Akan tetapi mengapakah beliau atau BN Pulau Pinang tidak berani menyaman saya ke mahkamah kalau saya tidak bercakap benar? Saya telah menyatakan samada kerugian kepada kerajaan negeri adalah RM40 juta ataupun RM14.7 juta ataupun RM500,000 ia tetap satu skendal. Jumlah wang yang kerugian rakyat samada RM40 juta ataupun RM500,000 tidak menukar istilah skendal kepada bukan skendal samada seperti yang haram tidak boleh dihalalkan hanya kerana jumlah yang terbabit dikurangkan.

Oleh kerana BN dan Dr Teng tidak berani buat saman malu ke atas saya, mereka telah membuat suatu tuduhan serius bahawa saya lebih suka membayar RM14,7 juta pampasan dalam skendal tanah Tang Hak Ju kepada mahkamah atas kepentingan peribadi saya. Tuduhan ini adalah serius kerana menyatakan saya telah menyalahgunakan kuasa saya untuk membuat bayaran RM14.7 juta kepada Tang Hak Ju dalam mahkamah yang sepatutnya tidak dibayar.

Mahkamah telah melepaskan wang RM14.7 juta kepada Tang Hak Ju tanpa restu kerajaan negeri. Tetapi bolehkah Teng dan BN mengambil pendirian bahawa kerajaan negeri berkuasa untuk engkar perintah mahkamah?

Kerajaan negeri telah menurut perintah mahkamah dan nasihat daripada Penasihat Undang-undang Negeri Pulau Pinang yang dilantik oleh Peguam Negara. Semua rekod ada minitkan bahawa pembayaran RM14.7 juta ini dibuat atas nasihat Penasihat Undang-undang sungguhpun dengan tidak rela hati oleh kerajaan negeri. Tuduhan BN Pulau Pinang dan Dr Teng adalah sungguh tidak bertanggungjawab dan serius kerana dibuat ke atas saya atau Penasihat Undang-undang Pulau Pinang bahawa pembayaran dibuat daripada dana wang rakyat kemudian dipolitikkan isu berkenaan demik kepentingan peribadi.

Bayaran deposit RM14.7 juta merupakan 50% daripada jumlah kos ganti rugi sebanyak RM29.4 juta kepada Tang Hak Ju. Sekiranya bayaran faedah yang dianggarkan sebanyak RM10 juta diambilkira, maka jumlah kos pampasan adalah sebanyak RM40 juta. Kes ini berlaku bila kerajaan BN yang lama “tersilap’ dengan memberikan kelulusan tanah seluas 10.6 ekar dan permit kuari kepada Tang Hak Ju atas tanah yang tidak dimiliki kerajaan negeri tetapi oleh pihak swasta.

Kerajaan Negeri Pulau Pinang telah mendepositkan wang sejumlah RM14,678,135.50 ke Mahkamah Tinggi Pulau Pinang pada 18 Mei 2009 seperti yang telah diperintahkan oleh mahkamah pada 19 Febuari 2009 sungguhpun skendal tanah ini berlaku pada pentadbiran lama.Berikutan suatu keputusan oleh Mahkamah Rayuan baru-baru ini telah mengurangkan bayaran ganti rugi untuk Tang Hak Ju kepada RM500,000/-. Akan tetapi perkara ini belum muktamad kerana proses perundangan belum selesai dan mungkin dirujuk kepada Mahkamah Persekutuan

Adakah kerajaan BN bersedia menghormati prinsip akauntabiliti menanggung pembayaran sekiranya kerajaan negeri PR berjaya mengurangkan pembayaran kepada RM500,000/-.. Lagi serius jika RM14.7 juta deposit yang telahpun dibayar kepada Tang Hak Ju tidak dikembalikan kepada kerajaan negeri adakah BN Pulau Pinang dan Dr Teng rela membayar RM14.7 juta ini?

Setiausaha BN Datuk Seri Dr Hilmi Yahya pula menyatakan bahawa Suruhanjya Pencegah Rasuah Malaysia(SPRM) pun telah sahkan bahawa kes ini bukan skendal atau penipuan sungguhpun kerajaan negeri tidak dimaklumkan tentang perkara ini. SPRM sepatutnya menghubungi kerajaan negeri yang buat laporan kepada SPRM tetapi tidak dimaklumkan langsung yang seterusnya menimbulkan soalan samada SPRM bertindak hanya sebagai alat dan senjata politik BN.

我挑战槟州国阵及丁福南医生 拿出证据，证明我一味地为了私人利益，而在陈合裕土地舞弊案件还在上诉的当中，缴付了1470万令吉。我知道槟州国阵与丁福南医生对我感到生气，是因为我拒绝针对指陈合裕土地案是一宗舞弊案撤回言论或道歉。

如果我讲的话不是事实，为什么他或槟州国阵不敢告我上法庭？我已经说了，不论是造成槟州政府损失4000万令吉、还是1470万令吉或是50万令吉，舞弊就是舞弊。人民钱财的损失，不论是4000万令吉，还是50万令吉，不会改变“舞弊”这个词的含义，正如非法的事情，不会因为涉及数额的大小，而变得合法。

由于国阵与丁福南不敢起诉我毁谤，他们做了一个严重的指责，说我为了个人的利益，在陈合裕土地舞弊案中缴付1470万令吉给法庭。这是一项严重的指责，等于说我滥用权力，在法庭缴付1470万令吉给陈合裕，这笔钱原本是不必还的。

法庭已经在未经州政府的同意下，将1470万令吉交给了陈合裕。丁福南和国阵能否表明立场，州政府是否可以违抗庭令？

州政府根据庭令并听取国家法律局所委任的州法律顾问的劝告。 所有记录都显示，州政府是在的听取州法律顾问的建议下，不情愿地缴付1470万令吉。槟州国阵及丁福南实在不负责任，还对我或州法律顾问进行严重的指控，指我们为了私利付款，然后将课题政治化。

上述1470万令吉的抵押金是付给陈合裕赔偿金2940万令吉的50%，这还不包括约1000万令吉的利息。这宗案件的发生是由于前朝国阵政府“失误”，批准陈合裕拥有一块10.6英亩的土地及采矿准证，这块土地并非由州政府拥有，而是属于私人地。

槟州政府已经在2009提5月18日遵从庭令，将1千467万8千135令吉50仙的款项，付给槟城第二高等法庭，作为陈合裕土地舞弊案的赔偿抵押金。此案也是前朝政府涉及土地舞弊所留下的。上诉庭最近已经将这笔赔给陈合裕的款项减少至50万令吉。但是这宗案件还没有了结，因为其司法程序还没有解决，可有可能会交由联邦法庭处理。

如果槟州民联政府成功将赔偿金减至50万令吉，国阵会不会负起责任缴付这笔赔偿金？更严重的是，如果州政府拿不回已经缴付给陈合裕的1470万令吉，槟州民联和丁福南是否愿意赔偿这1470万令吉？

国阵秘书拿督希尔米也说，反贪污委员会已经证实这起案件不是舞弊案也不是欺骗案，但是，州政府却对此毫不知情。既然是州政府向反贪委报案，他们应该直接通知州政府有关调查报告。这不禁让人怀疑，反贪委究竟是不是国阵的政治工具兼武器。

Hanya selepas 3 tahun, barulah sudi Datuk Zainal menjelaskan bahawa SPKR sebanyak RM1.1 juta diberikan bukan kepada 22 buah keluarga miskin tegar tetapi sebenarnya kepada 301 keluarga miskin. Datuk Zainal selaku Pengerusi Perhubungan Umno negeri Pulau Pinang telah dilaporkan di Berita Harian pada 26 Februari 2009 bahawa dana RM1.1 juta telah diperuntukan untuk SPKR untuk membantu 22 keluarga miskin tegar.

Dalam laporan Berita Harian 26 Februari 2009 daripada George Town, tidak ada sebarang sebutan istilah Nibong Tebal atau bahawa 22 buah keluarga miskin tegar adalah hanya daripada Nibong Tebal. Sekiranya RM1.1 juta diagihkan kepada 22 buah keluarga miskin, maka setiap keluarga akan memperolehi RM50,000.

Ahli EXCO kerajaan negeri YB Phee Boon Poh telahpun menulis dua surat pada 7hb April 2009 dan 12 Mei 2009 kepada Datuk Zainal, tetapi beliau enggan jawab. Satu laporan polis telahpun dibuat oleh YB Phee pada 31 Julai 2009, meminta siasatan polis dalam perkara ini tetapi tidak ada sebarang tindakan diambil.

Dalam penjelasan terbaru oleh Datuk Zainal, 301 buah keluarga yang menerima RM1.1 juta ini bermakna setiap keluarga miskin memperolehi RM3,654. Perlu ditanya mengapa hanya 301 buah keluarga miskin yang mendapat faedah sedangkan ada lebih 700 keluarga miskin tegar di Pulau Pinang. Mengapa 400 buah miskin tegar tidak mendapat perhatian daripada Kementerian Datuk Zainal?

Satu lagi perkara yang menarik ialah kenyataan Datuk Zainal bahawa jumlah RM1.1 juta itu adalah sebahagian daripada bantuan keseluruhan SPKR sebanyak RM22.9 juta di Pulau Pinang dari 2008 hingga 2012 untuk membantu 3,938 peserta miskin dan miskin tegar. Ini bermakna 22.9 juta telah diberikan dalam lebih 3 tahun ini kepada 3,938 peserta miskin ataupun secara purata setiap keluarga dapat RM5,815.

Ini menimbulkan persoalan macam mana 3,938 keluarga miskin dipilih oleh Datuk Zainal atau pihak Kementerian persekutuan kerana masih ada ramai keluarga miskin yang tidak menerima bantuan RM5,815 tersebut.

Ahli EXCO Kerajaan Negeri Phee Boon Poh ditugaskan untuk mendapat maklumat keluarga miskin atau miskin tegar yang diberikan bantuan daripada Datuk Zainal Abidin Osman supaya dapat membandingkan senarai keluarga miskin dan miskin tegar tulin agar bantuan sampai benar-benar ke tangan mereka.

槟州政府欢迎郊区发展及联邦直辖区部长拿督再纳阿比丁准备了301户赤贫及贫穷家庭的资料，我们等了三年，原来这些家庭在2009年获得人民福利发展计划（SPKR）下110万令吉的拨款援助。

三年后，拿督纳再才愿意讲清楚，人民福利发展计划的110万令吉拨款不是拨给22户赤贫家庭，而是给了301户贫穷家庭。2009年2月26日于《每日新闻》报道，槟州巫统联委会主席拿督再纳宣布在人民福利发展计划下，共协助了22户赤贫家庭。

在2009年2月26日的报道并没有提到高渊，也没有提到有关22户赤贫家庭来自高渊。如果真的将110万令吉拨给22户贫穷家庭，每户家庭将能够获得5万令吉。

槟州行政议员彭文宝也已经分别在2009年4月7日及2009年5月12日致函给拿督再纳，但是他不愿意回答。彭文宝已于2009年7月31日向警方报案，他要求警方调查这起事件，但是当局并没有采取任何行动。

拿督再纳在最近解释这件事时提及，共有301户贫穷家庭接受了110万令吉，意味着每户贫穷家庭获得3654令吉。我们要问为什么槟城有超过700户赤贫家庭, 只有这301户贫穷家庭获得有关福利， 为什么其余的400户赤贫家庭没有办法获得拿督再纳的关注？

还有一件更有趣的事，拿督再纳说上述110万令吉是整个人民福利发展计划拨款的一部分，上述计划在2008至2012年期间共拨出2290万令吉，协助3938名贫穷者及赤贫者。这意味着在过去三年多，当局平均拨给每户贫穷家庭5815令吉。

我们要问，拿督再纳或直辖区部是如何选出上述3938户贫穷家庭，因为还有很多贫穷家庭没有获得上述5815令吉。

槟州行政议员彭文宝受委在拿督再纳的协助下，收集贫穷家庭或赤贫家庭的资料，对照贫穷家庭及赤贫家庭的名单，以确保真正有需要的贫户受惠。

Allowing MCA members and supporters to attend Perkasa’s events not only proves MCA’s links with Perkasa. By doing so, MCA acknowledges Perkasa has an important role to play in Malaysian political life despite Perkasa’s racist and extremist struggle against non-Muslims and non-Malays. Is MCA and Chua so afraid of Perkasa that they dare not even prevent their members from attending Perkasa’s functions?

How can Chua and MCA claim to defend the interests of Malaysian Chinese when their members and supporters can go to Perkasa functions that breeds hate against non-Malays in the country and want to reduce them to 2nd-class or 3rd-class citizens? If MCA and Chua have any dignity or honour, no MCA member should be allowed to attend Perkasa events and thereby give credibility to this racist and extremist organization.

What is equally shocking is Chua’s defence of Perkasa distributing “white ang pow packets” was not done on purpose. Chua’s claim that Perkasa did not distribute white ang pows on purpose was disputed by former Sri Desa MCA branch chairperson Dr Collin Tiew, who has apologized to the Chinese community for speaking in defence of Perkasa and bringing elderly citizens to the Perkasa.

Dr Colin Tiew said Perkasa Chairman Ibrahim Ali was aware of Chinese customs and that the ang pows had to be red, not white as Ibrahim had distributed red ang pows in his parliamentary constituency in Kelantan. Dr Colin Tiew further said that he did tell Ibrahim that white ang pow is not suitable but Ibrahim did not bother. Clearly Perkasa and Chua’s claim that they did not distribute the white ang pows on purpose, is not believable that serves to deceive not only oneself but others too.

Clearly Perkasa was deliberately trampling rudely over the sensitivities of the Chinese community by giving white ang pows. Perkasa know they can do so with unhindered impunity because they have the whole-hearted support of UMNO and Prime Minister Datuk Seri Najib Tun Razak for their activities. Witness the failure of Datuk Seri Najib to condemn Perkasa for their insult to the Chinese community, and even rubbed salt into this open wound by saying that this incident can be used as a “social experience”. Is this gross insult that has angered the Chinese community merely reduced to the level of a “social experience”

Datuk Seri Najib’s reluctance to condemn Perkasa and MCA’s refusal to ban its members and supporters from attending Perkasa functions may be caused by the fact that BN had also used white ang pows during the BN Chinese New Year event in Seri Setia, Selangor. MCA Kelana Jaya division chief Ong Chong Swen had not denied that white envelopes with BN logos were distributed during the Chinese New Year event.

It is not too late for Datuk Seri Najib to salvage his 1Malaysia slogan which has been proven to be empty and meaningless when Deputy Prime Minister Tan Sri Muhyiddin Yassin pronounced that he is Malay first, and Malaysian second. Datuk Seri Najib should take the bold step to condemn Perkasa for their insensitive act and cut all ties with this racist and extremist organization.

土著权威组织摆明是一个针对非穆斯林及非马来人的种族主义及极端主义的组织，蔡细历应该禁止马华党员及支持者出席土权组织的活动，否则，这不只证明马华与土权有联系，并承认土权扮演重要角色。

民主行动党感到惊讶，马华总会长拿督斯里蔡细历宣布马华将不会禁止党员及支持者出席任何土著权威组织的活动。行动党请蔡细历改变他不理性及不负责的决定，进而禁止马华党员及支持者出席土权的活动。

允许马华党员及支持者出席土权的活动，不只证明马华与土权的联系，也代表马华承担土权在马来西亚人的政治里扮演重要的角色，因为土权摆明是一个与非穆斯林及非马来人作对的种族主义及极端主义组织。马华和蔡细历为何如此害怕土权，以致他们不敢阻止他们的党员参与土权的活动？

蔡细历与马华怎么可以说他们捍卫马来西亚人的利益，他们允许自己的党员与支持者去出席土权的活动，有关活动灌输针对国内非马来人的仇恨情绪，而且要把他们贬为二等或三等公民？如果马华及蔡细历还有自尊和尊严，那么他们根本不应该允许任何马华党员出席土权的活动，这只会助长这个种族及极端组织的威风。

更令人震惊的是，蔡细历竟然为土权辩护，指他们不是故意派“白包” 的。蔡细历的讲法已经被将斯里迪沙马华区会主席张秋明医生反驳，后者已经就他为土权辩护、安排老人家出席土权组织的活动而道歉。

张秋明说，土权主席依布拉欣阿里知道华人的风俗，而红包必须是红色，不是白色，因为依布拉欣阿里曾经在他的吉兰丹国会选区分派红包。张秋明也说，他曾告知依布拉欣不适合在农历新年期间派“白包”，但是依布拉欣不加理会。很明显的，土权及蔡细历说他们不是故意派“白包”的说法，无法让人相信，也是自欺欺人的。

很明显地，土权故意派“白包” ，违反华人的风俗习惯。土权这么做，因为他们知道他们将被免责，他们的活动有巫统及首相拿督斯里纳吉在背后撑腰。纳吉不但没有谴责土权这种侮辱华社的做法，甚至在伤口上洒盐，说这起事件是一次“社会经验和教材”。这样的侮辱已经引起华社愤怒，难道就能简单列为“社会经验和教材”？

拿督斯里纳吉不愿意谴责土权，而马华也不愿禁止马华党员及支持者出席土权的活动，很可能因为国阵也曾经在雪州斯里斯迪亚的农历新年活动派“白包”。马华格拉纳再也区会主席王锺璇也不否认，他们曾经农历新年期间，派发印有国阵标志的白色信封。

虽说副首相丹斯里慕尤丁已经公告天下他是“马来人优先，然后才是马来西亚人”，此时，纳吉还来得及抢救“一个马来西亚”这个空洞及无意义口号，他应该勇敢地谴责土权如此不敏感，并且断绝一切与这个种族主义及极端组织的关系。

As the Chinese New Year celebration ends with Chap Goh Meh, Penang awaits another year of challenges towards greater prosperity as well as a cleaner, greener and safer Penang.

Penang shall trust the future in the young not only by practicing integrity in leadership and good governance but also by fulfilling the promise of providing digital intelligence, building a culture of innovation and good education. Whilst integrity and good governance has been the success story behind Penang as the best governed state in Malaysia, these two elements alone are not enough to secure the future for Penang.

The promise of digital intelligence must be fulfilled to connect to cyberspace. Connectivity has become as essential as roads and electricity. Once connected to the Internet, this is one of the last things anyone would be willing to give up if they had to reduce their expenses. Being connected is not only crucial for keeping up with friends’ activities socially, it increasingly means access to income.

For this reason, Penang has undertaken an ambitious first ever free wifi project in Malaysia with 1,550 free wifi hotspots throughout Penang. So far 1,300 free wifi hotspots have been installed and will be completed by next year.

The promise of building a culture of innovation must be fulfilled with the establishment of a Penang Science Council(PSC). The PSC aims to establish Penang as a center of excellence for science and technology by rekindling interest amongst the young to choose science as their career choice. PSC is unique in that despite being supported by the government and with participation by the academia, it is driven purely by industry. Amongst some of the projects:-
• the annual Penang International Science Fair, the first one in Malaysia that is held in a sports stadium;
• the proposed Penang Tech Center showcasing the latest technology available in Penang; and
• the open tender for the Penang International Research And Innovation Incubator, the first privately-funded science research center in Malaysia at Fishermen Wharf in Bayan Baru.

Penang must fulfil the promise of providing a good education through the annual allocation for schools, encouragement of more private schools of excellence in Penang and the proposed Education Hub in Balik Pulau. The Penang PR state government believes that education can bring the young together where they can be united by common goals of rewarding performance, open ideas and principled ideals regardless of race, religion or gender.

Penang shall trust the future to the young, they have longer to live in it.

在打造革新文化方面，我们成立了槟州科学理事会。槟州科学理事会的宗旨是让槟州成为卓越的科学及工艺中心，让科学事业成为年轻一代的事业选项。槟州科学理事会的独特的，它有州政府的支持、学术人员的参与、 工业界的领导，其它的项目还有：
• 一年一度槟州国际科学博览会，全马首次在体育馆举行。
• 兴建槟州科学中心，展示槟州最新的科技工艺；

Jumlah RM500 juta merupakan jumlah yang paling besar diperuntukkan oleh mana-mana kerajaan negeri di Malaysia untuk membina rumah mampu milik. Jumlah wang ini diperolehi daripada pengswastaan Bayan Mutiara secara tender terbuka. Di bawah pentadbiran lama RM600-800 juta wang rakyat dicadangkan dibelanjakan untuk memindahkan pusat pentadbiran baru daripada Komtar ke Bayan Mutiara. Kerajaan baru Pakatan Rakyat telah menolak cadangan ini dan menggantikan dengan cadangan pengswastaan yang tidak perlu membelanjakan wang besar sebalik menambahkan sumber kewangan agar kerajaan negeri boleh menjalankan projek sosial seperti membina rumah mampu milik.

Sejak mengambil alih tampuk pemerintahan pada tahun 2008, Kerajaan Negeri berjiwa rakyat di bawah pimpinan Pakatan Rakyat telah meluluskan pembinaan rumah kos rendah dan kos sederhana rendah sebanyak 11,596 unit yang sekaligus menyangkal dakwaan yang mengatakan kerajaan negeri pakatan rakyat tidak membina rumah mampu milik kepada rakyatnya. Ini adalah di antara kos rendah (RM42,000) dan kos sederhana rendah (RM72,500) yang diluluskan.

Di bawah Kerajaan Negeri dan Agensi Kerajaan Negeri, projek perumahan Kos Rendah dan Sederhana Rendah seperti berikut yang dibangunkan adalah seperti berikut :

这笔总值5亿令吉的兴建平民屋基金，是全马各州当中，数额最高的可承担房屋基金。这笔基金，是透过公开招标、以私营化峇央珍珠而取得的。在前朝政府执政期间，前朝建议耗资6亿至8亿令吉的人民纳税钱，将现有的光大行政中心迁往峇央珍珠。不过，民联政府上台后，拒绝了这项建议，并以不需要花费巨额的私营化取而代之。这样一来，州政府还能增加财务资源，以推行各项如兴建可承担平民屋的社会计划。

以民为本的民联槟州政府，自从2008年执政以来，已批准了1万1千596间廉价及中廉价屋，而不是如一些人所指控般从未兴建任何可承担房屋。获批准的廉价屋为价格4万2千令吉，而中廉价屋则是7万2千500令吉。

下列是州政府及州政府机构所承建的廉价屋及中价屋工程：

Berikutan suatu keputusan oleh Mahkamah Rayuan baru-baru ini telah mengurangkan bayaran ganti rugi untuk Tang Hak Ju kepada RM500,000/-, Pengerusi Gerakan dan UMNO Pulau Pinang telah mendesak saya meminta maaf dan menarik balik istilah skendal yang digunakan kerana ia tidak melibatkan kerugian RM40 juta tetapi hanya RM500,000/-. Permintaan ini memang tidak masuk akal kerana samada ia melibatkan kehilangan wang kerajaan RM40 juta ataupun RM500,000, ia tetap adalah skendal tanah kerana membabitkan kehilangan wang rakyat.

Saya telah menolak desakan BN dan mencabar mereka saman malu saya atau kerajaan negeri. Malangnya sehingga hari ini baik Gerakan, Teng Hock Nan ataupun UMNO Pulau Pinang gagal berbuat demikian. Sekiranya kerajaan negeri PR berjaya mengurangkan pembayaran kepada RM500,000, adakah BN sedia tanggung jumlah ini dan juga RM14.7 juta deposit yang telahpun dibayar kepada Tang Hak Ju jika Tang Hak Ju enggan memulangkan RM14.7 juta ini?

Bayaran deposit RM14.7 juta merupakan 50% daripada jumlah kos ganti rugi sebanyak RM29.4 juta kepada Tang Hak Ju dan tidak mengambilkira bayaran faedah yang dianggarkan sebanyak RM10 juta. Kes ini berlaku bila kerajaan BN yang lama “tersilap’ dengan memberikan kelulusan tanah seluas 10.6 ekar dan permit kuari kepada Tang Hak Ju atas tanah yang tidak dimiliki kerajaan negeri tetapi oleh pihak swasta.

Sungguhpun begitu banyak wang rakyat kehilangan, tidak ada tindakan tegas diambil ke atas mereka yang bertanggungjawab kecuali suatu amaran sahaja. Hanya bila PR mengambil alih tampuk pemerintahan kerajaan negeri Pulau Pinang, barulah pegawai tersebut dipindah kepada jabatan lain. Saya ingin tahu mengapakah mereka tidak pernah meminta maaf kepada rakyat Pulau Pinang tentang skendal tanah ini.

Kerajaan Negeri PR kesal ahli-ahli pentadbiran dulu seperti Tan Sri Koh Tsu Koon dan Datuk Dr Teng Hock Nan enggan bekerjasama dalam skendal tanah ini, khususnya mengapa mereka tidak mahu menyelesaikan kes ini di luar mahkamah yang ditawarkan oleh Tang Hak Ju dengan ganti rugi yang jauh lebih rendah iaitu RM1.8 juta. Dengan kadar 8% sejak tahun Februari 2005 ke atas ganti rugi RM29.4 juta, itulah sebabnya jumlah kehilangan adalah sebanyak RM 40 juta.

如果槟州政府在陈合裕土地丑闻上诉案中败诉，国阵会不会偿还4000万令吉的赔偿金？如果槟州政府赢了这场官司，国阵会不会缴付1470万令吉的赔偿金？

如果槟州政府在陈合裕土地丑闻上诉案中败诉，国阵会不会偿还4000万令吉(包括自2005年2月起每年8%的利息累积成的1000万令吉)赔偿金？如果槟州政府赢了这场官司，国阵会不会缴付1470万令吉的赔偿金？槟州政府已经在2009提5月18日遵从庭令，将1千467万8千135令吉50仙的款项，付给槟城第二高等法庭，作为陈合裕土地舞弊案的赔偿抵押金。此案也是前朝政府涉及土地舞弊所留下的。

上诉庭最近已经将这笔赔给陈合裕的款项减少至50万令吉。民政党主席及槟州巫统便要求我道歉，并且撤回“丑闻”的用词，因为它造成的损失不是4000万令吉，而是50万令吉而已。这种要求实在荒谬，因为它涉及的款项不论是4000万令吉，还是50万令吉，它始终还是土地丑闻，因为它涉及人民金钱的损失。

我已经拒绝了国阵的要求，并挑战他们告我或州政府诽谤。不幸的是，直至今天，不论是民政党、丁福南还是槟州巫统，都没有任何行动。是不是只要民联政府成功将赔偿金减少至50万令吉，国阵就准备承担这笔费用以及1470万令吉已付给陈合裕的抵押金（如果他不愿意归还这笔款项）？

上述1470万令吉的抵押金是付给陈合裕赔偿金2940万令吉的50%，这还不包括约1000万令吉的利息。这宗案件的发生是由于前朝国阵政府“失误”，批准陈合裕拥有一块10.6英亩的土地及采矿准证，这块土地并非由州政府拥有，而是属于私人地。

虽然已经造成如此大笔的金钱损失，没有人对那些应该负起责任的人士采取严厉行动，只是警告而已。只有当民联夺下槟州政权以后，相关的官员才被调派到其它部门。我想知道为什么国阵不曾针对这宗土地丑闻向槟州人民道歉？

民联政府对于前朝行政议员如：丹斯里许子根及拿督丁福南在这起丑闻中拒绝合作的态度感到遗憾，尤其是为何他们拒绝陈合裕所提议的庭外合解，这涉及更少的赔偿金180万令吉？由于在赔偿金2940万令吉自2005年2月起每年另加利息8%，因此导致总赔偿金为4000万令吉。

In May 2011, the Penang State Government announced that Penang is targeting to achieve RM6.1 billion investments for 2011. Penang recorded its highest ever investment figures of RM 12.2 billion in 2010 topping the investment charts for the first time in history in Malaysia. A lower figure has been set to attract high value-added, high-tech, knowledge based companies that engender high-income, technology transfer and innovative industries.

Up to November 2011, Penang stood at RM6 billion in investments achieving the target of RM6.1 billion set. At the same time, there is a need to “digest” (consolidate) the record investments in 2010 so that the workers and skills shortage engendered does not overspill and damage the industry.

Penang hopes that the RM4 billion high-tech and solar energy investments by Ibiden and Robert Bosch Solar will be included into last year’s investment figures which will then put Penang’s investment at RM10 billion.

According to the recent report by investment and research firm Tholons on the 2012 Top 100 Outsourcing Destinations in the world, Penang has moved up 2 notches from 79 to 77 in ranking. The state government hopes to attract more of BPO and other preferred industries such medical, aerospace, LED and photovoltaic into Penang for 2012.

槟州政府于2011年5月宣布61亿令吉投资额的目标，槟州在2010年写下122亿令吉的史上最高投资额记录后，就锁定要吸引高附加价值、高科技和知识为基础的公司，以提供高收入、科技转移和创新工业。

截至2011年11月，槟城已达到60亿令吉投资目标，同时需要“消化”2010年创下的高投资记录，不让人工和技能短缺造成问题。

槟城希望，揖斐电和博世太阳能高科技的40亿令吉投资能列入去年的投资额，如此槟州2011年的总投资额将达100亿令吉。

Saya merujuk kepada lawatan saya ke tapak pembakaran sepanjang Jalan Pantai, Butterworth bersebelahan dengan stesen bas sementara Penang Sentral, di mana 25 gerai dibakar semalam. Pagi ini semasa membuat lawatan saya telah menyatakan bahawa saya akan mempertimbangkan bantuan kewangan kepada mangsa peniaga dan meminta mereka bekerjasama dengan Pejabat Daerah dan MPSP dengan memberikan maklumat.

Oleh kerana tapak yang dibakar adalah tapak perniagaan maka mangsa peniaga tidak layak menerima bantuan Tabung TYT Pulau Pinang, yang dikhususkan hanya untuk mangsa-mangsa yang kehilangan rumah kediaman. Apa-apa pemberian Tabung TYT untuk mangsa perniagaan yang kehilangan gerai sepertimana yang berlaku di Jalan Pantai adalah melanggari peraturan yang ditetapkan.

Untuk membantu mangsa-mangsa perniagaan ini,saya bersedia menggunakan peruntukan saya sendiri tetapi perlu mendapatkan maklumat demi memastikan mereka adalah rakyat Malaysia. Putting Penang First – The RM500 Million Affordable Housing Fund, The RM8 Billion Road Projects And Transforming Penang’s Civil Service That Is Competent, Accountable and Transparent Will Help Make Penang Cleaner, Greener & Safer.

The year of the water dragon holds much promise of making Penang cleaner, greener and safer, which is essential to Penang’s long-term vision of an international and intelligent state. To succeed the state government must retain the rakyat’s faith in our ability and will as well as encourage their unique spirit of creativity and innovation.

Penang’s unique spirit of creativity and innovation can be retained so long as Penangites maintains its faith in the government. Retaining the rakyat’s faith is more about our ability and will to choose the best that can deliver and execute. It is much more about believing in common values of freedom, the rule of law, human dignity and democracy. It is about sharing the commitment of always putting Penang first over our own private interests.

There is a certain confidence in Penang, born of optimism and past achievement in our ability and will to choose the best. Penang has
been praised by the Auditor-General for recording budget surpluses every year in state government finances. Most notable was saving
Majlis Perbandaran Seberang Perai from bankruptcy afer RM230 million of losses in 7 years under BN. Another notable achievement was reducing our state government debts by 95% or RM600 million from RM630 million to only RM30 million.

More important than these achievements, is the optimism in the future stemming from proving that a clean, competent, accountable and transparent can also work and succeed in Malaysia. Open tenders, public declaration of assets and public disclosure of government contracts has brought about confidence and optimism resulting in praise from Transparency Internantional as well as record levels of foreign investments and tourists.

These improvements are meaningful when achieved with respect for each other as well as the institutions of freedom, rule of law and
democracy. Respecting human dignity to speak freely and each other’s differences fosters peace and harmony. Penang’s ability to accommodate diversity has brought great pride to Penang, with the listing of George Town as a UNESCO World Heritage site.

However, present achievements are no guarantees for future success. Future success is only guaranteed when both the rakyat the state government is committed to putting Penang first over any private interests. Putting Penang first requires proof that prosperity is
shared and solutions to problems are inclusive. If possible no one is left behind.

To ensure that the civil service performs well by serving the rakyat with quality, good governance of competency, accountability and
transparency will be intensified to a higher level. There is no room for non-performance, delays, passing the buck from one department to another and corruption.

To deal with housing needs of the lower-income groups, the Penang state government has set up the largest affordable housing fund of any state government amounting to RM500 million. To deal with the traffic congestion caused by the sudden surge of investors and tourists, the government has outlined short-term, medium-term and long term plans of road infrastructure projects amounting to nearly RM8 billion.

龙年展望槟城更加清洁、绿意及安全，这可以实现槟城要成为国际及智能都市的长期愿景。如果要成功，州政府必须让人民相信的能力，同时也要鼓励人们革新创意的精神。

只有人民继续对州政府有信心，槟城才能保持独特的革新创意精神。要让人民有信心，在于我们有没有能力及意志，选择最好的人来工作及执行。我们是否相信一些普世价值如自由、法治、尊严和民主。我们是否可以共进退，首先考量槟城的利益，而不是个人的利益。

人民对槟城是有信心的，与生俱来的乐观、以及选择人才的意愿。槟城已因为连续数年都保持财政预算盈余的记录，而被总稽查司表扬。

Proposing To Issue a Gazette Notification Exempting All Local Authorities In Penang From Applying Section 15 of the Local Government Act 1976 Before Seeking A Court Declaration To Compel Elections Commission To Conduct Local Government Elections.

In 1956, George Town became the first local council in the country to have a fully elected council with the president elected from among the councillors. In 1965, local government elections in Malaysia were suspended. The official reasons given was that the country was facing the threat of Confrontation initiated by Indonesia.

The Local Government Act passed in 1976 , provided for only appointed councillors and presidents (Section 10) and was adopted by the Penang State Government. All councillors, including the presidents were appointed by the state government of the day. One of DAP’s key agenda is the restoration of local government elections.

The Penang PR state government has pressed for local government elections to enable councillors and mayors to be directly elected ever since we took power in 2008. Amongst some of the efforts taken by the Penang State Government to restore the third vote(after vote for parliament and state seats) are as follows:-

1. On 11/8/2009 The Penang State Government moved a resolution in the State Assembly calling on the Federal Government to bring back local government elections. This was passed by the Penang state assembly.
2. The State Government also engaged a 3 panel lawyer Dato Yeo Yang Poh, Mr Tommy Thomas and Malik Imtiaz and to provide legal opinion to the Penang State Government or our rights and powers to compel local government elections to be held.
3. The Penang State Government wrote a letter to National Council of Local Government (NCLG) under Article 95A of the Federal Constitution NCLG date on 13/7/2009 and requested bring up the topic of local government elections in this council. However the NCLG, rejected the State’s request.
4. Based on the advice of the 3 panel lawyers, I wrote to the Election Commission on behalf of Penang State Government on 4/3/2010 requesting the Election Commission to conduct local government elections. Under Article 113 (4) Federal Constitution, it is explicitly state that Federal or State law may authorise the Election Commission to conduct elections other than those referred to in Clause (1).

As Clause 1 refers to parliamentary and state seats, clearly the state government has jurisdiction over whether to hold election for municipal seats since local government is under the State list. The Ninth Schedule of the Federal Constitution of powers within the State List explicitly states that the state government decides over local government elections.

5. The reply by Election Commission dated 23 March 2010 to the Penang State Government rejecting the Penang State government’s request to restore Local Government Elections is disappointing. The Penang state government has no choice but to institute legal proceedings to compel the Election Commission to comply wth the state government’s directive to conduct local government elections.

As a first step, the Penang State Government has been advised by Tommy Thomas, at a meeting with Tommy Thomas and some EXCO members yesterday, to first negate Section 15 of the Local Government Act 1976. Section 15 states: “Not withstanding anything to the contrary contained in any written law, all provisions relating to local government elections shall cease to have force or effect.” In other words section 15 nullified all local government elections.

Tommy Thomas has also advised that the State government issue a Gazette notification exempting all the local authorities within Penang from applying Section 15 of the Local Government Act. This would result in section 15 not being applicable in Penang and is the first step towards seeking a court declaration to compel the Election Commission to conduct local government elections.

I will be proposing at the next EXCO meeting next week directing the State Legal Advisor to issue this gazette notification. This is a necessary precursor to take the issue to court to seek a declaration, which will be conducted by Tommy Thomas.

我们提议，在宪报上公布通令，让槟州所有地方政府可以免于实施1976年地方政府法令第15条文，进一步申请庭令，迫使选举委员会必须执行地方政府选举。

1956年，乔治市成为我国第一个全面推行地方政府选举的地方，而且地方政府主席是由市议员推举的。1965年，我国地方政府选举被撤销。官方的理由是当时我国面对印尼对抗的威胁。

地方政府法令在1976年通过，其中第10条阐明市议员及主席是被委任的，也由槟州政府采纳。所有的市议员包括地方政府主席，都是由当今政府所委任的。而民主行动党的其中一项竞选议程就是恢复地方议会选举。

槟州民联政府自2008年执政以来，我们都一再施压，要求通过地方议会选举来选出市议员与市政局主席。在这方面，我们进行了一些努力，以归还人民的第三票（另外两票在国会议席、州议席） ：
1. 2009年8月11日，槟州政府在州议会内动议，要求联邦政府恢复地方议会选举。上述动议获得通过。
2. 州政府也找来三名律师拿督杨文波、汤米汤姆斯、玛力英迪亚斯，以提供法律意见给槟州政府，有关我们是否可以强硬进行地方政府选举。
3. 2009年7月13日，槟州政府也写信联邦宪法第95A条文下的国家地方政府理事会，要求在有关理事会讨论地方选举事项。但是，国家地方政府理事会拒绝州政府的要求。
4. 在三名律师的建议下，2010年3月4日，我代表槟州政府写信给选举委会员，要求选委会执行地方议员选举。在联邦宪法第113（4）条文阐明，除了在第（1）条款里所说，联邦法令或州法令可以授权选委会举行选举。
第（1）条款指的是国会及州议会议席选举，很明显地，州政府有权决定是否要进行地方选举，因为地方政府归州政府所管辖。联邦宪法第9项说明州政府的权力范围，很明显地阐明州政府决定地方政府选举。

5. 令人失望的是，选委会在2010年3月23日回函，拒绝槟州政府进行地方政府选举的要求。槟州政府别无选择，只好通过法律途径，申请庭令，迫使选委会遵守州政府的指令，举行地方政府选举。

在与汤米及一些行政议员会谈过后，第一步要做的就是否定1976年地方政府法令第15条文。第15条文阐明：“即使有与其它法律相反之处，所有与地方政府选举有关的条文将中止。”换句话说，第15条文宣判所有地方政府选举无效。

汤米也建议州政府在宪报上公布通令，让槟州所有地方政府免于实施地方政府法令第15条文。这将导致第15条文不适用于槟州，然后进一步通过法庭宣判，迫使选举委员会举行地方政府选举。

我将在下一次的行政会议上，指示槟州法律顾问，发布这项宪报通令。这是必要的行动，以让我们进一步申请庭令，汤米将负责此事。

Yesterday the Penang state government publicly declared the assets of Penang State EXCO members. Today, the Penang state government officially uploads the information of their assets on our government website: http://www.penang.gov.my/. Penang State EXCO members holding positions of public trust believe that the rakyat has a right to demand accountability from public officials.

The public declaration of assets fulfils the personal obligation of PR leaders and political commitment of the Penang PR State government towards reinforcing leadership with integrity in line with the CAT principles of Competency, Accountability, Transparency principles.

For the first time in Malaysian history, this public declaration of assets was conducted not by the state government but by an independent audit company. I regret that this important piece of information was not published by certain media and blogs and hope that this can be corrected.

The Penang state government has chosen the internationally renowned accounting firm, KPMG and its senior partner Chartered Accountant Ooi Kok Seng, for the verification exercise and to formulate the template and presented to the public. As an independent audit firm, KPMG is required to uphold the highest standards of professional standards ensuring that it complies with the principles of objectivity, independence and no conflict of interest before undertaking any task.

I also express the hope that the media can publish the information of our assets in full. I regret that basic financial knowledge appears to be lacking when some print the value of assets without stating the loans taken out to purchase them. Or confuse the number of units in unit trusts(10,000 units) with value(RM10,000) as number and value of unit trusts are not equivalent. Most unit trusts are valued be between 30 cents to 50 cents per unit.

The Penang state EXCO members wish to stress that they have no other sources of income except from their public allowances as public officials and ADUNs. Their allowances can be obtained from the Enakmen Anggota Pentadbiran dan Ahli Dewan Undangan Negeri(Saraan) 1980.

Semalam, Kerajaan Negeri Pulau Pinang telah mengisytiharkan harta Ahli-ahli Majlis Mesyuarat Kerajaan Negeri (EXCO). Hari ini, Kerajaan Negeri Pulau Pinang dengan rasminya memuat naik maklumat tersebut ke dalam laman web kerajaan http://www.penang.gov.my. Ahli-ahli Majlis Mesyuarat Kerajaan Negeri Pulau Pinang yang memegang jawatan dan amanah awam sebulat suara bersetuju bahawa rakyat mempunyai hak untuk menuntut kebertanggungjawaban penjawat-penjawat awam.

Pengisytiharan harta secara terbuka ini memenuhi amanah peribadi dan juga komitmen politik Kerajaan PR Pulau Pinang terhadap kepimpinan yang lebih bersih berdasarkan prinsip CAT (Cekap, Akauntabel, Telus).

Untuk kali pertama dalam sejarah Malaysia, pengisytiharan harta secara terbuka telah dikendalikan bukan oleh kerajaan negeri tetapi oleh sebuah syarikat audit bebas. 昨天，槟州政府公开行政议员的财产。今天，槟州政府正式将有关资料上载至我们的官方网站：http://www.penang.gov.my/。 槟州行政议员相信，人民有权要求公职人问责、透明。

行政议员公布财产符合了民联领袖和槟州民联政府的政治意愿，也与领袖坚持奉行能干、公信及透明的廉正原则相一致。

这是马来西亚历史上，这项公开行政议员财产不是由州政府进行，而是由独立的稽查公司进行。我感到遗憾，这项消息并没有被一些媒体与部落客报道，我希望有关媒体可以指正。

槟州政府选择了国际著名的会计公司毕马威（KPMG）及其资深会计师黄国成， 进行查证及设计公布财产的格式并公布给公众。做为独立的稽查公司，毕马威在接下任务前，必须维护其最高的专业水平，以确保其工作符合目标与原则，保有独立性及没有利益冲突。

我希望媒体可以完整刊登我们所公布的资料。我感到遗憾，一些报道看来缺乏财经知识，在刊登某些资产价值时，对于贷款额只字不提。一些报道也混淆信托基金的单位与市场价值，将1万个单位等同于1万令吉，其实两者完全是不同等的。大多数的信托基金市场每单位介于30仙至50仙。

槟州行政议员要强调，除了身为公职人员及州议员的津贴，他们没有其它收入来源。而他们的津贴详情可以从1980年行政议员及州议员（津贴）法令中可以查知。

Adalah dikesali bahawa kerajaan Persekutuan bermain politik dengan wang rakyat dengan tidak salurkan semua projek pembangunan kepada pejabat daerah negeri tetapi diberikan kepada Pejabat Pembangunan Negeri Persekutuan(PPNP). Pemberian wang kepada PPNP bercanggah dengan semangat dan prinsip demokrasi kerana PPNP yang dikuasai oleh BN tidak dipilih oleh rakyat sebaliknya BN ditolak oleh rakyat pada pilihanraya besar 2008.

Bukan sahaja PR telah menangi majority 2/3 dengan 29 daripada 40 buah kerusi negeri tetapi juga menang 11 daripada 13 buah kerusi Parlimen di Pulau Pinang. Jelas sekali wang sumbangan oleh Pulau Pinang dalam bentuk cukai pendapatan dan kastan tidak diberikan balik kepada rakyat Pulau Pinag. Sebaliknya semua wang sumbangan dikuasai penuh oleh BN sungguhpun telahpun ditolak peringkat negeri dan Parlimen oleh rakyat Pulau Pinang.

Janganlah sebut juga bahawa kerajaan negeri mendapat bayaran balik wang yang memadai bila hakikat adalah sebaliknya. Mengikut jawapan Parlimen:-

1) Kutipan Cukai Oleh LHDN Dan KDRM Dari Setiap Negeri Bagi 2001 Hingga 2008

2) Pemberian Kerajaan Persekutuan Kepada Kerajaan Negeri Bagi 2001 Hingga 2008

3) Peratusan Pemberian Daripada Kutipan

a) Sumbangan bagi Kutipan Cukai Oleh LHDN dan KDRM dari setiap negeri bagi tahun 2001 hingga 2008, Pulau Pinang adalah keempat (4) tertinggi iaitu RM25.670 juta.

b) Pemberian Kerajaan Persekutuan kepada Kerajaan Negeri bagi tahun 2001 hingga 2008, Pulau Pinang merupakan ketiga (3) terendah iaitu RM794 juta.

c) Peratus pemberian antara kutipan daripada LHDN dan pemberian Kerajaan Persekutuan, Pulau Pinang adalah terendah sekali iaitu 3%. Bagi wang duduk tempat keempat dapat wang No. 1 belakang kira.

Selepas 2008, kerajaan Persekutuan hanya salurkan RM231.08 juta yang tidak disalurkan kepada Pejabat Daerah yang dikuasai kerajaan negeri tetapi diberikan kepada PPNP yang dikuasai BN. Berbanding dengan RM794 jtua yang diberikan dalam tempoh 8 tahun 2001-8, RM231.08 juta dalam 4 tahun ini lagi kecil daripada yang diberikan sebelum ini. Jelas BN tidak menghormati keputusan demokrasi rakyat Pulau Pinang dan menjalankan diskriminasi kewangan sedemikian.

Pejabat Pembangunan Negeri Pulau Pinang tidak melaksanakan projek dari tahun 2005 sehingga pertengahan tahun 2008. Projek berkenaan dilaksanakan oleh Pejabat Daearh dan agensi pelaksana yang lain di peringkat persekutuan dan negeri. Selepas PRU 2008, sehingga 15 November 2011, Pejabat Pembangunan Negeri Pulau Pinang telah melaksanakan 2822 projek bernilai RM231.08 juta. Jenis dan jumlah projek mengikut tahun adalah seperti berikut:

Perolehan projek-projek tersebut dibuat mengikut peraturan semasa yang ditetapkan oleh Kementerian Kewangan melalui Arahan Perbendaharaan, Surat Pekeliling Perbendaharaan dan surat-surat Kementerian Kewangan lain yang berkaitan. Sehingga 2009, perolehan bagi projek bernilai kurang daripada RM20,000 dibuat secara tawaran terus, nilai projek RM20,000 hingga RM200,000 dibuat secara sebut harga manakala lebih daripada RM200,000 secara tender. Walau bagaimanapun, had bagi perolehan secara sebut harga telah ditingkatkan kepada RM500,000 iaitu berdasarkan Surat Pekeliling Perbendaharaan Bil.5 tahun 2009 yang dikeluarkan oleh Kementerian Kewangan.

Keputusan tender diputuskan oleh Lembaga Perolehan Persekutuan(A/B) Negeri Pulau Pinang manakala sebut harga oleh Jawatankuasa Sebutharga Persekutuan Negeri Pulau Pinang dan tawaran terus yang diputuskan oleh Jawatankuasa Pemilihan Kontraktor.

Kontraktor yang ditawarkan bagi kerja-kerja berkenaan adalah terdiri daripada kontraktor kelas F bagi projek-projek yang dibuat secara sebut harga dan kontraktor-kontraktor kelas lain bergantung pada nilai kontrak masing-masing.

For nearly 225 years since Penang first appeared on the world map, the fortunes of Penang has risen and fallen. Penang has prospered when we realise that for a state without any natural resources, we need to rely our human resources and develop human talent. Penang has declined when we forget that it is the energy, expertise and entrepreneurship of our people that makes Penang so unique.

Despite the divergent paths taken by different governments over these 225 years, Penang has managed to survive because our ties to each other were bonded by blood, tested by time and driven by shared values of respect for diversity that endured till this day. This tradition of harmony and mutual respect amongst the different ethnic groups and cultures, symbolised by mosques, churches, Indian temples and Chinese temples built near to each other, was recognised by UNESCO when George Town was awarded World Heritage City status on 7.7.2008.

For this reason, there is confience that Penang can defeat the extremists who appeal to beastly emotions and overcome the racists who play up to our worst fears that it is either to dominate or be discriminated. Let us not be stuck in the past of neglect, indifference or even intolerance.

Penang is willing to embrace the future. For this reason Penang aspires to transform ourselves into an international and intelligent state as this is the only route to survival in the globalised world.

As a state without any natural resources, we need to build up our human capital by training, retraining, retaining and attracting new human talents.

Penang must embrace a sustainable future with affordable housing and more green spaces. We must embrace green technology of the future, especially renewable and solar energy. Whilst green initiatives will continue to ensure that resources used today will still be available tomorrow, this must include affordable housing. The Penang state government has allocated the largest amount for affordable housing amongst all state governments in Malaysia, a RM500 million Affordable Housing Fund to ensure that we can bring up our children with dignity.

We must embrace a future without poverty. Penang is the first state to wipe out hard-core poverty in Malaysia in 2009 and implement social cash handouts. Penang will ensure that all households receive a minimum of RM600 monthly next year. Penang intends to also be the first state in Malaysia to wipe out poverty by 2015.

We must embrace a future of safe neighbourhoods where crime is low and the city safe for women and children. Whilst the police in Penang has done their share to keep crime low, the state government has done its part by installing CCTVs and start community policing to make Penang the safest state in Malaysia.

We need to rekindle our memory and renew our ties to the values of working hard, working honestly and working smart. Only by establishing institutions and creating conditions can we succeed in inspiring innovation especially centered on high technology, high-value added and knowledge intensive economy.

We must embrace a future of integrity and no corruption. Malaysia has endured a lost decade from 2000-9 of losses of 1,007 billion in illicit funds according to the Washington-based Global Financial Integrity Report, including corruption money, secretly taken out of Malaysia. In contrast Penang has achieved record budget surpluses every year including rescuing the Majlis Perbandaran Seberang Perai from bankruptcy ever since the PR state government implemented CAT governance of competency, accountability and transparency that has won praise from Transparency International.

Let us embrace a future of a cleaner, greener and safer Penang that rewards those who work hard, work honestly and work smart. Happy New Year 2012!

Selama hampir 225 tahun sejak Pulau Pinang mula muncul dalam persada dunia, nasibnya telah mengalami kemakmuran dan juga kemerosotan. Pulau Pinang makmur apabila kita sedar bahawa sesuatu negeri tanpa apa-apa sumber asli haruslah bergantung kepada sumber manusia dan pembangunan modal insan. Pulau Pinang merosot apabila kita lupa bahawa sumber keistimewaan negeri kita merupakan tenaga, kepakaran dan daya kesusahawanan rakyat kita.

Walaupun kerajaan-kerajaan yang telah memerintah Pulau Pinang selama 225 tahun ini telah mengambil pelbagai haluan yang berlainan, negeri kita masih lagi kukuh kerana hubungan sesama rakyatnya yang dijalinkan melalui darah, diuji masa dan didorong oleh semangat hormat kepada kepelbagaian. Tahun depan, kita akan memastikan bahawa setiap keluarga di Pulau Pinang akan menerima pendapatan minima sebanyak RM600 sebulan. Pulau Pinang juga mempunyai hasrat untuk menjadi negeri pertama di Malaysia untuk membasmi kemiskinan menjelang 2015.

槟城自225年前首次出现在世界地图上时，它经历了起起落落。当我们发现，对于一个没有任何天然资源的州属，我们需要依赖我们的人力资源及栽培人才。当我们忘了是人民的活力、专业及企业精神让槟城变得如此独特，我们开始走下坡。

尽管在过去225年，不同的政府采用了不同的治理方式，槟城还是不断前进，因为时间证明我们血脉相依，大家在彼此共同尊敬多元的价值观下一起成长到今天。这项各族群及文化和谐共处及互相尊重的传统，可以从回教堂、基督堂、兴都庙及华人神庙兴建于毗邻可以看出，也在2008年7月7月被联合国科教文组织承认，而被列为世界文化遗产城。因此，槟城有信心，我们可以打败那些诉诸可怕情绪的极端分子及面对种族主义分子，他们总是玩弄我们最恐惧的事，不是谁主导谁、就是谁被岐视。让我们不要再被过往的忽略、漠视或甚至不容忍影响，停滞不前。

Project Background

The construction works of multi-storey car park at foot of Penang Hill were physically completed in Mar 2011. However, it could not be opened to public. Certificate of Compliance and Completion (CCC) could not be issued and plan approval could not be obtained from Majlis Perbandaran Pulau Pinang (MPPP). Major reasons being, the construction was not in compliance to minimum requirements stipulated in MPPP guidelines.

Ceiling value allocated for this project amounting RM5Million to provide one hundred and twelve (112) numbers of car parks and six (6) numbers of bus parking area. This four (4) storey car park at a total build-up area of 69,991.30 square feet was part of the ministry’s RM73Million Penang Hill Funicular Train upgrading project, under budgetary of RMKe-9.

In September 2007, Penang State Government, through Tourism Post-Exco Meeting assigned Penang Development Corporation (PDC) as implementation agency to JKR, whom was originally assigned to implement this multi-storey car park project. Formal award of contractor by PDC on behalf of Jawatan Kuasa Perolehan Persekutuan (Federal Tender Board Committee) headed by Federal government officer Nik Ali Mat Yunos to DTE Construction Sdn. Bhd was made in 22 July 2009. Date of contractual commencement of work on 10 August 2009. With fourteen (14) months of construction period, date of completion was scheduled on 09 October 2010.

Penang State Inquiry Board(Board)

Following a decision by the Penang state EXCO at the end of September 2011, the Penang State Inquiry Board was formed by Penang State Secretary office on 29th September 2011 to investigate the controversial multi-storey car park at the foot of Penang Hill. The Penang State Inquiry Board Panel Committee is chaired by Professor Sr. Omar bin Munir, Head of Department, Faculty of Engineering and Science, Department of Built Environment, Universiti Tunku Abdul Rahman; supported by Ar. Lawrence Lim, Malaysian Institute of Architects (Northern Chapter) Chairman and Ir. Lim Kok Khong, Institution of Engineers Malaysia (Northern Branch) former Chairman. The terms of reference are as follows:-

-Identify weaknesses in the implementation of the above captioned project and determine the ones responsible for the weaknesses in the project
-Propose actions to be taken
-Provide an independent viewpoint for solutions to rectify the problems

The Board’s Report was handed over to the State government on competed on 9 November 2011. The Board stated that those responsible for the weaknesses over layout and building plan design shall be the competent person entrusted by the Board of Architect Malaysia, looking after public’s interest.

In this case, the professional architect for the project is Ar. Khairil Faizi bin Abdul Majid. An architect is responsible in translating building requirements into practical reality, with the first obligation looking after public’s interest.

The Board also mentioned in passing that the tender drawing was issued with plan without approval. The ones responsible for the weaknesses over the tender stage shall be the Superintendent Officer Ir. Haji Mohd. Radzi bin Haji Othman. However the principal person responsible is the person who signed all the relevant design plans ie the architect.

Amongst the failures highlighted were:-

1. Physical commencement of work proceeds without obtaining plan approval

2. Documentation flow not in order

3. Latest drawing not transmitted to site for implementation

4. Clerk of Work (COW) without relevant trade experience

5. Dimension Error identified but not followed through

6. Design Error identified during construction not being rectified immediately but instructed to proceed instead

7. The ones responsible for the weaknesses over the construction stage shall be the architect above defined.

The recommendation in order of preference from the Inquiry Panel:

1. To demolish, redesign, reconstruct the entire building for 300 car parks at a cost of between RM 5.5 million RM 6.75 million;

2. To localize demolition, redesign, reconstruct at ramps area only at a cost of RM 1.5 million which would result in reducing the number of car parks from 112 to 96.

3. To localize demolition on ramps area only, replaced with Vehicular Lift.

DECISION

The state government through our State EXCO meeting on 1.12.2011 has decided to adopt the preferred recommendation made by the Inquiry Panel to demolish, redesign and reconstruct the entire car-park building taking and increase the number of parking from 112 to 300 lots with Split-Level Ramps.

The cost impact for a 300 lots car-park will be RM25,000.00 per parking lot. However the average cost per parking lot after taking the demolished cost of RM4.3 million into consideration shall be RM39,000.00 as compare to spending a RM1.5 million rectifying the ramps to have 96 lots resulting RM60,000.00 per lot.

The whole project or rebuilding the car park shall take at least 15 months to complete. The State EXCO has also endorsed the decision by the PDC Board to act on the Board’s Report and take all necessary action against those responsible as mentioned in the report. The architect mentioned in the report has been dismissed and further action including a complaint to the Lembaga Arkitek Malaysia and possible civil action.

这项耗资500万令吉的停车场提供112个停车位和6个巴士车位，4层楼的停车场总面积达0.62英亩地段是由联邦部门在第9大马计划下耗资7300万令吉作为升旗山缆车提升工程的一部分。

槟州政府在2009年9月，通过槟州旅游发展委员会委任槟州发展机构（PDC）作为公共工程局（原本进行工程的单位）的执行单位，并由槟州联邦发展官聂阿里代表联邦招标委员会在2009年7月22日颁发工程给予DTE Construction Sdn. Bhd，合约于2009年8月10日生效，有14个月的施工期，完工日期是2010年10月09日。

州政府调查委员会

槟州行政会议会于2011年9月底议决，由州秘书署于2011年9月19日组成州调查委员会，对升旗山脚下多层停车场的争议展开调查，主席是奥玛教授，成员包括北马绘测师公会主席林华光和前槟城工程师协会主席林国康。

调查委员会审理事项如下：

. 确认上述工程的实施缺陷，查明谁应该就工程的缺陷负起责任。

.建议应该采取的措施。

.为解决问题的方式提供独立观点。

委员会在2011年11月9日移交调查报告予州政府，报告指须为图测缺点负起责任的人应该是由马来西亚绘测师局（Board of Architect）所认可的，以照顾公众利益。

这个案件中的绘测师是凯里尔法兹。一名绘测师有责任实践建筑的需求，他的首要义务是照顾公众利益。

报告也指招标在图测未获批准的情况下进行，监督官员哈兹莫哈末拉兹应该为招标期间出现缺点负责，但是主要负责的人是签署所有相关图测的绘测师。

几乎所有显然的错误是：

1. 工程在图测未获批准的情况下动工。

2. 文件流程没有依照顺序

3. 最后的图测并没有传到工地，在工程中实施。

4. 在没有贸易经验的情况下进行建设监督 (COW)

5. 发现尺寸有问题但是没有跟进

6. 在建筑期间发现设计有问题，但是没有及时改正，反而下令继续。

调查委员会提出以下建议：

-拆除、重新设计、重建整栋建筑，届时能容纳300个停车位，耗资550万令吉至675万令吉之间。
只局部拆除，重新设计、只重建坡道范围，耗资150万令吉，从112个停车位减少至96个。
只拆除坡道范围，并以车辆电梯取代

最后决定

通过2011年12月1日的槟州行政议会，州政府决定采取委员会的建议，即拆除、重新设计、重建整栋建筑，分层坡道停车场将从112个增加至300个。

每依格停车位的成本为2万5000令吉，但若把拆除费430万令吉计算在内，每个停车位成本平均为3万9000令吉，相比花费150万令吉修改坡道，每个停车位的成本为6万令吉。

这项重建停车场工程至少需要15个月完成，州行政议会已同意由槟州发展机构采纳委员会的报告，对报告中提到需要负责任的人采取一切必要行动。报告中提到绘图师已被解雇，进一步行动包括向马来西亚绘测局投诉，并可能进行民事诉讼。

I am pleased to be at the “Soroptimist” Penang Dinner for Charity. Soroptimist are `ladies at their best, doing their best.’ In Penang we are unique. Not only do we have many capable ladies at their best and doing their best, we are different in that our ladies’ achievements are appreciated by the men in Penang.

Because men appreciate our women, that is the reason why there are so many women holding top state government positions. Both the President of both the Penang Island Municipal Council and the Seberang Perai Municipal Council are women, creating history as the first women local government presidents in Peninsular Malaysia.

However we need the men to also come in if we want to ensure individual progress and a successful transformation of Penang as an international and intelligent city. I just want to share four points of fellowship.

One, there is no substitute for excellence and human talent. This is especially true in Penang which has no natural resources. We need to train, retrain, retain and attract human talent. Only when we choose the best, then only can we on top of the best. We must not only choose the right person but also choose them for the right job.

Two, we must stay connected with each other as Malaysians and internationally with other global citizens. It does not matter what is the colour of your skin, but the content of your character and competency that counts. You are who you are because of what you do. Only when we connect with each other as human beings and Malaysians then can we confront the challenges of the future together.

Three, we must establish integrity in leadership, corporate and non-corporate governance as well as society. Honesty as the best policy must be taught in schools and practiced by grown-ups in society. Who says that honesty does not pay?

When we took over power in Penang on 8 March 2008, we set out to prove that a clean government can out-perform a corrupt and dirty government. We have recorded a budget surplus every year for our 4 years in power, which allows us to carry out social programs and give cash aid to Penangites for the first time in history. Equally important, we have reduced our debt from RM630 million on 8 March 2008 to RM30 million at end September 2011. This RM600 million debt reduction of 95% is the largest amongst all states in Malaysian history.

Fourth, we must all stay a little foolish and idealistic. Only the idealistic and the little foolish allows society to progress because they refuse to accept the status quo but simply want to be better. Because those who are a little foolish dare to dream dreams that never were, we have seen tremendous advances in technology and social media. I admit to being little foolish, until I was imprisoned because I refused to accept the status quo of racism, injustice and endemic corruption.

The future does not belong to the faint-hearted but to those with courage and a little foolishness in pursuing their dreams. Penang offers itself as a platform that gives equal opportunity for everyone to make your dreams come true.

槟州首席部长林冠英于2011年11月5日在国际兰馨交流协会槟城分会年度晚会上发表演讲，重点如下：

确保个人进步及槟州成功转型成为国际及智能都市的四个要点

在槟城我们是独特的，这不只因为我们有许多学有所长、并发挥所长的女性，而我们的男性也珍惜这些女性的成就。

因为男性珍惜我们的女性，因此，我们有那么多女性掌管州政府高职。槟岛市政局和威省市政局的主席都是女性，也是马来西亚历史上清一色女性任主席职的市政府。

然而，如果我们要确保个人进步，让槟州成功转型成为国际及智能都由，我们也需要男性。让我分享四个要点：

其一、卓越与人才没有替代品。尤其是像槟城这样没有天然资源的地方。我们必须培训、再培训、重才、惜才。唯有我们选择人才，我们才可以达到颠峰。我们不只要选对的人，也要把他们放在正确的岗位上。

其二、我们必须与全国各地及世界各地的人们保持交流联系。你的肤色并不重要，最重要的是你的品格及能力。你因自己的成就而脱颖而出。唯有当我们每个人视本身为人、一个马来西来人，我们才能够共同面对未来的挑战。

其三、我们必须建立领袖、企业及非企业管理、社会各阶层的廉正风气。学校里必须教导正直诚实，大人们也必须在社会上付诸于行。谁说正直诚实没有好处？

当我们在2008年3月8日执政时，我们立志证明一个廉洁的政府可以比贪污的政府做得更好。我们连续四年在财政上取得盈余，让我们得以进行各种社会计划，第一次派发补助金给槟城人。同时，我们也把我们的债务，从2008年的6亿3000万令吉，减少到2011年9月的3000万令吉。我们的债务减少了6亿令吉或95%，这样的减幅可说是全马各州最高的。

其四、我们必须是大智若愚的理想主义者。唯有这样，我们的社会才会不满足于现状，才会时时刻刻求进步。那些大智若愚者才会敢于梦想别人所不敢想的，正如我们在科技工艺及社会媒体上所取得的进步。我承认自己有点理想主义者的傻劲，直到我被监禁，因为我不愿意接受种族主义、不公义及贪污腐败的现实。

未来不属于胆怯的人，而是属于那些有勇气、有一股傻劲去追求理想的人。槟城就是这样一个地方，我们提供公平机会，让每个人实现梦想。
