民选政府，这种评论已经彰显他的不公正性。</p>
<p>行动党支持净选盟2.0的提议，让联合国促进和保护意见和言论自由权利特别专员（Special Rapporteur）拉鲁（Frank La Rue）前来我国调查净选盟3.0集会，后者已经自荐联同他的同事麦娜基亚、马来西亚人权委员会（SUHAKAM）参与调查工作。行动党也认同律师公会，即独立调查委员会缺乏法律框架，没有权力召见证人或参与者，也缺乏法律权力获取文件证据，因此没有法律地位。</p>
<p>鉴于上述原因以及敦哈聂夫受委领导独立调查团撤查净选盟3.0大集会暴力事件， 让人怀疑这是不是当局企图漂白警方对付和平集会者的暴力、掩饰受害者所承受的痛苦，或是以此找藉口，合理化国阵指净选盟3.0企图推翻民选政府的谎言？</p>

			<content:encoded><![CDATA[<p>DAP condemns the “burger protest” by pro-BN and anti-Bersih supporters, which set up an illegal burger stall outside Bersih co-chairperson Datuk Ambiga Sreenevasan’s house to protest against their claims of purported loss of income suffered due to the Bersih 3.0 rally on 28 April 2012. Is rule of law in Malaysia now replaced by rule of the jungle?</p>
<p>I fail to understand how DBKL can allow a burger stall to be set up outside a private residence with impunity in Kuala Lumpur? By failing to act against the “burger protest” set up illegally outside Datuk Ambiga’s house, BN and DBKL is subjecting her to undue harrassment, intimidation and invasion of privacy. Will DBKL allow a similar protest outside the private home of Ministers or the DBKL’s Mayor residence?</p>
<p><span id="more-2293"></span>Such an act of harrassment, intimidation and invasion of privacy has no place in our peaceful country, where Malaysians live together in mutual harmony and respect. Moreover, the symbolic act of setting up burger stalls and cooking meat as a protest outside Ambiga’s home is extremely disrespectful considering that the former Bar Council president is a vegetarian.</p>
<p>As Ambiga herself noted yesterday, such acts have “never happened in Malaysia, except to Lim Guan Eng. Now (he) and I have had our homes violated.” Yesterday, my own family’s privacy was invaded by a group of Perkasa members who performed a “funeral rite” intruding on my private space, by placing on my gate  a garland of flowers over a framed photo of me to signify my “death”. </p>
<p>Clearly this is the first time that such a death “wish” or death “threat” is made against a Chief Minister. What is equally clear is that the police present were indifferent and did not stop the Perkasa members from violating my private space.</p>
<p>It is the right of every Malaysian to be able to protest his or her own issues, but to do so by intruding into personal space and invading the privacy of family homes or wishing for the death of anyone is utterly vile, completely disrespectful and contrary to the basic tenets of democracy.</p>
<p>DAP calls on BN and DBKL to immediately remove the stall outside Datuk Ambiga’s home as a mark of respect towards not only to democracy and rule of law but to establish and uphold civil society.</p>

<p>Apakah keluruhan undang-undang di Malaysia telah digantikan dengan undang-undang rimba?</p>
<p>Saya tidak faham bagaimana DBKL boleh membenarkan sebuah gerai burger didirikan secara haram di luar rumah hak milik peribadi seorang di Kuala Lumpur tanpa sebarang tindakan dikenakan? Dengan kegagalan bertindak terhadap “protes burger”  yang dilakukan secara haram di luar rumah Pengerusi Bersama Bersih Datuk Ambiga, BN dan DBKL telah merelakan Ambiga diganggu-gugat, diintimidasi dan dicabul ruang peribadi beliau.</p>
<p>Adakah DBKL akan membenarkan protes yang sama dilakukan di luar rumah Menteri-Menteri atau Datuk Bandar Kuala Lumpur?</p>
<p>Perbuatan mengganggu-gugat, intimidasi dan pencabulan ruang peribadi tidak ada tempat di negara kita yang aman damai ini di mana rakyat Malaysia hidup bersama dalam keadaan harmoni dan saling hormat-menghormati. Lagi pun, tindakan simbolk mendirikan gerai burger dan memasak daging di luar rumah Ambiga sebagai satu bantahan adalah bersifat kurang ajar kerana bekas Presiden Majlis Peguam itu adalah seorang yang tidak memakan daging (vegetarian).</p>
<p>Sebagaimana yang dinyatakan oleh Ambiga sendiri semalam, perbuatan keji itu “tidak pernah berlaku di Malaysia, kecuali terhadap Lim Guan Eng. Kini rumah (beliau) dan saya telah dicabul dan diceroboh”.</p>
<p>Semalam, ruang peribadi keluarga saya sendiri telah dicabul oleh sekumpulan ahli Perkasa yang meletakkan kalungan bunga di atas bingkai gambar saya yang diletakkan di pintu pagar rumah saya, untuk memberi amaran tentang “kematian” saya.</p>
<p>Jelas ini adalah kali pertama “ugutan bunuh” dilakukan terhadap seorang Ketua Menteri. Apa yang turut jelas ialah kehadiran pihak polis yang tidak berbuat apa-apa dan tidak menghalang ahli-ahli Perkasa daripada menceroboh dan mencabul ruang peirbadi keluarga saya.</p>
<p>Adalah menjadi hak setiap rakyat Malaysia untuk membantah atau protes sebarang isu tetapi melakukannya dengan menceroboh ruang peribadi seseorang dan mencabul hak peribadi rumah keluarga, atau menuntut kematian seseorang adalah amat keji, kurang ajar dan bertentangan dengan rukun-rukun asas demokrasi.</p>
<p>DAP mendesak supaya BN dan DBKL memindahkan serta-merta gerai burger haram yang dibina di luar rumah Datuk Ambiga sebagai tanda menghormati, bukan sahaja demokrasi dan kedaulatan undang-undnag, tetapi juga untuk mewujudkan dan mempertahankan masyarakat madani.</p>

<p>民主行动党谴责亲国阵及反净选盟支持者所进行的“汉堡示威”，他们在净选盟联合主席拿督安美嘉屋前设立非法的汉堡摊子，抗议2012年4月28日的净选盟3.0大集会导致他们损失收入。马来西亚的法制什么时候变成丛林法则、弱肉强食？</p>
<p>我不明白为何吉隆坡市政局可以允许汉堡摊子在吉隆坡的住宅区内非法摆卖？国阵及吉隆坡市政局（DBKL）没有对付在净选盟联合主席安美嘉家门前的“汉堡示威”，如同眼巴巴让她承受不必要的骚扰、恐吓及隐私侵犯。吉隆坡市政局会不会允许类似的示威在部长们的私宅或吉隆坡市政局主席的家门前发生？</p>
<p>我们不应该让如此的骚扰、恐吓及隐私的侵犯发生在马来西亚人和谐共处、互相尊重的和平国家。再说，像这种在安美嘉家门前摆摊卖汉堡、煮肉，只一种完全无礼的做法，因为律师公会主席是一名素食者。</p>
<p>安美嘉昨天说，这种行为“在马来西亚从未发生过，除了林冠英的家。现在他的家和我的家都被侵犯了。”昨天，我家人的隐私也被一群土著权威组织的人侵犯，他们入侵我的私邸，设立“灵堂”，用我的肖像挂上死人花圈，挂在我家大门前，以示我的“死亡”。</p>
<p>很明显地，这是第一次对首长所做出的“希望你去死”或死亡恐吓。更明显的地，在场的警察竟然无动于衷，完全没有阻止土权成员侵犯我的私邸。</p>
<p>每一名马来西亚都有权利为自己的事情表达抗议、示威，但是，侵入私人空间 、闯入别人的家庭隐私，希望一个人死去，是彻底卑鄙、无礼、与民主基本原则背道而驰的。</p>
<p>行动党促请国阵和吉隆坡市政局马上移开安美嘉屋外的摊子，这不只是表示对民主和法治的尊重，也是维护和捍卫公民社会。</p>

Will Tun Mohammad Hanif Omar’s Appointment Be A Whitewash Of Police Brutality On Peaceful Demonstrators, A Massive Cover-Up Of The Sufferings Of The Victims Or A Pretext To Justify BN’s Wild Lies That Bersih 3.0 Was A Coup D&#8217;état Attempt.</strong></p>
<p>The appointment of former inspector-general of police Tun Mohamad Hanif Omar to head of the independent panel to probe incidents of violence during the Bersih 3.0 rally has raised deep public concerns that the investigation will either be a whitewash of police brutality on peaceful demonstrators, a massive cover-up of the sufferings of the victims or a pretext to justify BN’s wild lies that Bersih 3.0 was a coup d&#8217;état attempt.</p>
<p><span id="more-2288"></span>Hanif, who is now Genting Malaysia Bhd Deputy Chair, had claimed that communist sympathizers were involved in the Bersih 3.0 rally, and supported Prime Minister Najib Abdul Razak&#8217;s claim that the Bersih 3.0 rally was an attempt to overthrow the government. Hanif further stated that the tactics of using provocateurs to cause the demonstrators to clash with police and to bring children along in the hope they would get injured were tactics learnt from past pro-communist demonstrations.</p>
<p>How can Datuk Seri Najib Razak consider Hanif as a “credible, experienced and respectable” individual that ensures its investigation panel is independent and unbiased, when Hanif has adopted such a prejudiced and partisan stand against the Bersih 3.0 rally as an attempt to overthrow the government? What makes those claims of a coup d’tat by Najib and Hanif most ridiculous is that both of them ignored the fact that six local pressmen and about 12 photographers and journalists from the foreign media were reportedly assaulted during the fracas on April 28 Bersih 3.0 rally by police. </p>
<p>To add insult to injury, Hanif is now heading the investigation panel raising doubts about the integrity, reliability and credibility of its findings. As a former Inspector-General of Police, Hanif is first and foremost disqualified from serving on the investigation panel due to this conflict of interest as the police is being accused. Secondly, by publicly condemning Bersih, Hanif’s prejudiced bias would also disqualify him to serve on the investigation panel. Finally, by linking Bersih to communism, Hanif is still fighting yesterday’s long-concluded wars, making the outcome of these investigations a foregone conclusion.</p>
<p>For these reasons, the Prime Minister should try to salvage or restore some credibility and public confidence as well as renew faith that “justice will not only be done but be seen to be done” by replacing Hanif with an independent, apolitical, unbiased and an upright person of integrity.</p>

<p><strong>Adakah Perlantikan Tun Mohammad Hanif Omar Itu Akan Mengaburkan Kebenaran Keganasan Polis Atas Peserta Yang Berhimpun Secara Aman, Menutup Penderitaan Mangsa-Mangsa Ataupun Menjadi Alasan Untuk Mewajarkan Penipuan BN Bahawa Bersih 3.0 Merupakan Cubaan Coup D&#8217;état?</strong></p>
<p>Perlantikan mantan ketua polis negara Tun Mohammad Hanif Omar sebagai ketua panel penasihat bebas untuk menyiasat insiden keganasan semasa perhimpunan Bersih 3.0 telah menimbulkan kebimbangan rakyat dan persoalan sama ada siasatan ini akan mengaburkan kebenaran keganasan polis atas peserta yang berhimpun secara aman, menutup penderitaan mangsa-mangsa ataupun menjadi alasan untuk mewajarkan penipuan BN bahawa Bersih 3.0 merupakan cubaan coup d&#8217;état.</p>
<p>Hanif, yang kini menjadi timbalan pengerusi Genting Malaysia Bhd, telah mendakwa bahawa golongan pro-komunis telah terlibat dalam perhimpunan Bersih 3.0, dan telah menyokong dakwaan Perdana Menteri Najib Abdul Razak bahawa perhimpunan Bersih 3.0 adalah cubaan untuk menggulingkan kerajaan. Hanif telah menambah bahawa taktik menggunakan dalang pencetus provokasi untuk menyebabkan pertelingkahan dengan polis serta membawa kanak-kanak bersama dalam harapan mereka akan dicederakan merupakan taktik yang dipelajari oleh demonstrasi pro-komunis dahulu.</p>
<p>Bagaimana Dato’ Sri Najib Razak boleh menganggap Hanif sebagai seorang individu yang “kredibel, berpengalaman dan dihormati” yang akan memastikan panel siasatan itu bersih dan tidak berat sebelah, apabila Hanif sudah pun mengambil pendirian yang prejudis dan partisan terhadap perhimpunan Bersih 3.0 sebagai cubaan untuk menggulingkan kerajaan? Yang tidak masuk akalnya, dakwaan coup d&#8217;état oleh Najib dan Hanif itu telah mengabaikan hakikat bahawa enam wartawan tempatan dan 12 jurugambar dan wartawan media asing telah dilaporkan dipukul oleh polis semasa perhimpunan Bersih 3.0 pada 28 April.</p>
<p>Yang lebih teruknya, Hanif kini dilantik untuk mengetuai panel siasatan, lantas menimbulkan keraguan terhadap integriti, kepercayaan dan kredibiliti hasil siasatannya. Sebagai mantan ketua polis negara, Hanif seharusnya dikecualikan daripada menjadi ahli panel siasatan atas sebab konflik kepentingan kerana yang dituduh dalam kes ini adalah pihak polis. Kedua, dengan mengutuk Bersih secara terbuka, prejudis Hanif yang berat sebelah juga harus mengecualikannya daripada panel tersebut. Akhirnya, dengan mengaitkan Bersih dengan komunis, Hanif masih lagi melawan musuh zaman dahulu, serta membuatkan hasil siasatan ini satu perkara yang sudah pasti.</p>
<p>Untuk sebab-sebab ini, Perdana Menteri harus menyelamatkan atau memulihkan kredibiliti dan keyakinan umum bahawa “keadilan tidak hanya dilakukan tetapi juga dilihat sebagai dilakukan” dengan menggantikan Hanif dengan seorang yang bebas, tidak terlibat dalam politik, tidak berat sebelah dan seorang yang tegak berintegriti.</p>

<p>敦莫哈末哈聂夫奥玛受委率领独立调查团，是不是当局企图漂白警方对付和平集会者的暴力、掩饰受害者所承受的痛苦，或是以此找藉口，合理化国阵指净选盟3.0企图推翻民选政府的谎言？</p>
<p>前任全国总警长敦莫哈末哈聂夫受委领导独立调查团，以彻查净选盟3.0大集会的暴力事件，这项委任引起公众的关注，让人怀疑当局是不是企图漂白警方对付和平集会者的暴力、掩饰受害者所承受的痛苦，或是以此找藉口，合理化国阵指净选盟3.0企图推翻民选政府的谎言？</p>
<p>哈聂夫目前是云顶马来西亚有限公司的副主席，他曾指责净选盟3.0集会的参与者是共产党员的同情者，并支持首相纳吉的说法，指净选盟3.0企图推翻民选政府。哈聂夫还说，利用煽动分子鼓动示威者与警方发生冲突、携带小孩希望他们受伤的伎俩，都是从前亲共产党员示威时采用的策略。</p>
<p>在哈聂夫对净选盟持有如此偏见、认为净选盟3.0是企图推翻政府的集会，拿督斯里纳吉怎么可以视哈聂夫为“有公信力、有经验及受尊敬”的人士，确保有关独立调查团是独立、不偏不倚的？纳吉和哈聂夫的”推翻政府论” 最荒谬之处就是，他们完全忽略六名记者、12名摄影记者及外国媒体新闻从业员在428当天被警方使用暴力对待的事实。</p>
<p>更糟的是，独立调查团以哈聂夫为首，让它怀疑其报告的廉正、可信度及公信力。身为前任全国总警长，哈聂夫首先就没有资格受任成为这个调查团的成员，因为警方被指责，这变成直接的利益冲突。其二、哈聂夫公开谴责净选盟，既然他持有偏见，也没有资格成为调查团成员。最后，他指责净选盟与共产党有关联，既然他还活在已经从前那场已经总结的战争中，那么，我们可以预见这项调查工作的结果。</p>
<p>基于上述种种原因，首相应该撤换哈聂夫，另外委任一个独立、无党派、无偏见、正直的人士，以抢救或恢复一些公信力、公众信心以及让人相信“正义必须被实现，而且要以看得见的方式实现。”</p>

<p>BN Setting The Minimum Monthly Wage Of RM900 In Peninsular Malaysia And RM800 In Sabah And Sarawak Is Not The Right Thing To Do Is Wrong As It Is Below The Poverty Line Indicator(PLI) For Sabah &#038; Sarawak.</p>
<p>Prime Minister Dato’ Sri Najib Tun Razak’s announcement of a floor wage for the private sector at RM900 per month for workers in the Peninsular and RM800 per month for those in Sabah and Sarawak as the “right thing to do”, is wrong as it is blow the poverty line for Sabah &#038; Sarawak. Whilst DAP agrees with Najib that getting the correct balance between guaranteeing workers a decent wage and employers’ needs, BN must have lost it sense of balance to fix the minimum monthly wage below the PLI of RM830 per month for Sarawak and RM960 per month for Sabah.(9th Malaysia Plan)</p>
<p><span id="more-2290"></span>Najib should sack his senior economic advisors if he still believes that the minimum monthly wage had considered factors proposed by the World Bank such as cost of living, the poverty line index and unemployment rate. With productivity rising by 6.7 per cent annually but real wages going up by just 2.6 per cent each year, BN’s proposed minimum monthly wage is grossly insufficient as it is lower than Pakatan Rakyat’s RM 1,100 minimum take-home pay every month, which is inclusive of all fixed allowances but excluding over-time payments.</p>
<p>BN Federal Government’s minimum monthly wage of RM 900 in Peninsular Malaysia and RM 800 in Sabah and Sarawak is insufficient as it is not only discriminatory against workers but demonstrates a glaring lack of commitment by BN to reduce poverty when it is far below the poverty line for East Malaysia.</p>
<p>This is becase the cost of living in Sabah and Sarawak is much higher compared to the Peninsular, which has a PLI of RM720 per month. In other words, even if the RM800 per month minimum wage is implemented in Sabah and Sarawak, it will still be far below the PLI as defined by the Malaysian Government.</p>
<p>In addition to the proposed PR minimum wage of RM1,100 that will be able to meet the basic needs of workers across the country, we must also be aware that Malaysia is fast-becoming an indebted nation where families spend everything and beyond what they earn. For example, Bank Negara’s Annual Report 2010 revealed that Malaysia’s household debt at the end of 2010 was RM 581 billion or 76 per cent of GDP, thus giving us the dubious honour of having the second-highest level of household debt in Asia, after South Korea.</p>
<p>In addition, the Malaysian household debt service ratio stood at 47.8 per cent in 2010, meaning that nearly half of the average family’s income goes to repaying debts. As a rule, banks would not lend money to those whose total servicing of loans exceeded one third of their income. In other words, we are spiralling into an indebted nation.</p>
<p>Thus, even a minimum wage is not enough without two important considerations. Firstly, the minimum wage quantum must be indexed to the Consumer Price Index, so that it is adjusted with the rate of inflation. This will ensure that standard of living and quality of life will be protected and maintained.</p>
<p>Secondly, increasing the livelihood of Malaysians also requires an holistic economic strategy that is targetted at raising disposable income. In other words, we need to put more money into people’s pockets. However, this cannot be done just by setting a minimum wage. In the larger picture, we have to address the influx of unskilled foreign workers and their wage-suppressing effect, upgrade skills and productivity of our local workforce and also increase the participation of women in the workforce.</p>
<p>Besides that, the government must also invest in key sectors such as public transport, housing and healthcare. If cost of living is lower, disposable income will automatically increase. This concept is very simple – if it costs less to commute, buy a house and pay medical bills, then everyone will have more money. Imagine if every Malaysian had just RM10 extra every day, the economic multiplier effect will result in RM280 million extra circulating in the economy every day. That is no small amount. In other words, if we can increase the purchasing power of our people especially the lower income groups with a meaningful minimum monthly wage of RM1,100 inclusive of allowances, we will be able to increase domestic demand and create a healthier economy for all Malaysians.</p>

<p>首相拿督斯里敦拉萨宣布说马来半岛每月最低薪资900令吉以及沙巴、砂拉越两州每月最低薪资800令吉是“正确的事”，这是不确实的，因为这个最低薪资远远不及东马的贫穷水平线。民主行动党同意，纳吉试图在保障工人合理薪资及雇主的需要之间取得平衡点，但是，把最低薪资设定在砂州贫穷线830令吉及沙巴州贫穷线960令吉（大马第九计划）之下，国阵肯定是失去了平衡点。</p>
<p>纳吉如果相信每月最低薪金已经考虑了世界银行所建议的生活水平、贫穷线及失业率，他应该革除他的经济顾问。随着生产率每年上升6.7%，而工资每年上升2.6%，国阵的最低薪资是不足够的，它比民联的1100令吉扣税后实得工资还低。这包括所有固定津贴，但是不包括超时工资。</p>

<p>除了民联所提议的最低薪资1100令吉能够满足全国工人的基本需求，我们也要了解到，马来西亚已经快速成为举债国，几乎每个家庭的花费都超出他们所赚的。例如，2010年国家银行年度报告指出，马来西亚的家庭债务在2010年底是5810亿令吉或占国民生产总值的76%，让我们成为亚洲继韩国之后，家庭债务第二高的国家。</p>
<p>此外，我国的家庭债务偿债比率在2010年为47.8%， 意味着每个家庭平均有一半的收入是用来还债的。一般上，银行不会借钱给那些债务超过收入三分之一的人士。换句话说，我们正渐渐成为过度举债的国家。</p>
<p>因此，如果不考虑两个要素，单单拥有最低薪资是不够的。第一、最低薪资必须能够反映消费人指数。因此它必须依据通膨率调整。这才能够确保这项政策有助于保障及维持人民的生活水平及素质。</p>
<p>第二，随着马来西亚人民生活的提升，我们必须推出全方位的经济政策，以提高可支配收入为目标。换句话说，我们需要把钱放入人民的口袋。但是，这不能 只是单靠制定最低薪资。长远来说，我们必须解决无技能外劳涌入以及他们压低工资的影响。我们必须提升本地员工的技能及生产力、同时增加女性在工作的参与此外，政府也必须投资在关键领域如公共交通、房屋及保健。如果生活水平降低、可支配收入自然会增加。这个概念很简单，如果人民在交通、房屋及医药方面的花 费减少，那么每个人自然会有多一点钱。让我们想像，如果每个马来西亚人每天都多花10令吉，每天将会有额外的2亿8000万令吉在流通，产生经济倍增效 应。这不是一笔小数目。如果我们可以通过1100令吉最低薪金（包含各种津贴）增加人民的购买能力，特别是低收入群，我们将能够创造内需，为全民打造更健康的经济。</p>

<p>The Failure Of The MAS-Air Asia Share Swap Is Not Just An Ordinary Failed  Corporate Merger But A Failure Of The Prime Minister’s Economic Transformation Program(ETP) That Is Supposed To Stop The Rot Of Mismanagement, Financial Malpractices And Failed Strategies In GLCs Such As MAS.</p>
<p>After eight months, the controversial MAS-Air Asia share swap has been terminated, purportedly because it has become an impediment to the recovery efforts of the loss-making flag carrier. Under the original deal, MAS would swap a 20.5% stake for 10% in Air Asia. Now, as part of the reversal of the deal, AirAsia’s chief and founder Tan Sri Tony Fernandes and deputy Datuk Seri Kamarudin Meranun have resigned from the MAS board, with MAS director Mohamed Azman Yahya following suit from AirAsia’s board.</p>
<p><span id="more-2286"></span>Eight months ago, Malaysians were told that the share swap would be the cure needed to save the ailing national airline. Unfortunately, not long after that, MAS recorded a shocking net loss of RM2.52 billion for 2011, which is the tip of the iceberg for the airline that has been on a downward spiral since the departure of Dato’ Sri Idris Jala in 2009, with its bottomline declining from a net profit of RM490 million in 2009 to RM234 million in 2010 to the staggering loss of RM2.52 billion in 2011.</p>
<p>And now in a complete reversal, Khazanah has admitted that the latest merger of cross-holding of shares, which was intended to create economies of scale for the major shareholders, Khazanah and Tune Air, had become a distraction to the management’s efforts to turn around MAS. In other words, first we were told that the MAS-Air Asia swap would save the airline, and now after eight months we are told that it was actually causing it to fail. </p>
<p>The failure of MAS is a direct reflection of the fundamental problems of the BN legacy, from firstly privatising and subsequently re-nationalisation. Even the 2001 bailout in which the Federal Government paid double the market price at the time could not rescue MAS from its fundamental problems. The Federal Government paid RM1.8 billion or RM8 per share to Tan Sri Tajudin Ramli instead of the market value of RM3.68 at the time.</p>
<p>The failure of the MAS-Air Asia share swap is not just an ordinary failed  corporate merger but a failure of the Prime Minister’s much lauded ETPs that is supposed to stop the rot of mismanagement, financial malpractices and failed strategies in Government-Linked Corporations(GLCs) such as MAS. </p>

<p>马航亚航换股计划告吹，这不只是普通的企业合并失败案例，也是首相经济转型计划的失败，经济转型计划原本的用意是要阻止像马航这样的官联公司陷入管理不当、理财不善及策略失败的窘境。</p>
<p>经过8个月，具争议性的马航亚航换股计划正式告吹，因为它将阻碍原本在亏损的航空公司的复苏能力。在原本的换股计划下，马航须以20.5%的股份，换取亚航的10%股份。现在，随着换股交易解除同，亚航的主席兼创办人丹斯里汤尼菲南德斯及副主席拿督斯里卡玛鲁丁已经辞去马航董事的职位，而马航的董事莫哈末阿兹曼也离开亚航董事部。</p>
<p>八个月前，国人被告知换股计划是解救一直亏损的国营航空的解药。不幸地是，不久之后，马航爆出在2011年的亏损达25亿2000万令吉的消息，这只是坏消息的冰山一角，现任首相署部长拿督斯里依德利斯在2009年离开马航后，该公司业绩便急转直下，净利从2009年的4亿9000万令吉下滑至2010年的2亿3400万令吉，接着灾难性的在2011年净亏25亿2000万令吉。</p>
<p>随意换股计划解除，国库控股（Khazanah） 也承认，这宗国内最大的换股合并计划，原本是为主要股东（国库控股和亚航）创造经济规模， 但是，这项计划妨碍了整顿马航的管理。换句话说，本来他们说马航亚航合并可以拯救马航，现在八个月之后，他们说这项计划将让整顿马航的努力失败。</p>
<p>马航的失败直接反映了国阵政权的基本问题，从最先的私营化到国有化。就算2001年联邦政府以双倍的市价，动用公共基金出手拯救（bailout）马航，也无法从根本上救出马航 。当时，联邦政府支付丹斯里达祖丁18亿令吉或每股8令吉的价格，而不是市价每股3.68令吉。</p>

			<content:encoded><![CDATA[<p>SPEECH BY  CHIEF MINISTER OF PENANG AT THE FORUM ON LOCAL GOVERNMENT ELECTIONS AT THE TOWN HALL, ESPLANADE, 6 MAY 2012</p>
<p>Local government elections are a feature of practically every democratic country in the world. Even countries which are not democracies such as communist China hold local elections of one kind or another. Malaysia finds itself in a most peculiar position in that the Federal Government considers elections to be suitable for the Federal and State levels, but refuses to allow elections to be held at the local level. </p>
<p>In the 19th century, the French scholar Alexis de Tocqueville, in his seminal work, Democracy in America, referred to local democracy as a “fertile germ of free institutions”. He wrote: </p>
<p>The strength of free peoples resides in the local community.  Local institutions are to liberty what primary schools are to science; they put it within the people&#8217;s reach; they teach people to appreciate its peaceful enjoyment and accustom them to make use of it.</p>
<p><span id="more-2284"></span>In our country, the first partially-elected local council was established by the British colonial authorities here in George Town in 1857, but were discontinued due to colonial apathy. After the Second World War, with the increasing public demand for independence and self-government that led to Merdeka, local elections were then introduced in local councils across our country, with the first local elections held again here in George Town, in 1951. </p>
<p>In 1956, the Municipal Council of George Town became the first local council in Malaya to be fully elected, and the following year was elevated to the status of a City Council as a mark of royal and official esteem. Subsequently, Penang became the first and only State in Malaysia to have the whole territory of the State under the government of five local councils that were 100% elected.</p>
<p>Unfortunately, those in power in the Federal Government were not so pleased by the successes of local councils run by opposition parties at the local level. In 1961, the Federal Government abolished the elected Kuala Lumpur Municipal Council, and in 1965 issued an Emergency Regulation suspending local government elections throughout the States of Malaysia, using the excuse of the Confrontation with Indonesia.</p>
<p>The Prime Minister at the time, Tunku Abdul Rahman, promised the Dewan Rakyat that local government elections would be restored once the Confrontation was over. He said:</p>
<p>As soon as this peace and quietness has returned we would make haste with all proper preparations for the local council elections … The very moment peace is declared I can assure this House that the elections will be held. </p>
<p>However, although the Confrontation with Indonesia ended in 1966, local government elections were not restored as promised by the Alliance Government. In 1968, a Royal Commission on Local Government headed by Senator Athi Nahappan recommended that local government elections be restored, but this was rejected by the Federal Government. </p>
<p>Although the existing Proclamations of Emergency in Malaysia have now all been revoked, sections 10 &#038; 15 of the Local Government Act 1976 prevent the holding of local government elections under Federal law. To-date BN cannot give any reasonable explanation why Malaysians can elect their State and Federal governments or can select their Prime Minister and Chief Minister, but is denied to elect their own Councillor or Council President.</p>
<p>Restoring the “third vote” has long been a fundamental demand and commitment of the DAP, and in 2008, the Pakatan Rakyat Penang State Government was elected on manifesto commitments to implement local government elections, in order “to ensure accountability and efficiency” and “to create greater accountability at every level of government”.</p>
<p>On 14 July 2009, YB Chow Kon Yeow, the Penang State Exco for Local Government and Traffic Management, wrote to the Federal Government to ask for local government elections to be put on the agenda of the National Council of Local Government, but this request was refused. </p>
<p>Subsequently, on 11 August 2009, the Penang State Assembly passed a resolution calling upon the Federal authorities to take action to reinstate local government elections, but this resolution was again met with refusal.</p>
<p>A three-man legal panel consisting of Dato&#8217; Yeo Yang Poh, Mr Tommy Thomas and Mr Malik Imtiaz was then retained by the State Government, and it advised that the reintroduction of local government elections was within the powers of the State. </p>
<p>On 4 March 2010, I wrote to the Election Commission asking it to conduct local government elections to the MPPP and MPSP, but the Election Commission refused. On 12 March 2010, I also wrote to the Prime Minister offering to meet with him to discuss the State Government&#8217;s position but again received no response.</p>
<p>The State Government has been advised that local government is a State matter under the Federal Constitution, and the State Authority has the power under section 1(4) of the Local Government Act 1976 to exempt any local government area from any or all of the provisions of the Act. </p>
<p>On 18 January 2012, the State Government therefore decided, 45 years after the end of the Confrontation, to exercise its powers to exempt both the MPPP and the MPSP from section 15 of the Local Government Act 1976, which had rendered inoperative all legal provisions relating to local government elections. This was gazetted on 12 April 2012.</p>
<p>The State Government has now tabled a bill in the State Assembly, entitled the Local Government Elections (Penang Island and Province Wellesley) Bill 2012, which will provide for the Election Commission to hold local government elections to the MPPP and MPSP under State law. The text of this bill is now open for your comments at this forum, and we intend to pass this bill in this sitting of the State Assembly.</p>
<p>At the same time, we do not expect that the Federal Government and the Election Commission will give up on their obstruction and refusal to conduct local government elections so easily. It is the intention of the State Government, once this bill is passed into law, to refer this dispute with the Election Commission to the Courts, so that the Election Commission will be compelled to conduct local government elections in Penang. </p>
<p>The State Government&#8217;s desire to restore local government elections is based on our belief in democracy, in a system of government of the people, by the people, for the people. We believe in particular that the past 18 years of neglect and even financial scandals in MPSP suffered by Penang can be blamed in part on the system of political appointment of councillors by the BN State Government whose abilities were always secondary to their political loyalties to BN. </p>
<p>A clear case of financial wrongdoing by BN was the extraordinary loss of RM230 million by MPSP in 7 years causing MPSP, or Majlis Perbandaran Seberang Prai, to be practically bankrupt when PR took over in 2008. Adapting stringent rules and severe cost-cutting measures, PR managed to turnaround MPSP in the first year of government, reversing years of deep deficits and losses with the first profit in 2008. Ever since MPSP has recorded surpluses every year. There is a distinct possibility that Majlis Perbandaran Pulau Pinang would have met the same fate if BN had continued in power in 2008.</p>
<p>Under the present Pakatan Rakyat State Government through appointing competent councillors who were willing to defer to the authority of the Council President, who is a government civil servant, many of these misdeeds are now being unravelled, and both local councils have been restored to financial health. By stressing on CAT governance of competency and accountability, we have managed to turn around both local councils that are now providing better public services together with growing financial surpluses. </p>
<p>With growing financial surpluses,both MPPP and MPSP have been able to provide better infrastructure in terms of cleanliness, better roads and drainage system. At a time when many cities in Malaysia  faces flash floods, the well-administered MPPP and MPSP see significantly reduced flooding as compared to before. </p>
<p>This is part of the real political transformation of Penang. Where people can live with dignity by enjoying basic freedoms – Freedom of speech, Freedom of information, Freedom of peaceful assembly, Freedom to worship, Freedom from corruption, and Freedom to choose their own Local Government.</p>
<p>We are the first State to have passed a comprehensive Freedom of Information Act. We have made Penang relatively corruption free with open tenders, full disclosure of contracts and public declaration of assets by EXCO members and Chief Minister. Today, we take another milestone by passing the Penang Local Government Enactment. If BN is genuine about political transformation, can they not do what Penang has done.</p>
<p>Although we currently have full powers to appoint all 48 local councillors in the MPPP and the MPSP, this is a power which the Pakatan Rakyat State Government will willingly return to the people of Penang to be elected by them in the interests of the aspirations of the people of Penang.</p>
<p>On Merdeka Day, Malaysians had 3 votes to exercise the right to elect their Federal govt, State govt and local councils. Let us therefore restore the 3rd vote.</p>

<p><strong>国阵必须解释，他们为何拒绝恢复民主第三票</strong></p>
<p>在我国，英国殖民地首次于1857年在乔治市推动的地方议会选举。1956年，乔治市市政局成为马来亚第一个地方政府。</p>
<p>由于联邦政府不满地方政府由在野党占据。1961年，联邦政府废除吉隆坡地方政府选举，并在1965年，以马印对抗为理由，发出紧急条例撤销全国各地地方政府选举。</p>
<p>当时的首相东姑阿都拉曼在国会中承诺，一旦马印对抗结束，政府将恢复地方议会选举，他说：<br />
“只要和平与宁静的时刻到来，我们会即刻筹备地方政府选举… ..一旦和平到来，我向国会保证，我们将重新举行地方政府选举… …”</p>
<p>马印对抗于1966年结束，但是，当年联盟（后来的国阵）所承诺的地方政府选举至今还没有恢复。1968年，由上议员阿迪纳哈班所率领的地方政府皇家委员会曾提议恢复地方政府选举，但是联邦政府却拒绝他的建议。</p>
<p>虽然现存的紧急条例已经被废除，但是，1976年地方政府法令的第10及15条文依然阻止我们在联邦法令下执行地方政府选举。直到今天，国阵都还无法提供任何合理的解释，为什么马来西亚人可以选州政府、联邦政府，可以选首相或首长，但是不能票选自己的市议员或市政局主席。</p>
<p>“还我第三票”一直以来是行动党的基本诉求，2008年，民联州政府把恢复地方议会选举列入我们的竞选宣言，以确保政府的每一个阶层的透明度和效率。</p>
<p>2009年7月14日，槟州行政议员（地方政府兼交通管理委员会主席）曹观友已经就此致函房屋及地方政府部（国家地方政府理事会秘书处），但是，这项要求被拒绝。</p>
<p>2009年8月11日，槟州州议会动议并通过，要求联邦政府恢复地方议会选举。但是，当局再一次拒绝将有关动议列为讨论事项。<br />
州政府也找来三名律师拿督杨文波、汤米汤姆斯、玛力英迪亚斯，他们建议我们行使州政府的权力，重新根据1960年地方政府法令（1991年修正），举行地方议会选举。</p>
<p>2010年3月4日，我代表槟州政府写信给选举委会员，要求选委会执行槟岛市政局及威省市政局的地方议员选举，但是选委会却拒绝这项要求。2010年3月12日，我再次致函首相，要求与他见面阐明州政府的立场，依旧是石沉大海。</p>
<p>我们被告知，在联邦宪法底下，地方政府属于州管辖事务，而州政府有权力在1976年地方政府法令第1（4）条文下，免除地方政府遵从上述法令中的任何一项或所有条文。</p>
<p>2012年1月18日，槟州行政府决定，马印对抗已经结束45年，我们将行使州政府的权力，让槟州槟岛和威省两地的地方政府可以免于实施1976年地方政府法令第15条文，并于2012年4月12日在宪报上颁布通令。</p>
<p>州政府已经在州政会提呈地方政府选举（槟岛和威省）2012年法案，这将让选举委员会可以在州法令下举行槟岛及威省市政局选举。这项法案现在在论坛收集大家的意见，我们希望能在这次州议会通过这项法案。</p>
<p>我们也预料，联邦政府和选委会不会那么轻易地让我们执行地方政府选举。这是州政府的用意，一旦这项法案变成法令，我们将可以上庭解决与选委会的歧见，选举委员会将会被迫在槟州举行地方政府选举。</p>
<p>州政府基于我们对民主的信仰，希望可以恢复地方议会选举。我们相信，过去18年发生在威省市政局的财务丑闻，部分原因是由于市议员的政治委任制，国阵州政府往往重视他们的效忠胜于他们的能力。</p>
<p>最明显的是国阵在威省七年内造成2亿3000万的损失，2008年民联接管时濒临破产。我们实施严谨的理财及开源节流措施，得以在民联执政第一年改善威省市政局的财务状况。在2008年第一次取得盈利。此后威省市政局年年有余。如果国阵继续在2008年执政，槟岛市政局也可能面对同样的局面。</p>
<p>民联州政府通过委任有能力的市议员，他们愿意遵从市政局主席，很多不良做法已经被纠正，两个地方政府的财务恢复健康状况。我们秉持能干、公信及透明原则，我们改善了两个地方政府的运作，为公众提供更好的服务和财务盈余。</p>
<p>随意财务盈余增加，两个地方政府也能够提供更好的卫生基础建设、更好的道路及排水系统。当马来西亚全国各地不断地面对闪电水灾，我们可以看到在两个地方政府的管理下，两地的水灾情况有所缓解。</p>
<p>这是槟州的真正政府转型。人民活得有尊严，享受基本自由- 言论自由、资讯自由、集会自由、宗教自由、免于贪污、选出地方政府的自由。</p>
<p>目前，虽然我们有权委任槟岛及威省的48名市议员，但是我们为了槟州人民的利益，我们愿意还政予民，让他们选出市议员。</p>
<p>我国独立时，马来西亚人民曾经拥有三张票，选出联邦政府、州政府及地方政府。现在，让我们恢复地方议会选举，还我民主第三票。</p>

<p>Terlebih dahulu saya ingin mengambil kesempatan untuk mengucapkan ucapan penghargaan dan tahniah kepada jawatankuasa pengelola yang bertungkus lumus dalam memastikan perjalanan majlis pada hari ini dapat berjalan dengan lancarnya.</p>
<p>Bagi pihak Kerajaan Negeri Pulau Pinang, saya mengalu-alukan kehadiran 343 pelajar cemerlang SPM tahun 2011 ke majlis yang serba ringkas tetapi amat bermakna ini. Saya ingin mengambil kesempatan untuk mengucapkan syabas dan tahniah atas kejayaan yang diperolehi hasil daripada usaha gigih dan tekun yang telah berjaya dilaksanakan selama ini serta dorongan dan sokongan yang tidak pernah jemu daripada para guru dan ibu bapa.</p>
<p>Ini merupakan tahun ke- 4 majlis seumpama ini diadakan sejak Kerajaan Negeri mengambil alih tampuk pemerintahan negeri Pulau Pinang pada tahun 2008.</p>
<p><span id="more-2282"></span>Daripada jumlah 343, seramai 59 orang pelajar mendapat keputusan semua A+ dalam semua mata pelajaran yang diambil, 250 orang pelajar mendapat A dalam semua mata pelajaran (kombinasi A+ dan A sahaja) manakala 28 orang pelajar memperolehi minima 10A (kombinasi A+, A- dan  A). Kalau tahun lepas kita beri RM250 sahaja kepada semua pelajar yang memperolehi A+ dalam semua mata pelajaran tetapi tahun ini kita naikkan RM50 menjadikan jumlah sebanyak RM300. Begitu juga untuk kategori-kategori lain seperti kategori pelajar terbaik. Sebelum ini kita hanya beri RM150 tetapi tahun ini kita naikkan sebanyak sekali ganda menjadikannya sebanyak RM300.Ini jelas menunjukkan Kerajaan Negeri Pakatan Rakyat Pulau Pinang sentiasa peka dengan tuntutan arus kehidupan zaman kini selaras dengan konsep kerajaan berjiwa rakyat yang sentiasa menjaga kebajikan anak-anak tempatan tanpa mengira latar belakang, kaum dan jantina.</p>
<p>Kerajaan Negeri telah memperuntukkan sebanyak RM91,700 untuk diagihkan mengikut kategori termasuk pelajar terbaik mengikut kategori, pelajar  istimewa (khas) dan sekolah terbaik. Peruntukan ini semakin meningkat dari tahun ke ke tahun di mana pada tahun 2008, kita hanya memperuntukkan RM32, 000 , diikuti tahun 2009 sebanyak RM61, 300 dan  tahun 2010 sebanyak RM55, 950.<br />
Walaupun Pulau Pinang dipinggirkan daripada memperolehi bantuan daripada Kerajaan Persekutuan, kemampuan Kerajaan Negeri Pakatan Rakyat Pulau Pinang untuk mengadakan majlis-majlis sedemikian membuktikan Kerajaan Negeri mempunyai sumber kewangan yang secukupnya. Kita masih boleh menjalankan program-program kebajikan berikutan pengurusan sumber kewangan yang cekap dan efisien.</p>
<p>Lebihan bajet yang dicapai setiap tahun sejak Kerajaan Negeri Pakatan Rakyat Pulau Pinang pada tahun 2008 adalah urus tadbir CAT (Cekap, Akauntabiliti dan Telus). Kita telah meneruskan pemberian tahunan RM100 kepada warga emas, ibu tunggal dan OKU, serta bayaran “one-off” RM1,000 kepada waris apabila mereka meninggal dunia. Kita juga memberi RM1,000 kepada pelajar yang melanjutkan pengajian di universiti awam tempatan. RM200 untuk setiap bayi baru lahir di Pulau Pinang bermula tahun 2011. Dan yang terbaru kita akan memberikan sumbangan RM100 kepada pelajar-pelajar yang memasuki Tahun 1 dan 4 serta Tingkatan 1 dan 4. Sememangnya, wang yang diperolehi adalah 100% dari sumber yang halal hasil kempen anti-rasuah.</p>
<p>Di hadapan saya adalah muka-muka pemimpin pada masa hadapan. Bukan sahaja pemimpin-pemimpin dalam bidang ekonomi, kejuruteraan dan kedoktoran tetapi juga dalam bidang kepimpinan dan pentadbiran. Satu aspek yang ingin saya tegaskan di sini ialah tidak kira apa jua bidang yang diceburi, para pelajar perlu sentiasa ada nilai dan prinsip serta yang paling penting ialah integriti.</p>
<p>I know that all of you desire to take up careers that can make you wealthy quickly. That is normal and I encourage your to do so. But remember that wealth is not everything. There is something more important than wealth, which is health. What is the point of being rich if you do not have the health to enjoy it. The state government has looked after your health by refusing to allow any Lynas rare earth plant to operate in Penang. And also not allowing any nuclear power generators proposed by the Federal government(2) to be built in Penang.</p>
<p>Just as there is more important things in life than money, the same applies for running a state or a country. Is a rich or poor country determined solely by its wealth, natural resources or cash reserves? No, apart from wealth the people must also be allowed to live with dignity to enjoy it. What is the use of having money if you do not have human dignity to enjoy basic freedoms such as freedom of religion, freedom of speech, freedom from corruption and freedom of peaceful assembly? If a country does not enjoy these basic freedoms, it is a poor country despite its great wealth, which is the reason why Libya overthrew Muammar Gadaffi. Of course if you do not have money, you are still poor.</p>
<p>The ideal situation is for a rich country that is not only rich in wealth but also rich in freedoms that allows people to live with dignity. Penang has strived for the last four years to be successful not only financially but also in freedoms and human dignity. For the first time in history, Penang became No. 1 in attracting investments in Malaysia in 2010, To prove that this achievement was not a fluke but a fact, Penang repeated its champion performance again in 2011. During the last 2 years, Penang contributed towards 30% of Malaysia&#8217;s FDI despite being the 2nd smallest state in Malaysia.</p>
<p>But it is not only about wealth. Penang&#8217;s success is also driven by granting basic freedoms with a Freedom of Information Act, a Speakers&#8217; Square for freedom of speech as well as freedom after speech and pressing for local government elections. Penang is intent on being cleaner, greener, safer and healthier to allow Penangites to live with dignity. Perhaps this is why again for the first time in  Malaysian history, George Town Penang is a more liveable city than Kuala Lumpur. In 2011, ECA International listed George Town Penang as the most liveable city in Malaysia. Again proving that beating Kuala Lumpur was no fluke but a fact, Penang repeated that in 2012.</p>
<p>Selama 4 tahun kita telah membuktikan walaupun menghadapi kesukaran dan kesulitan, sebuah kerajaan yang bersih dapat melakukan lebih baik daripada kerajaan yang sentiasa mengamalkan rasuah. Kerajaan Negeri Pakatan Rakyat berpegang teguh dengan integriti. Kita telah buktikan dengan pentadbiran yang bersih, kejayaan dapat dikongsi bersama dengan rakyat.</p>
<p>Di majlis ini juga Kerajaan Negeri turut memberikan pengiktirafan kepada 3 buah sekolah terbaik di sekitar negeri Pulau Pinang yang dipilih berdasarkan Gred Purata Sekolah (GPS) yang diperolehi daripada Kementerian Pelajaran Sekolah. Syabas kepada sekolah- sekolah tersebut. Semoga kejayaan ini menjadi pemangkin dalam usaha untuk terus memajukan anak-anak bangsa kita.</p>
<p>Akhir kata, saya ingin mengingatkan pelajar-pelajar yang  bahawa perjalanan hidup masih jauh. Setiap kejayaan bermula daripada langkah pertama. Jangan lupa khidmat dan usaha daripada guru-guru. Oleh itu, hayatilah setiap detik perjalanan ini dengan semangat yang jitu, penuhkan dada dengan iltizam yang tinggi dan tingkatkan usaha kerana hari esok tidak menjanjikan kejayaan tanpa usaha.</p>
<p>Semoga hari esok menjanjikan masa depan yang lebih cerah dan kita harap kesemua pelajar cemerlang ini akan terus berjaya dan pulang ke Pulau Pinang untuk mencurahkan bakti</p>

<p>槟州首席部长林冠英于2012年5月6日颁发大马教育文凭优秀学生奖励金时发表演讲，重点如下：</p>
<p>在343名学生中，其中59名获得全科A＋， 在250名全科A（A+和A），另有28名学生获得至少10个A（包括A＋、A－和A）。如果去年我们只发出250令吉给获得全A＋的学生，今年我们多给50令吉，总奖励金为RM300。其它的优秀学生也一样。之前，我们只发出150令吉奖励金，今年我们增加奖励金至300令吉。显示槟州民联政府跟得上时代，时刻贯彻以民为本的精神。不分背景、种族和性别照顾我们孩子的福利。</p>
<p>州政府已经拨出9万1700令吉的奖励金给优秀学生、特殊学生及最好的学校。这项拨款每年都在增加，在2008年我们只拨出3万2000令吉，2009年为6万1300令吉，及2010年5万5950令吉。</p>
<p>虽然州政府在拨款方面被联邦政府边缘化，但是民联州政府有能力颁发奖励金，证明州政府拥有足够的财源。由于理财有当，我们还是可以推行各种福利计划。</p>
<p>我知道你们都希望从事那些能够让你们快速累积财富的事业，这是正常的，我也鼓励你们这么做。但是，要记得，财富不是人生的一切。有一件东西比财富更重要，就是健康。如果你有钱却没有健康的身体来享受，那有什么用？州政府照顾人民的健康，不让莱纳斯稀土厂建在槟城，我们也不让联邦政府在槟州兴建他们建议的两座核能发电厂。</p>
<p>在管理一个国家也一样，一个富国或穷国是否以财富、天然资然或现金储备来衡量？不是，除了财富，人们也必须可以活得有尊严来享受这些财富。如果你很有钱，却没有享受基本的自由如宗教自由、言论自由、免于贪污的自由和和平集会的自由，那有什么用？如果一个国家没有这些基本自由，就算它很有钱，它也是一个穷国，这就是为何利比亚人民推翻卡达菲政权。当然，如果你没有钱，你还是很穷。</p>
<p>一个理想的富国，不只拥有财富而已，也拥有自由，让人民活得有尊严。槟州在过去四年，不只在理财方面取得成功，也赋予人民自由及尊严。我们在2010年的所获投资额全国居冠，2011年再次全国第一，虽然是全国第二小的州属，过去两年，我们贡献了马来西亚外国直接投资的30%。</p>
<p>槟州也成功保障基本自由如资讯自由、言论者广场的言论自由及推动地方政府选举。槟州也立志打造一个更清洁、绿意、安全及健康的州属，让槟州人民活得有尊严。或许这也是为了马来西亚历史上，槟州乔治市成为比吉隆坡更宜居的城市。2011年，国际人力资源机构”(ECA International)将槟州乔治市列为马来西亚最宜居的城市。在2012， 我们再次超越吉隆坡。</p>

<p><strong>The Recent Case of the New Straits Times’ Deliberate Lies and Fabrication of News Against Australian Senator Nick Xenophon Demonstrates why the Chief Minister is Compelled Not to Invite the Unethical UMNO-linked Press to his Functions Purely as an Act of Self-Defence;  Chief Minister Lim Guan Eng Will Sue the New Straits Times Press and Utusan Melayu (Bhd) for the False Report of a Dinner with Senior Singapore PAP Leaders where National Secrets were Allegedly Disclosed<br />

The recent case of the New Straits Times’ deliberate lies and fabrication of news against Australian Senator Nick Xenophon demonstrates why I am compelled not to invite the unethical UMNO-linked press to my functions purely as an act of self-defence against such accomplished serial liars. </p>
<p><span id="more-2277"></span>The New Straits Times has admitted that it falsely replaced the word “Scientology” with “Islam” in a speech quoted in its 2 May 2012 news report, which claimed that the Australian Senator had called Islam a “criminal organisation” and which accused him of being “anti-Islam”.</p>
<p>Like Senator Xenophon, Malaysians are also sickened by the UMNO-linked press’s blatant fabrication of lies passed off as news to the Malaysian public. The Penang State Government is therefore fully justified in refusing to allow its press conferences and State functions to be deliberately misreported and misrepresented by the UMNO-linked press. Although we believe in the freedom of the press, the refusal of the UMNO-linked media to abide by the basic ethics of truthful journalism, and their refusal to give me the right of reply to correct false news,  leaves me without any choice but to act in self-defence by declining any news coverage from the UMNO-owned papers. Much as we want news coverage, better no coverage than coverage filled with hurtful lies, slander and falsehoods. </p>
<p>It has been reported that Senator Xenophon intends to go ahead and sue the New Straits Times for the damage that has been done to his reputation, despite the newspaper’s admission of guilt and statement of regret. In the case of a false news report carried by the New Sunday Times, Mingguan Malaysia and Berita Minggu on 2 October 2011, which was defamatory of me, Datuk Mohamed Azman Yahya and Datuk Seri Kalimullah Hassan, I have not received a single word of apology or of clarification. </p>
<p>These articles published in the UMNO-linked press carried PERKASA’s allegation that I, together with Datuk Azman and Datuk Seri Kalimullah, had attended a dinner with senior Singapore PAP leaders at which Malaysian national secrets were allegedly discussed. No attempt was made by these “newspapers” to clarify the allegation by contacting the parties alleged to have been involved. </p>
<p>These UMNO-linked “newspapers” have since apologised to Datuk Seri Kalimullah and to Datuk Azman for their false and defamatory allegation, but for political reasons have refused, in spite of my lawyers’ requests, to pay any damages or to publish any clarification or apology concerning the allegations against me.</p>
<p>I am therefore announcing that I will be instructing my lawyers to proceed to file an action for defamation in the High Court against PERKASA, the New Straits Times Press and Utusan Melayu (Bhd). I do not have the resources and ability to file a court defamation action every time the UMNO-linked media defame me. Even without their news coverage, the New Straits Times has continued to run defamatory articles against me. Imagine how many more court actions I would have to file if they were invited to run riot with lies at my news conferences.</p>

<p>最近《新海峡时报》针对澳洲上议员尼克色诺芬恶意谎言及虚假新闻，可以说明为何首长出于自卫，被迫不邀请没有职业道德的巫统关联媒体出席他的活动；槟州首长也将起诉《新海峡时报》和《马来西亚前锋报》的假新闻，诬指我们在与新加坡资深人民行动党领袖共进晚餐时，泄漏国家机密。</p>
<p>最近《新海峡时报》针对澳洲上议员尼克色诺芬恶意谎言及虚假新闻，可以说明为何我出于自卫，被迫不邀请没有职业道德的巫统关联媒体出席我的活动，以提防这些不择手段的系列谎言。 </p>
<p>《新海峡时报》承认它在2012年5月2日的报道中，误将有关澳洲上议员致词中的“科学论派（Scientology）”写成“伊斯兰（Islam）”，诬指他将伊斯兰称为“犯罪组织”并指他“反回教”。</p>
<p>正如澳洲上议员色诺芬，马来西亚人也对巫统关联媒体一再散布虚假谣言感到厌倦。因此，槟州政府拒绝这此媒体出席记者会及州属活动，以提防他们错误报道或诠释，完全合情合理。虽然我们相信新闻自由，但是，巫统关联媒体却不愿意遵守新闻的基本伦理- 真实性，他们也不愿给我回应错误新闻的权利，让我别无选择，只好进行自卫，拒绝巫统所属报章的报道。虽然我们也希望获得新闻报道，但是，与其让报章充斥伤害性谎言、诽谤及虚伪报道，还不如不要报道。</p>
<p>尽管《新海峡时报》已经道歉认错，但据报道色诺芬有意起诉《新海峡时报》 ，该报章已经对其名誉造成损伤。在2011年10月2日由《新海峡时报星期刊》、《每日新闻星期刊》及《每日新闻》都诽谤拿督莫哈末阿兹曼、拿督斯里卡立慕和我的虚假新闻，到今天，这些报道都还没有道歉或澄清。</p>
<p>这些巫统关联媒体所刊登的文章指中，土权组织伪称拿督阿兹曼、拿督斯里卡立慕都和我，一同与新加坡人民行动党资深领袖共进晚餐，并指我们讨论国家机密。这些报章完全没有意图联络相关人士进行澄清。</p>
<p>这些巫统关联报章后来针对本身的虚假、诽谤性言论道歉向拿督斯里卡立慕都和拿督阿兹曼道歉，但是尽管我的律师要求，基于政治理由，他们不愿针对我的指控赔偿损失或刊登任何澄清、道歉启示。</p>
<p>因此，我宣布，我将会指示我的律师入禀高庭，起诉土著权威组织、《新海峡时报》、《马来西亚前锋报》。我没有那多么资源和能力，在每次巫统关联媒体诽谤我时都起诉他们。就算他们没有报道，《新海峡时报》也一直撰写诽谤性文章针对我。可以想像，如果他们受邀出席我的新闻发布会，他们必会肆意制造谎言，到时，我到底要入禀多少次法庭。</p>

<p>Press freedom is essential in any functioning democratic society, is clearly under threat in Malaysia. In the aftermath of the Bersih 3.0 debacle that saw not only innocent protesters but also media workers such as reporters and photographers being manhandled, beaten up and their camera equipment destroyed, there is no doubt that press freedom in our country is deteriorating and getting more restricted.</p>
<p><span id="more-2274"></span>Earlier this year, there was short-lived joy as Malaysia gained 19 places in the 2011/2012 World Press Freedom Index by Reporters Without Borders to 122nd place, compared to being ranked 141st in 2010. In actual fact, we have actually regressed because we were ranked 92nd in 2006, and have merely regained some lost ground. That said, being ranked joint-122nd on the same level as Tajikistan and Algeria is not something we can be proud of. Even Cambodia fared better at rank 117th.</p>
<p>In light of recent events, Malaysia’s ranking is set to take a dive. Nearly 20 reporters and photographers were reported to have been assaulted police during the Bersih 3.0 rally, including The Sun reporter Radzi Razak who was assaulted by up to 15 police officers.</p>
<p>Even reporters from international agency Al-Jazeera were not spared, as they reported Al Jazeera cameraman Ray Jones was punched at the head while Al Jazeera’s correspondent Harry Fawcett was roughed up while they tried to film an officer beating up a protester. </p>
<p>Worse, BBC and Al-Jazeera’s news coverage was censored by Astro for breaching local content regulations. To date, neither the Home Ministry nor Astro has clarified what the local content regulations were.</p>
<p>The fact that the police did indeed beat up members of the media is irrefutable. Prime Minister Dato Seri Najib Tun Razak himself whispered an apology to the Sun reporter Radzi Razak who was warded to hospital after the beating and the Inspector General of Police Tan Sri Ismail Omar apology to another victim of police brutality, Malay Mail reporter Muhammad Ariff. </p>
<p>DAP regrets that the Minister of Home Affairs Datuk Seri Hishamudin Tun Hussein Onn’s stated that the issue must be looked at in the right context because those allegedly beaten by protesters are worse off than those beaten by the police. Hishamuddin’s statement is shocking as it appears to give police the right to illegally beat up protesters. Whilst DAP supports action against demonstrators who turn violent, action must also taken against violence by policemen on peaceful demonstrators.</p>
<p>The public is sceptical whether the new independent panel set up by the Home Ministry to investigate complaints of police brutality will result in any action when no action is taken by the police on attacks against reporters in July last year at the Penang Bridge and at the anti-Lynas rally at Speaker’s Corner in Esplanade, Penang on 26 February. In the first incident 2 reporters were attacked last year when covering a demonstration involving UMNO at the Penang Bridge. </p>
<p>At an Anti-Lynas rally on 26 February 2012, UMNO and Perkasa members violently attacked and injured two reporters. One of the reporters had to endure 8 stitches to close his injury. Up to now, not a single person has been either arrested or charged by the Penang police. If even UMNO and Perkasa gangsters are not charged in court for beating up reporters, how can the public hope that the police will charge policemen involved in beating up reporters?</p>
<p>Any talk about transformation and greater freedom has been nothing more than lip-service. Until and unless an Independent Police Complaints and Misconduct Commission (IPCMC) is formed and the Printing Presses and Publications Act abolished, there will never be true press freedom in Malaysia.</p>
<p>DAP expresses full support for all Malaysians to dress in black and pin a yellow ribbon to commemorate World Press Freedom Day today with many Chinese newspapers printing in black today. This occasion is important for press freedom and all Malaysians to stand in solidarity with not just Malaysians assembling peacefully but also the reporters and photographers who were either beaten, had their cameras taken away or smashed during Bersih 3.0 rally.</p>

马来西亚在2012-2013年世界新闻自由指数排名下滑是必定的（目前在178个国家中排名122），特别是警察在净选盟3.0及槟州反莱纳斯两场集会中，粗暴对待记者和摄影记者。</strong></p>
<p>新闻自由是任何功能健全的民主社会的要素，在马来西亚，新闻自由被侵犯着。在净选盟3.0集会中，不只是无辜的集会参与者受到暴力对待，就连媒体工作者如记者、摄影记者的摄影器材也被毁坏，无疑地，我国的新闻自由情况不断恶化、打压更加严厉。</p>
<p>今年初， 马来西亚刚刚为无边界记者的2011/2013新闻自由指数排名上升到122名而感到欢喜，这个排名比2010年141名上升19位。但是，我们其实在退步，因为我们在2006年排名第92位，我们只是赢回一点点。意思说，与塔及克斯坦、爱尔及利亚同样排名122并不值得骄傲，就连柬埔寨的排名117都略胜一筹。</p>
<p>最近发生了那么多事，马来西亚的排名肯定又将滑落，在净选盟3.0集会中，将近20名记者和摄影记者遭警方粗暴对待，包括被15名警察围殴的《太阳报》记者拉兹拉萨。</p>
<p>就连国际通讯社《半岛电视台》也没有幸免，他们的报导指出，他们的录像记者雷琼斯的头部中拳，而通讯员哈里弗吉企图拍摄一名警员殴打集会者的片段时，也遭围殴。</p>
<p>更糟的是，英国广播电台和半岛电视台的新闻，被指触犯我国媒体内容条例而被Astro电视台检查。至今，内政部和Astro电视台都没有说明到底他们触犯什么媒体内容条例。</p>
<p>事实上，警方殴打媒体工作者是不争的事实。首相拿督斯里纳吉在《太阳报》 记者拉兹拉萨被打送院后，在其耳边轻声道歉。而总警长丹斯里依斯迈奥玛也向另一名警察暴力受害者《马来邮报》记者莫哈末阿力夫道歉。</p>
<p>民主行动党对于内政部长拿督斯里希山慕丁说，我们看这个课题的真实内容，因为那些被集会者殴打的情况比被警员殴打的情况还严重。希山慕丁的言论令人震惊，看来，警员授权非法殴打集会人士。民主行动党支持采取行动，对付那些粗暴的集会者，我们也认为粗暴对待和平集会人士的警员也必须受到对付。</p>
<p>公众都很怀疑，内政部针对警方暴力新成立的独立调查团，是否又会不了了之? 去年7月， 亲巫统示威者在槟城第一大桥示威，以及今年2月26日发生在槟州旧关仔角演说者角落的反莱纳斯大集会，也发生记者遭袭击事件，前者两名记者在采访巫统涉及的集会时被殴。</p>
<p>在2月26日反莱纳斯集会中，巫统和土权组织的成员暴力致伤两名记者，其中一名受伤的记者还缝了八针。到今天，槟州警方也还没有逮捕或提控任何人。如果巫统和土权的流氓在攻击记者可以逍遥法外，当局都没有采取行动，我们真的可以指望警方会提控那些涉及殴打记者的警员吗？</p>
<p>谈什么转型、更多新闻自由都只是空谈而已。除非政府成立独立警方投诉及行为不检委员会（IPCMC）、出版及印刷法令废除，否则马来西亚不会有真正的新闻自由。</p>
<p>民主行动党全力支持全体马来西亚人穿黑衣及配戴黄丝带，来纪念世界新闻自由日，今天也有很多中文报章以黑色版面出街。这是新闻自由的重要日子，也是全体参与和平集会的马来西亚人表示团结一致，也对那些在净选盟3.0集会中被殴打、摄影器材被抢走或毁坏的记者和摄影记者表示声援支持。</p>

<p>Saya berasa kesal bahawa pada Hari Kebebasan Akhbar Sedunia, Bernama telah menyalahgunakan kebebasan untuk membuat lapuran mengelirukan tentang jawapan saya dalam mesyuarat Dewan Undangan Negeri Pulau Pinang semalam berkaitan penjualan tanah Bayan Mutiara secara tender terbuka.</p>
<p>Semalam, saya mengakui bahawa kerajaan negeri tidak mengikut penilaian yang ditetapkan oleh Jabatan Pernilaian dan Perkhidmatan Harta kerana anggaran harga itu adalah terlalu rendah. Jabatan Penilaian dan Perkhidmatan Harta dalam surat bertarikh 5 November 2009 telah menganggarkan harga sebanyak RM65 sekaki persegi. </p>
<p><span id="more-2272"></span>Sebaliknya kerajaan negeri tidak mengikuti harga R65 sekaki persegi dan menetapkan harga rizab sebanyak RM 200 sekaki persegi, iaiatu lebih 3 kali ganda daripada penilaian Jabatan Penilaian. Dalam tender terbuka yang tutup pada 31.12.2010, pemaju yang tawarkan harga paling tinggi sebanyak RM 240 sekaki persegi dipilih ataupun sebanyak RM1.07 bilion untuk 102.56 ekar.</p>
<p>Malangnya dalam laporan semalam, Bernama enggan menyiarkan harga penilaian yang disyorkan oleh Jabatan Penilaian sebanyak RM65 sekaki persegi tetapi hanya pengakuan bahawa saya tidak mengikut harga penilaian Jabatan Penilaian. Ini akan memberikan gambaran bahawa kerajaan negeri telah menetapkan harga yang lebih rendah daripada yang disyorkan oleh Jabatan Penilaian. Biasanya kerajaan BN tidak memakai tender terbuka dan akan menetapkan harga yang lebih rendah daripada harga Jabatan Penilaian.</p>
<p>Demi mengelakkan gambaran yang mengelirukan, pejabat saya telah meminta Bernama membetulkan laporan mengelirukan ini dengan menyiarkan harga penilaian oleh Jabatan Penilaian tetapi Bernama enggan buat demikian. Saya kesal dengan keengganan Bernama menyiarkan semua fakta berkaitan yang jelas disengajakan agar memberikan laporan yang mengelirukan.</p>

<p><strong>我感到遗憾，在世界新闻自由日，马新社滥用了新闻自由，以模糊的方式报道我昨天在槟州议会的有关公开招标出售峇央珍珠湾土地的问题。</strong></p>
<p>昨天，我承认州政府没有根据产业估价及服务局定下的价格，因为有关定价过低。当局在2009年11月5日的估价为每平方尺65令吉。</p>
<p>相反地，州政府并没有根据每平方尺65令吉的估价，并订下每平方尺200令吉的产业价格，比估价局高出3倍。在2010年12月31日的公开招标中，我们选择了出价最高，即每平方尺240令吉（102.6英亩总值10亿7000万令吉）的发展商。 </p>
<p>让人遗憾的是马新社昨晚的报导拒绝刊登估价局所做出的每方尺65令吉估价，可却只是刊登我没依据估价局的估价。如此将会让民众误以为州政府所拟定的底价比估价局的估价还要低。众所皆知，国阵政府在没有采用公开招标之下，通场所拟定的土地价格，都会比估价局所估的价格还要低。</p>
<p>为了避免让民众混淆，我的办公室已经要求马新社更正这则引起混淆的新闻，重新刊登估价局所做出的土地价格，可是马新社还是拒绝这么做。我非常失望马新社拒绝刊登全部的相关事实与数据，很明显的是要制造让人混淆的新闻。</p>

<p><strong>BN Federal Government’s Minimum Monthly Wage Of RM 900 In Peninsular Malaysia And RM 800 In Sabah And Sarawak Is Insufficient As It Is Not Only Discriminatory Against Workers But Demonstrates A Glaring Lack Of Commitment By BN To Reduce Poverty When It Is Far Below The Poverty Line For East Malaysia.</strong></p>
<p>Prime Minister Dato’ Sri Najib Tun Razak’s announcement of a floor wage for the private sector at RM 900 per month for workers in the Peninsular and RM 800 per month for those in Sabah and Sarawak is grossly insufficient as it is lower than Pakatan Rakyat’s RM 1,100 minimum take-home pay every month. PR had proposed RM1,100 minimum monthly take home pay, inclusive of all fixed allowances, but excluding over-time payments.</p>
<p><span id="more-2268"></span>BN Federal Government’s minimum monthly wage of RM 900 in Peninsular Malaysia and RM 800 in Sabah and Sarawak is insufficient as it is not only discriminatory against workers but demonstrates a glaring lack of commitment by BN to reduce poverty when it is far below the poverty line for East Malaysia. The reality of life in Malaysia is such that the quantum of RM900/RM800 is simply insufficient to cover the basic needs of a worker. While it will be marginal relief for the one third of workers in our country who currently earn below RM 700 per month, the fact is that RM 800 per month for Sabah and Sarawak will still mean that workers there will continue to live in poverty.</p>
<p>According to the 9th Malaysia Plan, the Poverty Line Indicator (PLI) is RM830 per month for Sarawak and RM960 per month for Sabah. This is becase the cost of living in those two states is much higher compared to the Peninsular, which has a PLI of RM720 per month. In other words, even if the RM800 per month minimum wage is implemented in Sabah and Sarawak, it will still be far below the PLI as defined by the Malaysian Government.</p>
<p>In addition to the proposed PR minimum wage of RM1,100 that will be able to meet the basic needs of workers across the country, we must also be aware that Malaysia is fast-becoming an indebted nation where families spend everything and beyond what they earn. For example, Bank Negara’s Annual Report 2010 revealed that Malaysia’s household debt at the end of 2010 was RM 581 billion or 76 per cent of GDP, thus giving us the dubious honour of having the second-highest level of household debt in Asia, after South Korea.</p>
<p>In addition, the Malaysian household debt service ratio stood at 47.8 per cent in 2010, meaning that nearly half of the average family’s income goes to repaying debts. As a rule, banks would not lend money to those whose total servicing of loans exceeded one third of their income. In other words, we are spiralling into an indebted nation.</p>
<p>Thus, even a minimum wage is not enough without two important considerations. Firstly, the minimum wage quantum must be indexed to the Consumer Price Index, so that it is adjusted  with the rate of inflation. This will ensure that standard of living and quality of life will be protected and maintained.</p>
<p>Secondly, increasing the livelihood of Malaysians also requires an holistic economic strategy that is targetted at raising disposable income. In other words, we need to put more money into people’s pockets. However, this cannot be done just by setting a minimum wage. In the larger picture, we have to address the influx of unskilled foreign workers and their wage-suppressing effect, upgrade skills and productivity of our local workforce and also increase the participation of women in the workforce.</p>
<p>Besides that, the government must also invest in key sectors such as public transport, housing and healthcare. If cost of living is lower, disposable income will automatically increase. This concept is very simple – if it costs less to commute, buy a house and pay medical bills, then everyone will have more money. Imagine if every Malaysian had just RM10 extra every day, the economic multiplier effect will result in RM280 million extra circulating in the economy every day. That is no small amount. In other words, if we can increase the purchasing power of our people, especially amongst the lower-income groups, we will be able to increase domestic demand and create a healthier economy for all Malaysians.</p>
<p>Therefore, we are extremely disappointed with the minimum wage of RM900 in Peninsular and RM800 in Sabah and Sarawak set by the Federal Government, which is not only insufficient to cover the basic needs of workers, but in fact below the poverty line indicator of RM830 per month in Sarawak and RM960 per month in Sabah.</p>
<p>As for the Penang State Government, we are committed to the PR-proposed figure of RM1,100 and in fact have already achieved the minimum monthly wage of RM1,100 (including allowances and cost of living) excluding overtime. In other words, all government servants in all state agencies and GLCs in Penang as well as the local councils MPPP and MPSP get much more than RM 1,100 monthly. Last year, the lowest paid road sweeper and drain cleaners at local authorities in Majlis Perbandaran Pulau Pinang and Majlis Perbandaran Seberang Perai were given an extra monthly incentive of RM150.</p>

<p>Pengumuman Perdana Menteri Dato’ Sri Najib Tun Razak bahawa gaji minima bagi sektor swasta ditetapkan pada kadar RM900 sebulan untuk pekerja di Semenanjung dan RM800 sebulan di Sabah dan Sarawak adalah sangat tidak mencukupi kerana ia adalah lebih rendah daripada gaji minima yang disyorkan Pakatan Rakyat iaitu RM1,100 sebulan. PR telah mencadangkan RM1,100 sebagai gaji minima yang merangkumi semua elaun tetapi tidak termasuk bayaran lebih masa.</p>
<p>Penetapan gaji minima RM900 sebulan di Semenanjung Malaysia dan RM800 di Sabah dan Sarawak oleh Kerajaan Persekutuan BN tidak mencukupi dan bukan sahaja mendiskriminasikan pekerja tetapi menunjukkan kekurangan komitmen oleh BN untuk membasmi kemiskinan kerana ia jauh di bawah garis kemiskinan di Malaysia Timur. Hakikatnya, kuantum RM900/RM800 adalah terlalu rendah dan tidak mencukupi untuk menanggung kos sara hidup seorang pekerja. Walaupun ia akan membawa sedikit kelegaan kepada satu pertiga pekerja di negara kita yang kini berpendapatan kurang daripada RM700 sebulan, hakikatnya RM800 sebulan untuk Sabah dan Sarawak bermakna bahawa pekerja-pekerja di sana akan terus hidup dalam kemiskinan.</p>
<p>Mengikut Rancangan Malaysia Ke-9, garis kemiskinan (PLI) adalah RM830 sebulan bagi Sarawak dan RM960 di Sabah. Ini adalah kerana kos sara hidup di kedua-dua negeri itu adalah lebih tinggi berbanding di Semenanjung, yang mempunyai PLI RM720 sebulan. Dalam erti kata lain, meskipun gaji minima RM800 dilaksanakan di Sabah dan Sarawak, ia masih lagi jauh d bawah PLI yang ditetapkan oleh Kerajaan Malaysia.</p>
<p>Tambahan kepada gaji minima RM1,100 sebulan yang dicadangkan PR, dan yang berupaya untuk memenuhi keperluan asas pekerja-pekerja di serata negara, kita harus sedar bahawa Malaysia sedang menjadi negara penghutang di mana isi-isi rumah kita membelanjakan semua dan lebih daripada pendapatan mereka. Sebagai contoh, Laporan Tahunan Bank Negara 2010 telah mendedahkan bahawa hutang isi rumah Malaysia pada akhir 2010 berada di tahap RM581 bilion ataupun 76 peratus daripada Keluaran Dalam Negara Kasar (KDNK), lantas “menobatkan” Malaysia sebagai negara dengan hutang isi rumah yang tertinggi di Asia selepas Korea Selatan.</p>
<p>Tambahan pula, nisbah bayaran hutang isi rumah Malaysia berada di tahap 47.8 peratus pada tahun 2010, atau dalam erti kata lain, setengah daripada pendapatan isi rumah digunakan untuk pembayaran hutang. Biasanya, institusi kewangan tidak akan memberi pinjaman jika jumlah bayaran hutang melebihi satu pertiga pendapatan. Dengan kata lain, Malaysia kian menjadi negara penghutang.</p>
<p>Oleh itu, gaji minima tidak mencukupi tanpa dua pertimbangan yang mustahak. Pertama, kuantum gaji minima haruslah dikaitkan secara langsung kepada Indeks Harga Pengguna, supaya ia akan disesuaikan dengan kadar inflasi. Ini akan memastikan taraf dan kualiti kehidupan tidak terjejas dan akan dilindungi.</p>
<p>Kedua, usaha menaikkan taraf kehidupan rakyat Malaysia memerlukan strategi ekonomi yang tuntas dan disasarkan kepada kenaikan pendapatan boleh guna. Dalam erti kata lain, kita harus memastikan rakyat mempunyai lebih banyak wang dalam saku. Ini tidak boleh dilakukan hanya dengan menetapkan gaji minima. Dalam konteks yang lebih besar, kita harus menangani kemasukan buruh asing tidak mahir dan kesan tekanan gaji yang menyusul sebagai akibatnya, meningkatkan kemahiran dan produktiviti pekerja tempatan dan juga meningkatkan penyertaan wanita dalam tenaga kerja.</p>
<p>Selain itu, kerajaan harus melabur dalam sektor-sektor utama seperti pengangkutan awam, perumahan dan kesihatan. Jika kos sara hidup diturunkan, pendapatan boleh guna akan meningkat. Konsepnya adalah mudah – jika kos dikurangkan untuk perjalanan ulang-alik ke tempat kerja, membeli rumah dan membayar bil kesihatan, maka semua orang akan mempunyai lebih banyak wang. Bayangkan sekiranya setiap rakyat Malaysia mempunyai RM10 lebih setiap hari, kesan pengganda ekonomi adalah besar iaitu RM280 juta lebih akan diedarkan dalam ekonomi setiap hari. Ini bukan jumlah kecil. Dalam erti kata lain, jika kita boleh meningkatkan kuasa membeli rakyat kita terutamanya di kalangan golongan berpendapatan rendah, kita akan berjaya meningkatkan permintaan tempatan dan mewujudkan ekonomi yang lebih sihat di Malaysia.</p>
<p>Oleh itu, kita sangat kecewa dengan gaji minima RM900 sebulan di Semenanjung dan RM800 sebulan di Sabah dan Sarawak yang ditetapkan oleh Kerajaan Persekutuan, yang bukan hanya tidak mencukupi untuk menanggung keperluan asas pekerja-pekerja, tetapi juga jauh lebih rendah daripada garis kemiskinan RM830 sebulan di Sarawak dan RM960 sebulan di Sabah.</p>
<p>Bagi Kerajaan Negeri Pulau Pinang pula, kita komited kepada cadangan PR iaitu RM1,100 sebulan dan sebenarnya sudah pun mencapai gaji minima RM1,100 (termasuk elaun dan COLA) tanpa mengira bayaran lebih masa. Dalam kata lain, semua kakitangan kerajaan di dalam semua agensi kerajaan negeri dan GLC di Pulau Pinang serta majlis-majlis perbandaran MPPP dan MPSP mempunyai pendapatan lebih daripada RM1,100 sebulan. Tahun lepas, penyapu jalan dan pencuci longkang di MPPP dan MPSP juga telah diberi insentif bulanan sebanyak RM150 sebulan.</p>

<p><strong>国阵联邦政府制定的马来半岛每月最低薪资900令吉以及沙巴、砂拉越两州每月最低薪资800令吉是不足够的，因为这不只是对工人的歧视，也显示国阵没有诚意扫除贫穷，因为这个最低薪资远远不及东马的贫穷水平线。</strong></p>
<p>首相拿督斯里纳吉宣布私人界的最低薪资分别是马来半岛900令吉、沙砂两州800令吉，这是不足够的，它比民联的1100令吉扣税后实得工资还低。民联建议把最低薪资订在1100令吉（扣税后的实得工资），包括所有固定津贴，但是不包括超时工资。</p>
<p>国阵联邦政府制定的马来半岛每月最低薪资900令吉以及沙砂两州每月最低薪资800令吉是不足够的，因为这不只是对工人的歧视，也显示国阵没有诚意扫除贫穷，因为这个最低薪资远远不及东马的贫穷水平线。 在马来西亚的生活现实是，900令吉或800令吉根本不足以应付一名员工的基本生活需求。它对于我国三分之一每月赚取低于700令吉的工人来说，或许是一个小小的安慰，但事实上，沙砂两州每月最低800令吉意味着当地的工人还是继续生活在贫困当中。</p>
<p>根据第九大马计划，砂拉越州的贫穷水平线为每月830令吉，而沙巴为每月960令吉。这是因为这两个州属的生活水平比马来半岛还高，马来半岛的贫穷线为每月720令吉。换句话说，就算在沙砂两州推行每月800令吉最低薪资，它还是远远不及马来西亚政府订下的贫穷水平线。</p>
<p>除了民联所提议的最低薪资1100令吉能够满足全国工人的基本需求，我们也要了解到，马来西亚已经快速成为举债国，几乎每个家庭的花费都超出他们所赚的。例如，2010年国家银行年度报告指出，马来西亚的家庭债务在2010年底是5810亿令吉或占国民生产总值的76%，让我们成为亚洲继韩国之后，家庭债务第二高的国家。</p>
<p>此外，我国的家庭债务偿债比率在2010年为47.8%， 意味着每个家庭平均有一半的收入是用来还债的。一般上，银行不会借钱给那些债务超过收入三分之一的人士。换句话说，我们正渐渐成为过度举债的国家。</p>
<p>因此，如果不考虑两个要素，单单拥有最低薪资是不够的。第一、最低薪资必须能够反映消费人指数。因此它必须依据通膨率调整。这才能够确保这项政策有助于保障及维持人民的生活水平及素质。</p>
<p>第二，随着马来西亚人民生活的提升，我们必须推出全方位的经济政策，以提高可支配收入为目标。换句话说，我们需要把钱放入人民的口袋。但是，这不能只是单靠制定最低薪资。长远来说，我们必须解决无技能外劳涌入以及他们压低工资的影响。我们必须提升本地员工的技能及生产力、同时增加女性在工作的参与。</p>
<p>此外，政府也必须投资在关键领域如公共交通、房屋及保健。如果生活水平降低、可支配收入自然会增加。这个概念很简单，如果人民在交通、房屋及医药方面的花费减少，那么每个人自然会有多一点钱。让我们想像，如果每个马来西亚人每天都多花10令吉，每天将会有额外的2亿8000万令吉在流通，产生经济倍增效应。这不是一笔小数目。如果我们可以增加人民的购买能力，特别是低收入群，我们将能够创造内需，为全民打造更健康的经济。</p>
<p>因此，我们对于联邦政府制定的最低薪资（马来半岛900令吉及沙砂两州800令吉）感到极度失望，这不只不足以应付一名工人的基本消费，事实上还低于砂拉越及沙巴州的贫穷水平线，即830令吉及960令吉。</p>
<p>至于槟州政府，我们支持民联所制定的最低薪金1100令吉，在事实上也达致每月1100令吉最低薪资（包括生活津贴），不包括超时工资。换句话说，槟州政府已经达到最低薪资1100令吉（包括生活津贴），不包括超时工资。换句话说，所有政府机构及官联公司，包括槟岛市政局及威省市政局的公务员，每个月都会获得超过1100令吉。去年，最低收入的清道夫及清沟员工，每个月也额外获得150令吉的奖掖。</p>

<p><strong>All Malaysians Should Dress In Black And Pin A Yellow Ribbon On 3 May 2012 Not Only To Commemorate World Press Freedom Day But Also Stand In Solidarity With The Reporters And Photographers Who Either Beaten, Had Their Cameras Taken Away Or Smashed As Well As Were Victimised By Police Brutality During Bersih 3.0 Rally In Kuala Lumpur.</strong></p>
<p>DAP fully supports and urges all Malaysians to dress in black and pin a yellow ribbon on 3 May 2012 not only to commemorate World Press Freedom day but also stand in solidarity with the reporters and photographers who either beaten, had their cameras taken away or smashed as well as were victimised by police brutality during Bersih 3.0 Rally in Kuala Lumpur</p>
<p>The public should stand in solidarity with media workers and reporters who became victims of police brutality during the peaceful Bersih 3.0 rally in Kuala Lumpur last Saturday. That the police did indeed beat up members of the media is irrefutable when the Prime Minister himself whispered an apology to the Sun reporter Radzi Razak who was warded to hospital after the beating.</p>
<p><span id="more-2266"></span>We strongly condemn the ugly scenes last Saturday at the Bersih 3.0 rally where many protesters, including media workers and reporters, were indiscriminately attacked and injured by police officers. Numerous reports have come in about incidents of police brutality, including Sun reporter Radzi Razak who was assaulted by up to 15 police officers, while a Malay Mail photographer was punched by the police and had his camera destroyed. A Malaysiakini reporter was arrested and his camera equipment confiscated. Even reporters from international agency Al-Jazeera were not spared, as they reported being roughed up while they tried to film an officer beating up a protester.</p>
<p>What has our country turned into when even the sacred rule of freedom of the press can be openly, publicly and blatantly violated. In the past, freedom of the press was curtailed secretly and not publicly with the BN imposing self-censorship by the editors. To make matters worse, Home Minister Datuk Seri Hishamuddin Hussein had the audacity to brush the allegations away by claiming that it was Standard Operating Procedure (SOP) for the police to confiscate camera equipment. However, the Inspector-General of Police Tan Sri Ismail Omar himself has now come out to contradict Hishamuddin by insisting that seizing camera equipment was not part of police SOP.</p>
<p>If the IGP is correct, then Hishamuddin must apologise to every reporter who was assaulted. He must also order an investigation into the misconduct of the police and bring those guilty to justice. There must be no cover up, or he will risk ruining what little reputation is left of the police.</p>
<p>Malaysians have great doubts as to whether a full and proper investigation will be fruitful and action taken against the perpetrators. We are reminded of similar police inaction in an incident at the First Penang Bridge on July last year when again pro-UMNO demonstrators disrupted traffic flow and beat up 2 reporters. To-date no one was arrested. </p>
<p>The second more serious accident happened again in an anti-Lynas rally in the Speaker’s Corner in Esplanade in Penang on 26 February,  UMNO and Perkasa members behaved like thugs, violently attacking and injuring 2 reporters during an anti-Lynas rally. One of the reporters had to endure 8 stitches to close his injury. </p>
<p>The policemen present just stood by and did not act to stop or arrest those involved in the barbaric attacks of UMNO and Perkasa members attacking peaceful anti-Lynas demonstrators and physically force the anti-Lynas demonstrators to leave. Up to now not a single person has been either arrested or charged by Penang police.</p>
<p>If UMNO and Perkasa ordinary thugs can get away with assaulting reporters in Penang, with no action taken to date despite plenty of photo and video evidence, can we really expect any justice when it is the police themselves perpetrating the act this time? Only an independent inquiry comprising international experts can trusted with providing a credible report on how to apportion blame to the police so that we can find out the truth of what happened.</p>

<p>DAP menyokong penuh dan menyeru agar semua rakyat Malaysia memakai hitam dan pin reben kuning pada 3 Mei 2012 bukan sahaja untuk memperingati Hari Kebebasan Akhbar Sedunia tetapi juga untuk berdiri dalam solidariti bersama para wartawan dan jurugambar yang telah dipukul, kamera dirampas atau dipecah serta dimangsakan oleh keganasan polis semasa perhimpunan Bersih 3.0 di Kuala Lumpur.</p>
<p>Pihak awam harus berdiri dalam solidariti bersama pekerja media dan wartawan yang telah menjadi mangsa keganasan polis semasa perhimpunan aman Bersih 3.0 di Kuala Lumpur Sabtu lepas. Memang sah bahawa pihak polis telah memukul para pekerja media apabila Perdana Menteri sendiri telah membisikkan maaf kepada wartawan The Sun Radzi Razak yang telah dimasukkan ke dalam wad hospital selepas dipukul.</p>
<p>Kami mengutuk hebat adegan-adegan ganas Sabtu lepas di perhimpunan Bersih 3.0 di mana ramai pemprotes termasuk pekerja media dan wartawan telah dipukul dan dicederakan oleh pegawai-pegawai polis. Banyak laporan yang menceritakan keganasan polis, termasuk wartawan The Sun Radzi Razak yang telah dipukul oleh sehingga 15 pegawai polis, sementara seorang jurugambar Malay Mail telah ditumbuk oleh polis dan kameranya dipecahkan. Seorang wartawan Malaysiakini pula telah ditahan dan peralatan kameranya telah dirampas. Malah wartawan antarabangsa daripada Al-Jazeera pun tidak terkecuali, apabila mereka telah dikasari semasa mengambil gambar polis sedang memukul pemprotes.</p>
<p>Apakah yang sudah terjadi apabila peraturan keramat kebebasan akhbar boleh dilanggar secara terbuka, umum dan terang-terangan? Dahulu, kebebasan akhbar telah disekat secara senyap dan bukan secara umum melalui penapisan sendiri oleh para pengarang. Yang lebih teruknya, Menteri Dalam Negeri Datuk Seri Hishamuddin Hussein tergamak menyatakan bahawa tindakan untuk merampas peralatan kamera itu adalah “Standard Operating Procedure” (SOP) polis. Namun demikian, Ketua Polis Negara Tan Sri Ismail Omar sendiri telah menyatakan bahawa perampasan peralatan kamera itu bukanlah SOP polis, lantas bercanggah dengan Hishamuddin.</p>
<p>Sekiranya Ketua Polis Negara betul, maka Hishamuddin harus meminta maaf kepada setiap wartawan yang telah dipukul. Beliau harus juga memerintah agar siasatan dibuat untuk membawa pegawai-pegawai yang bersalah ke muka pengadilan. Jika ini tidak dibuat dengan terbuka dan tanpa mengaburi kebenaran, maka beliau akan lagi merosakkan reputasi polis yang sudah terhakis.</p>
<p>Rakyat Malaysia mempunyai keraguan sama ada siasatan yang penuh akan berhasil dan tindakan akan diambil ke atas pesalah. Kita teringat kepada tindakan pihak polis yang tidak membuat apa-apa dalam insiden Jambatan Pulau Pinang pada bulan Julai tahun lepas apabila pembantah pro-UMNO telah menggangu aliran trafik dan memukul 2 orang wartawan. Sehingga kini tidak ada sebarang penangkapan.</p>
<p>Insiden yang kedua pula adalah semasa perhimpunan anti-Lynas di Sudut Pidato di Padang Kota Lama, Pulau Pinang pada 26 Februari, apabila ahli-ahli UMNO dan Perkasa telah bertindak ganas dan mencederakan 2 orang wartawan. Seorang wartawan terpaksa menerima 8 jahitan kerana kecederaannya.</p>
<p>Pegawai-pegawai polis di sana hanya berdiri dan tidak menghentikan atau menangkap mereka yang terlibat dalam keganasan ahli-ahli UMNO dan Perkasa yang menyerang para pemprotes anti-Lynas yang aman. Sehingga sekarang, tidak ada seorang pun yang telah ditahan atau didakwa oleh polis Pulau Pinang.</p>
<p>Jika samseng UMNO dan Perkasa boleh bertindak ganas terhadap wartawan di Pulau Pinang tanpa sebarang tindakan diambil walaupun terdapat banyak bukti gambar dan video, bolehkah kita mengharapkan keadilan apabila pihak polis pula yang kali ini bertindak ganas? Hanya siasatan yang terdiri daripada pakar antarabangsa boleh memberi laporan yang boleh dipercayai supaya kita boleh mengetahui kebenaran apa sebenarnya yang berlaku.</p>

<p><strong>全体国人应该在2012年5月3日穿黑衣及配戴黄丝带，不只是纪念世界新闻自由日，同时也对那些在吉隆坡净选盟3.0大集会中，遭警方粗暴对待、殴打、相机被抢甚至摧毁的记者及摄影记者，表示团结支持。</strong> </p>
<p>民主行动党全力支持并促请全体马来西亚人，在2012年5月3日穿黑衣及配戴黄丝带，不只是纪念世界新闻自由日，同时也对那些在吉隆坡净选盟3.0大集会中，遭警方粗暴对待、殴打、相机被抢甚至摧毁的记者及摄影记者，表示团结支持。</p>
<p>公众应该与媒体工作者及记者站在同一阵线上， 他们在上周六净选盟3.0集会中，成了警方暴力的受害者。警员殴打媒体记者是不争的事实，在《太阳报》记者拉兹拉萨被打致入院后，首相也亲自在他的耳边道歉。</p>
<p>我们强烈谴责上个星期六净选盟3.0大集会的丑陋场面，很多示威者、包括媒体工作者及记者，都遭到警员的袭击而受伤。我们看到很多关于警方暴力的报道，包括《太阳报》记者拉兹拉萨被15名警员袭击，一名《马来邮报》记者被警员挥拳殴打、相机器材也被毁坏。一名《当今大马》记者被逮捕、相机被没收。就连国际通讯社半岛电视台也没有幸免，根据报道，他们在录取一名警员殴打示威者的片段时，遭到粗暴对待。</p>
<p>我们的国家什么时候变成这样？就连神圣的新闻自由也可以被公开地、粗暴地侵犯。过去，国阵静悄悄地打压新闻自由、新闻编辑也被逼自我审查。更糟的是，内政部长拿督斯里希山慕丁竟然胆敢说，警方没收相机是他们的标准作业程序（SOP）。不过，总警长丹斯里依斯迈奥玛已经站出来，与希山慕丁言论相反，说明没收相机器材不是警方的标准作业程序。</p>
<p>如果总警长没说错，那么，希山慕丁必须向每一名被袭击的记者道歉。他必须下令调查警方的错误行为、将这些人绳之以法。他不能掩盖事实，否则警队仅有的声誉就将被他摧毁。</p>
<p>马来西亚人对于当局是否能够进行全面及正式的调查、是否有结果、动粗者是否会遭对付感到怀疑。我们不禁想起，去年7月， 亲巫统示威者在槟城第一大桥示威、扰乱交通殴打两名记者时，警方当时也是袖手旁观。直到今天都没有人被逮捕。</p>
<p>第二宗比较严重的意外就是今年2月26日发生在槟州旧关仔角演说者角落的反莱纳斯大集会，巫统和土权组织的成员表现得像流氓那样、也反对莱纳斯大集会时致伤两名记者，其中一名受伤的记者还缝了八针。</p>
<p>当时值勤的警方也只是站在一旁，没有阻止他们或逮捕这些行为粗暴、攻击和平集会者、强行驱赶反莱纳斯集会者的巫统及土权组织的成员。到今天，槟州警方也还没有逮捕或提控任何人。</p>
<p>如果巫纺和土权的流氓在槟州攻击记者可以逍遥法外，甚至有许多图片、录像为 证，当局都没有采取行动，我们真的可以指望警方这次的粗暴行动，会有人伸张正义吗？唯有一个独立调查团（包括外国专家成员）才能提供有公信力的报告、追究警方的责任，让真相水落实出。</p>
