			<content:encoded><![CDATA[<p>BN Pulau Pinang dan Dr Teng Hock Nan dicabar untuk menunjukkan bukti bahawa saya telah membuat bayaran RM14.7 juta dalam skendal tanah Tang Hak Ju sungguhpun kes ini masih dalam proses rayuan, semata-mata demi kepentingan peribadi saya. Saya tahu BN Pulau Pinang dan Dr Teng marah saya kerana saya enggan menarik balik atau meminta maaf kerana menyebut kes tanah Tang Hak Ju sebagai satu skendal.</p>
<p>Akan tetapi mengapakah beliau atau BN Pulau Pinang tidak berani menyaman saya ke mahkamah kalau saya tidak bercakap benar? Saya telah menyatakan samada kerugian kepada kerajaan negeri adalah RM40 juta ataupun RM14.7 juta ataupun RM500,000 ia tetap satu skendal. Jumlah wang yang kerugian rakyat samada RM40 juta ataupun RM500,000 tidak menukar istilah skendal kepada bukan skendal samada seperti yang haram tidak boleh dihalalkan hanya kerana jumlah yang terbabit dikurangkan.</p>
<p><span id="more-2015"></span>Oleh kerana BN dan Dr Teng tidak berani buat saman malu ke atas saya, mereka telah membuat suatu tuduhan serius bahawa saya lebih suka membayar RM14,7 juta pampasan dalam skendal tanah Tang Hak Ju kepada mahkamah atas kepentingan peribadi saya. Tuduhan ini adalah serius kerana menyatakan saya telah menyalahgunakan kuasa saya untuk membuat bayaran RM14.7 juta kepada Tang Hak Ju dalam mahkamah yang sepatutnya tidak dibayar.</p>
<p>Mahkamah telah melepaskan wang RM14.7 juta kepada Tang Hak Ju tanpa restu kerajaan negeri. Tetapi bolehkah Teng dan BN mengambil pendirian bahawa kerajaan negeri berkuasa untuk engkar perintah mahkamah?</p>
<p>Kerajaan negeri telah menurut perintah mahkamah dan nasihat daripada Penasihat Undang-undang Negeri Pulau Pinang yang dilantik oleh Peguam Negara. Semua rekod ada minitkan bahawa pembayaran RM14.7 juta ini dibuat atas nasihat Penasihat Undang-undang sungguhpun dengan tidak rela hati oleh kerajaan negeri. Tuduhan BN Pulau Pinang dan Dr Teng adalah sungguh tidak bertanggungjawab dan serius kerana dibuat ke atas saya atau Penasihat Undang-undang Pulau Pinang bahawa pembayaran dibuat daripada dana wang rakyat kemudian dipolitikkan isu berkenaan demik kepentingan peribadi.</p>
<p>Bayaran deposit RM14.7 juta merupakan 50% daripada jumlah kos ganti rugi sebanyak RM29.4 juta kepada Tang Hak Ju. Sekiranya bayaran faedah yang dianggarkan sebanyak RM10 juta diambilkira, maka jumlah kos pampasan adalah sebanyak RM40 juta. Kes ini berlaku bila kerajaan BN yang lama “tersilap’ dengan  memberikan kelulusan tanah seluas 10.6 ekar dan permit kuari kepada Tang Hak Ju atas tanah yang tidak dimiliki kerajaan negeri tetapi oleh pihak swasta.</p>
<p>Kerajaan Negeri Pulau Pinang telah mendepositkan wang sejumlah RM14,678,135.50 ke Mahkamah Tinggi Pulau Pinang pada 18 Mei 2009 seperti yang telah diperintahkan oleh mahkamah pada 19 Febuari 2009 sungguhpun skendal tanah ini berlaku pada pentadbiran lama.Berikutan suatu keputusan oleh Mahkamah Rayuan baru-baru ini telah mengurangkan bayaran ganti rugi untuk Tang Hak Ju kepada RM500,000/-. Akan tetapi perkara ini belum muktamad kerana proses perundangan belum selesai dan mungkin dirujuk kepada Mahkamah Persekutuan</p>
<p>Adakah kerajaan BN bersedia menghormati prinsip akauntabiliti menanggung pembayaran sekiranya kerajaan negeri PR berjaya mengurangkan pembayaran kepada RM500,000/-.. Lagi serius jika RM14.7 juta deposit yang telahpun dibayar kepada Tang Hak Ju tidak dikembalikan kepada kerajaan negeri adakah BN Pulau Pinang dan Dr Teng rela membayar RM14.7 juta ini?</p>
<p>Setiausaha BN Datuk Seri Dr Hilmi Yahya pula menyatakan bahawa Suruhanjya Pencegah Rasuah Malaysia(SPRM) pun telah sahkan bahawa kes ini bukan skendal atau penipuan sungguhpun kerajaan negeri tidak dimaklumkan tentang perkara ini. SPRM sepatutnya menghubungi kerajaan negeri yang buat laporan kepada SPRM tetapi tidak dimaklumkan langsung yang seterusnya menimbulkan soalan samada SPRM bertindak hanya sebagai alat dan senjata politik BN.</p>

<p>槟州首席部长林冠英于2012年2月7日在槟城乔治市发表声明：</p>
<p>我挑战槟州国阵及丁福南医生 拿出证据，证明我一味地为了私人利益，而在陈合裕土地丑闻案件还在上诉的当中，缴付了1470万令吉。</p>
<p>我挑战槟州国阵及丁福南医生 拿出证据，证明我一味地为了私人利益，而在陈合裕土地舞弊案件还在上诉的当中，缴付了1470万令吉。我知道槟州国阵与丁福南医生对我感到生气，是因为我拒绝针对指陈合裕土地案是一宗舞弊案撤回言论或道歉。</p>
<p>如果我讲的话不是事实，为什么他或槟州国阵不敢告我上法庭？我已经说了，不论是造成槟州政府损失4000万令吉、还是1470万令吉或是50万令吉，舞弊就是舞弊。人民钱财的损失，不论是4000万令吉，还是50万令吉，不会改变“舞弊”这个词的含义，正如非法的事情，不会因为涉及数额的大小，而变得合法。</p>
<p>由于国阵与丁福南不敢起诉我毁谤，他们做了一个严重的指责，说我为了个人的利益，在陈合裕土地舞弊案中缴付1470万令吉给法庭。这是一项严重的指责，等于说我滥用权力，在法庭缴付1470万令吉给陈合裕，这笔钱原本是不必还的。</p>
<p>法庭已经在未经州政府的同意下，将1470万令吉交给了陈合裕。丁福南和国阵能否表明立场，州政府是否可以违抗庭令？</p>
<p>州政府根据庭令并听取国家法律局所委任的州法律顾问的劝告。 所有记录都显示，州政府是在的听取州法律顾问的建议下，不情愿地缴付1470万令吉。槟州国阵及丁福南实在不负责任，还对我或州法律顾问进行严重的指控，指我们为了私利付款，然后将课题政治化。</p>
<p>上述1470万令吉的抵押金是付给陈合裕赔偿金2940万令吉的50%，这还不包括约1000万令吉的利息。这宗案件的发生是由于前朝国阵政府“失误”，批准陈合裕拥有一块10.6英亩的土地及采矿准证，这块土地并非由州政府拥有，而是属于私人地。</p>
<p>槟州政府已经在2009提5月18日遵从庭令，将1千467万8千135令吉50仙的款项，付给槟城第二高等法庭，作为陈合裕土地舞弊案的赔偿抵押金。此案也是前朝政府涉及土地舞弊所留下的。上诉庭最近已经将这笔赔给陈合裕的款项减少至50万令吉。但是这宗案件还没有了结，因为其司法程序还没有解决，可有可能会交由联邦法庭处理。</p>
<p>如果槟州民联政府成功将赔偿金减至50万令吉，国阵会不会负起责任缴付这笔赔偿金？更严重的是，如果州政府拿不回已经缴付给陈合裕的1470万令吉，槟州民联和丁福南是否愿意赔偿这1470万令吉？</p>
<p>国阵秘书拿督希尔米也说，反贪污委员会已经证实这起案件不是舞弊案也不是欺骗案，但是，州政府却对此毫不知情。既然是州政府向反贪委报案，他们应该直接通知州政府有关调查报告。这不禁让人怀疑，反贪委究竟是不是国阵的政治工具兼武器。</p>

<p>DAP wishes all Hindus a Happy Thaipusam festival. DAP hopes that the message of good over evil, wisdom and knowledge will reinforce our commitment to fight endemic corruption and crony capitalism. </p>
<p><span id="more-2013"></span>Malaysia has lost hundreds of billions in US dollars from corruption. In the latest Global Financial Integrity Report, a shocking RM 1,077 billion of illicit(mainly corruption money) was estimated to have been secretly taken out of Malaysia from 2000-9. The trillion ringgit losses made the first 10 years of the 21st century the lost decade of corruption. No action has been taken on the RM 52 billion bumi share scandal that was supposed to be distributed to poor bumis but just disappeared nor the Perwaja scandal and the Bank Negara forex losses amounting to nearly RM20 billion.</p>
<p>No wonder Malaysia’s ranking in the Transparency International Corruption Perception Index plummeted to its worst ever in history of No. 60. The refusal of the BN Federal Government to follow Penang state government’s historical initiative of publicly disclosing the assets of the Chief Minister and EXCOS, does not lend confidence to BN’s commitment to integrity in leadership and public accountability.</p>
<p>BN has also failed to implement an open tender system resulting in crony capitalism. For instance the recent RM7.07 billion West Coast Highway for the longest concession period of 60 years and the refusal to abolish toll for North-South Highway and Penang Bridge even though the toll operators have earned more than 100% profits over their capital investment, shows how crony capitalism benefits the few at the expense of 28 million Malaysians. </p>
<p>A welfare state that ensures the poor and weak are not left behind will not result in Malaysia becoming bankrupt. It is corruption and crony capitalism that will make Malaysia bankrupt. The time has come to wipe out poverty, impose a minimum wage and reduce the financial burden of the bottom 60% of our population who have an average household income of less than RM3,000 a month, while the bottom 40%  live on less than RM1,500 a month. </p>
<p>Rising inflation has made life more difficult for Malaysians and their children These social programs may cause billions of ringgit but not the magnitude of RM1,077 billion of illicit money taken out of the country. There is no reason for Prime Minister Datuk Seri Najib Tun Razak to be opposed to a welfare state which will make nearly all Malaysians winners, especially the poor, unless he is concerned about the few capitalistic cronies who will be the real losers.</p>

<p>Thaipusam diraikan bukan sahaja oleh masyarakat Hindu tetapi juga oleh golongan bukan Hindu sebagai tanda kemenangan kebaikan atas kejahatan serta kesedaran terhadap kebijakan dan pengetahuan. Ramai orang bukan Hindu juga mengangkat kavadi untuk menunaikan nazar. Inilah semangat harmoni dan saling hormat-menghormati yang begitu penting dalam sesebuah masyarakat berbilang budaya dan agama.</p>
<p>DAP mengucapkan selamat menyambut Hari Thaipusam kepada semua penganut Hindu. DAP berharap bahawa pesanan kebaikan mengatasi kejahatan serta kebijakan dan pengetahuan akan mengukuhkan komitmen kita untuk membanteras korupsi dan kapitalisme kroni.</p>
<p>Malaysia telah kehilangan beratus-ratus bilion dolar Amerika melalui korupsi. Dalam unjuran terbaru Global Financial Integrity, sejumlah RM1,077 bilion wang haram (kebanyakannya wang rasuah) telah dikeluarkan daripada Malaysia dari tahun 2000-9. Kerugian satu trilion ringgit ini bermakna bahawa 10 tahun pertama dalam abad ke-21 adalah dekad yang telah hilang dek korupsi. Tiada tindakan yang telah diambil ke atas skandal RM52 bilion saham bumi yang sepatutnya diagihkan kepada masyarakat Bumiputra yang miskin tetapi telah lenyap begitu sahaja. Begitu juga dengan skandal Perwaja dan kerugian dalam tukaran matawang asing (forex) oleh Bank Negara yang berjumlah RM20 bilion.</p>
<p>Tidak hairanlah mengapa kedudukan Malaysia dalam Indeks Persepsi Rasuah Transparency International telah menjunam ke tahap yang paling teruk selama 60 tahun. Keengganan Kerajaan Persekutuan BN untuk mengikuti jejak langkah Kerajaan Negeri Pulau Pinang untuk mengisytiharkan harta Ketua Menteri dan Ahli-ahli Majlis Mesyuarat Kerajaan Negeri menunjukkan kekurangan komitmen BN terhadap integriti dalam kepimpinan dan kebertanggungjawab awam.</p>
<p>Kegagalan BN untuk melaksanakan sistem tender terbuka juga telah mengakibatkan kapitalisme kroni. Sebagai contoh, Lebuhraya Pantai Barat RM7.07 bilion dengan tempoh konsesi selama 60 tahun serta keengganan untuk memansuhkan tol Lebuhraya Utara-Selatan dan Jambatan Pulau Pinang walaupun pengendali tol sudahpun mengaut keuntungan lebih daripada 100% ke atas pelaburan modal menunjukkan bagaimana kroni-kroni mendapat untung yang besar sementara yang ruginya 28 juta rakyat Malaysia.</p>
<p>Negara kebajikan yang memastikan bahawa yang miskin dan lemah tidak dipinggirkan tidak akan menjadikan Malaysia bankrap. Yang akan menjadikan Malaysia bankrap adalah korupsi dan kapitalisme kroni. Masa sudah tiba untuk membasmi kemiskinan, melaksanakan gaji minima dan mengurangkan beban kewangan golongan 60% terbawah yang mempunyai purata pendapatan isi rumah kurang daripada RM3,000 sebulan dan 40% terbawah yang terpaksa hidup dengan kurang daripada RM1,500 sebulan.</p>
<p>Inflasi yang melambung telah membawa kesukaran kepada rakyat Malaysia. Program-program sosial mungkin memerlukan berbilion-bilion ringgit, tetapi tidak sampai kerugian RM1,077 bilion yang telah dibawa keluar daripada negara kita. Tidak ada sebab mengapa Perdana Menteri Datuk Seri Najib Tun Razak ingin menentang negara kebajikan yang akan membantu semua rakyat Malaysia terutamanya yang miskin, melainkan beliau merasa bimbang untuk segelintir kroni kapitalis yang akan rugi.</p>

<p><strong>贪污与朋党资本主义才会导致马来西亚破产，而不是福利国。</strong></p>
<p>大宝森节不只是兴都徒庆祝的节日，也是非印裔普天同庆的节日，它庆祝正义战胜邪恶，也启发智慧与知识。很多非兴都徒都背负卡瓦迪来还愿。这是和谐及互相尊重的精神，特别是在这个和平的多元文化、多元宗教文化的社会。</p>
<p>行动党祝全体兴都徒大宝森节快乐。行动党希望邪不胜正、智慧、知识能够给我们力量，战胜我国猖獗的贪污及朋党资本主义。</p>
<p>马来西亚因贪污而损失了数千万美元。在最新的全球金融廉正报告中，我国在2000年至2009年期间，约有1兆7700亿令吉的黑钱外流。在21世纪的首十年，我们所损失的1兆令吉，象征了我国因贪污而失去的十年。原本应该分给贫穷土著的520亿土著股权失踪丑闻、造成近200亿令吉损失的柏华惹丑闻、国家银行丑闻皆没有结果，不了了之。 </p>
<p>难怪马来西亚在国际透明组织的贪污印象指数中，成绩跌到有史以来最低，排第60名。槟州政府历史性地公布首长及行政议员的财产，国阵联邦政府却不愿意跟随，让人们对国阵的廉正领导及公信力失去信心。</p>
<p>国阵也没有实行公开招标，这导致朋党资本主义的横行。例如最近颁布的价值70亿7000万令吉的西岸大道60年特许经营合约，以及国阵政府不愿废除南北大道及槟城大桥收费站，尽管大道公司的盈利已经超出投资额的100%，显示了朋党资本主义如何牺牲2800万人民的利益来谋取暴利。</p>
<p>福利国将保障贫穷及弱势群体不会被忽略、也不会造成马来西亚破产。贪污及朋党资本主义才是造成马来西亚破产的真正原因。是时候扫除贪污、实施最低薪资及减少我国60%平均月薪低于3000令吉家庭的生活负担，还有协助40%月入低于1500令吉的家庭。</p>
<p>通货膨胀已经让马来西亚人及他们的子女生活得更加辛苦。这些人民福利计划可以需要数十亿令吉的费用，但是绝对比不上非法流失海外的1兆7700亿令吉的一大笔黑钱。  因此，首相纳吉没有理由反对能让所有国人、尤其是穷人受惠的福利国，除非他担心少数的资本主义朋党将成为真正的输家。</p>

<p>Prime Minister Datuk Seri Najib Tun Razak might as well abandon the Fighting Corruption NKRA or New Key Results Area in his GTP if he dares not compel his Ministers and Deputy Ministers to publicly declare their assets and set up a Royal Commission of Inquiry(RCI) into the RM250 million cows &#038; condos scandal or the RM1,077 billion in illicit money(including corruption funds) secretly taken out of the country during 2000-9. </p>
<p><span id="more-1978"></span>The Prime Minister had announced in April 2009 that there were 6 NKRAs in his GTP, one of which was fighting corruption. Nearly 3 years later, the Prime Minister has no achievements to show. He has presided over the worst Transparency International (TI) Corruption Perception Index (CPI) ranking and score for Malaysia, dripping to No 60 out of 183 countries with a score of 4.3 out of 10. </p>
<p>The failures of the Malaysian Anti-Corruption Commission (MACC), despite being given huge annual budgets of over RM200 million since 2011, is only overshadowd by abuses within its ranks. Apart from allegations of corruption, there were two tragic deaths at MACC premises – Teoh Beng Hock in July 2009 and senior Customs officer Ahmad Sarbini Mohamed on April 6, 2011. </p>
<p>Parliament approved a RM202.2 million budget for MACC for 2011 and all it has to show is the country’s lowest CPI ranking of No. 60 and lowest-ever score of 4.3. In 1996, Parliament approved a budget of RM29.4 million for the Anti-Corruption Agency (ACA) and that was the year when Malaysia was ranked No. 26 and achieved the highest CPI score of 5.32 in the past 17 years.</p>
<p>Malaysians are entitled to compare the budgets given to ACA in 1996 and to MACC in 2011, and the TI CPI of Malaysia in these two years. Why MACC, despite being given a budget almost seven times that of 1996, had brought Malaysia’s TI CPI in 2011 to the lowest ranking of 60 and score of 4.3 when in 1996 we could be ranked No. 26 with a score of 5.32?</p>
<p>It would appear that the bigger the budget and more staffing and resources given to MACC, the more corrupt Malaysia has become. Where have the increased RM172.8 million in the anti-corruption budgets between 1996 and 2011 gone to?</p>

<p>Worse is the refusal by Deputy Prime Minister Tan Sri Muhydin Yassin to establish a RCI into the cows and condos scandal involving the family of a senior Cabinet Minister with the lame excuse that MACC is investigating the matter. It is precisely because the public has lost confidence in the MACC, as shown by the drastic drop in the TI rankings, that a RCI is needed to get to the bottom of the cows and condos scandal.</p>
<p>The Prime Minister’s NKRA of fighting corruption is also in trouble following the refusal of Ministers and Deputy Ministers to publicly declare their assets. On 29.1.2012, Deputy Minister in the Prime Minister&#8217;s Department VK Liew even justified his refusal to do so by questioning why Penang state excos took nearly 4 years to publicly declare their assets.</p>
<p>Should not BN leaders be ashamed of themselves that it took Penang PR state government less than 4 years to do so as compared to BN’s complete failure to do so after 55 years? Penang’s state exco’s asset declaration included asset and liabilities as at 8 March 2008 and as at 31.12.2011. Further, our asset declaration was made public, uploaded on the internet as well as verified by an independent audit accounting firm, KPMG. </p>
<p>Unless the Prime Minister gives MACC the independent powers to prosecute freely and is answerable only to Parliament, set up RCI for scandals and compel public declaration of assets, Malaysia’s Corruption Perception Index under the Transparency International will only deteriorate.</p>

<p>Perdana Menteri Datuk Seri Najib Tun Razak patut tinggalkan sahaja Bidang Keberhasilan Utama Negara (NKRA) memerangi rasuah dalam GTP jika beliau tidak berani mewajibkan menteri-menteri dan timbalan-timbalan menterinya untuk mengisytiharkan harta mereka secara terbuka dan menubuhkan Suruhanjaya Siasatan DiRaja (RCI) mengenai kes skandal RM250 juta “lembu dan kondo” ataupun kes wang haram berjumlah RM1,077 bilion (termasuk wang rasuah) yang telah dialirkan keluar daripada negara dari tahun 2000-9.<br />
Pada bulan April 2009, Perdana Menteri telah mengumumkan 6 NKRA dalam GTP, dan salah satu daripadanya merupakan NKRA memerangi rasuah. Selepas hampir 3 tahun, Perdana Menteri masih tidak ada kejayaan. Malah, Indeks Persepsi Rasuah (CPI) Transparency International (TI) Malaysia telah menurun kepada 4.3 daripada 10 dan tangga ke-60 daripada 183 negara dalam tempoh pentadbiran beliau.<br />
Kegagalan Suruhanjaya Pencegah Rasuah Malaysia (SPRM), walaupun diberi bajet tahunan sebanyak lebih RM200 juta sejak 2011 hanya diatasi oleh penyalahgunaan kuasa di kalangan pegawai-pegawainya. Selain daripada dakwaan rasuah, dua kes kematian telah terjadi dalam kawasan SPRM – Teoh Beng Hock pada Julai 2009 dan pegawai kanan Kastam Ahmad Sarbaini Mohamed pada April 6 2011.<br />
Parlimen telah memperuntukkan bajet RM202.2 juta untuk SPRM pada tahun 2011 dan hasilnya adalah kedudukan CPI terendah untuk negara kita iaitu tangga ke-60 dan juga kadar CPI terendah iaitu 4.3. Pada tahun 1996, Parlimen telah memperuntukkan bajet RM29.4 juta untuk Badan Pencegah Rasuah (BPR) dan pada tahun itu Malaysia menduduki tangga ke-26 dan mencapai CPI tertinggi dalam 17 tahun iaitu 5.32.<br />
Rakyat Malaysia berhak untuk membandingkan bajet yang diberi kepada BPR pada tahun 1996 dan SPRM pada tahun 2011, dengan CPI Malaysia pada kedua-dua tahun ini. Walaupun SPRM diberi bajet hampir 7 kali ganda apa yang diberi pada tahun 1996, kenapakah CPI Malaysia pada tahun 2011 mendapat kedudukan yang paling rendah iaitu tangga ke-60 dan kadar CPI 4.3 apabila pada tahun 1996 kita berada di kedudukan ke-26 dengan kadar 5.32?</p>
<p>Nampaknya lagi besar bajet, lagi ramai staf dan lagi banyak sumber yang diberi kepada SPRM, lagi teruk keadaan rasuah di Malaysia. Ke manakah perginya lebihan sebanyak RM172.8 juta dalam bajet anti-rasuah pada tahun 2011 berbanding 1996?<br />

<p>Yang lebih teruknya adalah keengganan Timbalan Perdana Menteri Tan Sri Muhyiddin Yassin untuk menubuhkan RCI mengenai skandal “lembu dan kondo” yang melibatkan keluarga seorang Menteri Kabinet dengan alasan lemah bahawa SPRM sedang menyiasat perkara ini. Sebenarnya, RCI diperlukan untuk menyiasat skandal “lembu dan kondo” ini kerana pihak umum sudah hilang kepercayaan dalam SPRM, seperti yang ditunjukkan oleh penurunan dalam kadar dan kedudukan TI.</p>
<p>NKRA memerangi rasuah yang dijuarai Perdana Menteri juga nampaknya bermasalah ekoran daripada keengganan menteri-menteri dan timbalan-timbalan menteri untuk mengisytiharkan harta mereka secara terbuka. Pada 29.1.2012, Timbalan Menteri dalam Jabatan Perdana Menteri VK Liew telah mewajarkan keengganan beliau dengan mempersoalkan kenapa Ahli-ahli MMK (Exco) Pulau Pinang mengambil masa 4 tahun untuk mengisytiharkan harta mereka secara terbuka. </p>
<p>Tidakkah pemimpin-pemimpin BN berasa malu kerana Kerajaan Negeri PR Pulau Pinang telah berjaya melakukan demikian selepas 4 tahun walhal BN telah gagal selepas 55 tahun? Pengisytiharan harta Ahli-ahli MMK Pulau Pinang merangkumi juga aset dan liabiliti mereka pada 8 Mac 2008 dan setakat 31.12.2011. Tambahan pula, pengisytiharan harta kita dibuat secara terbuka, dimuat naik ke dalam Internet dan telah disahkan oleh sebuah firma audit dan akauntan bebas, KPMG. </p>
<p>Jika Perdana Menteri tidak memberi SPRM kuasa pendakwaan bebas dan kebertanggungjawaban kepada Parlimen, menubuhkan RCI untuk skandal-skandal dan mewajibkan pengisyiharan harta secara terbuka, CPI Malaysia yang dikendalikan Transparency International akan terus merosot.</p>

<p>首相在2009年4月宣布他的国家转型计划中有六项国家关键成效领域，其中一项就是肃贪。事过3年，首相没有交出什么成绩。在他任内，马来西亚在国际透明组织的贪污印象指数在183个国家中排名第60名，10分当中只提4.3分。</p>
<p>这是马来西亚反贪委员会的失败，尽管自2011年起每年都获得超过2亿令吉的拨款，但其过大过功。除了贪污，还有两宗发生在反贪委大厦内的惨死案-即2009年7月坠楼惨死的赵明福及2011年4月6日坠楼惨死的关税局官员阿末沙比尼。 </p>
<p>国会在2011年拨出了2亿220万令吉给反贪委会，它交出的成绩却是最低的贪污印象指数排名60及4.3分。1996年，国会批准了2940万令吉给反贪局，那时马来西亚的贪污印象指标排26名，得分5.32，是过去17年最好的指数。</p>
<p>马来西亚人有权利比较1996年拨给反贪污局及2011年反贪污委员会的款项，以及这两年我国在国际透明的贪污印象指数。为什么反贪委目前所获的拨款几乎是1996年七倍，马来西亚却在2011年得到最低的贪污印象指数，排名60及得分4.3，而在1996年我们可以获排名26、得分5.32？</p>
<p>看起来，反贪委比从前拥有更多拨款、更多职员及资源，马来西亚贪污反而变得更猖獗。在1996年至2011年之间，拨给反贪工作的预算1亿7280万令吉岂不是付诸流水？</p>

<p>更糟的是，副首相丹斯里慕尤丁拒绝成立皇家调查委员会，调查一名内阁部长涉及的养牛公寓，理由是反贪委正在调查。这正是为什么公众对反贪委失去信心，正如国际透明组织的贪污指数排名，我们需要皇家调查委员会，追根究地，查出养牛公寓丑闻的真相。</p>
<p>首相的肃贪国家关键成效指数也有问题，正副部长们拒绝公布财产。2012年1月29日，首相署副部长刘伟强甚至通过质疑槟州行政议员在位四年后，才公布财产，来合理化他拒绝公布财产的做法。</p>
<p>国阵领袖是不是应该感到羞愧，槟州民联政府不到4年就公布财产，而国阵执政了55年，却还做不到？槟州行政议员公布的财产也包括2008年3月8日至2011年12月31日期间的资产及负债。再说，我们是对外公布财产，上载至网站，并且由独立稽查公司毕马威负责审核。</p>
<p>除非首相让反贪委独立自主，拥有提控权、只对国会负责，设立皇家调查委员会调查丑闻、强制性公布财产 ，否则马来西亚在国际透明组织的贪污印象指数只会越来越糟。</p>

Elected Public Officials Should Put Their Country First And Not Endanger Malaysia By Taking The First Necessary Step To Publicly Declare Their Assets To Promote Transparency And Accountability<br />

DAP urges BN to take a bipartisan approach towards promoting transparency and accountability in Malaysia by publicly declaring their assets. Whilst revealing the asset declarations of ministers and their immediate family members to the public may endanger the individuals concerned, as a first step those holding public office should disclose their assets publicly.</p>
<p>In the interest of bipartisanship, DAP is willing to start only with Ministers, Deputy Ministers or state excos publicly declaring their assets instead of their family members. Declaring to the Prime Minister alone or only to the Malaysian Anti-Corruption Commission(MACC) is not enough.<br />
<span id="more-1958"></span><br />
For this reason, the refusal of MACC to openly endorse the principle of public declaration of assets by Ministers, Deputy Ministers and state EXCOS deserve strong condemnation. I can understand BN’s concerns that such asset declarations may endanger public officials. However BN should also understand public concerns that failure to do so may also endanger Malaysia.</p>
<p>Those aspiring to be leaders should put their country first by being more willing to endanger themselves than endangering Malaysia. For this reason, a public declaration of assets by Ministers, Deputy Ministers and state excos is a necessary first step towards ensuring that public interest is protected over and above any private benefit.</p>
<p>Penang state EXCO members created history last week by being the first elected public officials in Malaysia to publicly declare their assets. Information about the EXCO members’ liabilities or loans and that the source of income were from their statutory allowances were also disclosed.</p>
<p>The Penang state EXCO public allowances as EXCOs and ADUNs can be referred from the Enakmen Anggota Pentadbiran dan Ahli Dewan Undangan Negeri(Saraan) 1980, which was also uploaded. Such information were even made available on the Penang state government website of www.penang.gov.my. This marks an important milestone towards ensuring that there is no accumulation of unexplained and extraordinary wealth by elected public officials.</p>
<p>The Penang state government took a further step in appointing the internationally renowned accounting and audit firm, KPMG and its senior partner Chartered Accountant Ooi Kok Seng, for the verification exercise and to formulate the template of asset declaration. Ooi was present at the press conference on 12 January 2012 in Penang publicly declaring the assets, where he said that KPMG is required to uphold professional standards of compliance with the principles of objectivity, independence and no conflict of interest before undertaking any task.</p>
<p>The Penang state government’s faith in the MACC has been shaken by MACC’s perceived failure to act against BN’s leaders involved in questionable deals and contracts as well as their perceived willingness to be used by BN for political purposes and lack of independent action. Penang state government’s lack of faith in MACC’s commitment to fight corruption is evident not only by their failure to act against various reports made by me in the past but also by the present Penang state government to the MACC.</p>
<p>The deteriorating state of corruption in Malaysia is highlighted by the decline in Malaysia’s rankings in the Transparency International’s Corruption Perception Index from No. 37 in 2003 to No. 60 last year. For this reason, verification by an internationally renowned audit and accounting firm would attract greater credibility and reliability than by MACC.</p>

DAP menggesa BN untuk mengambil pendekatan dwipartisan untuk menggalakkan ketelusan dan kebertanggungjawaban dalam Malaysia dengan mengisytiharkan harta mereka secara terbuka. Walaupun pengisytiharan harta secara terbuka oleh menteri-menteri serta keluarga terdekat mungkin membahayakan bagi individu-individu tersebut, sebagai langkah pertama hanya mereka yang memegang jawatan awam harus mengisytiharkan harta secara terbuka.</p>
<p>Demi kepentingan dwipartisan, DAP boleh terima sebagai permulaan jika hanya menteri-menteri, timbalan-timbalan menteri dan ahli-ahli majlis mesyuarat kerajaan negeri sahaja yang mengisytiharkan harta. Ahli keluarga mereka boleh dikecualikan. Sekadar mengisytiharkan kepada Perdana Menteri seorang atau pun kepada Suruhanjaya Pencegah Rasuah Malaysia (SPRM) tidak memadai.</p>
<p>Atas sebab ini, keengganan pihak SPRM untuk mengiktiraf prinsip pengisytiharan harta secara terbuka oleh para menteri, timbalan menteri dan ahli-ahli majlis mesyuarat kerajaan negeri perlu dikecam. Saya memahami kebimbangan BN bahawa pengisytiharan harta mungkin akan membahayakan penjawat-penjawat awam tersebut, namun BN juga harus memahami kebimbangan umum bahawa kegagalan untuk mengisytiharkan harta mungkin akan membahayakan Malaysia.</p>
<p>Sesiapa yang berhasrat untuk menjadi pemimpin harus mengutamakan negara mereka dan harus rela untuk membahayakan diri sendiri daripada membahayakan Malaysia. Oleh itu, pengisytiharan harta secara terbuka oleh menteri-menteri, timbalan-timbalan menteri dan ahli-ahli majlis mesyuarat kerajaan negeri adalah langkah pertama yang wajar untuk memastikan bahawa kepentingan umum akan terpelihara.</p>
<p>Minggu lepas, Ahli-ahli Majlis Mesyuarat Kerajaan Negeri (EXCO) Pulau Pinang telah mencipta sejarah dengan menjadi anggota-anggota pentadbiran dipilih yang pertama di Malaysia untuk mengisytiharkan harta secara terbuka. Maklumat mengenai pinjaman-pinjaman dan liabiliti-liabiliti Ahli-Ahli EXCO telah didedahkan. Pendapatan mereka juga jelas diperolehi daripada satu sumber sahaja, iaitu elaun sebagai wakil rakyat dan badan-badan berkanun.</p>
<p>Elaun untuk Ahli-ahli EXCO Pulau Pinang boleh dirujuk daripada Enakmen Anggota Pentadbiran dan Ahli Dewan Undangan Negeri (Saraan) 1980, yang turut dimuat naik. Maklumat ini boleh didapati di laman sesawang Kerajaan Negeri Pulau Pinang iaitu www.penang.gov.my. Ini adalah satu pencapaian dalam usaha untuk memastikan tidak berlaku pengumpulan harta yang luar biasa dan yang tidak dapat dijelaskan oleh anggota-anggota pentadbiran.</p>
<p>Kerajaan Negeri Pulau Pinang telah mengambil langkah yang lebih dengan melantik firma akauntan dan audit antarabangsa yang terkenal iaitu KPMG dan rakan kongsi kanannya Akauntan Bertauliah Ooi Kok Seng, untuk mengesahkan dan menetapkan templat yang akan dipaparkan kepada umum. Ooi juga hadir semasa sidang akhbar pada 12 Januari 2012 di Pulau Pinang apabila pengisytiharan harta itu dibuat dan telah berkata bahawa KPMG telah mendukung standard profesional yang tertinggi untuk memastikan pematuhan kepada prinsip-prinsip keobjektifan, kebebasan dan tiada konflik kepentingan sebelum menjalankan apa-apa tugasan.</p>
<p>Kepercayaan Kerajaan Negeri Pulau Pinang dalam SPRM sudah pun terhakis berikutan apa yang dilihat sebagai kegagalan untuk mengambil tindakan terhadap pemimpin-pemimpin BN yang terlibat dalam kontrak-kontrak yang mencurigakan serta apa yang dilihat sebagai tindak-tanduk mereka yang seolah-olah tidak bebas dan sanggup digunakan oleh BN bagi tujuan politik. Ketidakpercayaan Kerajaan Negeir Pulau Pinang terhadap komitmen SPRM untuk menangani rasuah adalah jelas bukan sahaja kerana kegagalan mereka untuk bertindak atas laporan-laporan yang dibuat oleh saya tetapi juga oleh Kerajaan Negeri Pulau Pinang.</p>
<p>Kemerosotan Malaysia dalam hal rasuah ini juga terserlah dengan penurunan kedudukan Malaysia dalam Indeks Persepsi Rasuah Transparency International dari tangga ke-37 pada tahun 2003 kepada tangga ke-60 tahun lepas. Oleh itu, pengesahan daripada sebuah firma audit dan akauntan antarabangsa yang terkemuka adalah lebih dipercayai dan boleh diharap berbanding dengan SPRM.</p>

<p>槟州首席部长兼民主行动党秘书长林冠英于2012年1月20日在吉隆坡发表声明：</p>
<p><strong>民选官员应该以国家利益为先，采取必要的措施，公开财产，促进透明度及公信力。</strong></p>
<p>民主行动党促请国阵领袖采纳两党磋商方式公开财产，促进透明度及公信力。尽管公布部长及他们直系亲属的财产可能危害他们的人身安全，但是那些拥有官职者应该踏出第一步，公布财产。</p>
<p>基于两党合作的利益，行动党愿意先让部长、副部长或州行政议员公开财产，而不是他们的家人。仅仅对首相一人，或是只对马来西亚反贪污委员会公开财产是不够的。</p>
<p>因此，我们强烈谴责反贪委不支持部长、副部长及州行政议员对外公开财产。我明白国阵担忧公开财产将威胁公职人员的人身安全。但是，国阵也应该明白人民的忧虑，他们不这么做可能危及马来西亚。</p>
<p>那些国家领袖应该以国家利益为先，宁可让自己受威胁也不可以危害国家。因此，正副部长及州行政议员应该踏出第一步，公开财产，确保公众利益受到保护，而不是任何私人利益。</p>
<p>槟州行政议员上个星期公开财产，而马来西亚第一批公开财产的民选公职人员。他们公布本身的负债、贷款、以及法定收入来源。<br />
槟州行政议员及州议员的津贴可以从1980年行政议员及州议员（津贴）法令得知。这些资料已经上载至州政府网站： www.penang.gov.my. 这是一个重要的里程碑，确保民选的公职人员没有累积来历不明的财富。</p>
<p>槟州政府选择了国际著名的会计公司毕马威（KPMG）及其资深会计师黄国成， 进行查证及设计公布财产的格式并公布给公众。做为独立的稽查公司，毕马威在接下任务前，必须维护其最高的专业水平，以确保其工作符合目标与原则，保有独立性及没有利益冲突。</p>
<p>对于大马反贪委会一直无法对国阵领袖涉及可疑的交易及合约采取行动，也仿佛愿意被国阵当时政治工具、无法独立运作，让槟州政府对大马反贪委员会的信心再次动摇。槟州政府不只因反贪污明显反贪无力而失去信心，也对我之前所做的数宗投报以及槟州政府最近所做的投报皆没有下文，而失去信心。</p>
<p>马来西亚在国际透明贪污印象指数的排名从2003年第37名、下滑至去年第60名。有鉴于此，与其叫大马反贪污委员会负责核实公开财产，倒不如叫国际著名的稽查及会计公司负责，这样反而更加有公信力、更可靠。</p>

<p>On behalf of the Penang State Government, I would like to wish all our Hindu friends a very auspicious and prosperous Pongal Festival.</p>
<p>The Pongal Festival was traditionally celebrated by farmers to give thanks for the harvest. Today, we share in the spirit of Pongal to celebrate the rakyat who work hard and with honesty to earn a living for their families.</p>
<p><span id="more-1943"></span>To honour the honest rakyat who work hard day in and day out, it is our duty to provide good governance, accountability and transparency in administration. That is why the Penang State Government has taken the important step to publicly declare the assets of its EXCO members.</p>
<p>This public declaration of assets fulfils the personal obligation of PR leaders and proves the political commitment of the Penang PR State Government towards reinforcing leadership with integrity in line with the CAT principles of Competency, Accountability, Transparency.</p>
<p>It is unfortunate that the same commitment is not shown by the BN Government. Because of the financial shenanigans of the BN leaders, Malaysians now mourn the “the lost decade of corruption”, where the Washington-based financial watchdog Global Financial Integrity (GFI) estimated RM 1,077 billon of illicit money (including corruption money) had been illegally siphoned out of our country from 2000 to 2009.</p>
<p>Therefore, it is no wonder that in the latest Transparency International (TI) Corruption Perception Index, Malaysia dropped to 60th place in 2011 as compared to 37th in 2003 when Tun Abdullah Ahmad first took over as Prime Minister.  In contrast, Penang was praised by TI for implementing open tenders.</p>
<p>In light of this, I have proposed 6 integrity measures to overcome the excessive corruption and abuse of power that is now prevalent in our country.</p>
<p>One, there must be a ban on political parties’ involvement in business which can only lead to conflict of interest.</p>
<p>Two, the ban on mixing politics with business must be followed by establishing an open tender system to check crony capitalism.</p>
<p>Third, Freedom of Information Act to ensure transparency and also public disclosure of government contracts.</p>
<p>Fourthly, following in the footsteps of Penang, there must be a public declaration of personal assets by public officials holding positions of public trust.</p>
<p>Fifth, there must be full and unconditional implementation of the 125 recommendations proposed by the 2005 Royal Commission on the Enhancement of the Management and Operation of PDRM, especially the formation of the Independent Police Complaints and Misconduct Commission (IPCMC).</p>
<p>Finally, the Elections Commission (EC) must be punished for failure to act or even failure to press for action by the relevant authorities on election bribery, especially failure to comply with the Election Offences Act 1954 imposing election spending limits of RM200,000 for every Parliamentary constituency and RM100,000 for every state constituency.</p>
<p>These are the steps required to ensure integrity, accountability and transparency in the public domain.</p>
<p>Once again, in the spirit of thanksgiving, I would Iike to wish all our Hindu friends a very happy and auspicious Pongal Festival.</p>

<p>我在此代表槟州政府祝贺我们的兴都徒同胞庞格尔节快乐！</p>
<p>庞格尔节在传统上是农人庆祝丰收的节日。今天，我们与全体努力工作养家活口的人民一起庆祝这个具丰收意义的日子。<br />
对于每天劳劳碌碌、奉公守法的普通老百姓，我们的责任就是提供一个良好施政、问政、透明的政府。因此，槟州政府采取了重要的措施，公开行政议员的财产。</p>
<p>这项公布行政议员财产的措施，是民联领袖履行的个人义务，也证明槟州民联政府立志打造与能干、公信及透明施政方针相一致的廉正领导。</p>
<p>很不幸地，国阵并没有同样的志气。由于国阵领袖的财务丑闻，马来西亚人悼念“因贪污失去的十年”，设在华盛顿的金融观察机构全球金融廉正机构（GFI） 估计，我国的非法外流资金在2000至2009年期间高达1兆7千700亿令吉的黑钱外流（包括贪污钱）。</p>
<p>难怪在最新的国际透明组织（TI)提呈的贪污印象指数及国际竞争指数，马来西亚从前首相敦阿都拉刚执政的2003年排名第37，至降至2011年的第60名。反之，槟州的实施公开招标就获得国际透明组织的赞扬。</p>
<p>有鉴于此，我提议推行六大措施，来解决目前国内猖獗的贪污和滥权问题：<br />
第一、	必须禁止政党从商，这只会造成利益冲突。<br />
第二、	禁止政治与商业挂钩，坚持公开招标制以杜绝裙带资本主义。<br />
第三、	制订自由资讯法，确保透明度，并允许公众检查政府工程合约。<br />
第四、	公职官员必须申报的个人资产，以获得公众信任。<br />
第五、	必须毫无条件的接受和实施皇家委员会于2005年的建议，执行125项建议，尤其是成立投诉警方独立监察和渎职委员会（ IPCMC ）。IPCMC旨在防止警方滥用权力和腐败，无法成立IPCMC显露国阵政府不愿处理公众对警察的负面看法。</p>
<p>最后，选举委员会必须受到惩罚，因为无法对付在选举行贿者，尤其无法遵守《1954年选举犯罪法令》的规定，即限制每个国会选区竞选开销最高20万令吉和每个州议席10万令吉。</p>
<p>这些都是确保公共领域廉正、具公信力及透明度的措施。</p>

			<content:encoded><![CDATA[<p>United Nations International Anti-Corruption Day on 9 December 2011 can only be celebrated meaningfully in Malaysia by ending money politics through 6 integrity measures. Malaysia performed dismally in the latest 2011 Transparency International (TI) Corruption Perception Index(CPI), dropping 4 spots to No. 60 out of 183 countries this year from No. 56 out of 178 last year.</p>
<p>Malaysia’s 2011 CPI dropped for the third year running, slipping to 4.3 this year, leaving it in 60th place out of 183 countries compared with 37th place when Tun Abdullah Ahmad Badawi took over as prime minister in 2003. TI Malaysia Deputy President Mohammad Ali even noted that Malaysia’s CPI has continued to decline as &#8220;elements of state” that facilitated &#8216;grand corruption&#8217; were still prevalent.</p>
<p><span id="more-1872"></span>Such a damning indictment by TI explains UMNO’s attacks against DAP as anti-Malay and anti-Islam at the UMNO General Assembly filled will lies, hatred and vulgar language. No criticism is leveled at the expose by the 2010 Auditor-General Report of over-expenditure of RM3.7 billion by government departments. No questions are raised about the RM 250 million “cows and condos scandal” where money is used to buy luxury condos instead of rearing cows, and money released two years even before the agreement was signed by both parties.</p>
<p>Worse, TI’s survey of 1,000 respondents also found that the police and political parties were seen as the most corrupt institutions in the country, with most Malaysians believing that corruption levels would remain the same in the next three years. DAP proposes 6 integrity measures to improve our anti-corruption rankings by first succeeding in ending money politics and combat corruption in the police.</p>
<p>One, there must be a ban on political parties involvement in business which can only lead to conflict of interest. How can politics mix with business as the former seeks to uphold public interests whereas the latter is to pursue private benefit and profit? How wealthy political parties that are involved in business have become can be seen by MCA giving money to its members every year.</p>
<p>Two, the ban on mixing politics with business must be followed by establishing an open tender system to check crony capitalism. An open tender system ensures that unjust contracts such as the Independent Power Producers and the toll concession operators do not benefit the few with tens of billions of ringgit in extraordinary profits at the expense of the 27 million ordinary citizens. The shocking losses in RM5 billion Perwaja scandal, Port Klang Free Trade Zone scandal and the RM52 billion bumis shares scandal all adds up to more than US$ 100 billion estimated to be lost by Malaysians from corrupt or financial malpractices.</p>
<p>Third, a right to non-confidential information must be protected under the Freedom of Information Act to ensure transparency.</p>
<p>Fourthly, there must be a declaration of personal assets by public officials holding positions of public trust.</p>
<p>Fifth, there must be full and unconditional implementation of the 125 recommendations proposed by the 2005 Royal Commission on the Enhancement of the Management and Operation of PDRM, especially the formation of the Independent Police Complaints and Misconduct Commissionv(IPCMC). The IPCMC was intended to cut down abuses of police powers and police corruption. Failure to set up the IPCMC only shows the unwillingness of the BN government to deal with the negative public perception about the police.</p>
<p>Finally, the Elections Commission(EC) must be punished for failure to act or even failure to press for action by the relevant authorities on election bribery, especially failure to comply with the Election Offences Act 1954 imposing election spending limits of RM200,000 for every Parliamentary constituency and RM100,000 for evey state constituency. So blatant is this election spending limits rule violated that the Election Commission had admitted that RM 110 million was spent on election posters alone in the 2004 general elections.</p>
<p>With 219 parliamentary seats and 445 state seats contested in the 2004 general elections, the election spending limits is a maximum of RM 88.3 million.  Clearly only BN can afford to spend RM110 million on election posters in the 2004 general elections. And yet despite this astonishing self-revelation and admission by BN, no action was taken by the EC.</p>
<p>These 6 integrity measures can begin to cleanse Malaysia of corruption, cronyism and abuse of power. A fundamental step to return power to the people is to punish those who undertake corrupt actions, reduce opportunities for corruption, implement a national integrity system through appropriate laws and institutions.</p>

6 Langkah-Langkah Integriti Untuk Menghentikan Politik Wang Dan Menyelesaikan Kebimbangan Transparency International Tentang Pihak Polis Serta Dapat Membersihkan Malaysia Daripada Rasuah, Kronisme Dan Penyalahgunaan Kuasa</strong></p>
<p>Hari Anti-Rasuah Antarabangsa Pertubuhan Bangsa-Bangsa Bersatu (UN) pada 9 Disember 2011 hanya boleh disambut dengan penuh bermakna jika kita mengambil 6 langkah-langkah integriti untuk menghentikan politik wang. Prestasi Malaysia telah merosot dalam laporan terkini Indeks Persepsi Rasuah (CPI) Transparency International 2011, di mana negara kita telah jatuh 4 kedudukan ke tangga ke-60 daripada 183 negara daripada tangga ke-56 daripada 178 negara tahun lepas.</p>
<p>CPI 2011 Malaysia telah menurun untuk tahun ketiga berturut-turut kepada 4.3 tahun ini dan tangga ke-60, berbanding tangga ke-37 semasa Tun Abdullah Ahmad Badawi mengambil alih pucuk pimpinan sebagai Perdana Menteri pada tahun 2033. Malah Timbalan Presiden TI Malaysia Mohammad Ali telah menyatakan bahawa CPI Malaysia terus merosot kerana “elemen-elemen kerajaan” yang memudahkan “rasuah besar” masih lagi berleluasa.</p>
<p>Dakwaan yang berat daripada TI ini menjelaskan sedikit sebanyak serangan UMNO yang penuh fitnah, kebencian dan maki hamun terhadap DAP sebagai anti-Melayu dan anti-Islam semasa Perhimpunan Agung UMNO. Tidak pula ada kritikan mengenai Laporan Ketua Audit Negara 2010 yang telah mendedahkan jabatan-jabatan kerajaan yang telah terlebih belanja sebanyak RM3.7 bilion. Tidak pula disebut tentang skandal lembu dan kondo, di mana RM250 juta yang sepatutnya digunakan untuk tujuan penternakan lembu telah digunakan untuk pembelian kondo mewah, dan bagaimana duit itu boleh diberi dua tahun sebelum perjanjian ditandatangani oleh kedua-dua pihak.</p>
<p>Yang lebih teruknya, kaji selidik TI ke atas 1,000 orang responden juga mendapati bahawa pihak polis dan parti-parti politik dilihat sebagai institusi-institusi yang paling korup dalam negara. Juga dilaporkan bahawa kebanyakan warga Malaysia percaya tahap rasuah tidak akan berubah dalam masa 3 tahun akan datang.</p>
<p>Oleh itu, DAP mencadangkan 6 langkah-langkah integriti untuk menambahbaikkan kedudukan anti-rasuah kita dengan menghentikan politik wang dan membanteras rasuah dalam polis.</p>
<p>Pertama, parti-parti politik harus diharamkan daripada melibatkan diri dalam perniagaan, yang lazimnya membawa kepada konflik kepentingan. Bagaimana politik boleh bercampur dengan perniagaan, apabila politik itu bertujuan untuk menjaga kepentingan awam manakala tujuan perniagaan adalah untuk keuntungan peribadi? Contoh parti politik yang telah menjadi kaya melalui perniagaan boleh dilihat dalam kes MCA yang sekarang berupaya untuk memberi wang kepada ahli-ahlinya setiap tahun.</p>
<p>Kedua, pengharaman percampuran politik dengan perniagaan harus diikuti dengan kewujudan sistem tender terbuka untuk menghentikan kapitalisme kroni. Sistem tender terbuka akan memastikan kontrak yang tidak adil di mana Penjana Elektrik Bebas (IPP) dan syarikat-syarikat pengendali tol tidak akan mendapat keuntungan luarbiasa sebanyak berpuluhan ribu bilion ringgit sementara 27 juta rakyat dibebankan. Kerugian RM5 bilion dalam skandal Perwaja, skandal Port Klang Free Trade Zone dan skandal saham bumiputra RM52 bilion kesemuanya berjumlah lebih daripada USD 100 bilion, iaitu jangkaan kerugian rakyat Malaysia akibat daripada penyelewengan dan rasuah.</p>
<p>Ketiga, hak untuk maklumat tidak sulit hendaklah dilindungi di bawah Akta Maklumat Bebas untuk memastikan ketelusan.</p>
<p>Keempat, semua penjawat awam yang memegang amanah awam hendaklah membuat pengisytiharan aset mereka.</p>
<p>Kelima, 125 cadangan oleh Suruhanjaya DiRaja Penambahbaikan Perjalanan dan Pengurusan PDRM 2005 hendaklah dilaksanakan tanpa apa-apa syarat, terutama sekali penubuhan Suruhanjaya Bebas Aduan dan Salah Laku Polis (IPCMC). IPCMC ini bertujuan untuk mengurangkan rasuah dan penyalahgunaan kuasa polis. Kegagalan untuk menubuhkan IPCMC hanya menunjukkan ketidak sanggupan Kerajaan BN untuk menangani persepsi negatif awam tentang polis.</p>
<p>Terakhir, Suruhanjaya Pilihan Raya (SPR) hendaklah dihukum untuk kegagalannya untuk bertindak atau menuntut tindakan daripada pihak berkuasa ke atas rasuah pilihan raya, terutama sekali kegagalannya untuk mematuhi Akta Kesalahan Pilihan Raya 1954 yang mengenakan had perbelanjaan pilihan raya sebanyak RM200,000 untuk kawasan parlimen dan RM100,000 untuk kawasan dewan undangan negeri. Pelanggaran peraturan ini berlaku secara terang-terangan sampai SPR sendiri telah mengaku bahawa RM110 juta telah dibelanjakan untuk poster pilihan raya sahaja dalam Pilihan Raya Umum 2004.</p>
<p>Dengan 219 kawasan parlimen dan 445 kawasan DUN yang ditandingi dalam PRU 2004, had perbelanjaan pilihan raya sepatutnya RM88.3 juta. Adalah amat jelas bahawa hanya BN sahaja yang dapat membelanjakan sebanyak RM110 juta untuk poster pilihan raya dalam PRU tersebut. Meskipun demikian, tiada sebarang tindakan yang telah diambil oleh SPR.</p>
<p>6 langkah-langkah integriti ini boleh memulakan proses pembersihan Malaysia daripada rasuah, kronisme dan penyalahgunaan kuasa. Langkah-langkah asas seperti menghukum mereka yang mengamalkan rasuah, mengurangkan peluang rasuah, melaksanakan sistem integriti kebangsaan melalui undang-undang dan institusi-institusi yang sesuai adalah antara langkah-langkah yang dapat mengembalikan kuasa kepada rakyat.</p>

<p><strong>透过6项廉正措施结束金钱政治， 认真看待国际透明组织就大马警员的评语，以洗净马来西亚的贪污、朋党及滥权臭名。</strong></p>
<p>马来西亚只有在透过6项廉正措施，结束金钱政治后，才能够有意义地庆祝落在2011年12月9日的联合国国际反贪污日。在国际透明组织最新出炉的2011年度贪污印象指数中，我国的排号名再次下滑，在183个国家排号第60，跌了4级，比去年的178个国家排行第56更糟。</p>
<p>这也是马来西亚在贪污印象指数排名中，连续三年创下下滑的记录，跌至今年的4.3，在183个国家中排名第60，这与敦阿都拉在2003年接任首相时的排名第37相去甚远。马来西亚国际透明组织署理主席莫哈末阿里说甚至点评，马来西亚的贪污印象指数会持续下滑，因为方便“大贪污腐败”的“政府元素”依然盛行。</p>
<p>国际透明组织这样一个确凿的指控，说明了巫统在巫统大会向行动党展开的“反马来人”及“反伊斯兰教”攻击， 是充满谎言、仇恨和粗俗语言的。整个巫统大会丝豪未提及或批评2010年度总稽查司报告指政府部门超支37亿令吉的事。更没有人质问原本应用来养牛的2亿5千万令吉转用来购买豪华公寓的“牛及豪华公寓丑闻”，以及正式签署合约的2年前就发出款项的事情。</p>
<p>更糟糕的是，国际透明组织对1千名民众的调查显示，警方及政党被视为国内贪污情况最严重的机构。大部分的马来西亚人认为，国内的贪污程度在未来的三年内会保持不变。行动党在此建议6项廉正措施，以提高我们在反贪的排名。首先就是结束金钱政治，打击警队中的贪污腐败。</p>
<p>第一， 必需禁止政党涉及商业活动，避免利益冲突。政商如何得以结为一体？政治是要维护公众利益，而商业则是要追求私人利益和利润。一个政党如何透过经商致富，看看马华，这是最佳例子。马华富裕到可以每年派钱给党员，就是一个政党透过经商致富的绝佳例子。</p>
<p>第二，禁止政商勾结的下一步，就是全面实行公开招标，杜绝朋党主义。公开招标能够确保类似独立发电厂及大道收费站合约等不公平的合约，不会继续牺牲2千700万人民利益来为朋党制造超常利润。马来西亚的贪污及财务不当，已经导致我国损失了超过1千亿美元，包括柏华惹钢铁厂丑闻的50亿令吉亏损、巴生港口自贸区丑闻、蒸发了的520亿令吉土著股权等。</p>
<p>第三，为确保透明度，非机密资料需获得资讯自由法的保障。</p>
<p>第四、出任公众利益职位的公职人员需申报财产。</p>
<p>第五、必需无条件地全面实施2005年皇家警察委员会的125项警队改革建议的执行报告，特别是成立“警方投诉及行为不检调查委员会”(IPCMC)。这个“警方投诉及行为不检调查委员会”旨在减少警方滥权及贪污。无法设立“警方投诉及行为不检调查委员会”只能突显出国阵政府不愿意处理警方在人民心目的负面印象。</p>
<p>最后，选举委员会必需就他们的无能而受到处分。因为他们没有严格根据1954年选举犯罪法令来惩罚或施压采取行动对付有关方面在贿选，特别是无法符合1954年选举犯罪法令下，限定每个国会选区不得开支超过20万令吉以及州选区不可超过10万令吉的事而受对付。这么明目张胆的超支违规，连选委会自已都承认，在2004年大选，只是海报就花了 1亿1千万令吉。</p>
<p>若根据2004年大选时的219个国会议席及445个州议席计算，选举最高开销应该是8千830万令吉。很明显的，只有国阵有能力在2004年大选时花掉1亿1千万令吉在选举海报上。尽管这些惊人的数据获得国阵方面的承认，可是选委会却完全没有采取行动对付相关人士。</p>
<p>这6项廉正措施，可以让马来西亚开始展开一项“净化大马”的行动，让马来西亚洗脱贪污、朋党主义和滥权的臭名。将权力归还予人民的基本步骤，就是惩罚那些涉及贪污的人，减少贪污的机会、透过法律和制度，落实国家诚信体系。</p>

			<content:encoded><![CDATA[<p>The BN Federal Government Practicing Double-standards By Dismissing The Unfavourable Transparency International(TI) Corruption Perception Index(CPI) As Subjective But The Favourable Global Competitiveness Index Is Objective. </p>
<p>The BN federal government is clearly practicing double-standards by dismissing the Transparency International(TI) Corruption Perception Index(CPI) as subjective because it is unfavourable but the favourable Global Competitiveness Index(GCI) by the World Economic Forum is objective. Second Finance Minister Datuk Seri Ahmad Husni Hanadzlah said that Malaysia’s Corruption Perception Index (CPI) rankings slide was “subjective” and “questionable”, saying that measures based on perception should not be used as an ultimate gauging method. </p>
<p><span id="more-1868"></span>TI said that Malaysia’s 2011 CPI dropped for the third year running, slipping to 4.3 this year, leaving it in 60th place out of 183 countries compared with 37th place when Tun Abdullah Ahmad Badawi took over as prime minister in 2003. Worse, TI’s survey of 1,000 respondents also found that the police and political parties were seen as the most corrupt institutions in the country, with most Malaysians believing that corruption levels would remain the same in the next three years. TI Malaysia Deputy President Mohammad Ali even noted that Malaysia’s CPI has continued to decline as &#8220;elements of state” that facilitated &#8216;grand corruption&#8217; were still prevalent. </p>
<p>This is a classic case of denial by the BN Federal government that corruption has worsened in Malaysia despite the Economic Transformation Program and Government Transformation Program by the Prime Minister. This state of denial that the truth hurts is most evident when the BN government praised itself for Malaysia’s improvement by five spots to 21st place in the World Economic Forum’s Global Competitiveness Index(GCI) 2011 ranking from No. 26 last year. </p>
<p>Why is the GCI not a subjective evaluation that is also questionable? Is the GCI neither subjective nor questionable just because it is favourable to the Federal Government? The BN should not take an ostrich in the sand approach but admit that Malaysia faces serious corruption levels. </p>
<p>If the evaluation by TI was done after the RM250 million “cows and condos” scandal was exposed by the 2010 Auditor-General’s Report, Malaysia decline in the CPI would be even worse. However the refusal of even a learned economist like Husni to face hard truths and reality shows that there is no hope of successfully combating corruption under a BN and UMNO that is willing to sacrifice principles for political expediency. </p>

<p>Kerajaan Persekutuan BN jelas mengamalkan “double-standards” dengan menolak laporan Indeks Persepsi Rasuah (CPI) yang dihasilkan oleh Transparency International (TI) sebagai subjektif kerana ia memberi pandangan yang negatif tetapi menerima Indeks Daya Saing Global (GCI) oleh World Economic Forum sebagai objektif kerana gambaran lebih positif yang diberikan. Menteri Kewangan II Datuk Seri Ahmad Husni Hanadzlah berkata bahawa kedudukan CPI Malaysia yang menurun adalah “subjektif” dan “boleh dipersoal”, dan bertambah bahawa kaji selidik yang berdasarkan persepsi tidak seharusnya digunakan sebagai kaedah penilaian. </p>
<p>Menurut TI, CPI Malaysia bagi tahun 2011 telah menurun untuk tahun ketiga berturut-turut kepada 4.3 dan kedudukan Malaysia telah jatuh ke tangga ke-60 daripada 183 negara, berbanding dengan tangga ke-37 pada tahun 2003 apabila Tun Abdullah Ahmad Badawi menjadi Perdana Menteri. Lebih teruknya, laporan TI yang telah mengkaji selidik seramai 1,000 responden telah mengenal pasti bahawa pihak polis dan parti-parti politik merupakan institusi-institusi yang dilihat sebagai paling korup di negara kita. Kebanyakan daripada responden juga percaya bahawa tahap rasuah atau korupsi di negara kita akan berkekalan untuk tiga tahun akan datang. Timbalan Presiden TI Malaysia Mohammad Ali juga menyatakan bahawa CPI Malaysian akan terus menurun kerana “elemen-elemen kerajaan” yang memudahkan “rasuah besar” masih lagi berleluasa. </p>
<p>Ini adalah satu contoh penafian oleh Kerajaan Persekutuan BN yang tidak ingin mengaku bahawa keadaan rasuah semakin teruk walaupun Perdana Menteri telah menjalankan pelbagai program seperti Program Transformasi Ekonomi dan Program Transformasi Kerajaan. Sikap tidak sedar diri ini amat jelas apabila Kerajaan BN memuji diri kerana kedudukan Malaysia telah meningkat 5 tangga dari 26 kepada 21 dalam Indeks Daya Saing Global (GCI) World Economic Forum pada tahun ini. </p>
<p>Kenapa GCI tidak dikatakan sebagai satu kaedah penilaian yang subjektif? Kenapa kaedah penilaiannya tidak dipersoal? Adakah begitu kerana laporannya memberi gambaran yang lebih positif? Kerajaan BN tidak seharusnya bersikap seperti burung unta yang membenamkan kepala dalam tanah tetapi mengaku bahawa negara kita sedang mengalami masalah rasuah yang serius. </p>
<p>Jika penilaian TI telah dilakukan selepas skandal “lembu dan kondo” sebanyak RM250 juta telah didedahkan oleh Laporan Ketua Audit Negara 2010, tahap penurunan CPI Malaysia barangkali akan lebih teruk. Akan tetapi, keengganan seorang pakar ekonomi yang terpelajar seperti Husni untuk menghadapi kebenaran menunjukkan bahawa tidak ada harapan untuk membasmi rasuah selagi negara berada di bawah pemerintahan UMNO dan BN yang sanggup menggadaikan prinsip untuk kepentingan politik. </p>

<p>国阵联邦政府很明显地在对待国际透明组织提呈的贪污印象指数及国际竞争指数两个国际评价，持有双重标准。当一项指数是对国阵联邦政府不利时，像国际透明组织的贪污印象指数般，它就是主观的评价；反之，对国阵政府有利的世界经济论坛报告，称我国国际竞争指数提升的指数则是客观的评价。第二财长拿督斯里阿末原斯尼说，我国的贪污印象指数排名下滑，是“主观”及“值得商权”的，因为以印象作为测量的方式，不应该作为最终的测量方式。 </p>
<p>国际透明组织指出，马来西亚在2011年度的贪污印象指数（CPI）排名，已经连续三年下滑，跌至今年的4.3分，在183个国家中，排名第60。这与敦阿都拉在2003年接任首相时的第 37排名相比，相去甚远。更糟糕的是，国际透明组织针对1千人展开的调查显示，警察及政党被视为国内最贪污的机构，大部分的马来西亚人相信，贪污程度在接下来的三年会保持不变。马来西亚国际透明组织署理主席莫哈末阿里说甚至点评，马来西亚的贪污印象指数会持续下滑，因为方便“大贪污腐败”的“政府元素”依然盛行。 </p>
<p>虽然首相推出了经济转型计划及政府转型计划，但是国内的贪污情况却更加恶化，这也是国阵联邦政府患上否认状态的经典案例。这种否认状态，在国阵自己称赞自己时更为显著。他们说马来西亚在世界经济论坛中的国际竞争指数，已从去年的排名第26，升至2011年度的排名第21，跳了5级。 </p>
<p>为什么国际竞争指数却不是主观或值得商权呢？难道只因它是对国阵联邦政府有利的评价就不是主观也不属于“值得商权”了吗？国阵不应该像驼鸟般把头藏在沙堆中，反之应该承认马来西亚正面对严重的贪污问题。 </p>
<p>若是国际透明组织的评估是在2010年度总稽查司揭发2 亿5000万令吉“养牛与豪华公寓”丑闻之后进行的话，马来西亚在贪污印象指数的排名将会更糟糕。然而，连一名诸如胡斯尼曾学过经济的人，都不愿面对真相和现实的话，这证明了在国阵及巫统的领导下，是没有肃贪的希望了，因为他们愿意为了政治上的权宜之计而牺牲他们的原则。 </p>

<p><strong>Malaysia’s Worst Score In 10 Years Under The 2011 Transparency International Corruption Perception Index Underscores The Failure Of Prime Minister’s Government Transformation Programme(GTP) Of Fighting Corruption And Economic Transformation Programme Of A High-Income Economy By 2020.</strong></p>
<p>Malaysia’s worst score in 10 years under the 2011 Transparency International(TI) Corruption Perception Index(CPI) underscores the failure of Prime MinisterDato Seri Najib Tun Razak’s GTP of fighting corruption. Failure to fight corruption will certainly lead to failure of his ETP of transforming Malaysia into a high-income economy by 2020.</p>
<p><span id="more-1862"></span>Malaysia’s Corruption Perception Index (CPI) score has worsened for the third year running, slipping to 4.3 this year from 4.4 in 2010. Worse Malaysia’s country ranking also fell to 60 out of 183 countries from 56 out of 178 last year. In 2003 when Tun Abdullah Ahmad Badawi took over as Malaysia’s fifth Prime Minister, Malaysia was ranked 37 in the survey covering 146 countries.</p>
<p>TI’s survey of 1,000 respondents also found that the police and political parties were seen as the most corrupt institutions in the country, with most Malaysians believing that corruption levels would remain the same in the next three years.</p>
<p>TI Malaysia Deputy President Mohammad Ali even noted that Malaysia’s CPI has continued to decline as &#8220;elements of state” that facilitated &#8216;grand corruption&#8217; were still prevalent.</p>
<p>Such a damning indictment by TI explains UMNO’s vicious attacks against DAP at the UMNO General Assembly centered on racism, sex, lies and vulgar language. UMNO’s attack on soft targets like Christians, Chinese, Bersih Chair S. Ambiga, DAP as trying to dominate the country and oppress the Malays, and even calling voters of DAP as bastards is a desperate attempt to distract attention from UMNO’s failure to address the hard targets of corruption, cronyism and abuse of power.</p>
<p>No criticism is levelled at the expose by the 2010 Auditor-General Report of over-expenditure of RM3.7 billion by government departments. No mention is made about the cows and condos scandal involving the family of a Federal Minister.</p>
<p>One wonders why is the ordinary Pak Chik in the kampong not given such an opportunity? No questions are raised why money from a RM250 million can be approved and released two years even before the agreement was signed by both parties. Every UMNO leader wants to cover up the scandal of using money meant to rear cows has been diverted to buy not one but two luxury condominiums.</p>
<p>Malaysians want integrity not corruption, open tenders not negotiated tenders, no toll hikes instead of toll hikes that benefits only the few toll operators, freedom not oppression and rule of law instead of injustice. There is only hope for corruption if we can successfully curb corruption. Corruption will be the main issue in the next general elections where the people can either choose to support BN that has stolen our future for the last 54 years or reject BN to prevent our children’s future from being stolen again.</p>

<p>Prestasi terburuk Malaysia selama 10 tahun dalam laporan Indeks Persepsi Rasuah 2011 oleh Transparency International (TI) menggariskan kegagalan Perdana Menteri Dato’ Sri Najib Tun Razak untuk mencapai matlamat anti-rasuah dalam Program Transformasi Kerajaan (GTP). Kegagalan untuk menangani gejala rasuah ini lantas akan membawa kepada kegagalan Program Transformasi Ekonomi (ETP) untuk mentransformasikan ekonomi Malaysia kepada sebuah ekonomi pendapatan tinggi menjelang 2020.</p>
<p>Indeks Persepsi Rasuah (CPI) Malaysia telah menurun untuk tiga tahun berturut-turut, iaitu 4.3 bagi tahun ini berbanding 4.4 pada tahun lepas. Lebih teruknya, kedudukan Malaysia telah jatuh kepada tangga ke-60 daripada 183 negara, berbanding tangga ke-56 daripada 178 negara pada tahun lepas. Pada tahun 2003 apabila Tun Abdullah Ahmad Badawi mengambil alih pucuk pimpinan negara sebagai Perdana Menteri kelima, Malaysia berada di tangga ke-37 dalam kaji selidik tersebut yang merangkumi 146 negara.</p>
<p>Kaji selidik TI ke atas 1,000 orang responden juga mendapati bahawa pihak polis dan parti-parti politik dilihat sebagai institusi-institusi yang paling korup dalam negara. Juga dilaporkan bahawa kebanyakan warga Malaysia percaya tahap rasuah tidak akan berubah dalam masa 3 tahun akan datang.</p>
<p>Timbalan Presiden TI Malaysia Mohammad Ali juga berkata bahawa CPI Malaysia terus merosot kerana “unsur-unsur kerajaan” yang memudahkan “rasuah besar” masih lagi tersebar luas.</p>
<p>Dakwaan yang begitu berat oleh TI jelas menerangkan serangan ganas UMNO terhadap DAP dalam Perhimpunan Agung UMNO yang berkisar pada perkauman, seks, fitnah dan bahasa kotor. Serangan UMNO terhadap sasaran mudah seperti Kristian, Cina, Pengerusi Bersih S. Ambiga, dan DAP sebagai penindas orang Melayu yang kononnya hendak menguasai negara, sampai penyokong DAP dilabel sebagai bangsat, merupakan tindakan terdesak untuk mengalih perhatian daripada kegagalan UMNO untuk menangani masalah-masalah seperti rasuah, kronisme dan penyalahgunaan kuasa.</p>
<p>Tidak pula ada kritikan mengenai Laporan Ketua Audit Negara 2010 yang telah mendedahkan terlebihan belanja sebanyak RM3.7 bilion oleh jabatan-jabatan kerajaan. Tidak pula disebut tentang skandal lembu dan kondo yang melibatkan keluarga seorang Menteri Persekutuan.</p>
<p>Soalan patut ditanya kenapa pakcik biasa di kampung tidak pernah diberi peluang yang serupa? Tidak pula disoal kenapa duit daripada pinjaman RM250 juta boleh diberi dua tahun sebelum perjanjian ditandatangani oleh kedua-dua pihak. Setiap pemimpin UMNO hanya ingin menutup skandal di mana duit yang sepatutnya digunakan untuk penternakan lembu telah digunakan untuk membeli bukan sebuah tetapi dua buah kondominium mewah.</p>
<p>Rakyat Malaysia menginginkan integriti dan bukan rasuah, tender terbuka dan bukan rundingan terus, tiada kenaikan tol dan bukan kenaikan tol yang membawa manfaat kepada syarikat-syarikat pengendali tol, kebebasan dan bukan penindasan, serta keluhuran undang-undang dan bukan ketidakadilan. Harapan untuk membasmi rasuah tidak akan tercapai selagi kita tidak mengambil langkah untuk menanganinya. Rasuah akan menjadi isu utama dalam pilihan raya umum yang akan datang, di mana rakyat boleh memilih sama ada untuk menyokong BN yang telah mencuri masa depan kita selama 54 tahun atau untuk menolak BN untuk mencegah masa depan anak-anak kita daripada dilenyapkan.</p>

<p>国际透明组织公布的2011年贪污印象指数报告中，马来西亚得到10年来最糟糕的评分，显示了首相拿督斯里纳吉对抗贪污的政府转型计划（GTP）是失败的，无法打击贪污也注定了他要大马在2020年转型为高收入国的经济转型计划（ETP）失败。</p>
<p>国际透明组织针对1000人展开的民调显示，民众将警方与政党列为大马最腐败的单位，多数受访者认为大马未来3年的贪污问题将保持不变。</p>
<p>大马国际透明组织副主席阿里哈山甚至指出，大马消费者物价指数继续下降，是因为“政府因素”促使“大腐败”继续盛行。</p>
<p>国际透明组织如此确凿的指控，足以解释巫统在代表大会上对民主行动党作出种族、性别、谎言和粗俗语言等恶性攻击。巫统专挑软的来吃，攻击基督徒、华人、净选盟主席安美嘉，和诬蔑行动党欺压马来人以夺取政权，甚至标签行动党的支持者为“杂种”，这都是为了转移巫统无法解决贪污、朋党主义和滥权的视线。</p>
<p>对于2010年总稽查司报告揭发政府机构超支37亿令吉，还有一名联邦部长家人涉及的豪宅养牛丑闻，巫统只字不提，更别说批评了。</p>
<p>应该要问的是，为什么乡区父老没有获得一样的机会？没有人问起，为什么2亿5千万令吉中的钱在双方未签约前就发放2年。原本应该养牛的钱却用来买了不只1间，而是2间豪华公寓的事，每个巫统领袖只想要遮盖这丑闻。</p>
<p>大马国民要完整性而非贪污、要公开招标而非谈判、要大道不涨价而非只带给大道公司好处的涨价、要自由而非欺压、要法治而非不公平。只有我们采取行动才能消灭贪污腐败，贪污将成为下届大选的主要课题，人民可以决定是否支持在过去54年偷取了我们未来的国阵，或是为了保护我们孩子的未来再被盗取而拒绝国阵。</p>

<p>BN dan UMNO sekali lagi menfitnah Program Anak Emas Kerajaan PR Pulau Pinang sebagai berbentuk rasuah dan pancing undi bila belum ada pilihanraya dan RM100 diberikan kepada setiap bayi dan bukannya kepada mana-mana pemimpin PR. Malah Suruhanjaya Pilihanraya pun tidak boleh menyatakan ia ada kaitan dengan pancing undi bila tidak ada mana-mana pilihanraya sekarang. Kemungkinan besar kerajaan PR tidak akan mengadakan pilihanraya bersama dengan BN sekiranya dijalankan tahun kerana mandate rakyat adalah untuk lima tahun.</p>
<p>Sungguh tidak waras dan tidak bertanggungjawab untuk BN dan UMNO mentakrifkan pemberian wang untuk meraikan tambahan cahaya mata kepada Pulau Pinang kepada rakyat sebagai amalan rasuah kerana pemberian wang kepada rakyat memang tindakan mana-mana kerajaan yang baik di dunia. <span id="more-1680"></span>Sebelum ini, Kerajaan PR Pulau Pinang dikutuk keras melakukan rasuah berikutan kejayaan Program Penghargaan Warga Emas RM100 setiap tahun dan RM1,000 “one-off” urusan jenazah kepada waris warga emas pada 2010 demi mengenang jasa bakti sumbangan warganegara yang melebihi 60 tahun kepada pembangunan negeri. </p>
<p>Ekoran tuduhan BN, saya telahpun menjemput Pengarah SPRM Negeri Pulau Pinang menyaksikan pemberian wang RM 100 kepada warga emas ataupun RM1,000 “one-off” urusan jenazah. Sehingga hari ini saya tidak pernah ditangkap ataupun disiasat pun melakukan rasuah kerana berikan wang kepada rakyat. Tuduhan rasuah oleh BN untuk mensabotajkan program penghargaan emas nyata gagal  dengan kadar pendaftaran warga emas kini melebihi 87% dengan hampir 115,000 warga emas Pulau Pinang telahpun mendaftarkan diri. </p>
<p>Oleh itu, BN dan UMNO harus meminta maaf dan menarik balik tuduhan jahat rasuah ini kerana memperbodohkan rakyat seakan-akan rakyat boleh dibeli dengan rasuah RM100 sahaja. BN dan UMNO perlu menjelaskan mengapa mengutuk kerajaan negeri PR bagi wang sedangkan satu sen pun tidak dibagi kepada warga emas dan bayi semasa BN memerintah Pulau Pinang sebelum ini.</p>
<p>Mesyuarat EXCO besok akan memutuskan pertimbangan memberikan RM 100 wang tunai “one-off” kepada setiap bayi kelahiran Pulau Pinang mulai tahun ini dan tahun berikutnya, di mana salah seorang ibubapa merupakan pengundi Pulau Pinang dan pengesahan bahawa pendapatan isi rumah keluarga tidak melebihi RM4,000 sebulan. Sumber kewangan program baru “Anak Emas Pulau Pinang” ini adalah sama dengan program penghargaaan warga emas iaitu datang daripada lebihan Bajet setiap tahun dan kejayaan kerajaan PR menjalankan kempen anti-rasuah yang dipuji oleh Transparency International.</p>

<p>国阵和巫统再一次污蔑槟州民联政府的“槟州宝贝计划”，诬指槟州民联政府贪污贿赂及捞取选票，尽管还没有举行大选，而有关100令吉是发给新生儿，而不是民联领袖。由于现在并没有进行任何选举，就连选委会也不能指这项计划是在捞取选票。民联政府也很有可能不会与国阵同步进行选举，因为人民给予政府的委托期限是五年。</p>
<p>国阵与巫统把槟州政府发给新生儿的补助金视为贪污贿赂，实在是不合适、也不负责任，因为世界上任何一个好政府都会分钱给人民。之前，槟州民联政府也因成功实施每年分发100令吉乐龄人士回馈金，以对60岁以上乐龄人士的贡献表示感激，以及发出一次性1000令吉怃恤金给逝世乐龄人士的家属，惨遭批评为贪污贿赂。</p>
<p>针对国阵的诬蔑，我已经邀请了槟州反贪污局总监见证了100令吉回馈金及1000令吉怃恤金的颁发仪式。直到今天，我还没有因为分钱给人民，而在贪污贿赂的罪名下被逮捕、被调查。国阵企图通过指责我们贪污贿赂来破坏乐龄人士回馈计划，但是，从已有11万5000名（或87%）的乐龄人士已经登记看来，他们已经失败。</p>
<p>因此，国阵与巫统应该道歉、马上收回他们那种居心不良的指责，他们以为人民都是愚蠢的，那么容易就可以被100令吉收买。国阵与巫统必须解释，为什么民联政府可以一直派钱，但是，当国阵执政槟州时，他们一分钱也没有给过乐龄人士和新生儿？</p>
<p>我们将在明天的州行政会议上议决，今年开始，发出一次性100令吉给新生儿的“宝贝计划”，只要新生儿的父母其中一人是槟州选民、并证明新生儿的家庭月入不及4000令吉便可。上述“槟州宝贝计划”的资金来源与乐龄人士回馈金一样，都是槟州开源节流的盈余，槟州推行的肃贪政策已经获国际透明组织表扬。</p>

<p>Malaysians are shocked at the exposes of impropriety in the award of advertising contracts worth a total of RM381 million by the Ministry. Integrated Strategic Communications(ISC), the advertising company behind the &#8216;Malaysia, Truly Asia&#8217; campaign since 1999, has alleged that bribes were solicited from them in order to secure the renewal of their contract.</p>
<p>ISC issued a press statement published by the Malaysian Insider that it withdrew a bid to renew its contract with the Tourism Ministry after being asked for bribes in exchange for the deal. ISC  said it was rebutting Tourism Minister Datuk Seri Dr Ng Yen Yen’s denial of “ambiguity” in the tender process for the advertising and promotions contract, worth a total of RM381 million.<br />
<span id="more-1353"></span><br />
ISC founder and chief executive officer Austen Zecha  alleged that both he and his deputy were jointly approached on January 19 to “offer the client” (the ministry) a 50 per cent “rebate” or an annual share of the firm’s income from the account. In exchange, he said, ISC would then “re-win” another three-year Tourism Malaysia contract for the Europe, North America and Oceania tender. This request for a bribe essentially led ISC to decide to withdraw its tender on Wednesday, January 26,” Zecha said.</p>
<p>Once again, corruption allegations from a big advertising agency have implicated a senior Cabinet Minister. Seen in the context of the recent arrests and charges against two former senior Ministers from the same party, Malaysians are rightfully disappointed with the opaque and irresponsible manner in which public funds are managed.</p>
<p>What is interesting is ISC’s claim that its chairman was at one time its co-founder and investor , Datuk Mukhriz Mahathir. The root of this ugly plague of corruption is the system that has long fomented such practices. The only solution therefore, is to allow for open tenders held in public view. Penang’s CAT administration of Competency, Accountability and Transparency that not only allowed open tenders but that the tenders be conducted through e-tenders online to limit human interaction.</p>
<p>The DAP urges the MACC to pursue these allegation without fear or favour. We also call for the Federal Government, and the Ministry of Tourism in particular, to prove their commitment to fiscal transparency as preached in the Prime Minister&#8217;s New Economic Model, by immediately instituting open tenders for all government projects henceforth.</p>

<p>DAP wishes to extend our congratulations to the Royal Malaysian Navy for its success in capturing 18 Somali pirates and preventing their attempted hijack of a Malaysian chemical tanker near the Gulf of Aden. This successful operation in saving the tanker and their crew without any loss of life inspires confidence in a professional navy that justifies the people’s faith. </p>
<p>Not Just Petronas But BN Must Come Clean On The Scandal Of Huge Illicit Capital  Outflows Of RM888 Billion From Malaysia In 9 Years From 2000-2008, The Fifth Highest In The World Amongst Developing Countries.</p>
<p>Whilst our navy boys are heroes for their successful capture of Somali pirates in international waters, DAP regrets that land “pirates” are allowed to roam freely in Malaysia. The US-based financial watchdog Global Financial integrity (GFI) reported that illicit money outflows from Malaysia tripled to US$68.2 billion (RM208.1 billion) in 2008, from US$22.2 billion in 2000.<br />

For the period 2000-2008, China tops the chart among the world&#8217;s exporters of illicit capital with a whopping US$2.8 trillion of outflows, followed by Russia (US$427 billion), Mexico (US$416 billion), Saudi Arabia (US$302 billion) and Malaysia (US$291 billion or RM888 billion). Other Asian countries with high illegal capital flight are Philippines ($109 billion), Indonesia ($104 billion) and India ($104 billion).</p>
<p>Clearly illegal capital flight from Malaysia of RM888 billion over 9 years from 2000-8 has dwarfed legitimate capital inflows into the country. GFI defines illicit financial flows as generally involving the transfer of money earned through illegal activities such as corruption, transactions involving contraband goods, criminal activities, and efforts to shelter wealth from a country&#8217;s tax authorities. </p>
<p>GFI said that poor governance, pervasive corruption and rising income inequality as contributory factors, making serious allegations that even GLCs such as Petronas could probably be driving illicit flows. This is a devastating indictment of the lack of enforcement, rule of law and a culture of corruption that has eroded confidence in our capital market.</p>
<p>GFI also pointed out the significant discrimination in labour markets was another factor which moved not only people but also illicit and unrecorded capital out of the country. Sadly, Malaysia’s loss of human talent has not only dimmed our future but also made all of us poorer.<br />
Clearly, not only Petronas but BN must come clean on the scandal of huge illicit money outflows RM888 billion from Malaysia in 9 years from 2000-2008, the 5th highest in the world amongst developing countries. </p>
<p>GFI proposes increasing transparency as critical to reducing the outflow of illicit money from developing countries.This is in line with Penang state government’s CAT governance of Competency, Accountability and Transparency, which has resulted in Penang being commended by the Auditor-General’s Report as the best financially managed state and won praise from Transparency International.</p>
<p>The refusal of BN to come clean will not only cause greater losses in the future, there is a possibility that the country may even go bankrupt by 2019 as Minister in the Prime Minister’s Department Datuk Seri Idris Jala had warned. RM888 billion in only 9 years is a huge sum by any measure, and more than four times our 2011 National Budget. If RM888 billion was given to 27 million Malaysians, each man woman and child would receive nearly 33,000/- each over 9 years. </p>
<p>Any clean and responsible government with integrity would have immediately established a Royal Commission of Inquiry into this RM888 billion illicit capital outflow scandal. However BN’s reluctance to establish a Royal Commission of Inquiry into other scandals such as RM52 billion bumi shares scandal, where Malays/bumis lost RM 52 billion of bumi shares which just “disappeared”, leaves Malaysians with no choice but to change the government if we want to unearth the truth and punish the culprits responsible.</p>

			<content:encoded><![CDATA[<p>Press Statement by Mr Baskaran Kunjamboo, Pengurus Kanan,Bahagian Khidmat Pengurusan, PDC– 1st March 2010</p>
<p>We refer to the article on the Star “Lim Blasted over tender clause” (“Article”), dated 1st March 2010 and wish to clarify our position on the matter. We are surprised at the actions of certain parties who wish to blow up completely out of proportion what is essentially a simple administrative matter.</p>
<p><span id="more-849"></span>As reported in the said article, we have indeed included a clause in our Tender Form A allowing termination of awarded contracts at any point in time and without any reason, on the orders of our PDC Chairman (the “Clause”). The Clause is not without its justification. </p>
<p>We wish to stress 4 points. 1, no contractor has ever expressed unhappiness or objected to the clauses contained in the tender Form A. 2, The Chief Minister had never cancelled any contract. 3, this clause is inserted as a form of protection for the public interests of PDC. As there is a time lapse of several months between the issuance of tender Form A and execution of the formal contract between PDC and the contractor, this clause protects PDC by giving PDC the right to terminate the tender before the contract is signed. PDC wants this right during the interim period before the contract is signed in the event of discovering any manipulation, malpractice, hanky-panky and corruption. 4, the Chief Minister/Chairman acts on the proposal of management and he may or may not accept the advice of the management to terminate on an urgent basis based on the reasons in point 3 above. So far, neither has management made any proposal nor The Chief Minister terminated any Tender Award. </p>
<p>For your clarification, Tender Form A is only the preliminary stage in PDC’s entire technical contract process. It is not the only document governing technical contracts. After the said form has been issued, PDC and the contractor are required to enter into and execute a separate agreement (PDC Form 203A) (“Agreement”) in order to formalize the contract awarded. It is to be noted that the Agreement contains regulations for breach on the part of the contractor. </p>
<p>Upon issuance of Tender Form A, the selected contractor would have begun his operations pending execution of the agreement. However, in many cases, there is usually a lapse of several months before the contractor actually executes the said Agreement. In the absence of a formal agreement, PDC faces difficulty in terminating the services of the contractor in the event of a breach or default or the occurrence of a negative event. </p>
<p>Thus, in order to regulate the services of the contractor during the interim period, i.e. prior to execution of the Agreement, PDC included the Clause giving a right to terminate the contract so awarded. The Clause is only meant to serve as a temporary regulatory measure until execution of the Agreement. </p>
<p>For further clarification, PDC did not incorporate the Clause into the Agreement as it already contains its own provisions for governing causes for termination. These provisions are adequate to deal with any form of events that may trigger termination during the period of the contract. This clearly indicates that our intention is not to simply terminate contracts at anytime. If otherwise, PDC would have surely carried the intention to terminate on the order of an individual throughout the entire process and into the Agreement. </p>
<p>We also wish to highlight that PDC’s present practice to deal with contracts considered for termination does not rest in any individual of PDC or the PDC Chairman. Instead, PDC has its own Tender Board to look into and decide on such matters. The Tender Board has the ultimate and final say on all technical contracts/matters and only decisions of the same are carried out. </p>
<p>In light of the above and for all intents and purposes, PDC’s practices have not strayed from the Treasury’s tender procedures as alleged in the Article. </p>
<p>PDC has, so far, awarded 10 contracts carrying the Clause in Tender Form A to 10 contractors. However, all these 10 contractors have each further executed the Agreement with PDC. Since the Agreements entered into do not contain the Clause, the contractors do not have to worry about their contracts being terminated on the order of an individual. </p>
<p>We hope that this simple administrative measure is seen as necessary to protect PDC from possible manipulation, malpractice or even corruption to protect public interest and not other irrelevant reasons.</p>

<p>Christmas marks the day Jesus was born, the divine being whom Christians believed to be the Son of God sent to save mankind. As such it is an occasion not only of salvation and redemption of our sins but also of peace and hope. </p>
<p>All Malaysians pray for the same values, especially in fighting corruption and abuse of power. The fall in Malaysia’s Transparency International rankings from No. 47 and 5.1 points in 2008 to No. 56 with 4.5 points this year has only spotlighted attention on how much Malaysia has lost to corruption.<br />
<span id="more-725"></span><br />
From the admission of RM 28 billion yearly by a Malaysian Minister to estimates of RM 100 billion by an Australian author to USD 100 billion by a Morgan Stanley economist, Malaysians demand some form of accountability. With so much public funds lost, a Royal Commission of Enquiry is the most appropriate forum to get to the root of the problem of corruption.</p>
<p>The theft of 2 fighter jet engines and other equipment from an air force military base worth more than RM 100 million has shamed Malaysia internationally. How can our armed forces defend the country, if they military bases are not safe? Worse, how could the jet engines be so easily smuggled out to be sold either in Africa or South America. Either there is a massive inside job happening or there are more military equipment stolen that we are still unaware of.</p>
<p>All Malaysians are united against corruption and demand a Royal Commission of Enquiry to ensure that there is no cover-up. The Federal government should come clean on these scandals to restore its damaged international credibility by taking stern action against those responsible. DAP is willing to co-operate with the Federal government to clean up our country’s image and fulfil the teachings not only of Christians but all other religions to practice “enjoin good, forbid evil”(amar maaruf, nahi mungkar)</p>
<p>Let us pledge to make not only our military camps secure but redeem our faith in good values and renew hope by fighting corruption. </p>

<p>Transparency International’s(TI) recognition of anti-corruption efforts by the Penang state government through CAT governance is backed up by savings of nearly 12% of the 2008 Penang state budget of RM 36 million from operating expenditure. This RM 36 million savings has allowed the state government to carry out social programs and implement its people-oriented government of 3Es that:</p>
<p>-         Enables the people with skills, knowledge and education to provide equal opportunity for all to create wealth</p>
<p>-         Empowers the people with fundamental rights, basic freedoms and responsibilities with full observance for the rule of law</p>
<p>-         Enrich the people by sharing wealth and economic benefits to pursue socio-economic justice </p>
<p>The success of the Penang Pakatan Rakyat state government in fighting corruption has been commended by Transparency International in the 2009 Global Corruption Report(GCR) released yesterday that stated,</p>
<p><span id="more-608"></span>“Penang state has introduced several measures to improve the regulatory environment with regard to government procurement, in what is referred to as a CAT – a Competent, Accountable and Transparent – government. It is the first state government to implement the open tender system for government procurement and contracts. As an example, in civil works, contractors are able to bid in an open tender process and to review the successful contractors and object if they are not satisfied. Furthermore, the Penang government has issued a directive whereby all administrators and state executive councilors are not allowed to make any new land applications. It has also invited professionals to serve on various boards, such as the Penang State Appeals Board, and has established a Working Professional Committee comprising individuals from five different professional bodies to improve land procedures.” </p>
<p>On behalf of the Penang state government, we feel humbled by the recognition given by a world renowned body such as Transparency International and would redouble efforts to ensure the anti-corruption reforms are institutionalized and ensure more professionals are appointed to key bodies. Fighting corruption generate savings for the people.</p>
<p>Apart from the RM 36 million in savings from operating expenditure, the 2 local authorities in Penang are expected to save another RM 34 million over three years. This additional savings were achieved from the transparent negotiation over the price of solid waste disposal that reduced the rates agreed to by the previous BN administration by a further 42.4%.</p>
<p>The Malaysian government would profit from the recommendations from the GCR 2009. Of great concern is the observation by PEMUDAH, the government’s special task force  to facilitate business, citing a World Bank study, estimates that corruption could cost Malaysia as much as RM10 billion a year – an amount equivalent to 1 or 2 per cent of GDP. PEMUDAH notes that, per capita, Malaysia spends only RM5 (approximately US$1.5) on anti-corruption efforts.</p>
<p>PEMUDAH also notes that the ACA investigated only 10.1 per cent, or just 7,223 cases, of the total 71,558 reported between 2000 and 2006. The number of people successfully convicted was only 0.7 per cent, or 524, of those suspected of corruption. The GCR 2009 concluded that this illustration of the Malaysian government’s inaction in the light of the serious corruption allegations, along with its seeming inability to catch the big fish instead focusing on the ‘small fry’, suggests that what anti-corruption efforts exist are mere tokens.</p>
<p>RM 10 billion in losses from corruption per year is a huge sum and there must be greater commitment from the Federal government towards fighting corruption to ensure that 27 million Malaysians can benefit from this RM 10 billion dividend from successfully combating corruption.</p>

			<content:encoded><![CDATA[<p>The Teoh Beng Hock Royal Commission Of Inquiry(RCI) Should Be Concerned Not Just About Human Rights That Were Violated As A Result MACC’s Interrogation Methods But Also For The Human Life That Was Lost. </p>
<p>DAP urges the Prime Minister Datuk Seri Najib Tun Razak to extend the terms of reference for RCI into the death of DAP’s Teoh Beng Hock to fully investigate the cause of death, identify the culprits responsible as well as identify and overcome weakness to prevent any more custodial deaths.   </p>
<p>The Teoh Beng Hock RCI should be concerned not just about the human rights that were violated as a result of Malaysian Anti-Corruption Commission’s (MACC) interrogation methods but also for causing the loss of human life.  </p>
<p><span id="more-463"></span>The BN government must respect the wishes of Beng Hock’s family calling for a full RCI instead of the superficial RCI set up that appears to hide rather than disclose what happenend.  Malaysians can not understand why the government is so concerned about Teoh’s human rights when Teoh is dead. There should be total focus on finding the real culprits and determine the truth so that justice can be done for Beng Hock.  </p>
<p>Further the members and Chair of the RCI should be independent and we propose Senator Tunku Aziz as the Chairman. Even though Senator Tunku Aziz is from the DAP, he is a well respected person of impeccable integrity and upright reputation who was not only the President of Transparency International but also International Vice-President of TI.  </p>
<p>Let Us Honour Him By Ensuring That There Would Be No More Teoh Beng Hocks Cases Again And Donating To The Teoh Beng Hock Trust Fund To Look After The Financial Needs Of His Unborn Child.</p>

<p>The Trust Fund’s purpose is to look after living, medical, education and other financial needs of the unborn child of late Sdr Teoh Beng Hock.   </p>
