DBKL and the Deputy IGP Tan Sri Khalid Abu Bakar has shamed Malaysia throughout the world by not acting against those who harassed Bersih co-Chair Datuk Ambiga with a “butt dance” and an illegal burger stall protest outside her home. DAP agrees with Datuk Ambiga that the butt dance is a form of sexual harassment of a woman by a group of armed forces veterans in front of her house.

Pro-BN supporters always have a big bully mentality and act above the law when they know they possess the tacit support not only of DBKL to set up illegal burger stalls but also Tan Sri Khalid’s shocking statement that legally there is nothing wrong with people demonstrating in front of private homes. By demonizing Datuk Ambiga as the enemy of the nation and carrying out these repulsive acts, shows their lack of humanity and questions the moral legitimacy of the government they support to rule.

Datuk Ambiga has not committed any criminal offence. She has not injured anyone nor harmed anyone with C4 plastic explosives. Neither has she stolen any public funds to buy condos instead of rearing cows. As a former President of the Bar Council, she upholds the rule of law to ensure justice is done. And yet she is vilified in a manner as if she is a greater threat to the nation than drug dealers or child kidnappers.

Her only crime is to defy BN by being part of Bersih 3.0 that mobilized 300,000 Malaysians in the largest peaceful gathering in Malaysian history pressing for clean, free and fair elections. BN is now seeking revenge with a tit-for-tat demonstration at her home, a gross intrusion of privacy that is condoned by both DBKL and the police.

To those who say that Datuk Ambiga should not be breaking the law, the black American nobel laureate Martin Luther King wrote,

We should never forget that everything Adolf Hitler did in Germany was “legal” and everything the Hungarian freedom fighters did in Hungary was “illegal”. The willingness to accept the penalty for breaking the unjust law is what makes civil disobedience a moral act and not merely an act of lawbreaking.

Malaysians did not seek freedom from an undemocratic colonial rule to be replaced by another native rule that is equally undemocratic. The time has come to remove unjust laws by removing the government that propagates and perpetuates such unjust laws. Whether this can be achieved is not important. What is important is that there is a clean, free and fair electoral process that ensures the will of the people be respected whether to remove or not these unjust laws.

DBKL dan Timbalan KPN Tan Sri Khalid Abu Bakar telah memalukan Malaysia di mata dunia dengan tidak mengambil tindakan terhadap mereka yang menggangu-gugat pengerusi bersama Bersih Datuk Ambiga dengan “tarian punggung” dan protes burger yang haram di luar rumahnya. DAP bersetuju dengan Datuk Ambiga bahawa “tarian punggung” itu merupakan satu bentuk gangguan seksual terhadap seorang wanita oleh sekumpulan bekas tentera di depan rumahnya.

Penyokong pro-BN selalu mengamalkan sikap buli dan bertindak tanpa mengira undang-undang apabila mereka tahu bahawa mereka akan disokong tanpa kata-kata bukan sahaja oleh DBKL untuk mendirikan gerai burger yang haram tetapi juga dengan kenyataan Tan Sri Khalid bahawa demonstrasi di depan rumah peribadi itu tidak menyalahi undang-undang. Dengan memomokkan Datuk Ambiga sebagai musuh negara dan tindakan jijik sedemikian, mereka menunjukkan kekurangan sifat kemanusiaan dan menimbulkan soalan tentang kesahihan moral kerajaan yang disokong mereka.

Datuk Ambiga tidak melakukan apa-apa kesalahan jenayah. Beliau juga tidak mencederakan sesiapa atau membahayakan sesiapa dengan bahan letupan C4. Beliau juga tidak mencuri dana awam yang sepatutnya digunakan untuk penternakan lembu dan menggunakannya untuk membeli kondo. Sebagai bekas presiden Majlis Peguam, beliau mendukung keluhuran undang-undang untuk memastikan keadilan. Namun begitu, beliau dicerca seolah-oleh beliau itu satu ancaman yang besar kepada negara yang lebih teruk daripada pengedar dadah atau penculik kanak-kanak.

Satu-satunya kesalahan beliau adalah untuk menentang BN melalui Bersih 3.0 dan menggerakkan 300,000 rakyat Malaysia dalam perhimpunan aman yang terbesar dalam sejarah Malaysia untuk menuntut pilihan raya yang bersih, bebas dan adil. BN kini ingin membalas dendam dengan demonstrasi di rumahnya, satu pencerobohan privasi yang tidak wajar yang diizinkan oleh DBKL dan polis.

Kepada mereka yang mengatakan bahawa Datuk Ambiga tidak patut melanggar undang-undang, pemenang anugerah Nobel dari Amerika Syarikat Martin Luther King Jr pernah menulis,

Janganlah kita lupa bahawa segala tindakan Adolf Hitler di negara Jerman itu “sah” di sisi undang-undang manakala segala yang dilakukan oleh pejuang kemerdekaan Hungary adalah “salah” di sisi undang-undang. Kesanggupan untuk menerima hukuman kerana melanggari undang-undang yang tidak adil itulah yang membuatkan tindakan keingkaran awam itu satu tindakan moral dan bukan tindakan yang melanggari undang-undang.

Rakyat Malaysia tidak menuntut kemerdekaan daripada penjajahan kolonial yang tidak demokratik hanya untuk digantikan dengan pemerintah tempatan yang serupa. Masa sudah tiba untuk menolak undang-undang yang tidak adil dengan menolak kerajaan yang menyebarkan dan mengekalkan undang-undang sedemikian. Sama ada matlamat ini boleh dicapai atau tidak itu tidak penting. Yang pentingnya kita mendapat proses pilihan raya yang bersih, bebas dan adil untuk memastikan kehendak rakyat akan dihormati sama ada untuk menolak atau tidak undang-undang yang tidak adil ini.

拿督安美嘉没有犯下任何罪行。她没有伤害任何人，也没有用C4炸弹伤害任何人。她也没有窃取养牛的公款来购买公寓。身为律师公会前主席，她捍卫法治以确保正义得以伸张。但是，她却被诽谤成比贩毒者或儿童绑架者更大威胁的国家。

她犯下的唯一错误就是违抗国阵，成为净选盟3.0的一分子，并动员30万名马来西亚人进行了我国历史上最大型的和平集会，要求干净、自由及公平的选举。国阵现在可说是秋后算账，以牙还牙在她家门前示威，侵犯隐私，而且还获吉隆坡市政厅及警方纵容。

对那些指拿督安美嘉不该犯法的人士，我想赠上美国黑人诺贝尔奖得主马丁路德金的名言：

我们不可忘记，希特勒在德国所做的一切都是“合法的 ”，而匈牙利自由斗士在匈牙利所做的一切都是非法的。为了不公平的法律而自愿接受法律的惩罚，让公民不服从变得道德正当，不仅仅是违法行为而已。

在脱离不民主的殖民统治取得自由后，我们不要继续志被同样不民主的本国法律统治。是时候废除那些不公的法律、换掉这个不停宣传及执行这些不公法律的政府。能不能达到这个目标并不重要，最重要的是我们需要一个干净、自由及公平的选举，来确保人民是不是要废除恶法的意愿获得尊重。

A civil society is a “shared society”, would allow Malaysians to make diversity a positive force for equal opportunity and social justice. Four elements constitute such a “shared society” — democratic participation in decision-making, respect for diversity and the dignity of an individual, equal opportunity and the prohibition of discrimination.

We must stand together to fight corruption and abuse of power because only this success will build trust, provide progress and development to the people. Then only can the people live with dignity. Our children possesses the inalienable right to live in dignity in an environment that is clean, green, safe and healthy.

Tun Mohammad Hanif Omar has dismissed allegations that as head of the investigation panel into the violence during the Bersih 3.0 rally, would result in biased findings saying that he has always acted fairly and impartially in previous enquiries and police investigations. The former Inspector-General of Police(IGP) said there would be no conflict of interest as the panel would be dealing with facts.

The question at hand is not whether he has been fair and impartial before or that he was the former IGP. The fatal flaw was that he had already taken a partisan stand against Bersih by claiming that communist sympathizers were involved and supporting Prime Minister Najib Abdul Razak’s allegation that the rally was an attempt to overthrow the government. In actual fact, by making such wild allegations, he should be a potential witness to the investigation panel rather than be a member.

Tun Hanif’s presence of the panel is a clear cut case of conflict of interest. For example, if a panel were to be set up to discuss whether to grant a sports betting license to other companies, then Tun Hanif would definitely not qualify due to conflict of interest, because as deputy chairman of Genting he would be a potential rival. As his affiliations are publicly known, his participation in such a panel would be untenable.

Tun Hanif is first and foremost disqualified from serving on the investigation panel due to this conflict of interest as not only is the police being accused, he has publicly condemned Bersih thereby revealing his prejudice and bias against the rally. Finally, by linking Bersih to communism, Hanif is still fighting yesterday’s long-concluded wars, making the outcome of these investigations a foregone conclusion. Following his perverse logic, then Malaysia should not have signed the peace agreement with the Communist Party of Malaya on 2.12.1989.

DAP thereby declares a full boycott of the independent panel into violence during the Bersih 3.0 rally so long as Tun Hanif Mohammad Hanif Omar is a chairman and member as he has compromised his impartiality by publicly condemning Bersih 3.0 as communist-linked and an attempt to overthrow the government.

DAP supports the Bersih steering committee’s suggestion that the panel would be better served by United Nations rapporteur Frank La Rue (left), who had offered to probe the matter, and his colleague Maina Kiai, as well as the National Human Rights Commission (Suhakam). DAP also agrees with the Malaysian Bar Council that the independent panel lacks any legal framework and no features as legal immunity for those involved in the proceeding as well as lacking legal power to call or subpoena witnesses or call for the production of documents.

For these reasons and Tun Mohamad Hanif Omar presence in the independent panel to probe incidents of violence during the Bersih 3.0 rally has raised deep public concerns that the investigation will either be a whitewash of police brutality on peaceful demonstrators, a massive cover-up of the sufferings of the victims or a pretext to justify BN’s wild lies that Bersih 3.0 was a coup d’état attempt.

DAP Mengisytiharkan Pemboikotan Panel Bebas Untuk Menyiasat Keganasan Semasa Perhimpunan Bersih 3.0 Selagi Tun Hanif Omar Menjadi Pengerusi Dan Ahli Kerana Beliau Telah Menunjukkan Pendiriannya Yang Berat Sebelah Dengan Mengecam Perhimpunan Bersih 3.0 Sebagai Berkait Dengan Komunis Dan Cubaan Untuk Menggulingkan Kerajaan.

Tun Mohammad Hanif Omar telah menolak dakwaan bahawa lantikan beliau sebagai ketua panel siasatan keganasan semasa perhimpunan Bersih 3.0 akan menghasilkan keputusan yang berat sebelah dengan menegaskan bahawa beliau selalu bersikap adil dan tidak berat sebelah dalam siasatan-siasatan terdahulu. Bekas Ketua Polis Negara (KPN) ini telah menjamin bahawa tidak akan berlaku konflik kepentingan kerana panel akan berhadapan dengan fakta.

Persoalannya bukan sama ada beliau pernah bersikap adil dan tidak berat sebelah dalam siasatan dahulu atau semasa beliau menjawat sebagai KPN. Kesilapan besarnya adalah apabila beliau mengambil pendirian yang partisan terhadap Bersih dengan mendakwa bahawa golongan pro-komunis telah terlibat serta menyokong dakwaan Perdana Menteri Najib Abdul Razak bahawa perhimpunan Bersih 3.0 adalah cubaan untuk menggulingkan kerajaan. Sebaliknya, dengan membuat tuduhan liar seperti itu, beliau berpotensi untuk menjadi saksi dan bukan ahli panel.

Kehadiran Tun Hanif dalam panel adalah suatu kes konflik kepentingan yang jelas. Sebagai contoh, jika sebuah panel ditubuhkan untuk membincangkan sama ada lesen judi sukan patut diberi kepada syarikat-syarikat lain, maka Tun Hanif tidak layak atas sebab konflik kepentingan sebagai timbalan pengerusi Genting yang merupakan syarikat pesaing. Oleh kerana hubungannya dengan Genting diketahui umum, maka beliau tidak akan layak untuk menyertai panel sedemikian.

Oleh itu, Tun Hanif terlebih dahulu tidak layak untuk menyertai panel siasatan kerana konflik kepentingan bukan sahaja kerana yang dituduhnya adalah pihak polis, tetapi kerana beliau telah mengecam Bersih secara umum dan mendedahkan pendiriannya yang berat sebelah terhadap perhimpunan tersebut. Akhirnya, dengan mengaitkan Bersih dengan komunis, Hanif masih lagi melawan musuh zaman dahulu, serta membuatkan hasil siasatan ini satu perkara yang sudah pasti. Mengikut logiknya yang tidak masuk akal, maka Malaysia tidak sepatutnya menandatangani perjanjian keamanan dengan Parti Komunis Malaya pada 2.12.1989.

Untuk sebab-sebab ini, kehadiran Tun Hanif Omar dalam panel bebas untuk menyiasat keganasan semasa perhimpunan Bersih 3.0 telah menimbulkan kebimbangan rakyat dan persoalan sama ada siasatan ini akan mengaburkan kebenaran keganasan polis atas peserta yang berhimpun secara aman, menutup penderitaan mangsa-mangsa ataupun menjadi alasan untuk mewajarkan penipuan BN bahawa Bersih 3.0 merupakan cubaan coup d’état.

敦莫哈末哈聂夫驳斥那些指责他领导独委会调查净选盟3.0暴力事件，将导致调查结果不公的言论，并说他在之前的警方调查工作向来公正不阿。这名前任总警长也说，他的委任并没有利益冲突，因为调查团将会处理真相。

现在在问题不在于他任职全国总警长期间，是否公平和公正。真正的问题在于他对于净选盟已有预设政治立场，他说共产党员的同情者也参与其中，他也支持首相纳吉的说法，宣称净选盟大集会意图推翻政府。事实上，在发表这种言论后，他应该被列为目击者，而不是独委会成员。

敦哈聂夫被委任为独委会成员，很明显地存有利益冲突。例如，如果政府要设立一个委员会，讨论是否要发出赌博娱乐执照给其它公司，那么敦哈聂夫肯定有利益冲突不符合资格受任， 他身为云顶的署理主席，肯定是潜在的竞争对手。而由于他的背景人人皆知，因此他不适合参与这类委员会。

敦哈聂夫应该是第一个 不具资格的独委会成员，由于这个独委会的调查对象涉及警方，而他曾经公开谴责净选盟，他对集会的偏见已经显示利益冲突的问题。最后，他竟然将净选盟与共产主义挂钩，看来他还活在那场已经总结的历史战争中，让我们可以预见调查的结果。根据他的错误逻辑，马来西亚根本不应该在1989年12月2日与马来亚共产党签署和平协议。

行动党因此宣布，只要敦哈聂夫继续担任主席及委员，我们将抵制净选盟3.0大集会暴力独立调查团， 因为他曾公开批评净选盟3.0与共产党员有关、有意推翻民选政府，这种评论已经彰显他的不公正性。

行动党支持净选盟2.0的提议，让联合国促进和保护意见和言论自由权利特别专员（Special Rapporteur）拉鲁（Frank La Rue）前来我国调查净选盟3.0集会，后者已经自荐联同他的同事麦娜基亚、马来西亚人权委员会（SUHAKAM）参与调查工作。行动党也认同律师公会，即独立调查委员会缺乏法律框架，没有权力召见证人或参与者，也缺乏法律权力获取文件证据，因此没有法律地位。

鉴于上述原因以及敦哈聂夫受委领导独立调查团撤查净选盟3.0大集会暴力事件， 让人怀疑这是不是当局企图漂白警方对付和平集会者的暴力、掩饰受害者所承受的痛苦，或是以此找藉口，合理化国阵指净选盟3.0企图推翻民选政府的谎言？

I fail to understand how DBKL can allow a burger stall to be set up outside a private residence with impunity in Kuala Lumpur? By failing to act against the “burger protest” set up illegally outside Datuk Ambiga’s house, BN and DBKL is subjecting her to undue harrassment, intimidation and invasion of privacy. Will DBKL allow a similar protest outside the private home of Ministers or the DBKL’s Mayor residence?

Such an act of harrassment, intimidation and invasion of privacy has no place in our peaceful country, where Malaysians live together in mutual harmony and respect. Moreover, the symbolic act of setting up burger stalls and cooking meat as a protest outside Ambiga’s home is extremely disrespectful considering that the former Bar Council president is a vegetarian.

As Ambiga herself noted yesterday, such acts have “never happened in Malaysia, except to Lim Guan Eng. Now (he) and I have had our homes violated.” Yesterday, my own family’s privacy was invaded by a group of Perkasa members who performed a “funeral rite” intruding on my private space, by placing on my gate a garland of flowers over a framed photo of me to signify my “death”.

Clearly this is the first time that such a death “wish” or death “threat” is made against a Chief Minister. What is equally clear is that the police present were indifferent and did not stop the Perkasa members from violating my private space.

It is the right of every Malaysian to be able to protest his or her own issues, but to do so by intruding into personal space and invading the privacy of family homes or wishing for the death of anyone is utterly vile, completely disrespectful and contrary to the basic tenets of democracy.

Dengan kegagalan bertindak terhadap “protes burger” yang dilakukan secara haram di luar rumah Pengerusi Bersama Bersih Datuk Ambiga, BN dan Dewan Bandaraya Kuala Lumpur (DBKL) telah merelakan Ambiga diganggu-gugat, diintimidasi dan dicabul ruang peribadi beliau

DAP mengutuk keras “protes burger” oleh penyokong-penyokong pro-BN dan anti-Bersih, yang telah mendirikan gerai burger secara haram di luar rumah Pengerusi Bersama Bersih Datuk Ambiga Sreenevasan untuk membantah apa yang mereka dakwa sebagai kononnya kehilangan pendapatan akibat perhimpunan Bersih 3.0 pada 28 April 2012.

Apakah keluruhan undang-undang di Malaysia telah digantikan dengan undang-undang rimba?

Saya tidak faham bagaimana DBKL boleh membenarkan sebuah gerai burger didirikan secara haram di luar rumah hak milik peribadi seorang di Kuala Lumpur tanpa sebarang tindakan dikenakan? Dengan kegagalan bertindak terhadap “protes burger” yang dilakukan secara haram di luar rumah Pengerusi Bersama Bersih Datuk Ambiga, BN dan DBKL telah merelakan Ambiga diganggu-gugat, diintimidasi dan dicabul ruang peribadi beliau.

Adakah DBKL akan membenarkan protes yang sama dilakukan di luar rumah Menteri-Menteri atau Datuk Bandar Kuala Lumpur?

Perbuatan mengganggu-gugat, intimidasi dan pencabulan ruang peribadi tidak ada tempat di negara kita yang aman damai ini di mana rakyat Malaysia hidup bersama dalam keadaan harmoni dan saling hormat-menghormati. Lagi pun, tindakan simbolk mendirikan gerai burger dan memasak daging di luar rumah Ambiga sebagai satu bantahan adalah bersifat kurang ajar kerana bekas Presiden Majlis Peguam itu adalah seorang yang tidak memakan daging (vegetarian).

Sebagaimana yang dinyatakan oleh Ambiga sendiri semalam, perbuatan keji itu “tidak pernah berlaku di Malaysia, kecuali terhadap Lim Guan Eng. Kini rumah (beliau) dan saya telah dicabul dan diceroboh”.

Semalam, ruang peribadi keluarga saya sendiri telah dicabul oleh sekumpulan ahli Perkasa yang meletakkan kalungan bunga di atas bingkai gambar saya yang diletakkan di pintu pagar rumah saya, untuk memberi amaran tentang “kematian” saya.

Jelas ini adalah kali pertama “ugutan bunuh” dilakukan terhadap seorang Ketua Menteri. Apa yang turut jelas ialah kehadiran pihak polis yang tidak berbuat apa-apa dan tidak menghalang ahli-ahli Perkasa daripada menceroboh dan mencabul ruang peirbadi keluarga saya.

Adalah menjadi hak setiap rakyat Malaysia untuk membantah atau protes sebarang isu tetapi melakukannya dengan menceroboh ruang peribadi seseorang dan mencabul hak peribadi rumah keluarga, atau menuntut kematian seseorang adalah amat keji, kurang ajar dan bertentangan dengan rukun-rukun asas demokrasi.

DAP mendesak supaya BN dan DBKL memindahkan serta-merta gerai burger haram yang dibina di luar rumah Datuk Ambiga sebagai tanda menghormati, bukan sahaja demokrasi dan kedaulatan undang-undnag, tetapi juga untuk mewujudkan dan mempertahankan masyarakat madani.

民主行动党谴责亲国阵及反净选盟支持者所进行的“汉堡示威”，他们在净选盟联合主席拿督安美嘉屋前设立非法的汉堡摊子，抗议2012年4月28日的净选盟3.0大集会导致他们损失收入。马来西亚的法制什么时候变成丛林法则、弱肉强食？

我不明白为何吉隆坡市政局可以允许汉堡摊子在吉隆坡的住宅区内非法摆卖？国阵及吉隆坡市政局（DBKL）没有对付在净选盟联合主席安美嘉家门前的“汉堡示威”，如同眼巴巴让她承受不必要的骚扰、恐吓及隐私侵犯。吉隆坡市政局会不会允许类似的示威在部长们的私宅或吉隆坡市政局主席的家门前发生？

我们不应该让如此的骚扰、恐吓及隐私的侵犯发生在马来西亚人和谐共处、互相尊重的和平国家。再说，像这种在安美嘉家门前摆摊卖汉堡、煮肉，只一种完全无礼的做法，因为律师公会主席是一名素食者。

安美嘉昨天说，这种行为“在马来西亚从未发生过，除了林冠英的家。现在他的家和我的家都被侵犯了。”昨天，我家人的隐私也被一群土著权威组织的人侵犯，他们入侵我的私邸，设立“灵堂”，用我的肖像挂上死人花圈，挂在我家大门前，以示我的“死亡”。

很明显地，这是第一次对首长所做出的“希望你去死”或死亡恐吓。更明显的地，在场的警察竟然无动于衷，完全没有阻止土权成员侵犯我的私邸。

每一名马来西亚都有权利为自己的事情表达抗议、示威，但是，侵入私人空间 、闯入别人的家庭隐私，希望一个人死去，是彻底卑鄙、无礼、与民主基本原则背道而驰的。

行动党促请国阵和吉隆坡市政局马上移开安美嘉屋外的摊子，这不只是表示对民主和法治的尊重，也是维护和捍卫公民社会。

The appointment of former inspector-general of police Tun Mohamad Hanif Omar to head of the independent panel to probe incidents of violence during the Bersih 3.0 rally has raised deep public concerns that the investigation will either be a whitewash of police brutality on peaceful demonstrators, a massive cover-up of the sufferings of the victims or a pretext to justify BN’s wild lies that Bersih 3.0 was a coup d’état attempt.

Hanif, who is now Genting Malaysia Bhd Deputy Chair, had claimed that communist sympathizers were involved in the Bersih 3.0 rally, and supported Prime Minister Najib Abdul Razak’s claim that the Bersih 3.0 rally was an attempt to overthrow the government. Hanif further stated that the tactics of using provocateurs to cause the demonstrators to clash with police and to bring children along in the hope they would get injured were tactics learnt from past pro-communist demonstrations.

How can Datuk Seri Najib Razak consider Hanif as a “credible, experienced and respectable” individual that ensures its investigation panel is independent and unbiased, when Hanif has adopted such a prejudiced and partisan stand against the Bersih 3.0 rally as an attempt to overthrow the government? What makes those claims of a coup d’tat by Najib and Hanif most ridiculous is that both of them ignored the fact that six local pressmen and about 12 photographers and journalists from the foreign media were reportedly assaulted during the fracas on April 28 Bersih 3.0 rally by police.

To add insult to injury, Hanif is now heading the investigation panel raising doubts about the integrity, reliability and credibility of its findings. As a former Inspector-General of Police, Hanif is first and foremost disqualified from serving on the investigation panel due to this conflict of interest as the police is being accused. Secondly, by publicly condemning Bersih, Hanif’s prejudiced bias would also disqualify him to serve on the investigation panel. Finally, by linking Bersih to communism, Hanif is still fighting yesterday’s long-concluded wars, making the outcome of these investigations a foregone conclusion.

For these reasons, the Prime Minister should try to salvage or restore some credibility and public confidence as well as renew faith that “justice will not only be done but be seen to be done” by replacing Hanif with an independent, apolitical, unbiased and an upright person of integrity.

Adakah Perlantikan Tun Mohammad Hanif Omar Itu Akan Mengaburkan Kebenaran Keganasan Polis Atas Peserta Yang Berhimpun Secara Aman, Menutup Penderitaan Mangsa-Mangsa Ataupun Menjadi Alasan Untuk Mewajarkan Penipuan BN Bahawa Bersih 3.0 Merupakan Cubaan Coup D’état?

Perlantikan mantan ketua polis negara Tun Mohammad Hanif Omar sebagai ketua panel penasihat bebas untuk menyiasat insiden keganasan semasa perhimpunan Bersih 3.0 telah menimbulkan kebimbangan rakyat dan persoalan sama ada siasatan ini akan mengaburkan kebenaran keganasan polis atas peserta yang berhimpun secara aman, menutup penderitaan mangsa-mangsa ataupun menjadi alasan untuk mewajarkan penipuan BN bahawa Bersih 3.0 merupakan cubaan coup d’état.

Hanif, yang kini menjadi timbalan pengerusi Genting Malaysia Bhd, telah mendakwa bahawa golongan pro-komunis telah terlibat dalam perhimpunan Bersih 3.0, dan telah menyokong dakwaan Perdana Menteri Najib Abdul Razak bahawa perhimpunan Bersih 3.0 adalah cubaan untuk menggulingkan kerajaan. Hanif telah menambah bahawa taktik menggunakan dalang pencetus provokasi untuk menyebabkan pertelingkahan dengan polis serta membawa kanak-kanak bersama dalam harapan mereka akan dicederakan merupakan taktik yang dipelajari oleh demonstrasi pro-komunis dahulu.

Bagaimana Dato’ Sri Najib Razak boleh menganggap Hanif sebagai seorang individu yang “kredibel, berpengalaman dan dihormati” yang akan memastikan panel siasatan itu bersih dan tidak berat sebelah, apabila Hanif sudah pun mengambil pendirian yang prejudis dan partisan terhadap perhimpunan Bersih 3.0 sebagai cubaan untuk menggulingkan kerajaan? Yang tidak masuk akalnya, dakwaan coup d’état oleh Najib dan Hanif itu telah mengabaikan hakikat bahawa enam wartawan tempatan dan 12 jurugambar dan wartawan media asing telah dilaporkan dipukul oleh polis semasa perhimpunan Bersih 3.0 pada 28 April.

Yang lebih teruknya, Hanif kini dilantik untuk mengetuai panel siasatan, lantas menimbulkan keraguan terhadap integriti, kepercayaan dan kredibiliti hasil siasatannya. Sebagai mantan ketua polis negara, Hanif seharusnya dikecualikan daripada menjadi ahli panel siasatan atas sebab konflik kepentingan kerana yang dituduh dalam kes ini adalah pihak polis. Kedua, dengan mengutuk Bersih secara terbuka, prejudis Hanif yang berat sebelah juga harus mengecualikannya daripada panel tersebut. Akhirnya, dengan mengaitkan Bersih dengan komunis, Hanif masih lagi melawan musuh zaman dahulu, serta membuatkan hasil siasatan ini satu perkara yang sudah pasti.

Untuk sebab-sebab ini, Perdana Menteri harus menyelamatkan atau memulihkan kredibiliti dan keyakinan umum bahawa “keadilan tidak hanya dilakukan tetapi juga dilihat sebagai dilakukan” dengan menggantikan Hanif dengan seorang yang bebas, tidak terlibat dalam politik, tidak berat sebelah dan seorang yang tegak berintegriti.

敦莫哈末哈聂夫奥玛受委率领独立调查团，是不是当局企图漂白警方对付和平集会者的暴力、掩饰受害者所承受的痛苦，或是以此找藉口，合理化国阵指净选盟3.0企图推翻民选政府的谎言？

前任全国总警长敦莫哈末哈聂夫受委领导独立调查团，以彻查净选盟3.0大集会的暴力事件，这项委任引起公众的关注，让人怀疑当局是不是企图漂白警方对付和平集会者的暴力、掩饰受害者所承受的痛苦，或是以此找藉口，合理化国阵指净选盟3.0企图推翻民选政府的谎言？

哈聂夫目前是云顶马来西亚有限公司的副主席，他曾指责净选盟3.0集会的参与者是共产党员的同情者，并支持首相纳吉的说法，指净选盟3.0企图推翻民选政府。哈聂夫还说，利用煽动分子鼓动示威者与警方发生冲突、携带小孩希望他们受伤的伎俩，都是从前亲共产党员示威时采用的策略。

在哈聂夫对净选盟持有如此偏见、认为净选盟3.0是企图推翻政府的集会，拿督斯里纳吉怎么可以视哈聂夫为“有公信力、有经验及受尊敬”的人士，确保有关独立调查团是独立、不偏不倚的？纳吉和哈聂夫的”推翻政府论” 最荒谬之处就是，他们完全忽略六名记者、12名摄影记者及外国媒体新闻从业员在428当天被警方使用暴力对待的事实。

更糟的是，独立调查团以哈聂夫为首，让它怀疑其报告的廉正、可信度及公信力。身为前任全国总警长，哈聂夫首先就没有资格受任成为这个调查团的成员，因为警方被指责，这变成直接的利益冲突。其二、哈聂夫公开谴责净选盟，既然他持有偏见，也没有资格成为调查团成员。最后，他指责净选盟与共产党有关联，既然他还活在已经从前那场已经总结的战争中，那么，我们可以预见这项调查工作的结果。

基于上述种种原因，首相应该撤换哈聂夫，另外委任一个独立、无党派、无偏见、正直的人士，以抢救或恢复一些公信力、公众信心以及让人相信“正义必须被实现，而且要以看得见的方式实现。”

With a politically-motivated Elections Commission (EC), Malaysians face the dirtiest general elections in history. As all other efforts to clean up the electoral process has failed, civil society has no other choice but to group under Bersih to involve all Malaysians to press for clean elections in the Bersih sit in protest tomorrow.

I am therefore compelled to publicly chastise Senator Tunku Abdul Aziz’s irresponsible remarks opposing Bersih’s right to assemble peacefully and conduct a sit-in protest at Dataran Merdeka at 2pm 28.4.2012 to press for clean, free, fair and independent elections. Tunku’s remarks is not the DAP stand but his own personal view. Senator Tunku is alone amongst the entire DAP Central Executive Committee in his stand on Bersih 3.0 at Dataran Merdeka.

Tunku has not notified the party leadership that he would be making his position publicly. By making his stand public, Tunku has contradicted the principle of collective leadership and decision-making where whilst one can disagree, but as leaders we all have to abide by the majority decision made by the party leadership.

This has placed the party in an embarrassing position of being criticized by our own Senator for fully endorsing Bersih’s sit-in protest as an exercise of a basic human right of peaceful assembly.

By opposing Bersih when so many Malaysians are working hard to effect change for a clean electoral process, Tunku has undermined their efforts and given a gift to BN and the tainted EC.

I have conveyed to Tunku Aziz the party’s rebuke and the unhappiness of almost all DAP members at the public expression of his personel views against Bersih’s sit-in protest. I have also impressed upon him that whilst DAP allow differences of opinion within the party, publicly opposing a policy decision taken by the party in the manner Tunku has conducted himself does more harm than good.

For the electorally abuses by a politically inclined EC, where its top officials were UMNO members that has allowed itself to be used as a tool by BN, DAP fully supports and will mobilize its members for the Bersih sit-in protest for clean elections on 2pm 28 April 2012 nation-wide. DAP urges all Malaysians to join the Bersih rallies nation-wide, especially at Dataran Merdeka.

DAP strongly condemns the actions and warnings by the government, especially Dewan Bandaraya Kuala Lumpur, to ban this peaceful sit-in protest by instilling fear of untoward incidents. The use of fear tactics only betrays the real character of the BN government as dictatorial and tyrannical. As American President Thomas Jefferson said,

When a government fears the people, there is liberty;

When the people fear the government, there is tyranny.

The time has come to ensure a bright and clean future for our children free from fear. Only a clean election process untainted by abuses committed by the EC can give birth to clean leaders that give hope to all Malaysians.

The Denial Of The Basic Democratic Principle Of One-Person, One-Vote Is Another Reason, Apart From Phantom Voters And Irregularities In The Electoral Roll, Why Malaysians Should Mobilise In Full Force For The Sit-In Bersih Protest On 2pm 28 April At Dataran Merdeka To Press For Clean, Free, Fair And Independent Elections.

The denial of the basic democratic principle of one-person, one-vote is another reason, apart from phantom voters and irregularities in the electoral roll, why Malaysians should mobilise in full force for the sit-in Bersih protest on 2pm 28 April 2012 at Dataran Merdeka to press for clean, free, fair and independent elections. Election watchdog NGO Tindak Malaysia, had provided irrefutable evidence that the Election Commission’s (EC) biasedness towards BN by gerrymandering and manipulating electoral boundaries until a rural voter is effect worth an average of six urban voters, as BN is stronger in the rural areas.

According to Tindak Malayisa, BN won 112 out of the smallest 139 federal seats in Election 2008, giving it simple majority in Parliament with just 18.9 per cent of the popular vote. The seats have not been changed for the next general election. Where is the democratic principle of not just “one-person, one vote” but also majority rule when BN can win 50.4 per cent of Parliament with just 18.9 per cent of the votes?

In effect BN won 62 of the smallest seats with just 6.2 per cent of the popular vote with the smallest federal seat was Putrajaya, won by BN, with 6,008 voters, while Kapar, won by PKR, had over 112,000. Instead of majority rules, we have a case of minority rules which is a gross violation of representative democracy.

There is no point for the EC to waste money to print 5,000 copies of a special Malay information booklet to counter all allegations against the EC’s faulty election process, when falsehoods can not prevail over facts. How can EC dismiss the issue of the over 42,000 ‘doubtful voters’ in the current electoral roll where they are not citizens as confirmed by the Registration Department and the alleged over-registration of voters in one single address. The problem may be even worse than the 42,000 doubtful cases admitted by both the EC and Registration Department.

The Malaysian Electoral Roll Analysis Project (Merap) headed by noted political scientist Dr Ong Kian Ming, had identified approximately 3.4 million cases where further investigation needs to be conducted by the EC in order to verify the legitimacy of these voters because this is the pool of problematic registrations that currently tars the integrity and accuracy of the electoral roll. He cited 4 critical issues.
1. approximately 3.1 million voters were identified as potential non-resident voters by the National Registration Department (NRD) in 2002. This data was given by NRD to the Election Commission (EC) but no action was taken by the EC to assess the magnitude of this problem and to identify ways to rectify it.
2. using the EC’s own data which lists the nationality or ‘bangsa’ of each voter, approximately 65,000 voters were identified as having foreign nationalities. Of these, close to 90 percent or 58,000 had IC numbers which indicate that they were born in Malaysia. In addition, approximately 49,000 of these voters came from one state alone – Sabah – which has a well-documented history where ICs were given to illegal immigrants in order to allow them to register as voters.
3. by comparing the electoral rolls in Quarter 4 (Q4) 2010 and Quarter 3 (Q3) 2011 and by cross-checking them with the quarterly updates in the first to third quarters in 2011, it was found that there were 106,743 voters removed from the electoral roll without public display and another 6,762 voters added to the electoral roll during the same period, also without public display.
4. important information provided by the EC in the Q1 to Q3 2011 quarterly roll updates such as the reasons for the deletion of names from the electoral roll were omitted in the Q4 2011 quarterly roll. This omission immediately raises concerns about the possibility of concealing important information by the EC in order to prevent detailed analysis from being conducted.

Further, the registration of foreigners as voters and the EC’s unilateral move to correct the voting localities of some 19,000 voters by shifting voters around without their consent. Even Selangor Menteri Besar Tan Sri Khalid Ibrahim was a victim when he found his voting locality shifted from Selangor to Federal Territory.

Other complaints from critics include the allegedly unnatural spike in voter numbers in certain constituencies, the existence of over 100 voters registered to a single address, claims that foreigners have been given voting rights, the moving of voters from one locality to another, the registration of the spouses of armed forces personnel as postal voters, the sudden spike of voters in certain constituencies and the unusual number of voters who are more than 100 years old.

For these abuses by a politically inclined EC that has allowed itself to be used as a tool by BN, DAP fully supports and will mobilize its members for the Bersih sit-in protest for clean elections on 2pm 28 April 2012 nation-wide. Penafian Prinsip Demokratik Asas Iaitu “Satu Orang, Satu Undi” Adalah Lagi Satu Sebab, Selain Daripada Pengundi Hantu Dan Kepincangan Dalam Daftar Pemilih, Mengapa Rakyat Malaysia Harus Menyertai Bantah-Dan-Duduk Bersih Pada Jam 2 Petang 28 April Di Dataran Merdeka Untuk Menuntut Pilihan Raya Yang Bersih, Bebas Dan Adil.

Penafian prinsip demokratik asas iaitu “satu orang, satu undi” adalah lagi satu sebab, selain daripada pengundi hantu dan kepincangan dalam daftar pemilih, mengapa rakyat Malasia harus menyertai Bantah-dan-Duduk Bersih pada jam 2 petang 28 April 2012 di Dataran Merdeka untuk menuntut pilihan raya yang bersih, bebas dan adil. Badan pemerhati pilihan raya Tindak Malaysia telah mengemukakan bukti bahawa Suruhanjaya Pilihan Raya (SPR) bersifat berat sebelah terhadap BN dengan “gerrymandering” dan manipulasi sempadan kawasan pilihan raya sehingga satu undi pengundi luar bandar adalah sama dengan enam undi pengundi bandar, kerana BN lebih kuat di kawasan luar bandar.

Mengikut Tindak Malaysia, BN telah memenangi 112 daripada 139 kerusi Parlimen yang paling kecil semasa Pilihan Raya Umum 2008, lantas memberikan mereka majoriti mudah dengan hanya 18.9 peratus undi popular. Daripada pemerintahan majoriti, kita mempunyai sistem pemerintahan minoriti, iaitu satu pelanggaran prinsip demokrasi perwakilan.

Tidak ada makna untuk SPR membazir duit mencetak 5,000 buah buku untuk menangkis dakwaan-dakwaan terhadap proses pilihan raya SPR yang pincang, apabila penipuan boleh mengatasi kebenaran. Bagaimana SPR boleh memperlekehkan isu lebih daripada 42,000 “pengundi ragu” dalam daftar pemilih apabila mereka bukan warganegara sepertimana yang disahkan oleh Jabatan Pendaftaran dan juga dakwaan pendaftaran pengundi yang terlalu banyak dalam satu alamat. Masalah ini mungkin lebih teruk daripada kes 42,2000 pengundi ragu yang diakui SPR dan Jabatan Pendaftaran.

Projek Analisa Daftar Pemilih Malaysia (Merap) yang diterajui ahli sains politik terkenal Dr Ong Kian Ming telah mengenal pasti lebih kurang 3.4 juta kes di mana siasatan lanjut harus dijalankan oleh SPR untuk mengesahkan kesahihan pengundi kerana ini adalah jumlah pendaftaran yang bermasalah dan mencemarkan integriti dan ketepatan data dalam daftar pemilih. Beliau telah mengutarakan 4 isu kritikal:

1. Lebih kurang 3.1 juta pengundi telah dikenal pasti sebagai bukan permastautin oleh Jabatan Pendaftaran Negara (JPN) pada tahun 2002. Data ini telah diberi kepada SPR tetapi tiada tindakan yang telah diambil oleh SPR untuk menilai masalah ini dan mencari penyelesaian.
2. Menggunakan data SPR yang menyenaraikan kewarganegaraan atau “bangsa” setiap pengundi, lebih kurang 65,000 pengundi telah dikenal pasti sebagai warga asing. Daripada jumlah ini, dekat 90 peratus atau 58,000 mempunyai nombor kad pengenalan yang menunjukkan bahawa mereka telah dilahirkan di Malaysia. Tambahan pula, lebih kurang 49,000 pengundi ini datang dari hanya satu neger – Sabah – yang mempunyai sejarah yang terkenal dengan sejarah di mana K/P telah diberikan kepada pendatang asing untuk membolehkan mereka menjadi pengundi.
3. Dengan membandingkan daftar pemilih pada suku tahun keempat (Q4) 2010 dan Q3 2011 dan dengan menyoal-periksa data itu dengan pengemaskinian kepada suku tahun pertama dan ketiga 2011, telah dijumpai bahawa terdapat 106,743 pengundi yang dikeluarkan daripada daftar pemilih tanpa paparan awam dan sebanyak 6,762 pengundi telah ditambah kepada daftar pemilih dalam tempoh masa yang sama, juga tanpa paparan awam.
4. Maklumat penting yang disediakan oleh SPR dalam pengemaskinian Q1 ke Q3 2011 seperti sebab untuk pengeluaran nama daripada daftar pemilih tidak dijelaskan dalam pengemaskianian suku tahun Q4 2011. Kekurangan penjelasan ini menimbulkan kebimbangan terhadap kemungkinan maklumat penting disembunyikan oleh SPR supaya analisa data yang terperinci tidak dapat dilakukan.

Tambahan, pendaftaran warga asing sebagai pengundi dan tindakan unilateral SPR untuk membetulkan lokaliti mengundi sebanyak 19,000 pengundi dengan mengalihkan pengundi tanpa persetujuan mereka. Bahkan Menteri Besar Selangor Tan Sri Khalid Ibrahim pun menjadi mangsa apabila lokaliti mengundinya telah ditukar daripada Selangor kepada Wilayah Persekutuan.

Aduan yang lain termasuk tambahan pengundi yang mendadak di kawasan-kawasan tertentu, kes-kes lebih 100 pengundi dalam satu alamat, dakwaan bahawa warga asing telah diberi hak mengundi, peralihan pengundi dari satu lokaliti ke lokaliti yang lain, pendaftaran pasangan kakitangan tentera sebagai pengundi pos, keputusan SPR secara tiba-tiba untuk meningkatkan jumlah pegawai yang bertugas pada hari mengundi dan kewujudan jumlah yang besar pengundi-pengundi yang berusia lebih 100 tahun.

Untuk sebab ini, DAP menyokong penuh dan akan menggerakkan ahli untuk Duduk-dan-Bantah Bersih pada jam 2 petang 28 April 2012 untuk pilihan raya yang bersih, dan menyeru agar semua rakyat Malaysia menyertai perhimpunan Bersih di merata negara, khususnya di Dataran Merdeka. DAP mengutuk hebat tindakan dan amaran oleh pihak kerajaan, terutamanya Dewan Bandaraya Kuala Lumpur, untuk mengharamkan bantahan secara aman ini dengan menakut-nakutkan orang. Penggunaan taktik ketakutan ini hanya mendedahkan watak sebenar kerajaan BN yang kuku besi dan bersifat zalim. Seperti yang dikatakan seorang Presiden Amerika Syarikat Thomas Jefferson,

Apabila rakyat takut kepada kerajaan, itu namanya kezaliman;
Apabila kerajaan takut kepada rakyat, itu namanya kebebasan.

Masa sudah tiba untuk memastikan masa depan yang cerah dan bersih serta bebas daripada ketakutan. Hanya proses pilihan raya yang bersih dan tanpa salah guna kuasa oleh SPR boleh menzahirkan pemimpin-pemimpin yang dapat memberi harapan baru kepada rakyat Malaysia.

由于选民册上出现幽灵选民及许多不正常的现象，破坏了选举一人一票的民主原则，因为马来西亚人必须全体总动员，于2012年4月28日参与净选盟3.0独立广场静坐抗议，要求一个干净、自由、公平及独立的选举。选举监察非政府组织行动马来西亚（Tindakan Malaysia）提供了一个无可辩驳的证据，选举委员会偏袒国阵，让国阵为己党利益擅改选区、操纵选民册，以致一个郊区选民的影响力与6个城区选民一样，这是由于郊区是国阵的票仓。

根据行动马来西亚的数据，国阵在2008年大选在139个最小的联邦议席中，赢得112个议席，让他们以18.9%的多数票在国会赢得简单多数议席。这些议员在来届大选不会改变。如果国阵可以18.9%的多数票，赢得50.4%的国会议席，这怎么是一人一票和多数派执政的民主原则？

实际上，国阵以6.2%的多数票，赢得62个最小的议席，其中最小的联邦议席是布城，他们赢得6008张选票，而公正党在加埔区赢得的选票却是11万2000张。这不是多数派执政，这是公然侵犯代表制民主的原则。

选举委员会不必浪费金钱，印刷5000本马来文版的小册子来反驳所有针对选委员错误执行选举的指控，事实胜于雄辩。选委会怎么可以对选民册上4万2000名可疑选民的课题视而不见？这些人不是国民登记局确定的公民，还有一个地址注册数十、甚至上百名选民。就连选委会和国民登记局都已经承认，这个问题可能比4万2000名可疑选民还严重。

由政治学者王建民博士为首的马来西亚选民册分析计划（Merap）发现，约340万选民的合法性需要选委会深入调查，选民注册问题一箩箩，让人怀疑选民册的廉正及准确性，他列出四大关键课题：
1. 根据2002年国民登记局资料显示，大约310万选民为非居民。这是国民登记局给选委会的数据，但是选委会没有采取行动来评估这个问题的严重性及确定解决方法。

2. 根据选委会本身列出的选民国籍和“种族”，约有6万5000名选民是外国国藉。当中，近90%或5万8000人拥有身份证，表明他们出生在马来西亚。还有，其中4万9000人来自沙巴州，这有历史可循，我国曾发出身份证给非法移民让他们登记成为选民。

3. 比较2010年第四季及2011年第三季选民册，然后对比检查2011年第一季到第三季每季的更新，他们发现有10万6743名选民从选民册上被移除，在同一个时期有6762名选民被加入选民册，这都是在没有公开展示的情况下进行的。

4. 选委会在2011年第一至第三季的选民册更新中，原本提供一些重要资料如选民名字被删除的原因，但是在2011年第四季却没有这些资料。这种做法让人担心选委会是为了隐埋实情，以阻止人们针对数据进行分析。

还有，选委员登记外国人为选民、在没有通知选民的情况下，随意移动选民的投票地点。就算雪州大臣丹斯里卡立也是受害者，他的投票地点竟然从雪兰莪被搬到联邦直辖区。

其它问题还包括一些选区选民人数暴增、一个地址拥有上百名选民、外国人拥有投票权、随意改动选民投票地点、军人配偶变成邮寄选民以及100岁以上的人瑞选民人数不寻常。

选委会操纵选举的政治举动，已经让自己成为国阵的工具，行动党全力支持并将动员党员支持全国各地静坐抗议，以争取干净选举。行动党也促请全体国人参与全国各地的净选盟集会，特别是独立广场的静坐抗议。

行动党强烈谴责政府发出打压及警告行动，特别是吉隆坡市政厅，禁止这场和平静坐集会，还恫言对付民众。这种恐吓的手段只是突显了国阵政府的独裁及暴政本质，正如美国总统托马斯杰弗逊所说：哪里的政府害怕人民，哪里就是自由；哪里的人民害怕政府，哪里就有暴政。

是时候许我们的孩子一个光明及干净的未来，让他们免于恐惧。唯有一个干净、不让选委会滥权操纵的选举制度，让能产生为全民带来希望的廉洁领袖。

It is generally accepted that the world has seen three waves of democracy. The first began with the adoption of democracy in early 19th century America and Europe, while the second wave occurred following the end of the Second World War through decolonisation and the restoration of democracy in many European countries. The third wave began in 1974, encompassing the democratic transitions of Southern Europe and Latin America all the way to the collapse of the Iron Curtain and the subsequent democratisation of the Eastern European countries.

In recent times, and certainly in the aftermath of the historic events now known as the Arab Spring, the world is once again undergoing a period of democratisation. In the Middle East, a region which has hitherto escaped democracy’s attention, totalitarian regimes and once-untouchable dictators such as Tunisia’s Ben Ali, Egypt’s Hosni Mubarak and Libya’s Colonel Ghadafi have been unseated and overthrown by their own people. The uprising of the Arab populace has spread like wildfire throughout the region, with many other regimes now under threat, most recently Syria’s President Bashar Al-Assad.

This current wave of democracy, which many have appropriately termed as the “fourth wave”,is not merely confined to the Middle East. In fact, we are now seeing repercussions and democratic assertions taking place in our own region, Southeast Asia. From the muted protests of the Singaporean people,to the Yellow Shirt Bersih movement in Malaysia, to the ground-breaking democratisation process in Myanmar, it is clear that the next decade or more in Asean will be an extremely interesting period.

I also feel that these events could not be happening at a morefortuitous time. With the decline of the 20th century economic powerhouses, a new global paradigm is emerging. As the United States, Europe and Japan, the traditional engines of global consumption, find themselves in a quicksand of long-term unemployment and underemployment, we in Asean find ourselves facing a serious challenge.

Ever since the end of the Second World War, emerging economies have been designed around an export-led production model to support these three major consumer markets. But now, with the Americans increasingly turning inward and with the debt crisis threatening to unravel the European economies further, the old model will no longer be tenable. With consumption power set to decline, who is going to buy our goods? In essence, we have to ask ourselves: who will be the consumers of tomorrow?

The answer is obvious. With more than 600 million people or around 9% of the world’s population in Southeast Asia, and nearly 3 billion people or 40% of the world if we includethe rising giants of East Asia and the Indian subcontinent, it is only natural that we arepoised to become the next major consumer market.

The potential for this to happen is certainly real, but we must be aware thatsuch a situation can only be achieved if our people become stronger consumers, which means that they need to have more money in their pockets. In other words, economic democratisation must first occur in order to facilitate the growth of a strong consumer market in the region.

Sandwiched between India and China, Asean must necessarily position itself to take advantage of the shifting global order. We must ensure that the potential for economic growth is leveraged upon in a responsible manner in order to produce greater democratisation and decentralisation, both political and economic. Only by truly opening up both our political structures and our economies can we find the synergy that is required to achieve the goal of a single unitedAsean Economic Community by 2015 and beyond.

Myanmar: Asean’s greatest test

Ladies and gentlemen,

As I mentioned earlier, our region is currently witness to sweeping and remarkable changes, not least of all in Myanmar, long considered as Asean’s collective responsibility.

As Nobel Prize winner and Myanmar opposition leader Aung San SyuuKyi herself observed, “The possibility of a great transformation is in sight.” These are exciting times for all of us in Asean, and we all share the greater responsibility of ensuring a peaceful democratic transition in our fellow member-state.

When Asean first decided to admit Myanmar in 1997, many had reservations. Some held the view that Myanmar should first democratise before being accepted as a full member. However, though it may be 15 years later, change is happening swiftly. In the last one year, we have seen the transition from totalitarian rule by an oppressive military junta to a more participatory and democratic society, albeit still at its early stages.

If democratisation in Myanmar is ultimately successful, we would then be able to offer the world a whole new model of democratisation. Myanmar would become proof that democratic change can occur not only peacefully, but in a wholly different manner compared to the uprisings in the Arab Spring. In the case of Myanmar, we are witnessing a top-down transformation as compared to the mass-led bottom-up revolutions in the Middle East.

We in Asean now have to play a crucial role in this historic transformation. Just as how we helped guide their entry into Asean, at a time when the rest of the world had shunned them, we now need to facilitate and provide assistance to ensure that the democratisation process fully benefits not only the 50 million people in Myanmar but also the other 600 million in Asean.

A new economy is opening up, and we must do all we can to ensure that their participation into the regional economy is as seamless and as mutually beneficial as possible.

Economic democratisation as an enabler of growth

Ladies and gentlemen,

The Arab Spring was a phenomenon that caught the world by surprise. Indeed, naysayers had for a long time claimed that the Middle Eastern people were not ready for democracy. You cannot democratise if your people are poor. As far as causality was concerned, economic development was seen as a prerequisite.

However, the Arab Spring and the worldwide movements it inspired, such as the anti-capitalist protests in Europe and Occupy Wall Street in the US, proved beyond doubt that people of all socio-economic backgrounds, whether they are rich or poor, professional or blue-collared, all simply want their voices to be heard. In other words, people desire for greater participation, both politically and economically.

While the Arab Spring was borne out of a hunger for democracy and political participation, the protests that took place in Europe and the US signalled a yearning for economic equity and participation. They may live in democratic and economically advanced countries, but they had very little economic value as individuals. In short, they were shut out of an economy dominated and advantageous only to a small group of capitalist elites.

Therefore, democracy must not only be understood in the political sense but must necessarily also mean economic equity and participation. The ordinary man and woman must be engaged with the economy in a meaningful and gainful manner.

In this context, economic democratisation can play a critical role as an enabler of growth. In normal circumstances, we talk about economic distribution as the natural next step after achieving growth. However, I now propose that we talk about economic distribution as a growth catalyst.

The idea is very simple. Take Indonesia for instance. If every Indonesian had one US dollar extra to spend every day, that will amount to 240 million US dollars extra circulating in the economy every day. That is no small amount. In other words, if we can increase the purchasing power of our people, especially amongst the lower-income groups, we will be sure to create a great consumer market.

In order for this to happen, we need a strategy that will collectively raise income levels, especially those at the bottom levels of the economy. This can be achieved by democratising the economy, allowing greater access and participation and creating more opportunities. Increasing skills will automatically increase productivity thereby allowing workers to increase their incomes. Higher incomes will mean higher purchasing power, and the natural result of that will be a healthy economy.

Therefore, our challenge in Asean is to identify this synergy between democracy and economic development. A truly democratised economy where people engage in meaningful participation will mean that we will no longer compete to see who can provide cheaper costs of business, but rather we will compete to produce more consumers. Instead of cannibalising each other and competing for FDI, it is far more productive for us to enrich each other.

Decentralisation as a key factor of multi-cultural Asean

Ladies and gentlemen,

Another key aspect of democratisation is decentralisation. It is an integral process that is based on the basic principles of freedom, empowerment and the sharing of responsibility.

We Asean countries have many things in common, chief amongst them a traditionally centralised structure of authority.Yet the process of democratisation in our region has seen these traditional structures broken down in favour of a more effective system where decision-making processes are shared through greater local autonomy for people at sub-national levels.

Decentralised structures of authority also allow central governments more space to focus on national policies rather than trying to resolve issues such as the collection of garbage or the efficiency of a bus route in a province hundreds of kilometres away. Unfortunately, my own country has been a little slow in adopting this approach, but we are hopeful for change when we take over.

Decentralisation is an exceptionally important issue in Asean, because our region is such that almost every country is multi-ethnic and multi-cultural, and by extension naturally wrought with the problems of identity politics.

For example, one third of Myanmar’s population is made up of various non-Burmese ethnic groups. In Thailand there is the question of the Muslims in the south, as is the same in the Philippines, while Indonesia’s expansive archipelago encompasses a myriad of different ethnic groups. Malaysia on the other hand is divided by the South China Sea, and with that comes many issues that divide Sabahans and Sarawakians from Peninsular Malaysians.

The question then is how do we resolve such issues? Do we resolve them by force and heavy-handed central authority or do we instead adopt a power-sharing approach?

In post-Reformasi Indonesia, democratisation has entailed a degree of decentralisation that has been remarkable to say the least. Some have termed it as “big bang decentralisation”, in which significant responsibility and financial resources were transferred to local levels of government. Regional spending multiplied, public service facilities were handed over to local jurisdiction and a brand new intergovernmental fiscal system was put in place.

Today, we see an Indonesia with flourishing sub-national regions. This is a case in which democratisation has meant greater accountability and competitiveness at the local levels resulting in a dynamic growth model that has been able to withstand global economic pressures without much adverse effect. For example, Indonesia’s secondary city Surabaya has been able to spearhead economic growth, surpassing the national average and continues to expand by capitalising on its niches and peculiar strengths.

Though far from perfect, Indonesia has been a somewhat successful experiment and indeed a model for the rest of Asean to learn from. Because of the multi-ethnic and multi-cultural nature of Asean, decentralisation is an issue that we need to be cognisant of. While important, decentralisation must necessarily be approached in a careful manner in order to create a situation of co-existence without compromising on national sovereignty.

Penang at the forefront of democratisation and economic development in Malaysia

Ladies and gentlemen,

I am glad to report that Penang has not been left behind in these developments. Ever since this government assumed power in 2008, Penang has undergone a process of democratisation, both in governance and in economy.

When we first took power, my first act as Chief Minister was to implement a new guiding principle for governance: CAT (Competency, Accountability and Transparency). Based on these core principles, Penang has become the first state in Malaysia to introduce an open tender system for all public procurements and supplies. This move, while simple, has been ground-breaking in Malaysia.

On top of that, we have also made available government contracts for public scrutiny, another unprecedented move in Malaysia. What’s more, our public projects also involve rigorous public consultation. For example, when we announced our intention to undertake four major public infrastructure projects last year, we held numerous press conferences asking for public opinion and even engaged various civil society groups in two townhall-style forums which I personally attended.

As a result of the above measures, we have been successful at combating corruption, making us the only state government in Malaysia to be praised by Transparency International.

We have now followed up on that by making a public declaration of assets for every member of the state cabinet. In addition, as a commitment to democracy and freedom, our State Assembly last year passed the Freedom of Information Enactment, which allows people the right to access previously off-limit government information. We have also established the first speaker’s corner in Malaysia, where one can not only enjoy freedom of speech, but also freedom after speech.

Our firm belief in good governance and democracy has paid off handsomely. For two years in a row, we have been tops in manufacturing investment in Malaysia. In 2010, we attracted RM12.2 billion worth of investments while we received RM9.1 billion last year. We have also charted the highest increase in passenger growth among all airports in Malaysia, achieved the highest drop in crime index, and are now rated the most liveable city in Malaysia. We have even achieved the most success in reducing debt – slashing RM600 million out of RM630 million in the last three and a half years – a 95% reduction of debt, the highest amongst all states in Malaysia.

When I spoke about economic democratisation and improving purchasing power and income levels of people, it was not mere rhetoric. In Penang we practice what we preach. Besides instituting the open tender system and achieving economic success, we also became the first state in Malaysia to eradicate hardcore poverty, with every household in Penang earning a minimum of RM600 a month. In addition, we also run a multitude of social welfare programmes, giving cash aid to senior citizens, single mothers, the disabled, schoolchildren, newborn babies and subsidised dialysis treatments. These are all part of our efforts to ensure that the downtrodden are taken care of, and in turn able to contribute meaningfully to our economy.

In other words, democratisation in Penang has taken the form of a people-centric government with people-centric policies. By this, we mean a government that does three things:

1. Listen to the people.

2. Do the people’s work.

3. Focus on the people.

These three principles guide our work as a people-centric government. It is also our commitment to the greater cause of democratisation.

However, the path to a truly democratic society is far from complete, especially in our country. Despite the gains that we have made in the last few years, many challenges lie in our path. Earlier I mentioned the Yellow-shirt Bersih 2.0 movement. On the 9th of July last year, tens of thousands of Malaysians took to the streets to protest against what they believe to be massive electoral irregularities.

Such is the situation in our country where we are plagued by phantom voters, widespread gerrymandering, mal-apportionment of constituencies that totally run askew of our demographics, a compromised electoral roll and incidents of vote-buying. These are critical problems that we need to overcome in order to truly democratise.

However, there is much hope to look forward to. Thanks to the Bersih 2.0 rally last year, the Malaysian public has awakened. Never before has such a massive rally been organised in which the participants represented Malaysians of all walks of life. Young and old, rich and poor, Malaysians from all communities stood together to demand their rights as democratic citizens, standing their ground in the face of tear gas and chemical-laced water cannons that were used by the authorities to quell the demonstration.

We now face a crucial general election that is anticipated to take place this year. The coming polls will be the litmus test of democracy as far as free and fair elections are concerned. We hope that the Federal Government will honour the basic rights of “one person, one vote” and ensure that no Malaysian citizen is disenfranchised.

Conclusion

Ladies and gentlemen,

Asean has set the goal of achieving regional economic integration via an Asean Economic Community (AEC) by 2015. The AEC seeks to be a single cohesive market and production base, a highly competitive economic region, a region of equitable economic development and one that is fully integrated into the global economy.

The time is ripe and the global conditions are in our favour. We must capitalise upon this, and we are certainly able to do so provided we are clear on our foundations.

Democratisation is a key factor for the continued growth of our region, and the fate of Myanmar is our biggest test. As responsible partners in Asean, it is our duty to ensure that the democratisation of Myanmar is achieved peacefully and will result in their becoming a meaningful partner of growth.

Secondly, political democratisation must necessarily be followed by economic democratisation. With the decline of the traditional consumer markets of USA, Europe and Japan, Asean must emerge as the next consumer base, and we must do this by raising the skills, productivity and income of our people. We must ensure that economic growth does not result in widening income inequality. Instead, economic distribution should be seen as a growth factor and not an afterthought.

Finally, decentralisation is a necessary model considering the multi-cultural and multi-ethnic makeup of our region. It is an important issue that we need to tread as part of the ultimate objective of becoming a major global economic player in the future.

In Penang, we have shown that democratisation has resulted in a people-centric government with people-centric policies. Only by listening to the people, doing the people’s work and focusing on the people, can we hope to catch the fourth wave of democracy.

The challenge therefore lies in our ability to ride this fourth wave of democracy, or risk being swamped and drowned by its undercurrents.

第四波民主浪潮

原本世界公认的，历史上只有三波的民主浪潮，那就是第一波19世纪美国与欧洲的民主浪潮、第二波是二战结束后的去殖民化及欧洲重回民主化，第三波是1974年以降的南欧及拉丁美洲民主化，进而连带的推倒了铁慕及最后让东欧国家也走上民主化。

最新的一波就是如今后续还在进行中的阿拉伯之春，全世界又再经历一次民主化的洗牌。极权主义政权及独裁者如突尼斯的本阿里、埃及的穆巴拉克及利比亚强人卡达菲，莫不被其人民拉下台。揭竿而起的阿拉伯民众如星火燎原传偏整个阿拉伯世界，使到其他极权政府备受威胁，最近的一例就是叙利亚的总统巴沙。

如今这第四波民主浪潮并不局限在中东世界，我们更可以看到，它正在我们的东南亚区域中发生。从新加坡的无声示威，到马来西亚净选盟的黄衫军运动，直到缅甸破冰的民主化首航，可以预见在接下来的十年，东盟国家局势将会非常值得关注。

我认为这一系列事情的发生并不是偶然，尤其在20世纪的经济强权衰弱之际，新的全球典范正在冉冉崛起。当美国、欧洲及日本，这些传统消费大国正面对着长期的失业率而困扰，我们东盟正面对严峻的挑战。

当这些经济强权购买力衰弱，谁来买我们的产品？换句话说，谁将是我们未来的客户？

答案很明显，就是占据世界人口9%，拥有6亿人口的东盟国家，外加东亚巨人及印度的两强，几乎涵盖了世界人口的40%，约30亿人口的市场。这将会是我们下一个主要的消费市场。

不过，要形成这个消费市场，前提是要这区域的人口袋里要有钱，拥有足够强劲的购买力。换句话说，就是要先实现经济民主化，以加强区域的消费市场。

东盟国家如三文治般夹在印度和中国之间，有必要在全球秩序重组之际，抓紧机会。我们必须认真进行政治及经济的民主化与去中央化，才能确保我们潜在的经济成长。唯有解构我们的政治经济结构，我们才能以加乘的效果，在2015年之后达到真正一体的东盟经济体。

缅甸：东盟最大的考验

如我之前所述，我们东盟正经历天翻地覆的改变，一直以来被认为是属于东盟国家集体责任的缅甸，却是改变最大的。

诺贝尔和平奖得主，缅甸的反对派领袖昂山素姬也点出“一个巨大的改变可能就在眼前”，这是让我们东盟国家无不振奋的。同时我们更要分担重大的责任，确保我们的邻邦在民主过渡期能和平渡过。

如果缅甸的民主化能够取得巨大的成功，我们就能向世人展现出有别于阿拉伯之春由下而上，群情汹涌的民主化模式，缅甸民主化将见证的将会是由上而下的权力和平转移。

作为东盟内的友邦，我们在这历史性的改变时刻扮演这重要角色，就如当年全世界遗弃他们的时候，我们如何帮助缅甸加入东盟一样，我们必须要协助缅甸在民主化中和平过渡，这不只福泽5000万缅甸人民，也将惠及东盟6亿人口。

新经济将诞生，我们必须确保缅甸能无间的加入东盟的经济体系，并尽可能的互惠互利。

经济民主化才能推动成长

从阿拉伯之春到欧洲的反资本主义示威，再到纽约的占领华尔街行动，在在显示了无论任何社会经济背景，是贫是富、专业人士或蓝领，所有人民只是希望他们的声音被听到。换句话说，人们渴望能在政治及经济上真正的参与其盛。

阿拉伯之春是渴望民主，而欧洲及美国的示威浪潮却是为了经济平等及经济参与，原因是他们虽然生活在进步国家，但是大多数人受到的经济利益少之又少，经济利益掌控在少数的资本精英手上，多数民众被拒于门外。

因此，民主并不是单单局限在政治范畴，它更扩及经济平等及经济参与的范畴。每一个普通的男女百姓都应该获得他们应得的经济权利。

在此，经济民主化可以推动成长。在一般的情况下，我们通常认为要先经济成长，下一步才来谈经济分配。但是，我今天的看法是经济分配应该作为经济成长的催化剂。

以印尼为例简单说明，若印尼人每天额外增加1美元消费，那么每天印尼经济将会有额外的2亿4000万美元在流通。这可不是一笔小数目。换句话说，若我们能增加低收入人民的购买力，我们将制造一个更大的消费市场。

为了让上述说法发生，我们得寻策让人们的收入集体增加，尤其是在经济阶级中最低的一群。这可透过经济民主化达到，允许人们更多的经济参与及制造更多的机会，增加人们的技能，自能增加生产力，也自然增加员工的收入，高收入将会带来高购买力，也自然会带来健康的经济。

因此，东盟的挑战就在于如何驾驭民主与经济发展所产生的加乘作用。真正的经济民主化乃在于人们在获得经济参与权利之后，不必再汲汲于比较谁能提供更廉价的商业成本，相反的是比较如何产生更多的消费者。与其你争我夺弱肉强食及在吸引外资上竞争，到不如一起互惠互利。

展现东盟多元文化的关键——去中央化

民主化的另一个重要层面是去中央化。去中央化是一个基建于自由、赋权(下放权力)及集体问则为原则的整合过程。

东盟国家的共同点或传统就是集权中央。但是东盟国家民主化过程中，这些集权中央的结构在国家层次之下，逐渐被更有效的以民为本的本土化集体决策系统所瓦解。

去中央化能让中央政府更能有效专注制定国家政策，而不是去管理各地方垃圾或是规划离首都数百公里的州属内巴士路线。很不幸的我的国家就是如此，还不能下放权力到地方，但一旦我们入主中央，我希望可以看到改变。

去中央化是东盟国家无法逃避的重要课题，因为我们每个国家几乎都是多元种族及多元文化的国家，这自然就会有身份认同的政治问题。

例如，三份之一的缅甸人是由各非缅甸裔的种族组成。在泰南与菲律宾南部都存在着穆斯林的矛盾，同时在印尼的群岛当中，更是存在着不计其数的不同种族。马来西亚则在隔着南中国海之下，让马来半岛人民与沙巴砂拉越人民产生隔阂。

问题在于我们如何解决这个问题？我们是否以中央的铁腕及武力解决，还是我们更应该以权力共享的方式来解决问题？

印尼在后烈火莫熄时代，民主化运动已经进入到去中央化的阶段，并取得不错的成果。有人形容这是印尼“开天辟地式的去中央化”，很多重要权责及经济资源都下放到地方政府。区域财务多元化，公共交通地方化，而新的政府与政府之间的关系也一切到位。

今天，我们看见印尼国家层级以下的各政府百花齐放。这就是民主化让地方政府有公信及能干，充满动力的地方政府让印尼能抵受全球经济的影响。如印尼次级城市泗水就能获得比国家平均更杰出的经济增长。

印尼的民主化所带来的助益，已经成为东盟国家学习的楷模。因为我们东盟都是多元种族及多元文化的国家，所以我们必须认识去中央化。去中央化虽然很重要，但是在去中央化的过程中，我们必须小心翼翼进行，在不危损国家主权的前提下，创造共存的局面。

槟城在大马民主化和经济发展的前端

自从2008年槟州换政府后，无论在治理和经济上，槟城都已经历民主化过程。

当我们首次执政，我任首席部长的第一件事就是落实能干、公信、透明的施政方针（CAT），在这个原则的基础下，槟城成为全国首个无论在公共采购和供应体系上都公开招标的州属。这是马来西亚第一个突破。

更重要的是，我们的公共工程都征求公众意见，如去年宣布要进行四项公共设施工程后，召开多次的新闻发布会，要求公众提供意见，并在两个市议会举办相关论坛，我也参与其内。这使我们成功对抗贪污腐败，槟城是全国唯一受到国际透明组织表扬的州属。

接着我们公布槟州行政议员的资产，槟州议会也在去年通过自由资讯法案，赐予民众权利翻查之前受到限制的政府文件，我们成立全国第一个言论广场，除了还民发言的自由，也给他们发言后的自由。

良好的施政和民主带来丰厚回报，槟城连续两年在制造业投资额中全马居冠 2010年投资额达122亿令吉，去年为91亿令吉。槟州也是全国机场客运增长率最高的州属，罪案率是全国降幅最多，现在是全国最适宜居住的城市。我们也成功在3年半内减少95%的债务，原本6亿3千万令吉的债务减去了6亿令吉。

经济民主化和提高国民购买力不是空谈的。在槟城，我们除了实行公开招标和达到成功的经济，我们也是全国首个消除赤贫的州属，帮助每月收入低于600令吉的赤贫家庭。此外，槟州也实行数个福利计划，提供回馈金给乐龄人士、单身妈妈、残障人士、中小学生、新生儿和津贴给洗肾病人。

换句话说，槟城的民主采取了以民为本的政策，我们定义一个政府必须做到3件事：听人民的话、做人民的事、关注人民。

这3项原则导我们做个以民为本的政府，也是我们迈向更强大民主社会的承诺。

但是，要达到真正民主社会的路还很远，尤其是在我国。尽管这几年我们已取得一点成就，但前面还有许多挑战。刚才我提到净选盟2.0人民集会的黄衫军运动，去年7月9日，数以万计的马来西亚人走上街头，抗议不公平的选举。

我们的国家存在幽灵选民、不公正划分选区，选区人口统计不公、妥协的选民登记册和贿赂选民问题，这些都是需要克服才能真正做到民主化。

感谢去年净选盟2.0人民集会唤醒了许多人，以前不曾有过涵盖各行各业国人的如此大规模集会，年轻人和长者、穷人和富人、来自各社区的人民站在一线，即使面对催泪弹和化学水泡的镇压，大家依然不畏惧，为了权利和公民民主站稳立场。

预计今年举行的大选很关键，这将是备受关注的公正选举和自由的民主试金石，我们希望联邦政府履行“一人一票”，确保马来西亚公民的基本权利没被剥夺。

结论

东盟通过“东盟经济共同体（AEC），设下在2015年实现区域经济一体化的目标。AEC主要目标是共创一个单一市场和生产基地、一个激烈竞争的经济区域、一个公平的经济发展区域 和一个地区完全融入全球经济。

现在是成熟的时机，全球情况有利于我们，我们必须善用，只要我们在明确的基础上，一定能做到。

民主化是对本区域持续增长的关键因素，缅甸的命运是最大考验，身为东盟负责任的伙伴，我们有责任确保缅甸和平实现民主，成为我们有意义的成长伙伴。

其次，经济民主化必须紧追政治民主化。美国、欧洲和日本的传统消费市场购买能力下跌，东盟必须成为未来的消费群，我们必须通过提高技能、国民生产力和收入，确保经济增长不会拉大收入不平均的距离，经济分布应被视为经济增长的因素，而不是事后才讨论。

最后，下放权力是一个必要的模型，有鉴于本地区的多元文化和多种族结构，这是一个重要的课题，我们需要走在基础的道上，成为未来全球主要经济的一部分。

在槟城，我们已经表明，民主的政府必须实施以民为本的政策，只有听人民的话、做人民的事和关注人民，才有希望赶上第四波民主浪潮。

挑战在于，我们是否有能力驾驭第四波民主浪潮，还是被暗流淹没吞噬。

Chua Soi Lek’s refusal to release his own debate transcript in Bahasa Malaysia and English will only prove to non-Chinese speaking Malaysians that he focused on making personal attacks, lies and adopted divisive tactics during the historic Mandarin. Not only did Chua made personal attacks against me during the historic debate on 18.2.2012, even his predecessor Datuk Seri Ong Tee Keat was also not spared.

I had refused to trade personal insults or indulged in personal attacks with Chua during the debate as I believed that a debate should be a contest of ideas, ideals and principles. Chua knows releasing his own debate transcripts will only expose himself as indulging in baseless personal attacks against me as well as Ong Tee Keat. Worse Chua will also be exposed for his divisive tactics and lies against the record of PR.

MCA and Chua are using their control over the BN mass media to whitewash Chua’s personal attacks and twist the outcome of the debate into lies. Even the Star was compelled to apologise to me in their enthusiasm to whitewash Chua’s performance. Facts and figures do not lie. Let the debate transcripts speak for themselves.

In the interests of historical veracity, Chua should emulate what I have done by releasing the debate transcripts in Bahasa Malaysia and English for the benefit of non-Chinese speaking Malaysians. Yesterday
I have released my debate transcripts in Bahasa Malaysia. Today I release my debate transcripts in English which clearly showed that unlike Chua I did not launch any personal attacks against Chua’s past
or record.

Introduction, Lim Guan Eng:

First of all, I would like to thank the organisers for this live televised debate. Televised debates mark a new chapter in Malaysian political democracy because it is an important element in the democratisation process. I hope that from today onwards, televised debates will be a common phenomenon in the Malaysian democratic system just like in Europe and the United States.

Thus, I believe what Malaysians really want to see is a debate between Prime Minister Datuk Seri Najib Tun Razak and Opposition Leader Datuk Seri Anwar Ibrahim, to see who really deserves to be Prime Minister. Whoever isn’t brave enough to debate, don’t hope to think of becoming Prime Minister.
Chua suggested that DAP is being used by PAS. If we observe UMNO amongst the Malays, UMNO claims that PAS is being used by DAP. Therefore, I believe this self-contradictory statement is a dirty tactic employed by BN. I wish to stress here that Pakatan Rakyat component parties, be it PAS, PKR or DAP, we never use each other. We are only prepared to be “used” by the people! At the same time, we are also not anti-Malay or even anti-non-Malay; we are merely against a government that is riddled with corruption!

I feel that today’s theme, “Is A Two-Party System Becoming a Two-Race System?”, is quite strange. Because, there already exists a two-race system at the present moment, and we want to change it into a
two-party system. This two-race system, which is BN’s long-held ideology since Independence until now, has BN dividing the people into Malays and non-Malays, this is a ‘divide-and-rule’ strategy. The Deputy Prime Minister Tan Sri Muhyiddin Yassin had had said, “I am a Malay first, then only a Malaysian.” Is this 1Malaysia or is this Bluff(Tipu) Malaysia? This is indeed a two-race system.

On the other hand, a two-party system is premised on ideology, ideals and principles, without racial discrimination because we are all Malaysians.

In BN, UMNO only takes care of the Malays, MCA only takes care of the Chinese, MIC only takes care of the Indians, Gerakan… I don’t know takes care of who???…. That’s BN with their “you take care of your
race, I take care of my race”. That is a two-race system! Conversely, in a two-party system, we are all brothers and sisters, we take care of each other; every Malaysian is part of one big family!

UMNO always proclaims “Malay Supremacy”. Does the MCA not see this, hear this or feel this, and thus are not brave enough to stand up to them? Hence, we still hear that the Chinese are immigrants(pendatang)
and do not deserve equal rights.

PR is different from BN. We don’t want “Malay Supremacy”, what we want is “Rakyat(People) Supremacy”! Anwar not only speaks about “Rakyat Supremacy” in front of non-Malays, but he also says the same thing to
the Malays. Will UMNO leaders dare to stop proclaiming “Malay Supremacy” and instead support “Rakyat Supremacy”.

When the people or PR leaders expose abuse of power or corruption and question the Police or the Malaysian Anti-Corruption Commission, we are accused of challenging the Malay institutions – this is a two-race system, because corruption does not discriminate against the colour of one’s skin. The late Ahmad Sarbaini, the customs officer who lost his life, is he not a human being?

Pakatan Rakyat wants to abolish corruption, BN wants corruption. PR wants to ensure leaders who are honest and a government that is clean, including public declaration of assets of government leaders, open
tenders, now this is a two-party system! Most importantly, the real corrupt officers must be caught, and not slandering the poor innocent Teoh Beng Hock.

My opponent always says: “Other races become government, Chinese become opposition”. This is totally wrong. In truth, “BN MCA becomes opposition, PR DAP becomes government” is what worries MCA. Not only does the Chinese support PR to bring change, the Malays do so as well, if not PR would not have been able to gain 40% Malay support and the political tsunami would not have happened. Without the political
tsunami I believe I would not have the opportunity to stand here as the Chief Minister of Penang and Chua would not have the chance to become the President of the MCA.

In a democratic system, a two-party system requires alternating governments. Let the BN fall and become the opposition, let PR rise to become the government. If PR does not rule well, then the people have
the right to change again after five years. This is a two-party system, with alternating parties ruling, only then will the people have a better life.

Question from the moderator:

The Chinese community have welcomed a two-party system since 1980. If we refer to the 2008 results, the amount of votes given to BN and PR are about the same. This shows that half the people are happy with BN
while the other half harbour hopes for PR. Does this mean that both parties have achieved a two-party system? How would your party seek to win the other half?

Answer from LGE:

If PR is given the chance to rule, our policy will bring benefits to the people. Today, inflation is rising, our income is not enough to make ends meet. We want to reduce the people’s burden. If we become
gvernment, we will abolish the North-South Expressway and the Penang Bridge tolls. We will also increase oil royalties from 5% to 20% for Sabah and Sarawak.

I know, since Penang gave RM100 to senior citizens every year, BN has copied. Not only BN has copied, MCA too has copied. So, besides thanking Chua, they(MCA members) should also thank the Penang State
Government. If we take power at the federal level, we wish to inform all 2.1 million senior citizens in the country that we promise to give RM1,000 every year. These are the benefits of alternating governments.

They are judged on their policies. We want to become a policy state not a police state.

Answers for the Q&A session:

LGE: Was that Perak Exco Ma Han Soon? I think we all know that when PR was the government in Perak, it was PR which started the initiative to grant land to schools and permanent land titles to new village
residents and the poor. However, since BN became government, this has been abolished. Because of that, I feel that you have no right to question anyone.

On the question of the Penang State Government making empty promises, I wish to stress that we have fulfilled all our election promises. On why the Sungai Nyior toll has not been abolished, we must remember that this is under the power of the Federal Government. We have not taken over the Federal Government, so be patient…. When we have taken over the Federal Government, of course we will abolish it, as well as the North-South Expressway and the Penang Bridge tolls. However, even though we have not abolished the Sungai Nyior toll, we have built a road to bypass the toll plaza, so it is the same, no need to pay toll.

The success of Penang, I believe has been proven. After March 2008, everyone can see, touch and feel the changes that have happened. In Peninsular Malaysia, the first dual lingual road signs in Chinese were
erected in Penang. The first Tamil road signs in Malaysia are also in Penang. For the first time in Penang, we also have road signs in Arabic, all due to the success of the PR Government. Penang’s success
in combating corruption is also notable, resulting in praise from Transparency International. If there are people who are guilty, we will not let them get off scot-free, and the fact the Penang has zero
corruption has been recognised by an international organisation. When we say we don’t take money, we don’t take money. Thank you.

Questions to each other:

CSL: We hear populist policies, giving RM100, abolish this, abolish that… Can you, on this stage, tell us what is the community development and economic model of Pakatan Rakyat so that Malaysia can escape the low-income trap and achieve high income status, including implementing the promises in the Buku Jingga?

LGE: I believe this is the difference between myself and Chua. He is not anxiously concerned about corruption, while I am very anxiously concerned about corruption. We need to have a framework for
administrating the country’s affairs. What is the plan to bring economic development? I wish to use the Penang model as an example.

This is the result of the Penang Pakatan Rakyat State Government’s practice of “money makes money”. This system stresses four key aspects. First, “money raise money” through cooperation between the
private and public sectors (Public Private Partnerships) in executing development projects. Secondly is “money earns money” through an open tender system, the State Government can cut costs. Third is “money
creates money” through innovation and creativity. Finally, “money saves money”. If we don’t take money, for sure there will always be money to be saved.

Therefore, the Penang State Government has enjoyed a budget surplus every year for four years, and is able to give back to the people through our Senior Citizens Programme with RM 100 every year, and
RM1,000 one-off to beneficiaries of senior citizens who pass away. Even newborn babies get RM200 under our Golden Child Programme. When Barisan Nasional was ruling Penang, not a single sen was given, but
with the principle of “money makes money”, we have given benefits to the people of Penang, and this is actually an anti-corruption dividend!

In addition to that, in Malaysia, I believe that if we abolish corruption, we will be able to save a lot of money and give back to the people. This is our promise, Penang is the best proof! If we dare
to fight corruption, we will definitely have money. Thank you.

Answers to the Q&A and Conclusion, LGE:

First of all, I would like to rebut certain accusations that the Penang State Government has not given land to Chinese schools. I feel this is not only lying to yourself but also lying to others. This is
because we have proof, even the schools can verify that the Pakatan Rakyat Government has given land. Don’t forget, the Pakatan Rakyat State Government has now institutionalised allocations to all school
streams, not just Chinese schools, also Tamil schools, Sekolah Agama Rakyat or religious schools and private Chinese schools. Before, there was nothing, and now they receive yearly allocations.

Here, I would like to make a plea to all Malaysians. Be brave enough to change, we must not surrender our destiny to fate. We deserve equal opportunities. No longer must we kneel down and beg. We must boldly
rise up with dignity to seek change! We do not want to be lied to anymore, change now! Look, the MCA President too has changed, for the first time he is debating with the Rocket. But this debate is not as
important as whether MCA dares to say “No” to UMNO?

Why say “No” to UMNO? Because UMNO uses racial and religious sentiments, including supporting PERKASA to inflame and divide the people! Secondly, UMNO abuses laws that impinge upon human rights. UMNO condones corruption, Shahrizat’s case with the cows is only the tip of the iceberg. Even more serious, in the last 10 years, RM1 trillion of illicit funds (corruption money) has been illegally taken out of the country. How do we account for this? This is why we want a two-party system.

As what the former MCA President Ong Tee Keat described MCA’s cooperation with UMNO. He said, “Before at least MCA could eat the leftovers dishes on the table, but now the best they can hope for are the breadcrumbs.”

Many Malays have not enjoyed the fruits of development of this country. They don’t get RM250 million to raise cows, because most of the “good fruits” have been eaten by BN cronies leaving to the people only the “dead” fruits.

The problems faced by the Chinese community, I believe everyone knows there are many problems. Besides the problem of the private school certificates (UEC) not being recognised, Chinese schools do not get
enough allocation funds, teachers who are not proficient in Chinese are sent to Chinese schools, there are also problems with temporary teachers that have not been resolved. But issues of unequal access to
the economy and jobs, I believe are not only faced by the Chinese, but also by other races. That is why we have to take this chance to work together with the other races to bring about change.

What we stress now is about the future of our children. The future of my generation has already been robbed by BN for 50 years, don’t let our children’s future be robbed as well. Therefore, we are awaiting
the chance to change.

This morning before I came, I told my daughter that if given the chance, I would like to be the voice of her generation. I hope to provide policies that will enable you to live here and not to migrate.

We must give importance to talent. Remember, only by appreciating, emphasising and choosing talent can the future of Malaysia be bright and prosperous.

Look at South Korea, in 1970, their average per capita income was only USD260 in 1970 Malaysia was better, we had USD380 then. However, South Korea has now surpassed Malaysia. Now, our average income is USD7,760 while South Korea has reached USD20,000! Why has South Korea become a high income nation while Malaysia has failed? The main factor is that South Korea is a democratic country, practices a two-party system, has an alternating change of government. Therefore, if we want to change, if we want Malaysia to become a high income nation, we must be brave to rise up for change, we must be brave to realise a two party system.This path is not easy, but I wish to remind everyone, our cooperation with PAS, PKR is based on a written manifesto. It has been announced in public, PAS has their ideology, DAP has our ideology, but don’t forget, PAS has never caused the death of a single Chinese. Let us be strong, will ourselves to change. Even though the path may be difficult, but for the sake of our younger generation, we must complete this journey of change!

Ini adalah untuk menjawab usaha media massa yang dikuasai BN, yang putar belit ucapan saya dengan fitnah. Pada 21 Februari 2012 suratkhabar milikan MCA, The Star telah meminta maaf kerana fitnah dalam artikel Baradan Kuppusamy di bawah tajuk “All hype but no climax?” yang cuba mengindahkan Chua.

Teks ucapan ini adalah penting untuk menangkis tuduhan puak rasis dan ekstremis yang cuba menggambarkan parti berbilang kaum seperti DAP sebagai parti perkauman sedangkan sebenarnya parti MCA adalah parti perkauman sama seperti UMNO dan MIC. Teks ucapan penuh adalah seperti berikut:-

Pendahuluan, Lim Guan Eng:

Pertama sekali saya ingin mengucap terima kasih kepada penganjur kerana melangsungkan debat televisyen ini. Debat televisyen mencipta satu bab yang baru dalam politik demokrasi Malaysia kerana ia merupakan satu sifat penting dalam kemajuan demokrasi. Saya berharap mulai hari ini, debat televisyen akan menjadi satu fenomena umum yang lumrah dalam sistem demokrasi Malaysia seperti di Eropah dan Amerika Syarikat.

Oleh itu saya berpendapat bahawa, apa yang warga Malaysia benar-benar ingin saksikan, adalah debat antara Perdana Menteri Najib dengan Anwar, untuk melihat siapa yang sebenarnya lebih layak menjadi Perdana Menteri. Siapa tidak berani berdebat, jangan harap nak jadi Perdana Menteri!

Chua ada menimbulkan dakwaan bahawa DAP diperalatkan oleh PAS, tetapi jikalau tuan-tuan dan puan-puan perhatikan, di kalangan orang Melayu, UMNO mengatakan bahawa PAS diperalatkan oleh DAP. Oleh itu, hujah yang bercanggah sesama sendiri ini saya percaya merupakan taktik kotor BN. Saya ingin tekankan di sini, parti komponen dalam Pakatan Rakyat, biarpun PAS, PKR atau DAP, kami tidak memperalatkan sesama sendiri, kami hanya bersiap sedia untuk ‘diperalatkan’ oleh rakyat! Pada masa yang sama, kami bukan anti-Melayu, ataupun anti-bukan Melayu, kami cuma anti-kerajaan yang bergelumang dengan rasuah!

Tema hari ini ‘Adakah Sistem Dua Parti akan menjadi Sistem Dua Kaum’, sebenarnya saya berasa pelik. Kerana, sekarang sudah wujud Sistem Dua Kaum, kami nak menjadikannya Sistem Dua Parti. Sistem Dua Kaum ini sememangnya ideologi BN selama ini, sejak kemerdekaan sehingga kini, BN telah membezakan rakyat sebagai Melayu dan Bukan Melayu, ini adalah taktik pecah dan perintah. Timbalan Perdana Menteri Muhyiddin Yassin pernah berkata, saya utamakan Melayu dahulu, barulah rakyat Malaysia. Adakah ini Satu Malaysia? Ataupun ini Tipu Malaysia? Inilah Sistem Dua Kaum!

Sebaliknya, Sistem Dua Parti itu berasaskan ideologi, idealisma dan prinsip, tanpa membezakan kaum kerana kita semua adalah rakyat Malaysia.

Dalam BN, UMNO hanya menjaga orang Melayu, MCA hanya menjaga orang Cina, MIC hanya menjaga orang India, Gerakan itu… tak tahulah dia menjaga siapa.. Itulah BN yang ‘kamu jaga kaum kamu, saya jaga kaum saya’, ini adalah sistem Dua Kaum!

Sebaliknya, di dalam Sistem Dua Parti, kita semua sanak saudara perjuangan, kita menjaga kebaikan antara satu sama lain; setiap warga Malaysia adalah seperti ahli sekeluarga!

UMNO selalu melaung-laungkan ‘Ketuanan Melayu’. Adakah MCA tidak terlihat, tidak terdengar dan tidak terasa, sebab itulah tidak berani untuk menghalangnya? Justeru itu, kita masih mendengar bahawa orang Cina adalah pendatang, tidak berhak menuntut hak yang saksama di Malaysia.

PR berlainan dengan BN. Apa yang kita mahu bukan ‘Ketuanan Melayu’, apa yang kita mahu ialah ‘Ketuanan Rakyat’! Anwar bukan sahaja bercakap tentang ‘Ketuanan Rakyat’ di depan orang bukan melayu, tetapi dengan orang Melayu juga beliau cakap yang sama. Saya tidak pasti sama ada pemimpin UMNO berani berhenti melaungkan ‘Ketuanan Melayu’ tetapi menyokong ‘Ketuanan Rakyat’.

Apabila rakyat ataupun pemimpin PR membongkar penyalahgunaan kuasa atau rasuah dan menyoalkan integriti Polis atau Suruhanjaya Pencegah Rasuah, kami dituduh mencabar institusi Melayu – ini adalah sistem Dua Kaum! Rasuah itu tidak mengenali perbezaan warna kulit. Allayarhan Ahmad Sarbaini, pegawai kastam yang terkorban, bukankan beliau seorang manusia?

Pakatan Rakyat mahu hapuskan rasuah, BN mahukan rasuah! PR akan memastikan pemimpin yang jujur dan kerajaan yang bersih, termasuk mengisytiharkan aset, tender terbuka, ini barulah sistem dua parti! Yang paling penting sekali, menangkap pegawai yang benar-benar rasuah, bukan memfitnah Teoh Beng Hock yang tidak bersalah.

Pihak lawan saya selalu berkata: ‘Kaum lain menjadi kerajaan, Kaum Cina menjadi pembangkang’. Ini salah sama sekali. Sebenarnya, ‘BN MCA menjadi pembangkang, PR DAP menjadi kerajaan’ barulah yang resahkan MCA. Bukan sahaja orang Cina yang menyokong PR untuk berubah, orang Melayu pun sama, jika kami tidak dapat sokongan 40% orang Melayu, tsunami politik tidak mungkin akan berlaku. Saya percaya, saya pun tidak akan berpeluang berdiri di sini sebagai Ketua Menteri Pulau Pinang. Chua pun mungkin tidak berpeluang menjadi Presiden MCA.

Dalam sistem yang demokratik, sistem Dua Parti perlu peralihan parti pemerintah secara alternatif. Biar BN tumbang jadi pembangkang, biar PR bangkit jadi kerajaan! Jikalau PR tidak memerintah dengan baik, rakyat berhak bertukar lagi selepas lima tahun. Ini barulah sistem Dua Parti, peralihan parti pemerintah secara alternatif, barulah rakyat akan ada kehidupan yang baik.

Soalan daripada moderator:

Moderator: Masyarakat Cina sudah mulai mengalu-alukan sistem dua parti sejak 1980. Jikalau kita menggunakan keputusan 2008 sebagai satu rujukan, undi yang diberi kepada BN dan PR adalah lebih kurang separuh masing-masing. Ini menunjukkan separuh rakyat berpuas hati dengan pemerintahan BN, separuh rakyat mempunyai harapan kepada PR. Adakah ini bermaksud sekarang kedua-dua pihak telah mencapai tahap perjuangan dua parti? Macam manakah parti anda memenangi undi yang separuh lagi?

Jawapan Daripada LGE:

Kalau PR berpeluang menjadi kerajaan, dasar kami adalah untuk memberi manfaat kepada rakyat. Sekarang semua harga barang naik, duit tak cukup menampung hidup rakyat, kami hendak meringankan beban rakyat. Kalau jadi kerajaan, kami akan memansuhkan toll Utara-Selatan dan Jambatan Pulau Pinang. Kami juga akan meningkatkan royalti minyak daripada 5% kepada 20% bagi Sabah dan Sarawak. Lagi, warga emas. Saya tahu, sejak Pulau Pinang memberi warga emas RM100 setiap tahun, BN ciplak, bukan sahaja BN yang ciplak, MCA pun meniru. Jadi, selain daripada berterima kasih kepada Chua, mereka (ahli MCA) harus berterima kasih kepada kerajaan Pulau Pinang jugalah. Jika kami boleh mengambil kuasa di peringkat pusat, kami ingin maklumkan warga emas seramai 2.1 juta di seluruh negara bahawa kami janji akan memberi RM1,000 setiap tahun. Ini adalah kebaikan peralihan kerajaan secara alternatif. Kebaikannya adalah bahawa parti dinilai berdasarkan dasar atau polisi mereka, kami hendak jadi ‘negeri polisi’ dan bukan negeri polis. Sekian.

LGE: Tadi itu Exco Perak Mah Hang Soon kan? Saya rasa kita semua tahu waktu PR menjadi kerajaan di Perak, PR lah yang mulakan inisiatif memberi tanah kepada sekolah, dan juga memberi pajakan tanah kekal kepada penduduk kampung baru dan penduduk miskin. Tetapi sejak BN menjadi kerajaan, ini sudah dimansuhkan. Sebab itu, saya berasa anda tidak layak untuk mempersoalkan sesiapa.

Tentang soalan bahawa kerajaan Pulau Pinang memberi janji kosong, saya nak menekankan bahawa kami sudah menunaikan semua janji pilihan raya. Tentang kenapa tol Sungai Nyior tidak dimansuhkan, para hadirin harus ingat bahawa itu di bawah bidang kuasa kerajaan pusat. Kami belum mengambil kuasa kerajaan pusat, jadi sabarlah… Bila kami mengambil kuasa kerajaan pusat, sudah tentu kami akan memansuhkannya, termasuk Lebuhraya Utara-Selatan dan Jambatan Pulau Pinang. Tetapi, walaupun belum dimansuh, kami sudah membina satu jalan untuk memintas tol Sungai Nyior itu, jadi samalah, tidak perlu membayar tol tak munasabah ini.

Kejayaan Pulau Pinang, saya percaya ia boleh dibuktikan. Selepas Mac 2008, semua orang boleh lihat, sentuh dan rasa perubahan yang berlaku. Di Semenanjung Malaysia, papan tanda dwibahasa dengan Bahasa Cina yang pertama didirikan. Papan tanda berbahasa Tamil yang pertama di Malaysia juga terletak di Pulau Pinang. Pulau Pinang pertama kali mendirikan papan tanda berbahasa Arab, juga kerana kejayaan kerajaan PR. Kejayaan Pulau Pinang dalam membanteras rasuah pun yang paling terserlah, sehingga kami dapat pujian Transparency International. Kalau ada orang yang bersalah, kami tidak akan melepaskannya sebegitu sahaja, tetapi Pulau Pinang yang mempunyai rasuah sifar adalah satu hakikat yang diakui oleh organisasi dunia. Kami tidak makan duit itu memang tidak makan duit. Terima kasih.

CSL: Kita dengar polisi yang populis, beri RM100, mansuh ini mansuh itu, adakan anda boleh memberitahu atas persada ini apakah model pembangunan masyarakat dan ekonomi Pakatan Rakyat supaya Malaysia boleh keluar daripada situasi berpendapatan rendah dan mencapai pendapatan tinggi, termasuk menunaikan janji-janji dalam Buku Jingga?

LGE: Saya rasa ini perbezaan antara saya dengan Presiden Chua. Beliau tidak risau kepada isu rasuah, saya pula risau sangat tentang isu rasuah. Kita perlu ada satu kerangka untuk mengurus hal ehwal negara. Apakah rancangan untuk membawa pembangunan ekonomi? Saya ingin mengambil model Pulau Pinang sebagai contoh. Ini semua adalah hasil daripada amalan sistem pemerintahan Kerajaan Negeri Pakatan Rakyat Pulau Pinang yang mempraktikkan sistem ‘wang gandakan wang’. Sistem ini menekankan 4 aspek utama iaitu yang pertama, wang kumpulkan wang melalui inisiatif kerjasama antara pihak awam dan swasta dalam menjalankan projek pembangunan. Kedua ialah wang untungkan wang. Melalui amalan sistem tender terbuka, Kerajaan Negeri berjaya mengurangkan kos pembiayaan. Ketiga ialah wang hasilkan wang menerusi pendekatan kreatif dan inovatif. Dan yang terakhir ialah wang jimatkan wang. Sekiranya kita tidak makan wang, sudah tentu wang akan sentiasa ada.

Oleh itu, dalam 4 tahun berturut-turut ini, Kerajaan Pulau Pinang mendapat keuntungan tiap-tiap tahun dan mampu beri balik duit kepada rakyat melalui Program Warga Emas RM100 setiap tahun, pewaris kepada warga emas yang meninggal dunia akan menerima RM1000 sekali sahaja, malah lahir bayi pun dapat RM200 di bawah Program Anak Emas. Semasa Barisan Nasional memerintah Pulau Pinang, satu sen pun tidak beri, tetapi dengan prinsip ‘wang gandakan wang’ ini, kami memberi manfaat kepada rakyat Pulau Pinang, dan ini sebenarnya dividen anti-rasuah!

Di samping itu, di Malaysia, saya percaya jika kita boleh membanteras rasuah, dan bukan makin banteras makin rasuah, kita boleh menjimatkan banyak wang dan memberi balik kepada rakyat jelata. Inilah janji kami, Pulau Pinang adalah bukti yang terbaik! Jikalau kita berani membanteras rasuah, kita tentu akan perolehi wang. Terima kasih.

Pertama sekali saya ingin membalas sesetengah tuduhan bahawa Kerajaan Negeri Pulau Pinang tidak memberi tanah kepada sekolah Cina, saya rasa ini bukan sahaja hendak menipu diri sendiri tetapi juga hendak menipu orang lain. Ini kerana kami mempunyai bukti, sekolah pun boleh mengesahkan bahawa Kerajaan Pakatan Rakyat telah memberi tanah. Jangan lupa, Kerajaan Negeri Pakatan Rakyat sekarang memberi peruntukan yang diinstitusikan kepada semua aliran sekolah, selain daripada sekolah Cina, ada lagi sekolah Tamil, sekolah agama rakyat dan sekolah swasta cina. Dulu tidak ada langsung, kini tiap-tiap tahun dapat peruntukan.

Di sini, saya ingin menyeru semua rakyat Malaysia, beranilah untuk berubah, kita tidak harus serah diri kepada nasib. Kita berhak menikmati peluang yang saksama. Kita tidak harus melutut untuk minta, kita harus bangkit dengan berani dan bermaruah untuk berubah! Kita tidak mahu ditipu lagi, berubah sekarang juga! Tengok, presiden MCA juga sudah berubah, pertama kali berdebat dengan Roket. Tetapi berdebat itu tidak penting, yang penting itu, beranikah MCA cakap ‘Tak Nak’ kepada UMNO?

Kenapa harus cakap ‘Tak Nak’ kepada UMNO? Kerana UMNO menggunakan sentimen perkauman dan agama, termasuk menyokong PERKASA untuk menghasut dan memecah-belahkan rakyat! Kedua, UMNO menyalahgunakan undang-undang yang menyalahi hak asasi manusia. UMNO rasuah, isu Kak Shahrizat dengan Lembu itu hanya ‘tip of the iceberg’. Yang lagi serius itu, dalam 10 tahun yang lalu, sejumlah RM1 trillion wang haram (rasuah) telah dibawa keluar dari negara ini secara curi-curi. Yang ini (RM1 trillion) macam mana kira?

Seperti apa yang diakui oleh mantan presiden MCA Ong Tee Keat tentang MCA bekerjasama dengan UMNO, dulu MCA sekurang-kurangnya boleh makan semeja baki hidangan UMNO. Sekarang paling baik pun dapat cebis dan sisa roti sahaja.

Ramai Melayu tidak dapat menikmati pembangunan negara, tidak ada RM250 juta untuk menternak lembu, kerana terlalu banyak “buah-buah yang baik dimakan oleh kroni BN”, rakyat hanya boleh tertunggu-tunggu, makan sisa buah!

Masalah yang dihadapi masyarakat Cina, saya percaya para hadirin pun tahu, berlonggok-longgok, kita semua tahu apa masalahnya. Selain daripada masalah sijil sekolah swasta (UEC) tidak diakui, sekolah Cina tidak mendapat peruntukan yang mencukupi, guru-guru yang tidak arif berbahasa Cina dihantar ke sekolah Cina, ada juga masalah guru sandaran yang belum diselesaikan. Oleh itu kesemua isu peluang yang tak saksama dalam ekonomi dan pekerjaan ini, saya percaya bukan sahaja orang Cina tetapi kaum lain juga menghadapinya. Oleh sebab itu kita harus mengambil peluang ini untuk berusaha dengan kaum lain untuk membawa perubahan.

Apa yang kita menitikberat sekarang adalah masa hadapan anak-anak kita. Masa depan generasi saya sudah dirompak BN selama 50 tahun ini, jangan biar masa depan anak-anak kita dirompak juga. Oleh itu, kita sedang menunggu peluang untuk berubah.

Pagi ini sebelum saya datang, saya beritahu anak perempuan saya, kalau ada peluang, saya hendak menjadi suara generasi muda kamu. Saya harap kita ada polisi yang terbuka untuk membolehkan kamu tinggal di sini, jangan berhijrah keluar lagi. Kita hendak menitikberatkan bakat. Ingat, hanya dengan menitikberat, menghargai dan memilih bakat, barulah masa depan Malaysia akan cerah dan makmur.

Kita lihat Korea Selatan, pada tahun 1970, pendapatan purata mereka hanya USD260 seorang, pada tahun 1970 Malaysia lebih baik, ada USD380. Tetapi sekarang Korea Selatan sudah melangkaui Malaysia, sekarang Malaysia mempunyai pendapatan purata USD7760, manakala Korea Selatan sudah mengecapi USD20,000!

Kenapa Korea Selatan boleh menjadi negara berpendapatan tinggi, tetapi Malaysia masih terkandas? Faktor terutama ialah Korea Selatan adalah negara demokrasi, ada sistem Dua Parti, ada peralihan parti pemerintah secara alternatif. Oleh itu, sekiranya kita mahu berubah, kita mahu Malaysia menjadi negara berpendapatan tinggi, kita perlu ada keberanian untuk bangkit dan berubah, ada keberanian untuk merealisasikan sistem dua parti. Jalan ini sememangnya tidak mudah, tetapi saya mahu mengingati semua, kerjasama kami dengan PAS, PKR adalah satu manifesto deklarasi yang bertulis, Ini sudah diumumkan kepada semua, PAS ada ideologi PAS, DAP ada ideologi DAP, tetapi jangan lupa, PAS tidak pernah membunuh walau seorang pun orang Cina. Ini realiti, biarlah kita bertabah hati, bertekad untuk berubah, walaupun susah, tetapi demi generasi muda, kita harus sempurnakan jalan perubahan ini! Sekian.

今天，我公布我与蔡细历于“两线制是否成为两种族制？”辩论会上的辩论稿手抄本。我这么做是为了回应国阵控制媒体的诬蔑，他们扭曲我在辩论所说的话。马华所拥有的媒体《星报》终于在2012年2月21日，向我作出道歉，因为他们的专栏作者巴拉丹在题为“缺乏高潮的一昧博宣传”(All hype but no climax)一文中为蔡细历粉饰太平而诬蔑我。

因此，这篇辩论会马来文译稿非常重要，因为它揭穿种族主义及极端主义者恶意污蔑多元种族的行动党是种族政党的阴谋，虽然马华如同巫统与印度国大党才是真正的种族政党。辩论全稿如下：

槟州首席部长林冠英与马华总会长拿督斯里蔡细历医生辩论：

辩题：两线制会否成为两种族制？

首先，我感谢主办当局主办电视辩论，开创马来西亚民主政治的新里程碑，电视辩论是民主进程的重要部分，我希望从今天开始，电视辩论将能像欧美国家一样，成为大马民主的常态。

因此我认为，全马来西亚的观众想要见证的，不只是我们今天辩论的，想要见证的是首相纳吉跟安华的辩论，谁不敢辩论的话，就别想当首相。

蔡总有提到说行动党是被回教党利用，但是如果大家有注意到，在马来选区，巫统时常讲，回教党被行动党利用。我相信这就是国阵的技俩和肮脏手段。

我在这里要强调，在民联，不管是行动党、回教党或公正党，我们没有互相利用，我们只是准备被人民利用罢了。我们没有反马来人，也没有反非马来人，我们只是反贪污腐败。

今天的辩题“两线制会否成为两种族制”，其实我感觉到这个主题有点奇怪，因为现在已经是两种族制了，我们要把它变成两线制。但他却倒转过来讲。

两种族制就是国阵治理大马的理念和精神，看看国阵，从独立到今天，就是把国民区分为“马来人”和“非马来人”，这就是分而治之。副首相慕尤丁说，“我是马来人优先，才是马来西亚人。”难道，“一个马来西亚”是这样的咩？这个根本是欺骗马来西亚人，这就是两种族制！

相反的，两线制是为理念、为理想及原则，不分种族，大家都是马来西亚人。

在国阵，巫统只顾马来人，马华只顾华人，印度国大党只照顾印度人，民政党呢—　不知道在顾什么人。。。国阵就是你照顾你的种族、我照顾我的种族，这就是两种族制！

相反的，两线制是四海之内皆兄弟，大家互相照顾，每个马来西亚人都是一家人。

巫统时常喊“马来主权”，难道马华看不到，听不到，感觉不到，因此不敢阻止。结果我们看作是“寄居”的，没有权力住在马来西亚。

民联与国阵不同，我们不认同“马来主权”，我们赞同的是“人民主权”。安华不只是对非马来人社会，也敢敢在马来社会高喊“人民主权”，我不知道，任何巫统领袖，能不能够不喊马来主权，喊人民主权？

当人民或民联揭发贪污滥权，质疑警方与反贪委员会没有采取行动，却被攻击为挑战马来人机构，这就是两种族制！因为贪污是不会有肤色歧视的。Ahmad Sabaini，那个关税局的官员，不是人吗？

民联肃贪，国阵要贪。民联会确保清廉领袖及廉洁政府，包括公布财产、公开招标，这才是两线制！最重要的是抓真正的贪官，而不是冤枉无辜的赵明福。

我的对手常说，“他族在朝、华族在野”。这是错的。其实是：“国阵马华在野，民联火箭在朝”才是马华最担心的事。现在，不只是华人支持民联改朝换代，马来人也一样，如果是获得少过４０％马来人支持，根本没可能会有政治海啸。我相信，我也不会站在槟城成为当首席部长，蔡总也不会当总会长啦。

在一个民主制度，两线制就是要政党轮替，让国阵下台做反对党，让民联上台做政府! 如果民联做不好，五年后，让人民也有权利换政府！这个才是两线制！政党轮替，大家过更好的日子！

回答主持人问题：

我们谈两线制就是要政党轮替，如果说马华做不好，你们下来，让另外一个政党上来。如果这个政党做得不好，也一样拉它下来。而且我们的原则是，如果民联有机会做政府，我们要减轻人民的负担。如果我们做政府，我们就废除南北大道和槟城大桥的过路费。同时，确保给沙巴和砂拉越的石油税增加, 从５％到２０％。我知道，自从槟州开始给１００块制度化拨款给乐龄人士，国阵抄袭。不单单国阵联邦政府抄袭，连马华也抄袭。现在不只是要感谢总会长蔡细历，也要感谢槟城政府啊。如果我们能够执政中央，全马来２１０万的乐龄人士，民联保证每一年制度化给１０００块！政党轮替的好处，就是以政策来衡量，我们要成为政策州（Policy State），而不是一个警察州（Police State）！

回答民众的问题

大家都知道，民联开始执政霹雳州时，先实行送地养校，同时发给新村居民永久地契和帮助贫穷者，但是自从国阵上台后，就全部被推翻。所以，我认为，马汉顺你没有资格提出质问。

槟州民联政府兑现所有的大选承诺，至于双溪育收费站，大家都知道，这属于联邦政府的权限，让我们有机会执政中央，我们就会废除它。虽然我们无权废除收费站，可是我们建了另一条替代道路，让人民避开收费站，不必须要缴交过路费。

槟城的政绩，308后，大家都可以看到、摸到、感觉到我们做出的改变。在半岛，第一个安装中文双语路牌，就是在槟州。全马来西亚，第一个淡米尔文路牌，也是在槟州；第一次的阿拉伯文路牌，也是民联政府做的。

回答蔡细历的提问：

肃贪这方面，我们最称职，槟州零度贪污，是国际透明组织承认的。没有吃钱，就是没有吃钱。我看这就是我和蔡总的分别，他对贪污不紧张，我就很紧张。

民联有什么计划来带动经济发展，我要拿槟城“四两拨千斤”的经济管理系统，确保槟城年年有财政盈余。什么是“四两拨千斤”？就是钱钱钱钱，第一是“钱筹钱”，邀请私人界参与政府伙伴计划来筹钱，减少开销。“钱赚钱”，就是公开招标，节省开销，槟城的廉政甚至被国际透明组织和国家总稽查司表扬。还有“钱生钱”，以创意革新的方式生钱。最后是“钱省钱”，只要不“吃钱”就能省钱”，找更多的钱来惠及人民。

这4年来，四两拨千斤的“钱钱钱钱”，使到槟城每一年赚钱，我们能够回馈乐龄人士每年100令吉、逝世后继承人1000令吉、宝贝计划200令吉等等。国阵执政槟州一分钱都没给，但是现在四两拨千斤的管理，我们能够让人民受惠，因为他们获得反贪污的红利。

如果我们能够肃贪，真正肃贪而不是越肃越贪，我相信我们能够省更多钱，槟城是最好的证明。我们如果敢敢肃贪，我们一定有钱拿。谢谢。

总结

首先我要针对一些指责说槟州政府没有批地给华小，我看这是自欺欺人。因为这个是有证据，而且学校也能够证实。不要忘记槟州政府现在是制度化拨款给各源流学校，除了华小、淡小、人民宗教学校，还有独中。之前根本没有，现在确实每一年有获得拨款。

我在这边，我要呼吁全马人民，有勇气改变，我们不应该认命。我们有权力享受平等的对待的机会，我们不应该再跪下来求，而是要勇气、有尊严的站起来求变。我们不要再被骗，现在就要改变。你看，连马华总会长也要改变噢，第一次跟火箭辩，当然是辩论的辩。可是跟火箭辩论不重要，重要的是，马华敢不敢跟巫统说“不”？

为什么要跟巫统说不？

因为

1.这些年来，巫统通过种族和宗教情绪，包括支持极端的Perkasa来煽动和分裂人民

2.这些年，巫统通过滥权和违反人权的法令

3.这些年，巫统通过巫统贪污腐败，莎大姐的养牛事件只不过是冰山一角。更严重的是，这10年来，有超过一兆令吉的黑钱被偷偷拿出国。这个跟人民怎样算？

因为，好像前总会长翁诗杰承认，在马华和巫统合作下，以前最少马华还能够跟巫统同一桌吃饭的时候，能够吃到剩下来的菜，现在最多啊（为了）要吃饱，只是希望能够拾到面包屑。

许多马来人也无法享有国家发展的果实，没有2亿5千万令吉来养牛，因为太多的果实被国阵的朋党吃掉，人民只能排排坐，吃白果！

所以华社面对的问题，我相信大家也知道，华社面对的问题一箩筐，天知地知，你也知我知，华社的问题是什么。除了统考不被承认，华小拨款不足、不谙华文的教师被调去华小教书、还有临教的问题到现在还没有获得解决，所以这些经济就业教育的不平等对待，我相信不是单单华裔面对，我们友族也时面对，所以我们应该趁这个机会，跟友族联和在一起，敢敢带动改变。

我们现在要重视的是，我们要确保我们孩子的将来。我们的将来已经给国阵抢掉剥夺50年，不要让我们的孩子同样被剥夺，所以我们正在等这个机会。

今天早上，我还没来之前，我跟我女儿讲，如果有机会，我要成为你们这一代年轻人的喉舌。希望我们有开明开放的政策让你们留下来，不要你们再外流。（我们要）重视人才，不要只是重视木材，记得，只有重才、惜才、选秀才，马来西亚才能发大财啊。

看看韩国，韩国1970年比马来西亚差，它的总平均收入（人均收入）只是260美元，在1970年马来西亚还比韩国好（有）380美元，但是现在不是单单韩国追上来（还）超越马来西亚，现在马来西亚7千760美元，韩国已经是两万（美元）啊！

为什么韩国能够成为高入息的国家，马来西亚还是卡在那边？主要原因是因为韩国属民主（国家），有两线制，有两党轮替，所以如果我们要改变，我们要马来西亚成为高收入国，我们应该有这个勇气，站起来。有这个勇气，我们有这个勇气实现两线制，这条路当然是不容易，但是我要提醒大家，我们跟回教党、公正党合作，是以一个白纸黑字的共同宣言，这个是早早就公布出来，回教党有回教党的理念，行动党有行动党的理念，可是不要忘记，回教党没有杀过一个华人，这是一个事实，让我们坚持下去，不惜改变，辛苦是辛苦，为了下一代要走完这条路，不经一翻寒彻骨，焉得梅花扑鼻香，谢谢各位！

The Debate With Chua Soi Lek Is On The Topic “Is the 2-Party System Becoming a 2-Race System” Should See A Contest of Ideas, Ideals And Policies That Benefits Democracy And Also All Malaysians Not Just Chinese Alone.

The debate with MCA President Datuk Seri Dr Chua Soi Lek organised by MCA’s Institute of Strategic Analysis and Policy Research(INSAP) and Asian Strategy & Leadership Institute(ASLI) is not on topic of “The Malaysian Chinese In The Coming General Elections – Quo Vadis?” but on the topic “Is the 2-Party System Becoming a 2-Race System”.

The topic of the debate “Is the 2-Party System Becoming a 2-Race System” was suggested by the organisers through a letter by ASLI’s CEO Datuk Dr Michael Yeoh on 3 February 2012. I had accepted this topic as this is in line with DAP’s and the Penang state government’s commitment to fight for the rights of all Malaysians just as MCA believes in fighting for only one community. It is wrong for Chua to change the topic on the merits and demerits of a 2-party system or whether it is becoming a 2-race system to one of “Malaysian Chinese-Quo Vadis?”.

MCA is organising the conference on “Malaysian Chinese at Political Crossroads” to be officiated by Prime Minister Datuk Seri Najib Tun Razak, and several other topics will be explored by various speakers. The organisers had agreed that Chua will I be debating in Mandarin at Berjaya Times Square Hotel in Kuala Lumpur on 5-6pm 18 February 2012 carried live by Astro AEC television station.

I wish to stress that I am willing to debate in English or Bahasa Malaysia at another slot similar to my debate in 1991 with Datuk Seri Ong Tee Keat where two debates were held, one in Mandarin and the other in English. I have appointed my Political Secretary and Komtar ADUN YB Ng Weik Aik to finalise debate arrangements and details with MCA as well as DAPSY National Chair Rasah MP YB Anthony Loke to handle the logistics of the debate.

The debate with Chua Soi Lek is on the topic “Is the 2-Party System Becoming a 2-Race System” should see a contest of ideas, ideals and policies that benefits democracy and also all Malaysians not just Chinese alone. DAP offers the ideas, ideals and policies implemented in Penang that can be translated nationally of fostering a sense of belonging, a sense of togetherness and a sense of ownership amongst all Malaysians. Only when when there is respect of political rights, socio-economic justice and respect for each other’s human dignity are we Malaysians regardless whether we are Malay, Chinese, Indian, orang Asli, Iban or Kadazan.

Debat dengan Presiden MCA Datuk Seri Chua Soi Lek yang dianjurkan oleh kumpulan pemikir MCA Institute of Strategic Analysis & Policy Research (INSAP) dan Asian Strategy & Leadership Institute (ASLI) bukanlah atas topik “Kaum Cina Dalam Pilihan Raya Umum Akan Datang – Quo Vadis?” tetapi atas topik “Adakah Sistem Dwiparti Akan Menjadi Sistem Dua Kaum?”

Topik debat iaitu “Adakah Sistem Dwiparti Akan Menjadi Sistem Dua Kaum?” telah dicadangkan oleh pihak penganjur melalui surat daripada CEO ASLI Datuk Dr Michael Yeoh pada 3 Februari 2012. Justeru, tindakan Chua untuk menukar topik yang memperihalkan pro dan kontra sistem dwiparti dan juga sama ada ia akan menjadi sistem dua kaum kepada topik yang mempersoalkan masa depan kaum Cina dalam topik “Kaum Cina di Malaysia – Quo Vadis?” adalah salah.

MCA akan menganjurkan persidangan “Kaum Cina Di Persimpangan” yang akan dirasmikan oleh Perdana Menteri Datuk Seri Najib Tun Razak, di mana beberapa topik lain akan dibicarakan oleh pelbagai penceramah. Pihak penganjur telah bersetuju bahawa saya akan berdebat dengan Chua dalam Bahasa Mandarin di Hotel Berjaya Times Square di Kuala Lumpur pada pukul 5-6 petang 18 Februari 2012 yang akan disiarkan secara langsung oleh stesen televisyen Astro AEC.

Saya ingin menegaskan bahawa saya sanggup berdebat dalam Bahasa Melayu atau Inggeris dalam pentas yang serupa dengan debat saya pada tahun 1991 dengan Datuk Seri Ong Tee Keat di mana 2 sesi telah diadakan, satu dalam Bahasa Mandarin dan satu dalam Bahasa Inggeris. 槟州首席部长兼民主行动党秘书长林冠英于2012年2月11日，在吉隆坡发表声明：

我与蔡细历辩论的辩题是“两线制会不会变成两种族制？” ，我们应该在辩论中交换能为民主制度及全国人民（不只是华人）带来好处的心得、理念及政策。

这场由马华策略研究所（Insap）与亚洲策略与领导机构（Asli）联办的辩论会，我将与马华总会长拿督斯里蔡细历辩论，辩题并不是“来届大选华人何去何从？”，而是“两线制会不会变成两种族制？”。

上述辩题“两线制会不会变成两种族制？”是主办单位亚洲策略与领导机构行政总裁杨元庆在2012年2月3日来函中所订下的题目。我已经接下这个题目，因为行动党和槟州政府的立场是为全民的权益奋斗，不像马华那样相信只会单一族群奋斗。蔡细历不应该把这个题目改为“来届大选华人何去何从？”

马华正主办一场名为 “来届全国大选：华人政治分水岭”的政治研讨会，首相拿督斯里纳吉将主持开幕，其它主讲人将主讲其它课题。主办当局也已经同意，我和蔡细历将于2012年2月18日，5时-6时，假吉隆坡时代广场酒店，进行一场华语辩论，由Astro AEC现场直播。

我要强调，我愿意分别在另一个环节以英语或马来语辩论，正如我在1991年与拿督斯里翁诗杰进行的两场辩论那样，分别以华语、英语进行 。我已经指示我的政治秘书兼光大区州议员黄伟益与马华敲定辩论细节，而民主行动党社青团团长兼拉沙区国会议员陆兆福将负责辩论的后勤工作。

我与蔡细历辩论的辩题是“两线制会不会变成两种族制？” ，我们应该在辩论中交换能为民主制度及全国人民（不只是华人而已）带来好处的心得、理念及政策。行动党在槟州推行的建议、理念与政策，也可以在全国实施，促进各族人民间的归属感、凝聚力及拥有感。唯有我们能够不分种族，无论是马来人、华人、印度人、原住民、伊班人或卡达山人，互相尊重彼此的政治权利、社会经济正义、尊重彼此的尊严时，我们才是真正的马来西亚人。

UMNO Deputy President Tan Sri Muhyiddin Yassin and UMNO Information chief Datuk Ahmad Maslan is embarking on a dangerous game of lies against minority Malaysians as a clear and present threats to frighten the Malays and justify why the Malays must return back UMNO. Both UMNO leaders must stop using the Christians and the Chinese as soft targets to create enmity and hatred against these innocent Malaysians.

Tan Sri Muhyiddin Yassin was reported as exploiting the race card when he urged Umno to defend the Malay race, culture and institutions from the opposition Pakatan Rakyat (PR) and labelled DAP as an anti-Islam and anti-Malay force. DAP challenges Muhyiddin to show proof of his allegations and that DAP’s agenda is form a republic. This is seditious and a blatant lie!

Has Muhyiddin and UMNO run out of ideas that when scandals are exposed within government, then this expose by DAP is an attack on the Malays, never mind that the Malays that have also lost out on financial scandals? Is Muhyiddin racist approach of being a Malay first, and Malaysian second sufficient to ignore principles of democracy, integrity, accountability and transparency?

DAP believes that a majority of Malaysians comprising both Malays and non-Malays rejects this implication that a racial approach justifies lies and financial scandals, such the cows and condos scandal involving an UMNO Minister or makes irrelevant the 2010 Auditor-General criticism of RM 3.7 billion over-expenditure in government departments.

DAP has never been anti-Malay or anti-Islam. The increase in funding for Islamic affairs in Penang and renewal of funding for religious schools that was terminated by UMNO is proof that DAP respect Islam and is fair to all. The Penang state government has not evicted a single Malay kampong house. The only Malay kampong house torn down in Penang is by an UMNO-led koperasi, whose Chairman was also a former UMNO State Assemblyman.

It makes political sense for UMNO to be anti-Chinese, anti-Indian or anti-Christians but it is political suicide for any political party to be anti-Malay or anti-Islam. DAP does not believe in political suicide but is committed towards national reconciliation and collaboration.

Where is the moderate approach promised by the Prime Minister’s 1 Malaysia when UMNO Information chief Datuk Ahmad Maslan can threaten Malays with losing their rights because the the Chinese community was slowly gaining control of the country’s politics and economy or that DAP does not even respect the royal institution by refusing royal titles of Datukship.

DAP leaders have never pursued royal titles of Datukships. Does that makes us disrespectful of royal institutions just because we do not behave like BN leaders in lusting after titles? If so, then is the late Deputy Prime Minister Tun Ghafar Baba also disrespectful because he refused to accept royal titles too when he was in active politics.

How can the Chinese community be slowly gaining control of the country’s politics and economy when the number of Chinese in government service is declining? And the Chinese no longer control the main economic sectors of banking, insurance, automobile, construction, communications and transport.

Ahmad even lied that the DAP are “agents of Christianisation” because Ronnie Liu, Xavier, Elizabeth, Teresa Kok are Selangor State EXCO members. Despite numerous investigations, the authorities have admitted that there is no process of Christianisation by DAP. Are Christians not qualified to be an EXCO member just because he or she is a Christian? And Ronnie Liu is not even a Christian.

For Ahmad to single out the Chinese and the Christians as threats to Malays is no different from what Hitler did in Nazi Germany to frighten Germans to support his rule as an absolute dictator. Innocent minorities suffered in Germany under Hitler. It is morally repugnant that UMNO is willing to see innocent minorities of Chinese and Christians suffer from such lies so that UMNO can get back the support of Malays.

This climate of fear, enmity and hatred by UMNO is not only against 1 Malaysia but destroys national unity and racial harmony. We know what Hitler did to Germany. Malaysians must stand together in the next general elections and not allow UMNO to do the same to Malaysia.

Tan Sri Muhyiddin Yassin dan Datuk Ahmad Maslan Harus Berhenti Menggunakan Kaum Cina Dan Penganut Kristian Sebagai Sasaran Mudah Untuk Mencetuskan Kebencian Dan Permusuhan Terhadap Rakyat Minoriti Yang Tidak Bersalah Hanya Untuk Menakutkan Orang Melayu Supaya Kembali Ke Pangkuan UMNO.

Timbalan Presiden UMNO Tan Sri Muhyiddin Yassin dan Ketua Penerangan UMNO Datuk Ahmad Maslan sedang bermain dengan api dengan memangsakan kaum-kaum minoriti di Malaysia sebagai ancaman untuk menakutkan orang Melayu supaya kembali ke pangkuan UMNO. Kedua-dua pemimpin UMNO ini harus berhenti menggunakan kaum Cina dan penganut Kristian sebagai sasaran mudah untuk mencetuskan kebencian dan permusuhan terhadap rakyat Malaysia yang tidak bersalah.

Mengikut laporan, Tan Sri Muhyiddin Yassin telah menggunakan isu perkauman untuk meniup semangat ahli-ahli UMNO untuk mempertahankan bangsa, budaya dan institusi negara daripada Pakatan Rakyat (PR), di samping memfitnahkan DAP sebagai anti-Islam dan anti-Melayu. DAP mencabar Muhyiddin untuk membuktikan dakwaannya bahawa agenda DAP adalah untuk membentukkan sebuah negara republik. Ini adalah hasutan dan penipuan semata-mata!

Adakah Muhyiddin dan UMNO sudah ketandusan idea sampai apa-apa skandal kerajaan yang dibongkarkan DAP akan dianggap sebagai serangan terhadap kaum Melayu? Bukankah wang awam yang terbabit dalam skandal-skandal kewangan itu kepunyaan orang Melayu juga? Adakah cukup dengan pendekatan Muhyiddin yang mengaku dirinya Melayu dahulu dan rakyat Malaysia kemudian, sampai prinsip-prinsip demokrasi, integriti, amanah dan ketelusan semuanya boleh diabaikan begitu sahaja?

DAP percaya bahawa majoriti rakyat Malaysia, sama ada Melayu atau bukan Melayu, akan menolak hujah yang mewajarkan penipuan dan skandal kewangan atas nama perkauman, seperti dalam skandal lembu dan kondo mewah seorang Menteri UMNO, ataupun pendedahan Laporan Ketua Audit Negara 2010 tentang terlebihan belanja oleh jabatan-jabatan kerajaan sebanyak RM3.7 bilion.

DAP tidak pernah mengambil pendirian anti-Melayu atau anti-Islam. Kenaikan berkali-kali ganda peruntukan untuk hal-ehwal agama Islam di Pulau Pinang serta penerusan peruntukan untuk sekolah-sekolah agama yang telah ditamatkan oleh UMNO menjadi bukti bahawa DAP menghormati Islam dan adil kepada semua. Kerajaan Negeri Pulau Pinang tidak pernah mengusir walaupun sebuah rumah kampung Melayu. Satu-satunya rumah kampung Melayu yang pernah dirobohkan di Pulau Pinang telah diroboh oleh pemaju-kaitan-UMNO yang dipengerusikan seorang bekas ADUN UMNO.

Mungkin menjadi strategi politik yang berkesan bagi UMNO untuk mengambil pendirian anti-Cina, anti-India atau anti-Kristian, tetapi hanya parti yang ingin membunuh diri sahaja yang akan mengambil pendirian anti-Melayu atau anti-Islam. DAP tidak ingin membunuh diri tetapi komited ke arah perdamaian kebangsaan dan kerjasama antara semua.

Di manakah pendekatan sederhana yang dijanjikan konsep 1Malaysia Perdana Menteri, apabila Ketua Penerangan UMNO sendiri boleh mengugut Melayu dengan mengatakan bahawa mereka akan kehilangan hak kerana kononnya masyarakat Cina makin bertambah kuasa dari segi politik dan ekonomi, atau dengan mengatakan bahawa DAP tidak menghormati institusi raja kerana enggan menerima pingat atau darjah kebesaran yang membawa gelaran-gelaran seperti Datuk?

Pemimpin-pemimpin DAP tidak pernah mengejar gelaran-gelaran seperti Datuk, bukan macam pemimpin-pemimpin BN yang terhegeh-hegeh mengejarnya. Adakah ini bermakna kami tidak menghormati institusi Raja? Jika begitu, adakah mantan Timbalan Perdana Menteri Tun Ghafar Baba juga seorang yang tidak menghormati institusi raja kerana allahyarham juga enggan menerima apa-apa gelaran semasa aktif berpolitik?

Tambahan pula, bagaimana masyarakat Cina boleh bertambah kuasa dari segi politik dan ekonomi apabila bilangan penjawat awam yang berbangsa Cina makin menurun? Di samping itu, masyarakat Cina sudah tidak lagi menguasai sektor-sektor ekonomi seperti perbankan, insuran, industri automobil, pembinaan, komunikasi dan pengangkutan.

Ahmad juga telah menyindir DAP sebagai “agen Kristian” kerana Ronnie Liu, Xavier, Elizabeth, Teresa Kok merupakan EXCO Kerajaan Negeri Selangor. Setelah disiasat berulang kali, pihak berkuasa sudah pun mengakui bahawa tidak ada berlaku sebarang penyebaran agama Kristian oleh DAP. Adakah seseorang itu tidak berlayak untuk menjadi ahli EXCO kerana beliau itu seorang penganut Kristian? Tambahan pula, Ronnie Liu bukan seorang penganut Kristian.

Tindakan Ahmad untuk mensasarkan kaum Cina dan penganut Kristian sebagai ancaman kepada orang Melayu adalah perbuatan yang tidak berbeza dengan taktik ketakutan yang digunakan oleh Hilter pada zaman Nazi di negara Jerman untuk mengekalkan kuasa mutlaknya sebagai diktator. Minoriti yang tidak bersalah di negara Jerman telah mengalami penderitaan di bawah pemerintahan Hitler. Adalah tidak berperi kemanusiaan bagi UMNO untuk menggunakan penipuan dan fitnah yang serupa hanya untuk memenangi sokongan Melayu.

Iklim ketakutan, permusuhan dan kebencian yang digalakkan UMNO bukan sahaja bertentangan dengan 1Malaysia malah membinasakan perpaduan negara dan keharmonian kaum. Kita semua tahu kerosakan yang telah dibawa oleh Hitler kepada negara Jerman. Oleh itu, rakyat Malaysia hendaklah bersatu dalam pilihan raya umum yang akan datang untuk menghalang UMNO daripada melakukan kerosakan yang sama kepada negara Malaysia.

丹斯里慕尤丁及拿督阿末马斯兰应该停止利用华族及基督教徒为软目标，以对这些无辜的少数马来西亚人制造敌意及仇恨，以吓唬马来人重回巫统的怀抱。

巫统署理主席丹斯里慕尤丁及巫统全国宣传局主任拿督阿末马斯兰应正在玩弄着一场针对少数马来西亚人的危险撒谎游戏，以威胁及吓唬马来人需重回巫统怀抱，并合法化为何马来人需重回巫统。这两名巫统领袖应该停止利用华族及基督教徒为软目标，以对这些无辜的马来西亚人制造敌意及仇恨。

根据报导，丹斯里慕尤丁利用种族牌，呼吁巫统从民联的手中，捍卫马来民族、文化及权益，并把民主行动党标签成反伊斯兰教及反马来人。行动党挑战慕尤丁，为他指行动党的议程是要成立一个共和国的指控示出证据。这根本就是煽动及天大的谎言！

难道慕尤丁及巫统在政府面对众多舞弊丑闻的当儿，已经江郎才尽？如果说这是行动党揭露政府丑闻就是攻击马来人的话，难道就不担心马来人也在这场丑闻中输掉了吗？难道慕尤丁的马来人优先、马来西亚人其次的种族主义思维，已足以忽视民主、廉政、问责及透明度？

行动党相信大部分的马来西亚人，不管是马来人或非马来人，都会拒绝以种族主义方式合理化谎言及财务丑闻，就如涉及巫统部长的养牛公寓丑闻，或者是2010年度总稽查司报告批评政府部门超支37亿令吉一事。

民主行动党从未反马来人及反伊斯兰。在槟城，我们每年增加给宗教用途的拨款，以及重新发放巫统早前中断掉的宗教学校拨款，证明了行动党是一个尊重伊斯兰教、对全民公平的政党。槟城州政府从未拆除任何一个马来柑榜屋。槟城唯一被拆毁的马来人房子，是被巫统主导的合作社所拆除，而其主席也是一名前州议员。

巫统反华人、反印度人及反基督教是政治常识，但反马来人或反伊斯兰教对一个政党而言就是一场政治自杀行为。行动党不相信政治自杀，但致力于民族和解及合作。

当巫统全国宣传主任拿督阿末马斯兰以“华社已慢慢地控制国家的政治及经济”，或是行动党拒绝受封拿督勋衔，是不尊重王室的行为，来恐吓马来人会失去权益的当儿，首相在“一个马来西亚”标语中所承诺的中庸去了哪里？

行动党从来不追求王室发出的拿督等勋衔。难道只因我们没有像国阵领袖一样垂涎这些头衔，就指我们不尊重王室？如果这个指责可以成立的话，那我们的前副首相敦嘉华峇峇是否也一样须被套上不尊重王室的罪名？因为他活跃于政治时，也一样拒绝受封赐。

同样的，当政府机构的华裔公务员人数直线下降的当儿，华社如何慢慢地控制国家的政治及经济呢？目前，华人已不再控制经济主要支柱的金融界、保险界、汽车领域、建筑领域、通讯领域及交通领域了。

阿末甚至撒谎指行动党是“基督化的代理”，因为刘天球、Xavier、黄洁冰及郭素沁等皆为雪州行政议员。尽管多次调查，但当局也承认行动党并没有涉及任何的基督传教活动。难道基督教徒因为他（她）本身是基督教徒，就没有资格当行政议员吗？再说，刘天球根本不是一个基督教徒。

阿末将华人或基督教徒标签成对马来人的威胁之举，与当年希特勒在德国纳粹展开的恐吓德国人，以逼使德国人接受他的条规、让他成为绝对的独裁者之举没有分别。在德国，无辜的德国人在希特勒领导下受苦。 巫统为了夺回马来人的支持，情愿看着无辜的少数华人及基督教徒在这类谎言下受害。这在道德上是令人反感的。

这种由巫统所制造的恐惧、敌意和仇恨的气氛，不只是毁了“一个马来西亚”的标语，也毁了我们的国家团结及种族和谐。我们知道希特勒对德国做了什么。马来西亚人应该在下届大选齐心站起来，别让巫统以同样的手法对待马来西亚。

Menentang Rang Undang-undang Perhimpunan “Haram” Yang Akan Mengharamkan Hak Berhimpun, Memberikan Kuasa Mutlak Kepada Polis Yang Memihak Kepada BN Untuk Membenarkannya Atau Tidak Dan Menghakis Lagi Hak Asasi Manusia Di Malaysia.

Tuan yang dipertua,

Di ambang Hari Malaysia yang ke-48 pada 15 September 2011, YAB Perdana Menteri telah mengumumkan bahawa Kerajaan akan mengkaji semula Seksyen 27 Akta Polis untuk menyelaraskannya dengan Artikel 10 Perlembagaan Persekutuan yang menjamin kebebasan rakyat untuk “berhimpun secara aman dan dengan tidak bersenjata”, dan supaya mematuhi norma-norma antarabangsa.

Malangnya, tidak disangka bahawa negara-negara “antarabangsa” yang dirujuk beliau merupakan negara-negara Zimbabwe dan Myanmar.

Namun sekarang, nampaknya negara Myanmar pun sudah menjadi sebuah negara demokratik yang lebih bebas jika dibandingkan dengan Malaysia. Rang Undang-Undang yang baru diluluskan oleh Parlimen Myanmar hanya memerlukan pemberitahuan awal kepada pihak polis selama 5 hari, manakala Rang Undang-Undang yang dibentangkan dalam Dewan yang mulia ini memerlukan pemberitahuan yang jauh lagi awal.

Sungguhpun YAB Perdana Menteri mengumumkan pindaan akan dibuat agar notis pemberitahuan dipendekkan daripada 30 hari kepada 10 hari, ia jauh lebih panjang daripada apa yang diamalkan daripada sebuah negara berkuku besi seperti Myanmar. Adakah Malaysia kini lebih teruk daripada Myanmar?

Ini jelas membuktikan bahawa Program Transformasi Politik yang diuar-uarkan adalah satu penipuan semata-mata. Dalam ucapannya tempoh hari, YAB Perdana Menteri telah menyatakan bahawa Rang Undang-Undang ini akan menjamin hak rakyat untuk berhimpun secara aman dan tanpa bersenjata, tetapi hakikatnya Rang Undang-Undang ini adalah satu cubaan untuk meningkatkan kawalan dan larangan ke atas hak rakyat untuk berhimpun secara aman.

Jelas juga bahawa Rang Undang-Undang yang dicadangkan ini telah mengambil petikan-petikan yang berbunyi merdu daripada undang-undang negara demokratik lain seperti Queensland dan United Kingdom, dan telah memutar-belitkannya kepada alat untuk menindas rakyat. Saya ingin bertanyakan samada Rang Undang-undang ini diciplak daripada model Queensland Peaceful Assembly Act 1992 dan sekiranya ia mengapa tidak mengikuti keseluruhannya yang berteraskan hak asasi manusia. Sebaliknya yang baik tidak diikuti iaitu Rang Undang-undang ini telah ambil yang keruh, buang yang jernih pula.

Dalam versi Queensland, hanya notis 5 hari diperlukan di bawah seksyen 10 di mana ia dianggap diluluskan sekiranya tidak ada perintah mahkamah yang menghalang/mengharamkannya seperti berikut:-

Approval of public assembly
(1) A public assembly is taken to have been approved for the purposes of section 7(c) if, after the giving of the assembly notice for the assembly—
(a) the required notice of permission for the assembly has been given to the organiser of the assembly; or
(b) if the assembly notice was given not less than 5 business days before the day on which the assembly is held—a Magistrates Court has not made an order under section 12 refusing to authorise the holding of the assembly; or
(c) if the assembly notice was given less than 5 business days before the day on which the assembly is held—a Magistrates Court has made an order under section 14 authorising the holding of the assembly.
(2) The required notice of permission for a public assembly is—
(a) a notice by the Commissioner stating that the Commissioner does not oppose the holding of the assembly; and
(b) if the assembly notice was given to a local authority—a notice by the local authority stating that the authority does not oppose the holding of the assembly; and
(c) if the place of assembly is a place for the time being open to or used by the public by the express or implied consent of the owner or occupier or on payment of money—a notice by the owner or occupier of the place consenting to the holding of the assembly.
(3) A notice mentioned in subsection (2) must be in writing.

Tuan yang dipertua, biarkan saya mengulas.

Pertama sekali, saya ingin menyentuh tentang salah satu kehendak atau keperluan dalam Rang Undang-Undang ini yang telah menjana pelbagai kontroversi. Keperluan untuk memberi pemberitahuan awal kepada pihak polis jelas bertujuan untuk menangguhkan perhimpunan selama mungkin supaya tujuan perhimpunan akan menjadi lapuk. Ini adalah satu muslihat yang kotor, dan sekarang Kerajaan pun terpaksa membuat “go-astern” untuk mengkaji semula tempoh pemberitahuan. Walau pun dikurangkan kepada 10 hari, ia tetap 10 hari terlalu lama.

Di UK dan Queensland, langsung tidak ada kewajipan untuk memberi pemberitahuan awal kepada pihak polis, melainkan dalam keadaan tertentu. Di UK, pemberitahuan 6 hari awal hanya diperlukan apabila perarakan awam akan diadakan, iaitu untuk tujuan mengurus dan menyenggarakan aliran trafik. Di Queensland, pemberitahuan 5 hari bekerja hanya diperlukan apabila perhimpunan itu memerlukan imuniti daripada kesalahan menghalang laluan awam di bawah Akta Trafik.

Bagi Rang Undang-Undang yang sedang dicadangkan dalam Dewan yang mulia ini pula, pemberitahuan diperlukan bagi semua perhimpunan awam kecuali di sesuatu tempat perhimpunan yang ditetapkan oleh Menteri atau jika jatuh di bawah Jadual Ketiga.

Definisi tempat awam pula termasuk apa-apa kawasan yang terbuka kepada umum seperti hotel, restoran atau dewan kuliah, dan kegagalan untuk memberi pemberitahuan awal akan mengakibatkan denda maksima RM10,000. Lagipun kegagalan untuk bersurai akan dikenakan denda maksima RM20,000. Denda dua kali ini RM10,000 dan RM20,000 adalah lebih berat berbanding dengan hukuman perhimpunan haram sebelum ini sekali sahaja sebanyak maksima RM10,000/-.

Kedua, definisi perhimpunan yang digunakan adalah terlalu lebar sampai pelbagai acara yang biasa juga termasuk sebagai sesuatu perhimpunan dalam konteks Rang Undang-Undang ini. Oleh kerana itu, Jadual Ketiga terpaksa ditambah untuk menjelaskan jenis-jenis perhimpunan awam yang dibenarkan tanpa pemberitahuan kepada pihak polis.

Namun begitu, skop Jadual Ketiga ini jelas mempunyai pelbagai kekurangan. Sebagai contoh, perhimpunan keluarga dibenarkan tetapi bagaimana dengan perhimpunan sekumpulan sahabat? Perhimpunan perkahwinan dibenarkan tetapi bagaimana pula dengan majlis harijadi yang tidak ternyata dalam Jadual Ketiga?

Mengikut Rang Undang-Undang yang dibentangkan ini, pemberitahuan 10 hari perlu diberi kepada pihak polis jika sesiapa ingin mengadakan majlis ulangtahun perkahwinan atau majlis harijadi di sebuah tempat awam seperti hotel atau restoran, kecuali jika tempat perhimpunan itu telah ditetapkan oleh Menteri.

Tambahan pula, Menteri mempunyai kuasa tanpa batasan untuk meminda Jadual Ketiga dan untuk menetapkan atau menarik balik tetapan yang diberi kepada sesuatu tempat. Apakah yang akan berlaku jika Menteri secara tiba-tiba membuat keputusan bahawa majlis keluarga juga tidak boleh diadakan tanpa pemberitahuan kepada pihak polis? Bagaimana jika Menteri memutus untuk menarik balik ketetapan sesuatu hotel sebagai tempat perhimpunan yang sah? Kuasa arbitrari yang terletak di tangan Menteri ini adalah tidak wajar sama sekali dan akan mengakibatkan banyak masalah.

Ketiga, Rang Undang-Undang ini memberi pihak polis kuasa untuk mengenakan pelbagai sekatan dan syarat ke atas tarikh, masa dan tempoh sesuatu perhimpunan, tempat perhimpunan, kaedah perhimpunan, kelakuan para peserta perhimpunan, atau apa-apa perkara lain yang difikirkan perlu atau sesuai. Dalam erti kata lain, pihak polis akan mempunyai kuasa untuk memutuskan bila, berapa lama, mana, siapa yang mengambil bahagian dan juga isi kandungan sesuatu ceramah. Jelas Rang Undang-Undang ini bukan digubal untuk menggalakkan kebebasan untuk berhimpun, tetapi sebaliknya menjadikan rakyat sebagai boneka polis.

Rekod polis yang memihak kepada BN dan menentang PR tidak menimbulkan keyakinan orangramai. Perhimpunan ganas oleh BN atau pro-BN dibiarkan tanpa sebarang tindakan manakala perhimpunan aman yang dianggap pro-PR ataupun anti-BN dikenakan tindakan ganas.

Lihatlah perhimpunan aman Bersih yang dikutuk kuat seluruh dunia. Bandingkanlah dengan perhimpunan ganas oleh UMNO di Komtar dan tengah-tengah Jambatan Pulau Pinang pada 1 Julai 2011 yang dihadiri oleh Senator Ezam Mohd Nor.

Dalam perhimpunan ganas itu, Ezam bukan sahaja mahu menggulingkan kerajaan negeri saya tanpa menunggu pilihanraya tetapi para demonstrasi telah menghentikan trafik di tengah Jambatan Pulau Pinang yang menyebabkan kesesakan trafik sepanjang 10km. Lagi teruk dua wartawan yang meliputi demonstrasi dipukul. Sehingga sekarang mereka serta samseng yang pukul wartawan tidak diambil tindakan.

Bolehkah polis dipercayai bertindak adil dan bebas. Sungguhpun hampir setiap minggu ada protes jalanraya di Pulau Pinang oleh mereka yang pro-BN hak demonstrasi secara aman haruslah disokong. Tetapi tindakan keras harus diambil ke atas mereka yang mengganas ataupun mahu mengancam dengan menghantarkan keranda. Mana negeri yang akan membenarkan Mat Rempit pun demonstrasi sampai Mat Rempit pun boleh “diescort” polis buat demonstrasi menggelarkan saya “rasis” kerana tidak sediakan “racing track” Mat Rempit. Kalau di negeri BN pula, Mat Rempit yang cuba buat demonstrasi akan ditahan polis dengan serta-merta.

Keempat, terdapat larangan mutlak ke atas semua perhimpunan yang diadakan dalam lingkungan 50 meter daripada tempat-tempat larangan yang disenaraikan dalam Jadual Pertama. Tempat-tempat larangan ini termasuk stesyen minyak, hospital, balai bomba, lapangan terbang, landasan keretapi, terminal pengangkutan awam darat, pelabuhan, terusan, limbungan, dermaga, jeti, jambatan, marina, tempat ibadat, tadika dan sekolah. Saya ingin menegaskan di sini bahawa larangan mutlak ke atas tempat-tempat larangan ini tidak boleh ditarik balik dengan apa-apa pemberitahuan, permit atau pengecualian daripada Menteri, dan pelanggaran larangan ini akan mengakibatkan denda RM10,000.

Larangan mutlak ke atas tempat-tempat larangan ini juga bermakna bahawa semua perhimpunan sekolah adalah haram kerana berlaku di dalam tempat larangan. Ini juga bermakna segala perhimpunan atau acara sukan di Stadium Merdeka adalah haram kerana berada dalam lingkungan 50 meter dari SMK Victoria. Ini juga bermakna segala mesyuarat yang berlaku di dalam Badan Peguam Malaysia adalah haram kerana berada dalam linkungan 50 meter daripada sebuah jambatan.

Ini juga bermakna apa-apa perhimpunan yang berlaku di Persiaran Gurney atau Padang Kota di Pulau Pinang, termasuk “Sudut Pidato”, adalah haram kerana berada dalam linkungan 50 meter daripada laut antara Pulau Pinang dan Butterworth, iaitu had yang diwartakan sebagai Pelabuhan Pulau Pinang. Ini juga bermakna jika rumah seseorang itu berada di sebelah stesyen minyak, orang itu tidak boleh mengadakan kenduri atau rumah terbuka, melainkan beliau tidak kisah didenda RM20,000.

Hujah kelima saya berkenaan dengan larangan mutlak ke atas protes jalanan. Adakah Kerajaan begitu takut dengan Perhimpunan Bersih 2.0 pada 9 Julai yang lalu sampai mereka sanggup melakukan apa sahaja untuk menghindari daripada berlakunya perhimpunan sedemikian?

Tidak ada mana-mana negara demokratik dalam dunia ini yang melarang sama sekali protes jalanan. Namun di Malaysia, sesiapa yang mengambil bahagian dalam protes jalanan akan didenda RM10,000. Ataupun kemungkinan ini merupakan salah satu cara untuk mengurangkan hutang Kerajaan yang kian mendadak, kerana jika kesemua 50,000 peserta Bersih 2.0 dikenakan denda RM10,000, Kerajaan akan mengumpul sebanyak RM500 juta. Tidak cukupkah dengan GST yang ingin diperkenalkan, sampai orang yang hendak berhimpun pun terpaksa dikenakan cukai?

Kenapa Kerajaan begitu gentar dengan rakyat? Adakah Kerajaan ingat bahawa pada tahun 1946, beribu-ribu rakyat Melayu telah mengambil bahagian dalam perhimpunan gergasi di seluruh Malaya untuk menentang gagasan Malayan Union? Jika Rang Undang-Undang ini berkuatkuasa pada tahun 1946, perhimpunan anti-Malayan Union sudah tidak mungkin dapat berlaku dan UMNO tidak mungkin akan dibentukkan. Sememangnya UMNO ini mudah lupa.

Tuan yang dipertua,
DAP dan PR menentang Rang Undang-undang Perhimpunan “Haram” yang akan mengharamkan hak berhimpun, memberikan kuasa mutlak kepada polis yang memihak kepada BN untuk membenarkannya atau tidak dan menghakis lagi hak asasi manusia di Malaysia. Jangan cemarkan imej negara Malaysia dengan meluluskan Rang Undang-undang ini. Rang Undang-Undang ini tidak boleh diselamatkan dengan apa-apa pembetulan atau pindaan, dan harus ditarik balik dengan serta merta dan digubal semula.

民主行动党秘书长及峇眼区国会议员林冠英于2011年11月29日在国会下议院反对和平集会法的演讲。

反对将集会自由权利视为非法的“非法”和平集会法。这项法案赋予偏邦国阵的警察批准与否的绝对权力，这项法案也再次侵蚀大马的人权。

回溯2011年9月15第48届马来西亚日前夕，首相宣布政府将重新检讨警察法令第27条以符合联邦宪法第10章所确保人民能在“不携带武器下和集会自由，并且根据国际集会惯例。”

很不幸的，让人难以预料所谓的“国际”，参考的竟然是津巴布韦及缅甸诸国。

然而，目前纵观缅甸局势，该国的民主进展似乎比马来西亚更自由了。缅甸国会刚通过的法案，集会只需5天前通s知警方即可，可是我们这肃穆的国会殿堂所提成的和平集会法案却要求离集会非常早的日子就必须通知警方。

虽然首相已经宣布向警方发出集会通知将从30天缩短至10天，但仍然还是比世人所知的缅甸铁幕政权所要求的还要长。难道马来西亚现在比缅甸还糟糕?

很明显的，喧嚣高唱的所谓政治转型计划只是一个骗局。首相较早前说明这项法案是赋予人民享有在不携带武器下和平集会的自由，但是这项法案的真正目的反而是提高限制及阻止人民应享有的集会自由。

明显的国阵正选择性沿用一些民主国家如昆士兰及英国的和平集会法，偷龙转凤来对付我们的人民。我要问和平集会法是不是抄袭1992年昆士兰和平集会法的模式，如果是的话，那为何没有完整抄足其真正强调是人权?相反的我们的和平集会法却好的不学，学坏的，弃清流以取浊溪。

在昆士兰的版本中，集会通知在第10条文中列明只需5天，而且只要没有法庭发出庭令阻止及视为非法，不然一旦通知将被视为已批准如下：
公众集会批准
(1)一旦发出集会通知，公众集会将在第7(c)条文下被当作已经批准：
(a)集会准证已经发出给主办集会者，或——
(b) 若该集会通知在超过集会5天前发出，同时地庭没有行使第12条问的命令拒绝赋予该集会的权利，或——
(c) 若集会通知在少于集会5天前通知，同时地庭行使第14条文命令赋予主办集会的权利。
(2) 要求的集会准证如下—
(a) 专员须发出的准证，注明专员不反对该集会，及——
(b)若向地方当局发出集会通知，则地方当局须发出准证，注明地方当局不反对该集会，及——
(c)若集会地点是暂时性；或用以公众表达用途；或地点拥有者或占有者所默许；或付费使用，需要地点拥有者及占有者的集会批准准证。
(3)第(2)子条文下所指的准证，皆须以书面形式发出。

议长请容许我解释，

首先，我要触及该法案内引起争议的必要性及必需性。必需尽早向警方发出集会通知，很明显是要尽可能拖延集会举行，让集会目的失去时效性。这是个肮脏的欺骗手段，如今政府终于踩煞车，重新检讨要求发出集会通知的时间。如今，虽然递减至10天，但是10天还是太长了。

除非有特定情况，在英国或昆士兰根本不必向警方发出集会通知。在英国，当公众游行，只需要在6天前发出集会通知，目的只是要准备管理及疏导游行时的交通。同样的，在昆士兰只是为了避免触犯阻挡公共交通的法令，所以须在5天前发出集会通知。

在我们这个尊崇的国会殿堂所正在提呈的这项法案，却要求所有公众集会必须发出集会通知，除了部长所指定的地点，或是如图表(3)所列明的地方。

公众地方的定义包括了酒店、餐厅或人民讲堂，在这些地方集会若没尽早发出集会通知，将会最高罚款1万令吉，若还不取消解散集会将罚款2万令吉。这1万令吉与2万令吉的双重罚款，比之前的非法集会的一次性最高1万令吉的法款逞罚还来得重。

第二，集会的定义实在太广泛了，连许多普通的事件都属于这个和平集会法案的范围内。因此被逼增加第三附表，以说明各种无需知会警方的和平集会种类。

虽然如此，这个第三附表的范围很明显地存在多项不足之处。比如，家庭集会是被允许的，但是一群好友的集会又作何解？婚姻的集会也是被允许，但是不被列入第三附表的生日会应如何？

根据被提呈的法案，若有任何人欲在公共场合如酒店或餐厅，举行结婚周年庆或者是生日会，须在10天前知会警方，除非有关的集会地点是由部长所决定的。

再说，在第三附表下，部长拥有不受限制的权力以修改第三附表，以及决定或收回已经给予某一地方的批准。试问，要是部长突然间决定家庭餐会也不准在没有知会警方的情况下举行，那该怎么办？或者是部长决定收回某家酒店作为合法集会地点的决定时，应该怎么样？部长手中特有的专断权力是不适当的，也会引起很多问题的。

第三，这项法案赋予警方权力，以施加各种限制及条件在集会的日期、时间、集会期限、集会地点、集会的方式、参与集会者的行为举止，或者是任何被答为需要或适当的事件。换句话说，警方有权力决定集会在什么时候举行、多久、谁会参与，以及某个演讲会的内容。很明显的，这个和平集会法案不是修定来鼓励自由集会，反之，把人民变成了警察的傀儡。

警方倾向国阵、反民联的记录，也引起了民众对这项法案的信心动摇。警方纵容国阵或亲国阵者的暴力集会，从未对这些人采取任何行动；反观，亲民联或反国阵的和平集会，却遭警方以暴力行动对待。

看看那被全球关注的“净选盟2.0”和平集会，以及2011年7月1日由巫统在光大及槟城大桥中央的暴力集会相比就有比较，而巫统的上议员依占也出现在有关的暴力集会中。

在那场暴力集会中，依占不只是扬言称不需要等到大选就可以推翻我所领导的槟城州政府，参与示威者更在大桥的中央，截停车辆，引发了长达10公里的车龙。更糟糕的是，两名负责采访的记者被示威者殴打。截至目前为止，那些涉及者及殴打记者的流氓依然逍遥法外，没有被采取任何的行动。

我们还可以相信我们的警方是会公平及自由地执行任务吗？在槟城，虽然几乎每个星期都有由亲国阵者主导的街头示威，但我们应支持捍卫和平示威的权力。不过，对于那些暴力示威者，以及送棺材以恐吓者的行为，则需要采取严厉的行动对付。在马来西亚有哪一个州属允许飙车党示威，到连飙车党都能够获得警车开路护送的？这些飙车党点名称我是种族主义者（rasis），只因为我没有为他们准备一条飙车跑道（racing track）。换作是在国阵执政的州属，这些试图要示威的飙车党会立刻被警方扣留了。

第四，当局禁止在附表一的禁区50公尺范围内集会。这些地点包括油站、医院、消防局、机场、
火车轨道、陆路交通中心、港口、水坝、集水区、滤水站、发电站、码头、桥梁、海港、宗教场所、幼稚园及学校。我在此强调，这些禁区的禁令是不能够被收回、也不会从部长处获得准证及豁免权，一旦违例，则须面对1万令吉的罚款、

这些禁止集会地点的禁令意味着，全部在学校举行的集会都是非法的，因为地点是在禁区内。这也意味着在独立广场举行的一切集会及运动会也是非法的，因不它是在维多利亚中学（SMK Victoria）的50公尺范围内。这项禁令也表示，所有在马来西亚律师公会召开的会议都是非法的，因为它是在一座桥的50公尺范围内。

同样的，这也意味着任何在新关仔角或旧关仔角的集会，包括在民联州政府设立的言论广场所举行的一切集会都是非法的，只因它位于槟岛及北海海港的50公尺范围内，也就是槟城港口在宪报上的权限。这也表示，若某人的屋子在油站的隔壁的话，那这个人就不可以在他的家里举办任何形式的门户开放或宴会，除非他不介意被罚2万令吉。

我的第五个要点是有关游行集会的禁令。政府是不是怕了2011年7月9日的净选盟2.0游行，而不择手段避免类似的集会重演？

世界上没有一个民主国家是禁止游行集会的。但是在马来西亚，任何一名参与游行集会者将会被罚款1万令吉。也许，这是政府欲减轻国家债务的良策？若以参与净选盟2.0游行的5万人次、每人罚款1万令吉的话，那么政府就可以筹获5亿令吉基金了。难道我们的服务税还缴不够吗？竟然连集会也被逼缴税。

为什么政府这么惧怕人民？政府是不是忆起在1946年时，成千马来人在整个马来亚参与反马来联邦的集会？如果这项法案是在1946年生效的话，那么反马来联邦集会就不可能发生，而巫统就不可能诞生了。这个事实，巫统却这么健忘。

民主行动党及民联反对“非法和平集会法案”，因为它禁止集会的权利、赋予警方过多的权力以倾向国阵，进一步削夺马来西亚的人权。请不要通过这项法案来污染了马来西亚的国家形象。这个法案是不可能通过任何的修正或更改来挽救，并且应该被收回及重新制定。

BN should stop destroying Malaysia’s financial reputation with irresponsible statements like freezing the assets of those deemed risky to the nation’s security because they participate in Bersih rallies calling for clean and fair elections as well as receive funding from non-profit foreign NGOs. Bersih had clarified that money the group received from two US organisations — the National Democratic Institute (NDI) and Open Society Institute (OSI) — were for other projects unrelated to the July 9 march.

DAP strongly condemns Deputy Finance Minister Datuk Awang Adek Hussin’s irresponsible statement that Bank Negara Malaysia (BNM) can freeze the assets of those believed to be participating in activities if the police recommend so. Such actions are detrimental to Malaysia’s efforts to establish itself as a safe haven for capital and investments.

Datuk Awang is the same person who announced that the Federal government had approved sports betting licenses in time for the 2010 World Cup. BN was embarrassed and forced to withdraw the sports betting licenses after the Penang state government announced the ban on sports betting, thereby destroying UMNO’s arguments that of gambling is part of Chinese culture.

If assets can be frozen just for participating in a peaceful assembly or for receiving funds from non-profit foreign NGOs, then many innocent Malaysians and organisations will be unfairly victimised. Using this as a political weapon against opponents of BN would be a gross abuse of the provisions within the Anti-Money Laundering and Counter-Terrorism Financing Act allowed for the central bank to not only bar access to such funds but also trace both deposits and withdrawals of the offending accounts.

Would others involved in “illegal assemblies” like UMNO Youth chief Khairy Jamaluddin have their assets frozen? Why then were these provisions not applied against those suspected of corruption of accumulating extraordinary wealth beyond their means? For instance no such action was taken against those suspected of secretly taking out RM 888 billion in illicit money over a 9 year period.

BN government only has itself to blame for the negative image overseas, portrayed by the international news media for its harsh crackdown on the peaceful protest Bersih. So ridiculous was the crackdown that wearing yellow was sufficient cause for arrest. And yet Queen Elizabeth received the Prime Minister Datuk Seri Najib Tun Razak in a bright yellow dress two days ago in London.

The Bersih protest calling for clean and fair elections descended into chaos when the police fired tear gas and water cannons to disperse protestors. The documented beatings and recorded brutal treatment on video tape was completely unprovoked and put Malaysia on the same international platform as the repressive Arab regimes in the Middle-East.

The BN government should clean up Malaysia’s image by owning up its mistakes such as firing tear gas into Tung Shin Hospitals, insulting the Hindus and the Indian community by calling the revocation of Bersih Datuk S. Ambiga’s citizenship, detaining Datuk A. Samad Said because his poems is considered a weapon and apologising for the brutal crackdown.

It is good that Najib has admitted that the rally attracted 15,000 demonstrators and not the 5-6,000 demonstrators claimed by police. However this is not enough as more needs to be done such as withdrawing charges and releasing immediately all those arrested such as the PSM 6 including MP of Sungai Siput Dr Jeyakumar, for Bersih related activities.

The Bersih rally was a paradigm shift or a transformational event that attracted all Malaysians. In many of the Bersih stories told by ordinary Malaysians marching on 9 July, many amongst the 30,000 crowd was so outraged by the repression of the police as well as moved by the solidarity and support shown by other Malaysians that they felt part of the nation called Malaysia. Finally every one felt 1Malaysia regardless of race or religion or even political affiliation, whether one is rich or poor, male or female, old or young.

Even Marina Mahathir defiantly marched. Everyone marched because they wanted to be “Bersih!”.

The 13th General Elections will be decided by the economy, the choice between the economy for the people Vs the cronies. The Malaysian economy is not even as Tony Pua puts it, a tiger that has lost its roar. It is more like a cat that has even lost its meow.

The next elections will be fought by who can best deliver policies and solutions to those who suffer most. The bottom 60 per cent of the rakyat has an average household income of less than RM3,000 a month, while the bottom 40 percent lives on less than RM1,500 a month.

While commodity and food prices have increased alarmingly in recent times, real income, especially for the lower strata, has stagnated. This has resulted in a dire situation whereby the bottom 40 per cent of our population earns only 14.3 per cent of the total income while the top 20 per cent shares 50 per cent of the total income. In addition, household debts in Malaysia are now 77% of our GDP, which makes us the second highest in Asia after Japan.

What is sorely required are policies and actions that will directly affect those in the bottom 60 per cent especially those living on less with average household income than RM1,500 per month. These are the Malaysians who really need help. DAP remains strongly committed to minimum wage and to economic solutions that are sustainable, especially environmental friendly. We must ensure that resources utilised today must be available tomorrow.

民主行动党秘书长林冠英于2011年7月16日在芙蓉的“民主行动党全国领袖干训营”发表演讲：

国阵应该停止破坏马来西亚的经济名誉，勿再发表“任何人因参与净选盟集会，以及接受外国非政府组织捐款的人士，若被证实涉及威胁国家安全的活动，国家银行可冻结有关人士的银行户头”这种言论。净选盟已经澄清，他们从两个美国组织即国民民主研究院（National Democratic Institute）及开发社会研究院(Open Society Institute)接受的捐款，是用在其它活动，与709集会游行毫无关系。

民主行动党强烈谴责财政部副部长拿督阿旺阿迪发表不负责任的言论，他说，一旦证明有关人士参与上述活动而警方劝告，国家银行可以冻结他们的资产。这种言论对于标榜本身为“资本与投资天堂”的马来西亚是具破坏性的。

拿督阿旺就是在2010年世界杯期间，宣布联邦政府已经批准赌球执照的那位部长。在槟州政府宣布禁止赌球活动后，当时国阵被迫尴尬地撤回赌球执照，因此，这也反驳了巫统指“赌博是华人文化”的言论。

如果纯粹因为参与和平集会或接受外国非政府组织的捐款就被冻结资产，很多无辜的马来西亚人与组织将不公平地受牵连。国阵利用这种政治武器来对付异己，将严重滥用反洗黑钱及反恐怖主义资助法令，它不只允许国家银行阻止这类资金流入，也可以追踪有关账户的存款人与提款人。

其它像巫青团团长凯里那样涉及“非法集会”的人士是不是也会遭冻结财产？为什么有关当局不用这个法令对付那些累积财富多于应得收入、涉及贪污的人士？例如：当局至今还没有针对过去9年流出国外的8880亿令吉非法资金采取任何行动。

对于我们国际形象受损、被国际媒体描述为粗暴镇压净选盟和平集会者，国阵政府只能怪自己。镇压行动最离谱的一点是，穿黄衣也足以成为被逮捕的理由。最讽刺的是，两天前，英女皇还在伦敦身穿黄衣接待首相纳吉。

净选盟集会旨在争取干净及公平的选举，它在警方开始以催泪弹及水炮解散示威者时，升级变成混乱。录像记录皆证明警方是无缘无故殴打群众及发动暴力攻击，它令马来西亚登上与中东阿拉伯极政国家同等级的国际平台。

国阵政府应该勇于认错，承认自己发射摧泪弹进入同善医院、通过要求褫夺拿督安美嘉的公民权污辱印度社群、扣留诗人沙末沙益视其诗歌为武器，针对本身的镇压行动道歉，挽回马来西亚的形象。

纳吉承认约有1万5000名人士参与示威，而不是警方所说的5、6千人，这是一件好事。但是，这还不足够，他还必须马止释放那些还被扣留的人士、并撤销对他们的控状，例如社会主义党六人包括和丰区国会议员再也古玛，以及与净选盟活动有关的人士。

净选盟集会是一项范例的转型或是具变革意义的活动，它吸引了全体马来西亚人。这场3万人集会的参与者所述说的“709净选盟小故事”中，很多人都对警方的暴行感到非常生气，他们也对其他马来西亚人的互助互爱感到非常感动，也感觉到自己是马来西亚的一分子。最后，每个人都终于感觉到“一个马来西亚”，不分种族、宗教、政治背景，也不管它他们贫富与否、也不论男女老幼。

就连玛丽娜马哈迪都毅然走上街头，每个人都走上街游行，因为他们都想要成为“干净”的一群。

下届大选，谁能为贫苦大众落实政策与方案，谁将胜出。我国底层60%人民的平均月收入不过3000令吉，最底层40%的每月收入更低於1500令吉。

当各种原料与食品价格节节高涨之际，底层人民的实际收入却原封不动，导致我国人口中的底层40%人民的收入比例只占总收入14.3％，但顶层的20%人民的收入却战占总收入的50%。此外，马来西亚的家计负债已经高达国内生产总值的77%，在全亚洲仅次日本，位居第二位。

我们现在需要的是可以直接影响底层60%人民的政策与行动，特别是针对那些每月家计收入少於1500令吉者，他们才是真正需要援助的人民。民主行动党坚持推动最低薪金政策，以及可以永续经营、友善环境的经济方案，我们必须确保今日所使用之资源，仍然能为下一代所用。
